I hope all of you are<br />

enjoying a great start to<br />

<strong>2019</strong>. Certainly <strong>2019</strong> has<br />

gotten off to a fast start.<br />

Our annual convention will<br />

be here before you know it.<br />

As I hope you remember,<br />

this year’s convention will<br />

begin on Sunday, April<br />

28, at the new Convention<br />

Center at Gulf Shores State<br />

Park. I will talk more about<br />

that later in this message.<br />

First, I want to update you<br />

on a couple of things. As you know, we have<br />

been working very diligently getting Insurance<br />

Education as a “credentialed” curriculum<br />

with the State Department of Education. The<br />

State Insurance Department is behind us 100<br />

percent. In fact, they made the statement that<br />

this is something they have wanted for a long<br />

time but just had not made the effort to get it<br />

done. We are now waiting to see if the State<br />

Department of Education needs anything else<br />

from us in order to make this happen.<br />

All of you have now been informed by Bill of<br />

his upcoming retirement. I cannot say enough<br />

about the great job that he has done. We are<br />

now in a position, thanks to Bill, where we can<br />

search for a replacement; and after their being<br />

hired, Bill will work with them to help them<br />

understand where we are as an association. An<br />

Ad Hoc committee has been formed to search<br />

for a replacement, and we will do our best to<br />

keep you informed as we move forward.<br />

Shifting now to Sunday, April 28, when we will<br />

be kicking off our <strong>2019</strong> convention. We want to<br />

welcome the Secure Risk group as they once<br />

again join us during our convention time. Being<br />

at this new convention center is exciting as we<br />

have been hearing about its development for a<br />

few years. I will not reveal everything about the<br />

convention, but I do want you to know that we<br />

will again have the band Mr. Big and the Rhythm<br />

Sisters with us as we did a couple of years ago<br />

at the Hilton. They were a fun, engaging band<br />

that I think everyone enjoyed and I wanted us<br />

to be able to enjoy them again. I had previously<br />

revealed our three main convention speakers to<br />

you and will now revisit that with you.<br />

Jim Morris, the inspiration for the movie “The<br />

Rookie,” will inspire and truly entertain us as<br />

he tells his personal story. Because of injuries<br />

and immaturity at the age of 24, Jim failed in his<br />

attempt to make it as a major league baseball<br />

player. Later as a high school physics teacher<br />

and baseball coach of a struggling team, he<br />

agreed to again try to make it in baseball if the<br />

team won the district championships. The team<br />

was successful; and at the age of 35, he threw<br />

12 consecutive fast balls of 98 mph. Needless<br />

to say, he joined the minor leagues and three<br />

months later made his first major league<br />

appearance striking out All-Star Royce Clayton<br />

in front of family and friends back in Texas. It<br />

has been said that having the opportunity to<br />

have Jim inspire and speak to you is like having<br />

Tom Hanks over for a cup of coffee.<br />

Besides insurance, I bet there is one thing all of<br />

us have in common. We all have struggled or are<br />

now struggling to attract and retain top millennial<br />

talent. There is one thing for sure; nobody will be<br />

bored as we learn a lot more about Generation Y<br />

which is more commonly referred to as millennials.<br />

Kristin Scroggin, the Managing Partner and Lead<br />

Trainer at genWHY Communication Strategies,<br />

realized she had a big problem three years into<br />

her teaching career at The University of <strong>Alabama</strong><br />

in Huntsville. Her plan of making all her millennial<br />

students “love her” (so they would work harder in<br />

her classes) was backfiring. Instead of working<br />

harder, they thought she was more likely to “hook<br />

them up” with a good grade. It was time to find<br />

a new pedagogical (teaching) style that would<br />

work for a new generation of students. That’s<br />

when she began actively studying the millennial<br />

generation.<br />

For the next 11 years, Kristin surveyed and<br />

interviewed students who came through her<br />

communications classes. Students ranged from<br />

children of NASA rocket scientists to military<br />

“brats” who spent years living across the United<br />

States. Data was collected on everything from<br />

future family plans, to ideal work hours, and<br />

measured across the decade. This information<br />

was collated and put into a humorous and<br />

informative presentation that has been<br />

given over 200 times since June of 2013 at<br />

conferences and companies across the country.<br />

