More code complaints against Modi<br />

than any other PM: Congress<br />

New Delhi : Congress has<br />

filed 10 complaints against<br />

Prime Minister Narendra Modi<br />

with the Election Commission<br />

for alleged violation of Model<br />

Code of Conduct (MCC) and the<br />

party says it is the highest number<br />

of complaints faced by any<br />

Prime Minister in a Lok Sabha<br />

election. The Election<br />

Commission has given a decision<br />

on six of these complaints<br />

so far, giving a clean chit to the<br />

Prime Minister in all the cases.<br />

Sources said in two of these<br />

cases the decision was not unanimous<br />

with one of the two election<br />

commissioners registering<br />

his verbal dissent with the matter<br />

having been decided according<br />

to the opinion of the majority.<br />

The complaints, which cover<br />

a period from March 20 to April<br />

30, relate to several speeches of<br />

Court on Monday issued a notice<br />

to the Election Commission on a<br />

plea challenging the legal provision<br />

mandating six months jail<br />

for questioning Electronic<br />

Voting Machines (EVMs).<br />

On a petition filed by<br />

Sunil Ahya, an SC bench<br />

headed by Chief Justice<br />

Ranjan Gogoi heard the<br />

arguments and issued the<br />

notice to the Election<br />

Commission.<br />

According to Section<br />

49 MA of the Code of<br />

Election Rules, if a person<br />

files a complaint regarding<br />

discrepancy in the<br />

EVM, and if after investigation<br />

it is found to be false or<br />

incorrect, then the complainant<br />

can be prosecuted under Section<br />

177 of the Indian Penal Code for<br />

"furnishing false information".<br />

This section invites "six months<br />

in jail or a fine of Rs 1,000 or<br />

both". Ahya contended that such<br />

Modi including those in<br />

Maharshtra, Gujarat, Rajasthan<br />

and Uttar Pradesh. There is also<br />

a complaint about "illegal" roadshow<br />

in Gujarat on April 23.<br />

Court to dismiss the contempt<br />

petition filed against him by the<br />

BJP, terming it a political move<br />

and also an attempt to gag him in<br />

ongoing elections.<br />

Gandhi, in his<br />

affidavit, contended<br />

that the contents<br />

of the explanation<br />

submitted<br />

to the court on<br />

April 22 were<br />

comprehensive<br />

and may be read as a part and<br />

parcel of the present reply.<br />

Although both explanations submitted<br />

in court are similar in<br />

nature, the affidavits do express<br />

regret but don't offer an apology.<br />

Gandhi urged that Meenakshi<br />

Lekhi, by filing the contempt<br />

petition, was trying to drag the<br />

court into a political controversy<br />

and taking political mileage. He<br />

and the model code of conduct is in force.<br />

The Election Commission of India shall<br />

immediately and suo-motu take cognizance<br />

of these shameful remarks by the<br />

Prime Minister and initiate action against<br />

him."<br />

"These comments vindicate our stand<br />

that, after destroying all the Institutions,<br />

the Prime Minister is now trying to<br />

destroy democracy itself," Naidu added.<br />

for ascribing the comments to<br />

the court and said this happened<br />

in the "heat of campaigning".<br />

Gandhi in his affidavit told<br />

the court that his remarks were<br />

not meant to scandalise the court<br />

in any manner.<br />
