After Harvey, the Army Corps of Engineers refused to take responsibility for<br />
intentionally using Upstream properties to store storm water. After a hard-fought<br />
courtroom battle in 2019, Judge Lettow issued his decision. He found the<br />
government liable under the Fifth Amendment for the intentional flooding of<br />
Upstream homes and businesses. In a landmark case, Judge Lettow ruled that<br />
intentional government action was the sole cause of the Upstream flooding.<br />
Upstream residents have filed lawsuits to protect and enforce their Fifth<br />

HELP HORNE ELEMENTARY!<br />
An easy way to help our school is to turn trash into cash. Horne Elementary<br />
participates in the Box Tops for Education program. Some of the grocery items<br />
we use have Box Tops on them. Each Box Top is worth 10 cents for the school. You<br />
would pick up a dime on street - so cut out the Box Tops and donate to Horne! You<br />
can find the Box Tops logo on hundreds of products like Cheerios®, Hamburger<br />
Helper® and Kleenex®, in almost every aisle of the store. To donate the Box Tops,<br />
simply bring them to the reception desk at Horne, give them to a family with<br />
children who attend Horne or contact this year’s coordinator, Rufina Bonilla, for<br />

HOA ANNUAL MEETING<br />
Our annual meeting is still scheduled to be held in early November when this<br />
article is written (early Sept). Please look out for letter and proxy in the mail around<br />
late <strong>October</strong> for details. Due to the pandemic, changes may occur and we will<br />
always communicate updates in our TownSq app.<br />
TRASH CANS AFTER TRASH PICK-UP<br />
We continue to see a lot of garbage cans left on curbside or front yard of houses.<br />
Please know that this is a deed violation. All garbage cans need to be put away from<br />
street view by evening of trash day. If you continue to leave it on front yard, curbside<br />
etc. (street views) we will have to spent money to send you violation citations and if<br />
the problem continues, then legal action is to ensue. This is a rather simple action on<br />
all of us who live here in our subdivision. All deed restrictions are created to enhance<br />
the overall appearance and maintain our property values at the same time. We want<br />
to thank those who always abide by the rules and try to do their best to make this a<br />
pleasant neighborhood. And if you were not aware of this particular restriction, you<br />
now understand that you need to put your garbage cans away after each pick-up<br />
away from street view. We appreciate everyone’s cooperation.<br />

Documents in our TownSq app. You will first need to sign up for an account in the<br />

MONTH OF OCTOBER<br />
<strong>October</strong> is Breast Cancer awareness month. <strong>October</strong> 5 th is the last day to register<br />
to vote this November. <strong>October</strong> is a good time to talk to your family doctor to get<br />
your flu shot. It is particularly important to get the flu shot this year due to the<br />
pandemic. <strong>October</strong> 10 th is world mental health day, while we try to take care of our<br />
body, let’s not forget about our mental health fitness and those who are suffering<br />
from mental health issues.<br />
LAWN CARE TIPS FOR THE FALL<br />
Fall is a time when we may finally have some tolerable temperature and is more<br />
pleasant for us to spend some time outside taking care of our lawns and yards.<br />
Here are some tips we can all use:<br />
• Trim shrubs and hedges to maintain their shapes and appearances.<br />
• Lawn mower blades may be lowered to 3” unless we have very hot days again<br />
like we had in August.<br />
• Check on your fall vegetable garden if you had started one earlier.<br />
• Decorate your yard with fall colors and/or pumpkins.<br />
• Garden Mums of wide array of colors will be in season throughout fall.<br />

Our <strong>October</strong> monthly meeting is scheduled to be held on 10/13/20 at 7 PM. At<br />
time when this article is written the meeting is still expected to be a conference<br />
call instead of face-to-face meeting. Meeting information can always be found in<br />

(BCS3) GARAGE SALES<br />
At present, there are no plans to have a neighborhood wide garage sale for BCS3<br />
this year. But the Bylaws allow for individual residents to have up to four garage<br />
sales per year. If you are interested in having your own garage sale, please contact<br />
any Board member to let them know you are planning to do this. Thank you for<br />
your cooperation as to this issue.<br />