Tuesday morning, September 11, 2001, began<br />

as usual for Lieutenant Colonel Robert Darling<br />

of the United States Marine Corp and the rest<br />

of Washington, D.C., New York, and our entire<br />

country. However, in a very short time our<br />

country was under attack, and Lt. Col.<br />

Darling while working for the White House<br />

Military Office Airlift Operations Department,<br />

found himself inside the President’s bunker<br />

supporting the Vice President, National<br />

Security Advisor, and others. They sought<br />

to coordinate with the President, who was<br />

visiting a school in Florida, in an effort to<br />

protect him, our citizens, and our government.<br />

We were being attacked by an unknown<br />

enemy, at different locations, in the largest<br />

attack on our country’s soil that we had ever<br />

encountered. While working to support our<br />

decision makers, he was part of one of the<br />

greatest crisis leadership teams ever. What<br />

he learned he now not only teaches but also<br />

inspires as he speaks on crisis leadership<br />

and decision making. A very close friend of<br />

mine who attends many conferences and<br />

conventions throughout the U.S. told me<br />

after hearing Darling that for a solid hour “you<br />

could hear a pin drop.”<br />

Along with the entire association staff, I am<br />

excited about this year’s convention. By the<br />

time late April arrives we are usually ready<br />

for some beach time. Please make a special<br />

effort to join us on Sunday, April 28, for a fun,<br />

inspiring, and educational convention.<br />

This is the last letter I will be writing to you<br />

since my term as your president lasted only<br />

ten months because last year’s convention<br />

was in late June and this year’s convention<br />

is in late April. It has been my pleasure to<br />

serve you as your president. I believe we<br />

have accomplished some very good things<br />

for our industry in <strong>Alabama</strong> with the initiation<br />

of the idea with the State Department of<br />

Education along with the State Department of<br />

Insurance to see that the study of insurance<br />

be included as a credentialed area of study in<br />

high schools throughout our state. I feel very<br />

confident that this will be accomplished in the<br />

very near future. This will give our members<br />

an opportunity to assist in this process by<br />

helping the individual teachers as an outside<br />

resource to their classrooms. This is a very<br />

important step for our association. I look<br />

forward to addressing you at our convention<br />

and, hopefully, providing an update on this<br />

matter. I certainly hope to see you there.<br />

There is just something<br />

about flipping the<br />

calendar to a new year.<br />

It brings hope and many<br />

times a renewed spirit<br />

to attempt things never<br />

done, create things<br />

only thought about and<br />

achieve a focus where<br />

none had existed … and<br />

as always we might try to<br />

lose a few pounds!<br />

Our first four and one-half months of <strong>2019</strong><br />

is requiring our immediate attention and a<br />

little extra effort to get things in place. Our<br />

Legislative Conference in Montgomery March<br />

13 and 14, the Excalibur Clay Shoot on April 19,<br />

our annual Convention and Trade Show April<br />

28-30 and our National Legislative Conference<br />

in Washington May 8–10. Your AIIA staff has<br />

been working diligently to get things in place for<br />

each event. I hope you will consider attending<br />

some or all of the events.<br />

could impact our industry or small business in<br />

general. You may be called on, as in the past,<br />

to assist us in communicating with local elected<br />

officials about specific issues. We’ll keep you<br />

posted.<br />

Many of you are aware and have been utilizing<br />

our new online webinars for some of your<br />

continuing education classes. If you are not<br />

aware of the program, I encourage you to give it<br />

a try and make your staff aware of the offerings.<br />

Each webinar is taught by agents and people<br />

you know. All classes are three hours and the<br />

cost is $45, which includes the CE filing fee. Go<br />

to our website www.aiia.org and you will find<br />

the classes under education.<br />

Both of your entities … AIIA and AIMS finished<br />

2018 with pretty good years financially. We<br />

continue to look for ways to increase revenue<br />

and hold down expenses in order to be good<br />

stewards of the resources we have. The monthly<br />

financials from both entities are distributed to<br />

the Executive Committee and the AIIA Finance<br />

Committee for their review.<br />

Your President Steve Sprayberry has put<br />

together an excellent program for the annual<br />

convention to be held at the new Gulf Shores<br />

