ORDINANCE NO. 7331<br />

AN UNCODIFIED ORDINANCE<br />

OF THE CITY OF PASADENA<br />

APPROVING A DEVELOPMENT<br />

AGREEMENT BETWEEN THE CITY<br />

OF PASADENA AND ARTCENTER<br />

COLLEGE OF DESIGN RELATED<br />

TO THE MASTER PLAN FOR THE<br />

SOUTH CAMPUS (870, 888, 950,<br />

AND 988 S. RAYMOND AVENUE<br />

AND 1111 S. ARROYO PARKWAY)<br />

AND HILLSIDE CAMPUS (1700<br />

LIDA STREET)<br />

WHEREAS, California Government<br />

Code Section 65864 provides, in<br />

pertinent<br />

part:<br />

“The Legislature finds and declares<br />

that:<br />

(a) The lack of certainty in the<br />

approval of development projects<br />

can result in a waste of resources,<br />

escalate the cost of housing and<br />

other development to the consumer,<br />

and discourage investment in and<br />

commitment to comprehensive<br />

planning, which would make<br />

maximum efficient utilization of<br />

resources at the least economic cost<br />

to the public.<br />

(b) Assurance to the applicant for<br />

a development project that upon<br />

approval of a future project, the<br />

applicant may proceed with a future<br />

project in accordance with existing<br />

policies, rules and regulations,<br />

and subject to conditions of<br />

approval, will strengthen the public<br />

planning process, encourage private<br />

participation in comprehensive<br />

planning, and reduce the economic<br />

costs of development”; and<br />

WHEREAS, California Government<br />

Code Section 65865 provides, in<br />

pertinent<br />

part:<br />

“(a) Any city...may enter into a<br />

development agreement with any<br />

person having a legal or equitable<br />

interest in real property for the<br />

development of the property as<br />

provided in this article...”; and<br />

WHEREAS, California Government<br />

Code Section 65865.2 provides, in<br />

pertinent part:<br />

“A development agreement<br />

shall specify the duration of the<br />

agreement, the permitted uses of the<br />

property, the density or intensity of<br />

use, the maximum height and size of<br />

proposed buildings, and provisions<br />

for reservation or dedication of land<br />

for public purposes. The development<br />

agreement may include conditions,<br />

terms, restrictions, and requirements<br />

for subsequent discretionary actions,<br />

provided that such conditions,<br />

terms, restrictions, and requirements<br />

for discretionary actions shall not<br />

prevent development of the land<br />

for the uses and to the density or<br />

intensity of development set forth<br />

in the agreement...”; and WHEREAS,<br />

consistent with state law, the City of<br />

Pasadena provides a process for the<br />

adoption of development agreements<br />

pursuant to the Pasadena Municipal<br />

Code, Title 17, Chapter 17.66, which<br />

sets forth specific findings that<br />

must be made before a development<br />

agreement may be approved; and<br />

WHEREAS, ArtCenter College of<br />

Design (“Developer”) proposes<br />

to enter into a development<br />

agreement with the City of Pasadena<br />

(“Development Agreement”), which is<br />

attached to this Ordinance as Exhibit<br />

“A,” in connection with development<br />

of a 15-year Master Plan at its<br />

South Campus (870, 888, 950, and<br />

988 S. Raymond Avenue and 1111<br />

S. Arroyo Parkway) and Hillside<br />

Campus (1700 Lida Street), in the<br />

City of Pasadena, and described<br />

in the legal descriptions attached<br />

to the Development Agreement as<br />

Exhibit A, and incorporated herein by<br />

reference (the “Project”); and<br />

WHEREAS, the Project, including<br />

this Ordinance and the Development<br />

Agreement, has been reviewed<br />

pursuant to the provisions of the<br />

California Environmental Quality Act<br />

(Public<br />

Resources Code Sections 21000,<br />

et seq. (“CEQA”), the State CEQA<br />

Guidelines (California Code of<br />

Regulations, Title 14, Sections<br />

15000, et seq.), and the City’s Local<br />

CEQA Guidelines. The City prepared<br />

an initial study and, based on the<br />

information contained in the initial<br />

study, concluded that the Project<br />

had the potential to cause significant<br />

impacts on the environment, and<br />

prepared an Environmental Impact<br />

Report (EIR). On May 9, 2018,<br />

the City’s Planning Commission<br />

considered the Project and Final EIR<br />

for the Project and recommended<br />

certification of the Final EIR<br />

and approval of the Project and<br />

Development Agreement. The<br />

documents and other materials that<br />

constitute the record are located in<br />

the City’s Planning and Community<br />

Development Department and are<br />

in the custody of David Sinclair,<br />

175 N. Garfield Avenue, Pasadena,<br />

California 91101; and<br />

WHEREAS, on May 9, 2018, the<br />

City’s Planning Commission<br />

conducted a duly noticed public<br />

hearing to consider the Project,<br />

including the Development<br />

Agreement. Notice of the time, place<br />

and purpose of the public hearing<br />

was duly provided in accordance<br />

with California Government Code<br />

Sections 65867, 65090, and 65091,<br />

and the City’s ordinances. The<br />

Planning Commission considered<br />

the Project and Final EIR, and<br />

recommended certification of the<br />

Final EIR and approval of the Project<br />

and development agreement; and<br />

WHEREAS, on July 16, 2018, the<br />

City Council conducted a duly<br />

noticed public hearing to consider<br />

the Development Agreement and<br />

the Project. Notice of the time, place<br />

and purpose of the public hearing<br />

were duly provided in accordance<br />

with California Government Code<br />

Sections 65867, 65090 and 65091,<br />

