Although privacy law and the<br />
Alberta Teachers’ Association’s<br />
code of conduct would, in many<br />
cases, prevent school staff from<br />
disclosing a student’s gender<br />
identity or sexual orientation to<br />
their family members without<br />
the student’s permission, Eggen<br />
said Albertans need legal<br />
clarity after some parents<br />
demanded the right to know<br />
what their children are doing at<br />
school.<br />
“This assertion is inaccurate,”<br />
stated Calgary lawyer<br />
John Carpay, President of the<br />
Justice Centre. As explained in<br />
great detail in a legal paper<br />
released this past April, Alberta<br />
law requires that parents be<br />
fully informed about all aspects<br />
of their children’s education,<br />
including their children’s<br />

countries.<br />
Both connect more closely to their<br />
U.S. counterparts than to each other.<br />
Geography, climate, market size and<br />
location, and the physical properties<br />
of refined products all play a role.<br />
When it comes to refinery feedstocks,<br />
transport infrastructure and<br />
upgrading capacity are key factors.<br />
From proposed ultra-low carbon<br />
refineries in British Columbia, to a<br />
gas-to-liquids project in Alberta and<br />
Canada’s biggest refinery on the<br />
Atlantic coast, Canadian refineries<br />
and their related facilities are as<br />
diverse as the terrain and time zones<br />
their pipelines cross.<br />

parents’ legal rights and<br />
responsibilities for their<br />

“Existing laws already protect<br />
students in the rare<br />
circumstances where they may<br />
face abuse from parents. What<br />
Minister Eggen is proposing to<br />
do presumes all Alberta parents<br />
are abusive,” continued<br />
Carpay.<br />
The legal paper concludes as<br />
follows:<br />
Schools have no legal right to<br />
withhold information from parents.<br />
Instead, teachers and<br />
principals have a positive duty<br />
to inform parents, including<br />
notifying parents of a child’s<br />
involvement with a GSA or<br />
GSA-related activities.<br />
The legal obligation to inform<br />
parents is modified only in<br />
cases where doing so would,<br />
objectively, put the child at risk.<br />
Such circumstances are<br />
exceedingly rare, and Alberta’s<br />
current laws provide for them.<br />
The vast majority of parents<br />
do not engage in abusive behaviour<br />
that would justify the<br />
withholding of information<br />
regarding the education of their<br />
child.<br />
Parents have the right to<br />
choose the kind of education<br />
their child receives, including<br />
extracurricular activities, and<br />
the right to be informed<br />
regarding what their child is<br />
learning inside of and outside of<br />
the classroom, and what extracurricular<br />
activities their child<br />
is involved with.<br />
The foregoing is made clear<br />
by the Alberta Bill of Rights,<br />
the Alberta Family Law Act,<br />
the Universal Declaration of<br />
Human Rights, the<br />
International Covenant on Civil<br />
and Political Rights, and the<br />
rulings of the Supreme<br />
Court of Canada and other<br />
Canadian courts.<br />