Convention Complex. From the speakers to<br />

the networking trade show to the excellent food<br />

and time to catch up with old friends, we hope<br />

to see you there. Maybe you haven’t attended<br />

our convention in a few years; let this be the<br />

year to enjoy the benefits again.<br />

Chair Report<br />

Hello again, Young Agents! I am Toni Jones,<br />

Vice President of Transportation Marketing<br />

at Palomar Insurance Corporation and<br />

current Young Agents Chair. <strong>2019</strong> is off to<br />

a great start, and we have several exciting<br />

events planned. In addition to the Legislative<br />

Conference in March, Excalibur Clay Shoot<br />

in April, and Summer Conference in July,<br />

Young Agents is also working to host social<br />

hours in both north and south <strong>Alabama</strong>.<br />

Thanks to generous donations from a<br />

number of insurance carriers, we have<br />

raised the funding needed to have events<br />

in the first and second quarters of <strong>2019</strong>.<br />

We are still working out the logistics, but<br />

our Young Agents landing page on the AIIA<br />

website and our social media pages will stay<br />

up-to-date with the latest information. We<br />

are hopeful that these events will result in<br />

increased participation from young agents<br />

in the Huntsville and Mobile areas. We have<br />

an amazing group of active young agents in<br />

central <strong>Alabama</strong>, and we are now striving to<br />

expand our reach to all areas of the state.<br />

For that reason, we’ve created pages for<br />

<strong>Alabama</strong> Young Agents on Facebook,<br />

LinkedIn, Instagram, and Twitter. Please<br />

connect with us, if you haven’t already done<br />

so, to stay abreast of current events.<br />

We are looking forward to a fantastic<br />

Summer Conference to be held July 25-<br />

27, <strong>2019</strong> at Pensacola Beach, Florida.<br />

This year, we’re moving away from the<br />

technology focus we’ve had for the past<br />

few years. Robb Zbierski, a dynamic and<br />

engaging speaker, will present techniques to<br />

train your brain by improving your memory<br />

power and harnessing<br />

the creative capacity of<br />

your mind to achieve your<br />

personal best. He comes<br />

highly recommended and<br />

has spoken at Insurance<br />

Association Conferences<br />

across the country. He’ll<br />

provide insights that will help us become<br />

better insurance professionals through<br />

increased productivity and positivity. This<br />

is an event that you won’t want to miss!<br />

Once again, I encourage all young agents<br />

to ask the decision-makers in their office<br />

well in advance for approval to attend so<br />

the expense can be budgeted as needed.<br />

Also, please consider requesting a carrier<br />

sponsorship if you are a first-time attendee.<br />

These are not always available, but they<br />

may be an option if your agency has the<br />

financial need and a strong relationship with<br />

a carrier. We want to see a record number of<br />

attendees this year, and we are completely<br />

invested in making that happen.<br />

Please reach out to us if you are a “young<br />

agent” in terms of years of experience or in<br />

terms of age. We want you involved in this<br />

organization. As you grow in the insurance<br />

field, the connections you make will prove<br />

a valuable resource. Your fellow young<br />

agents are always willing to lend a helping<br />

hand when it comes to coverage or carrier<br />

questions. We are a group focused on<br />

collaboration rather than competition, and<br />

we want you to prosper so the insurance<br />

industry as a whole can thrive.<br />

As the federal government exercises more and more power<br />

over small business, the future of our industry becomes<br />

greatly dependent upon our ability to become engaged in<br />

the federal political process. The U.S. Congress regularly<br />

considers legislation that directly affects the livelihood of<br />

independent agents – from taxes, healthcare, and flood<br />

insurance to the overhaul of the insurance regulatory<br />

system. Your federal political action committee (InsurPac)<br />

plays a key role in the Big I’s legislative success. InsurPac<br />

raises money to contribute to candidates running for<br />

federal office, while increasing agent visibility on Capitol<br />

Hill and empowering members to participate in the political<br />

process.<br />

BIG “I” COMMENDS FINAL PASS-<br />

THROUGH TAX REGULATION<br />

IRS confirms that insurance agency owners and<br />

shareholders can fully utilize new tax deduction<br />

The <strong>Independent</strong> Insurance Agents & Brokers of America (IIABA or the Big “I”)<br />

commends the Trump Administration for finalizing an IRS regulation making clear<br />

that owners and shareholders of insurance agencies and brokerages organized as<br />

