SMME NEWS 10 September 2018 Business Profiles Driven youth turns art into thriving business Congolese SMME hits ground running in SA Founder and owner of Esk Originators, Vuyo Khumalo Anele Gumede Vuyo Ayanda Khumalo owner and founder of Esk Originators, was born and raised in Esikhawini Township a small area in the KwaZulu Natal province. Esk Originators mainly offers Photography, videography, designing of photo book and logos “Growing up in Esikhawini was pretty much like any other township where we play sports and any other riddles that one can navigate to pass time, but I knew that arts and everything around it was definitely in my radar and ‘fine arts’ was one of my hidden talents. So my passion for art grew from my drawings and beyond trying to rap and reciting poems I had written during my primary years.” For many people starting a business is for the purpose of accumulating income, whilst young people like Vuyo are driven by the need to help their community. “When we started we were actually putting together a non-profitable organisation that would serve all the kids around our area, we had always felt that the local municipality is not doing enough to assist the community to truly reach their potential with the infrastructure and the programs” Vuyo says looking at the people in the community they had agreed to also start something of their own as a side project that will help them sustain who they are and that was the birth of Esk Originators. “I consider myself as an artistic photographer because the photos I take do not resonate with the norm but portrays an utterly new dimension of taking photographs.” He added “When I started all I had was my drawings and no digital camera on me but I would take pictures using my phone and edit them as if they were actual drawings, and that drove me to come up with a new photography genre called ‘artistic photography’ I felt that I could merge arts and photography. What inspired and still inspires me to be in this business is the passion and obsession I have for pop culture and the different dynamics that we adapt to in the townships. LOANS!!! The first decision that must be given due consideration is the type of entity to house the business. Any business that wishes to transact with government and the formal sector, or wishes to access certain types of government support, is generally required to be registered with the Companies and Intellectual Property Commission (CIPC). While there are different types of entities available on CIPC, the private company is one of the most common entity types formed, (Close corporations (CC’s) became redundant under the most recent Companies Act, but those registered prior to 1 May 2011 could continue to operate). Private companies are companies incorporated by one or more persons, must have at least one director and may not offer its securities (shares or debentures) to members of the public. Once registered, private companies have “(Proprietary) Limited” or (Pty) Ltd. after their name. All South African companies are governed by the Companies Act No 71 of 2008. Company registrations can be performed online at the CIPC website, www.cipc. co.za, or contact Isibani to manage the registration on your behalf. As the South African Revenue Service (SARS) is linked with CIPC, you will receive a tax reference number once the company has been registered (Keep an eye out for future publications where we will provide guidance on various taxation issues faced by small businesses) The company’s public interest (PI) score will be used to determine whether or not the company will require audited financial statements. The act requires that every company calculate its PI score for each financial year. PI score is calculated based on the number of employees, money owed in terms of loans, suppliers, debentures, and other external financing, turnover and individuals who are known by the company to directly or indirectly have a beneficial interest in any of the company’s issued securities. Companies scoring less than 100 points do not require an audit or an independent review. Those scoring between 100 - 350 points must have an independent review conducted by a registered auditor or a chartered accountant. However, if the annual financial statements of a company are internally compiled and the PI score is between 100 and 350, an audit is required. If the PI score is less than 100 an independent review is required. Companies scoring 350 points or more are required to have an audit. If the shareholders are not directors of the company and are not actively involved in the day to day running of the business, e.g. silent shareholders, then the company is subject to an independent review regardless of the PI score. Deshan Chetty – Head of Audit and Accounting: Another young humble family man who grew up in a small town on the South Coast of KwaZulu-Natal. Opportunities weren’t many in the town, therefore he had to leave for Durban to commence his studies at UKZN, upon matriculating. After completing his post graduate degree, Deshan joined Deloitte and Touché as a trainee accountant. In 2007, Deshan went on secondment to Canada where he worked on large real estate clients. On his return he joined Deloitte and Touché as a manager and spent the next 10 years servicing various medium to large and listed clients, including a central bank, as a senior manager. Deshan has attended numerous training workshops, through his career, including a leadership course in Belgium. He has served on various leadership roles including that of the Audit Committee Chairman of the Durban Chamber of Commerce and Industry for a period of 3 years.
