That the <strong>Town</strong> will vote to amend the Zoning Bylaw<br />

SECTION 9: NON-CONFORMING SITUATIONS, 5. Nonconforming Lots, B., first<br />

sentence, by inserting the phrase “or use” after the words “a nonconforming building”, by<br />

inserting the phrase “the dwelling” after the words “or frontage, and”, by adding commas<br />

between the words “changed” and “extended” and between the words “extended” and “or”, by<br />

inserting the phrase “(but a single-family dwelling use may not be changed as <strong>of</strong> right to a tw<strong>of</strong>amily<br />

use)” after the words “altered by right”, and by removing “6.B” and replacing 6.B with<br />

“6-B”, within said sentence, such that said sentence within the Zoning Bylaw will be changed to<br />

read as follows [phrases to be removed are crossed <strong>of</strong>f, and phrases to be inserted are in italics<br />

and underlined, in the following text]:<br />

� A one-family or two-family dwelling shall not be deemed a nonconforming building or<br />

use solely due to the lot’s deficiency in area or frontage, and the dwelling may be<br />

changed, extended, or altered by right (but a single-family dwelling use may not be<br />

changed as <strong>of</strong> right to a two-family use) if otherwise in conformity with the dimensional<br />

requirements in Section 6.B 6-B.<br />

ARTICLE 18: On Motion by the Finance Committee; It was Moved and Seconded:<br />

That the <strong>Town</strong> amend the Zoning Bylaw, SECTION 12: WATER RESOURCE<br />

PROTECTION OVERLAY DISTRICT, for the purpose <strong>of</strong> clarifying the requirements for<br />

when a full site plan shall be submitted with a Special Permit application under said SECTION<br />

12, as follows:<br />

Amend Section 12.4. Procedures for Issuance <strong>of</strong> Special Permit, by adding text to Paragraph<br />

A.(1),<br />

as follows (text to be added is in italics and underlined):<br />

Procedures for Issuance <strong>of</strong> Special Permit<br />

A. Application Contents<br />

Any applicant for a Special Permit in the WRPOD shall submit the following materials and<br />

documentation to the SPGA.<br />

(1) All requirements for Full Site Plan Review as listed in Section 13 <strong>of</strong> the<br />

Zoning Bylaw, only if a Site Plan is required. One-family, two-family,<br />

and three-family dwellings as defined in Section 14.2. <strong>of</strong> this Zoning<br />

Bylaw shall be exempt from the requirements for Full Site Plan Review as<br />

listed in Section 13 <strong>of</strong> the Zoning Bylaw. An applicant for a Special<br />

Permit may apply for waivers from specific Site Plan Review<br />

requirements that may not be relevant to the proposed use.<br />