pass-through entities can fully benefit from a new tax deduction.<br />

“Today the IRS released a final<br />

regulation implementing a new<br />

section of the tax code to create<br />

a deduction for owners and<br />

shareholders of certain pass-through<br />

businesses, including insurance<br />

agencies and brokerages,” says<br />

Bob Rusbuldt, Big “I” president &<br />

CEO. “This regulation is a major and<br />

hard-fought win for Big ‘I’ members<br />

— the vast majority of which are<br />

organized as pass-through entities.<br />

Prior to the regulation being finalized<br />

there was uncertainty surrounding<br />

the application of the deduction to<br />

insurance businesses.”<br />

Under the regulation, owners and<br />

shareholders of insurance agencies<br />

and brokerages can take up to a<br />

20% tax deduction on qualified<br />

business income, no matter their<br />

taxable income levels, because the<br />

IRS does not consider insurance<br />

agents and brokers to be engaged<br />

in a “specified service trade or<br />

business.” Owners and shareholders<br />

of “specified service trades and<br />

businesses” cannot take advantage<br />

of the deduction if their taxable<br />

income is over a certain level.<br />

“Big ‘I’ members, whether organized<br />

as a pass-through entity or a<br />

C-corporation, can now rest assured<br />

that the tax reform law is working<br />

for them and their employees,”<br />

says Charles Symington, Big “I”<br />

senior vice president of external,<br />

industry & government affairs. “We<br />

thank Congress for its previous<br />

work on this landmark tax law and<br />

the Administration for working to<br />

finalize this regulation as quickly as<br />

QUESTION: Our client has a Umbrella policy. He has sold<br />

his vehicle and cancelled his auto policy. He is driving his<br />

son’s car. His son is not a resident of the household and<br />

Dad has care and custody of the vehicle at all times.<br />

His question is, will the umbrella step down if the son<br />

does not have enough coverage and he is sued as the<br />

driver? What if the son’s limits are lower than those<br />

required by the umbrella?<br />

Based on what I am reading as long as they have given<br />

him permission the umbrella would still step down since<br />

he is not a “family member” under the definition.<br />

ANSWER: It would be helpful to have the son’s policy.<br />

If it’s an ISO-based policy, the father is probably an<br />

“insured” on the son’s policy as ‘anyone using<br />

“your covered auto”’ or a “permissive operator,”<br />

depending on the policy. The son’s limits should<br />

apply to a loss on a primary basis. Be aware that<br />

some carriers exclude coverage for undisclosed<br />

policy will not drop down. If the<br />

will be the father’s responsibility.<br />

Disclosure to all carriers is<br />

important. The son’s carrier<br />

has the right to know about and<br />

charge for the additional operator.<br />

The umbrella carrier has the<br />

right to know about underlying<br />

coverage and the underlying<br />

policy might need to be listed on<br />

the umbrella declaration page.<br />

QUESTION: Can an unlicensed agent issue certificates?<br />

They would be issuing them with a signature of a licensed<br />

agent on the Acord 25. Often language is added to the COI<br />

and/or advisable?<br />

ANSWER: This is a REALLY, REALLY bad idea!!!! Issuing<br />

a certificate should not be considered a clerical function.<br />

A certificate should be issued by a knowledgeable<br />

person. By the way, what is an “unlicensed agent”?<br />

An unlicensed person is not an agent. The certificate<br />

requires the signature of an “authorized representative” of<br />

the carrier(s). An unlicensed person is not an authorized<br />

representative. It is very possible that you are in breach<br />

of the agency-company contract. If the unlicensed person<br />

does complete the certificate, it should be reviewed and<br />

signed by an agent before being sent to the certificate<br />

holder. Be aware that about 5 percent of new E&O claims<br />

arise out of certificates. Your agency needs to have a<br />

certificate procedure so that everyone is on the same<br />

page.<br />

QUESTION: If I pay the insurance premium on behalf of<br />

a customer and he subsequently does not pay me, can I<br />

order cancellation from the carrier for non-payment?<br />

ANSWER: No. The insured has the right to cancel the<br />

policy, not the agent. From the carrier’s standpoint, the<br />

premium has been paid. I think the obvious response is,<br />

“why in the world would you do that?” Fronting money<br />

for an insured is always a bad idea for the very thing you<br />

mentioned. It’s not a good business practice. You could<br />

take legal action to recoup what amounts to a loan, but<br />

you may not get your money. Chalk this up as a lesson<br />

learned.<br />

HOMEWOOD<br />

Byars|Wright, a local family owned and operated<br />

independent insurance agency, announces its expansion<br />