and the City’s ordinances. The City<br />

Council considered the Final EIR<br />

in conjunction with consideration<br />

of this Ordinance, and adopted a<br />

resolution certifying the Final EIR,<br />

and approved the Project. The City<br />

Council finds and determines that<br />

there are no changes to the Project<br />

or its circumstances, or other new<br />

information that require further<br />

environmental analysis pursuant to<br />

the California Environmental Quality<br />

Act and hereby finds the Final ElR as<br />

certified sufficient for taking action<br />

on the Development Agreement.<br />

Further, the mitigation measures<br />

set forth in the Final EIR are made<br />

applicable to the Project through<br />

conditions of approval; and<br />

WHEREAS, all legal prerequisites<br />

prior to the adoption of this<br />

Ordinance have occurred.<br />

NOW, THEREFORE, the People of the<br />

City of Pasadena ordain as follows:<br />

SECTION 1. This ordinance, due to<br />

its length and the corresponding cost<br />

of publication, will be published by<br />

title and summary as permitted by<br />

Section 508 of the Pasadena City<br />

Charter. The approved summary of<br />

this ordinance is as follows:<br />

“Summary<br />

Ordinance No. 7331 is an uncodified<br />

ordinance through which a<br />

Development Agreement between<br />

the City of Pasadena and ArtCenter<br />

College of Design is approved.<br />

The purpose of the Development<br />

Agreement is to provide for the<br />

orderly development of a 15-year,<br />

two-phase, Master Plan at its South<br />

Campus (870, 888, 950, and 988 S.<br />

Raymond Avenue and 1111 S. Arroyo<br />

Parkway) and Hillside Campus (1700<br />

Lida Street). Development at the<br />

South Campus during Phase 1 would<br />

include the construction of two<br />

eight-story, 100-foot tall buildings<br />

for academic programs and student<br />

housing, an elevated open quad<br />

area over the Metro Gold Line, and<br />

a mobility hub below the quad area;<br />

renovation and internal floor area<br />

addition to an existing two-story<br />

building; renovation of an existing<br />

six-story building for academic<br />

purposes, and installation of an 8,000<br />

square foot digital gallery on the<br />

south-eastern façade of the six-story<br />

building. In addition, a compressed<br />

natural gas (CNG) fueling facility<br />

is proposed within the mobility<br />

hub area. Phase 2 development<br />

would include the demolition of<br />

an existing one-story building and<br />

construction of four eight-story,<br />

100-foot tall buildings for academic<br />

programs and/or student housing<br />

and an elevated “quad” area.<br />

Improvements within the Hillside<br />

Campus would include renovations,<br />

reconstruction, and additions to<br />

existing buildings, removal of a twostory<br />

modular building, construction<br />

of photovoltaic (PV) solar cell<br />

canopies within the parking lots,<br />

and construction of an entrance<br />

kiosk. Findings in support of the<br />

Development Agreement are set forth<br />

in the full text of the Ordinance. The<br />

Development Agreement (including<br />

legal descriptions of all affected<br />

parcels) is attached to the full text<br />

of the Ordinance and is on file in the<br />

City Clerk’s Office.<br />

Ordinance No. 7331 shall take effect<br />

upon publication.<br />

SECTION 2. The City Clerk is hereby<br />

directed to cause a summary of this<br />

Ordinance to be published at least<br />

once in a newspaper of general<br />

circulation published and circulated<br />

in the City within fifteen (15) days<br />

after its passage, in accordance with<br />

Section 36933 of the Government<br />

Code; and shall certify to the<br />

adoption of this Ordinance.<br />

SECTION 3. This ordinance shall<br />

take effect upon publication.<br />

NOTICE OF PUBLIC HEARING<br />

Zoning Code Amendment to Allow<br />

Conversions of Hotels and<br />

Motels to Affordable Housing<br />

PROJECT DESCRIPTION: In response<br />

to the increasing need for a variety of<br />

affordable housing types the Planning<br />

and Community Development Department<br />

has prepared a Zoning Code<br />

Amendment to allow the conversion of<br />

existing hotels and motels to affordable<br />

housing, including permanent<br />

supportive housing.<br />

PROJECT LOCATION: Properties that<br />

are currently developed with hotels<br />

and motels throughout the City of<br />

Pasadena.<br />

ENVIRONMENTAL DETERMINA-<br />

TION: The Planning Commission<br />

will consider whether adoption of the<br />

proposed Zoning Code Amendment<br />

is exempt from the California Environmental<br />

Quality Act under Section<br />

15301 (Class 1 - Existing Facilities)<br />

and there are no features that distinguish<br />

this project from others in the<br />

exempt class; therefore, there are<br />

no unusual circumstances. Section<br />

15301 allows the conversion of existing<br />

structures to a use that is similar in<br />

operation and intensity.<br />

APPROVALS NEEDED: The Planning<br />

Commission will conduct a public<br />

hearing and consider the proposed<br />

Zoning Code Amendment on September<br />

12, 2018. The Planning Commission<br />

will forward its recommendation<br />

to the City Council. The City Council<br />

will make a fi nal decision on the proposed<br />

Zoning Code Amendment at a<br />

separately-noticed public hearing.<br />

NOTICE IS HEREBY GIVEN that the<br />

Planning Commission will hold a<br />

public hearing to receive input from<br />

the public and provide comments on<br />

the proposed Zoning Code Amendment<br />

to allow conversions of hotels<br />

and motels to affordable housing,<br />

including permanent supportive<br />

housing.<br />
