Way forward for <strong>PPN</strong><br />
Gauthier Pierens EC Commission – DG Internal Market<br />
Mr. Pierens appreciated the <strong>PPN</strong> work on the 'remedies' Directive 2007/66/EC and suggested<br />
that the <strong>PPN</strong> considered developing the same activity regarding the 'EC Defence and Security<br />
<strong>Procurement</strong>' Directive 2009/81/EC earlier in the transposition phase. This could provide all <strong>PPN</strong><br />
members a useful comparative table on points where different approaches would be available for<br />
the transposition of the Directive.<br />
With reference to the issues highlighted by the UK delegation on problems met in applying<br />
exclusion criteria under certain circumstances, Mr. Pierens referred to the non conclusive<br />
discussions that already took place with Member States, and encouraged therefore <strong>PPN</strong> members to<br />
further exchange information on solutions which have been developed in Member States.<br />
On social considerations in public procurement, Mr. Pierens referred to the guide to be<br />
published by the Commission services.<br />
On the implementation of the Small Business Act for Europe, Mr. Pierens confirmed the interest<br />
expressed by the Commission in further and fruitful exchanges between <strong>PPN</strong> members on practices<br />
facilitating the access by SMEs to public procurement contracts.<br />
However, Mr. Pierens suggested that the <strong>PPN</strong> continued to develop its activities in keeping with<br />
three key objectives : 1) complementarity between work done by the EU Commission, on the one<br />
hand, and work undertaken by <strong>PPN</strong>, on the other hand; 2) prioritizing or focusing on a limited<br />
number of actions which can reasonably be developed in parallel in the context of the <strong>PPN</strong>; 3) pro-<br />
active cooperation between all Members in support of the <strong>PPN</strong> Presidency.<br />
Sen. Giuseppe Brienza – Conclusions<br />
Recalling the importance of the cooperation between Commission and <strong>PPN</strong>, Sen. Brienza<br />
invited Member States to complete the question-form concerning the transposition of the<br />
“Remedies” Directive.<br />
On his proposal the <strong>PPN</strong> Members also agreed to make the same activity on the Defence and<br />
Security Directive as it was suggested by European Commission Delegate.<br />
