BYLAW 14: COMPLAINT RESOLUTION PROCEDURES<br />
Definitions<br />
14.1 In these procedures:<br />
14.1.1 “agent” means an agent as defined in the <strong>Forest</strong>ers Act, and for the purposes <strong>of</strong> Section<br />
24 <strong>of</strong> the <strong>Forest</strong>ers Act, includes:<br />
14.1.1.1 The Registrar<br />
14.1.1.2 Members <strong>of</strong> the complaints resolution committee;<br />
14.1.1.3 A person or persons designated by the complaints resolution committee to<br />
investigate a matter or act as a fact finder to assist with attempts at alternative complaint<br />
resolution;<br />
14.1.1.4 Members <strong>of</strong> the standing investigations committee; or<br />
14.1.1.5 A person or persons designated by the standing investigations committee to<br />
investigate a complaint made against a subject member;<br />
14.1.2 “alternative complaint resolution” means a process or processes established under<br />
these bylaws to assist in appropriate circumstances in the resolution <strong>of</strong> complaints without<br />
completion <strong>of</strong> a discipline hearing and includes without limitation:<br />
14.1.2.1 Negotiation <strong>of</strong> a resolution;<br />
14.1.2.2 Conditional admissions;<br />
14.1.2.3 Investigation or fact finding;<br />
14.1.2.4 Mediation;<br />
14.1.2.5 Arbitration; or<br />
14.1.2.6 A combination <strong>of</strong> the above;<br />
14.1.3 “association” means the <strong>Association</strong> <strong>of</strong> British Columbia <strong>Forest</strong> Pr<strong>of</strong>essionals or its<br />
predecessor the <strong>Association</strong> <strong>of</strong> British Columbia Pr<strong>of</strong>essional <strong>Forest</strong>ers;<br />
14.1.4 “citation” means a citation issued under Section 24(4)(a) <strong>of</strong> the <strong>Forest</strong>ers Act;<br />
14.1.5 “complaints resolution committee” means a committee appointed by council under<br />
bylaw 14.8.<br />
14.1.6 “conduct unbecoming a member” means conduct <strong>of</strong> a member that:<br />
14.1.6.1 Brings or may bring the association or its members into disrepute;<br />
14.1.6.2 Undermines the scientific methods and principles that are the foundation <strong>of</strong> the<br />
practice <strong>of</strong> pr<strong>of</strong>essional forestry; or<br />
14.1.6.3 Undermines the principles <strong>of</strong> stewardship that are the foundation <strong>of</strong> the practice <strong>of</strong><br />