into Homewood. Gabe Clement, currently a producer<br />

within the agency was recently promoted to lead the new<br />

office located at 1701 28th Avenue South, as the branch<br />

manager.<br />

“We’re excited to announce our new Homewood office<br />

and to be a part of the continual progress in this city,” said<br />

Haig Wright II, president and CEO of Byars|Wright. “With<br />

a branch in Homewood, we are well positioned to continue<br />

cultivating our footprint in the greater Birmingham area.<br />

This opportunity is a positive reflection on our entire team<br />

and customer base, as they are critical to the success of<br />

our endeavors.”<br />

Homewood’s commitment to its community and robust<br />

growth in recent years mirrors Byars|Wright’s commitment<br />

to its customers and long-term growth strategy. Wright<br />

said that serving their communities is a primary focus of<br />

each Byars|Wright branch. “We are looking forward to<br />

supporting Homewood and becoming part of this great<br />

community,” he said.<br />

As branch manager, Clement will relocate his office from<br />

Gardendale to Homewood.<br />

The Auburn University alumnus is a current resident of<br />

Homewood and heavily involved with the Associated<br />

Builders & Contractors of <strong>Alabama</strong>, which is located down<br />

the street from Byars|Wright.<br />

“Not only do Gabe’s customers genuinely like and trust<br />

him, his teammates within the agency feel the same,” said<br />

John Byars, vice president of Byars|Wright. “From the<br />

beginning, Gabe has been an extremely hard worker and<br />

big time performer. As his mentor, it didn’t take me long to<br />

recognize his potential.”<br />

“Our agency model, a 73-year-old system that has allowed<br />

us to experience tremendous growth as a family owned<br />

company, is to ‘bring them in, build them up, send them out’,”<br />

Byars continued. “Today is about Gabe and Homewood,<br />

but the days ahead will bring additional opportunities. We<br />

have no plans to slow down.”<br />

Murray Building Company, headquartered in Homewood,<br />

will complete the renovations to the interior of the former<br />

Village Bridal storefront. The building will house multiple<br />

workspaces for the Byars|Wright team and is expected to<br />

be completed and open for business in late spring of <strong>2019</strong>.<br />

Byars|Wright plans to grow this office organically and is<br />

actively seeking talented individuals to join their team.<br />

Byars|Wright opened its third office in Alabaster only seven<br />

months ago with the acquisition of The Insurance Store.<br />

With each new branch, the agency extends Byars|Wright’s<br />

long-standing history of developing strong relationships<br />

and producing unique insurance solutions for customers.<br />

KNIGHT-FREE INSURANCE IS<br />

75 YEARS OLD!! By Westcoat Free<br />

since then, from the way insurance policies were rated<br />

by hand and accounting books were kept in big ledges. (I<br />

still have the ones Grandpa and Dad used.) Now we do<br />

all the ratings and accounting on the computer, BUT our<br />

commitment to customer service is unchanged.<br />

Back in 1943, Paul R. Knight (Grandpa) started his insurance<br />

and tax business. In 1970, W. Elliot Free, just out of the<br />

Navy, joined him and they created Knight-Free Insurance in<br />

1971. The office was upstairs in the Fuller Building on the<br />

corner of Hwy 278 and Hwy 31. (It was a perfect location to<br />

watch the Fair and Christmas parades.) Grandpa retired in<br />

1982, and a year later Dad relocated the office to the newly<br />

remodeled Ice House Building on Frist Avenue between<br />

Busy Bee and Mary Carter. We are in the same location<br />

today. I joined Knight-Free in 1993 after I graduated from<br />

Auburn University.<br />

We have been dedicated to serving the good people of<br />

Cullman County since 1943. I know things have changed<br />

In the past 10 years we have served and supported our<br />

customers through the tornadoes in 2011, the hail storm of<br />

2018, and countless other obstacles and challenges. Our<br />

most important asset at Knight-Free is our staff. Since 1970<br />

we have had only a few employees: Judie Hubbard, Nelda<br />

Simpson, Laura Harris, Angie Hardman, Tracy Pewitt, Tina<br />

Calloway, Karen Nixon and Dawn Wright. Judi, Nelda and<br />

Karen have retired and Laura and Tracy moved on to other<br />

jobs, but without all of these ladies, Knight-Free would not<br />

be where it is today.<br />

We will continue to adapt to the changing way of business,<br />

but we will always treat people like Grandpa and Dad did.<br />

SYMPATHY<br />

Our thoughts have been with the Gardner family since<br />

the passing of Hope Gardner. She passed away during<br />

the overnight hours of February 25-26. Hope retired from<br />

CRC Insurance Services and was an active member of<br />

Birmingham Area Insurance Professionals where she served<br />

as President multiple times. She will be greatly missed.<br />