Please do not put the trash out until the night before trash pick-up. If trash is left<br />
out, it is exposed to rodents.<br />
Parked Cars on Streets Close Stop Signs, Commercial Vehicles & Trailers:<br />
• We are still seeing cars parked on the street close to stop signs which becomes very<br />
dangerous for drivers to maneuver around oncoming traffic. Please park cars safely on the<br />
streets to avoid accidents. We love our residents and do not want to see anyone injured.<br />
• There are several community parking areas around the park and patio homes in<br />
the front of our subdivision. Please do not park there longer necessary. Please be<br />
cognizant of our neighbors. If you haven’t seen tow signs already, these will be<br />
posted soon. Cars parked in Charlestown Colony community parking spots longer<br />
than necessary will be towed at the owner’s expense.<br />
• IT IS A VIOLATION OF OUR DEED RESTRICTIONS TO PARK COMMERCIAL<br />
VEHICLES, TRAILERS, ETC. IN PUBLIC VIEW FOR AN EXCESSIVE AMOUNT OF TIME.<br />
The number of hours these vehicles can be parked on the street is limited. Please<br />
refer to our deed restrictions. Harris County will be conducting a traffic study in our<br />
area to determine where street tow signs will be posted.<br />
<strong>2020</strong> HOA Annual Assessments:<br />
If you have not paid the annual HOA dues by now, it is delinquent!<br />
New Application: https://app.townsq.io: See instructions on page 4.<br />
The management company is using a new application which is much more robust<br />
than the previous online website. To register for the application, the HOA account<br />
number and an email address is needed. Within the application, HOA dues can<br />
be paid, messages can be sent to the management company, other requests for<br />
home improvement projects etc. can also be done by click or swipe.<br />
Annual Dues Payment: Thank you to all who have paid your HOA dues!<br />
Since the Board has not increased the HOA dues for <strong>2020</strong>, there should<br />
be no excuse for paying delinquent! February 1 st , unpaid annual dues are<br />
considered delinquent and subject to late fees and penalties. Our management<br />
company has new policies and procedures in place to collect on past due HOA<br />
assessments. If these have not been paid yet, please make every effort to pay<br />
or make a payment arrangement. The Board worked diligently to maintain our<br />
HOA dues at $330 for <strong>2020</strong>.<br />

(CC) ANNUAL DUES PAYMENTS<br />
Thank you to all those who have paid their annual assessment dues to the Concord<br />
Colony HOA. A reminder for those who have not, a late fee and interest will be<br />
added to your outstanding balance every month the dues balance is not paid off.<br />
Dropping off your payment at the PMG office does not expedite the posting of<br />
the payment. The PMG office can only take your check and mail it for you - the late<br />
fees and interest are still applied. If you would like to arrange for a payment plan,<br />
please contact Shannon Abernathy, our management company representative, at<br />
281-367-8137 immediately or at s.abernathy@pmghouston.com.<br />

If you have already signed up for TownSq, you can log in to the app and check your<br />
balance. We encourage all homeowners to check their balance in case an error has<br />
been made and, if present, to contact Shannon Abernathy to resolve the error as<br />
soon as possible. TownSq Documents is the location for deed restrictions, by-laws<br />
and other documents pertaining to Concord Colony.<br />

Due to the CDC Coronavirus (COVID-19) guidelines and recommendations, the<br />
Concord Colony HOA Board has postponed the annual election meeting until<br />
<strong>October</strong>. Currently, the Board is reviewing digital meeting options in place of<br />
the face-to-face monthly meetings. Updates on these changes will be released<br />
when available. Meeting changes will be published on TownSq under My<br />
Community.<br />

(CC) DEED RESTRICTIONS<br />
Since the CDC Coronavirus (COVID-19) guidelines and recommendations are in<br />
place, you may be using this time to make major changes to your property or<br />
yard. Please remember that deed restrictions are strongly enforced. Any outside<br />
construction or major landscaping changes to your home or yard must be<br />
approved by the Architectural Control Committee (ACC). This includes reroofing<br />
your home. You can download the ACC form through TownSq. It is under the<br />
documents section on the left side of the screen. Complete the ACC form and<br />
include a paint chip, if necessary. The paint ‘chip’ and the ACC form can be mailed<br />
to the address listed on the bottom of the form or emailed with a scanned copy of<br />
the paint chip to the address also on the bottom of the form.<br />
The ACC committee will review your request. The committee has up to a month to<br />
act on your request. PMGHouston will notify the homeowner on the outcome of<br />
the request. The approved colors are Sherwin Williams colors and color numbers.<br />

(GC1) CURRENT BOARD MEMBERSHIP UPDATE<br />
Since the last annual meeting, several Board members have made the personal<br />
decision to resign from their positions. The current Board membership can be<br />
found in the Import Numbers section of the newsletter. In next year’s 2021 annual<br />
meeting (March 2021), the current Board of Director’s membership will be further<br />
reduced due to a change in state law. We would love to work with interested<br />
homeowners who like to join the Board, please consider serving your community<br />

Due to Covid-19, there will be no face to face meetings at the MUD building. These will be<br />

ANNUAL JAMESTOWN HOMEOWNERS MEETING - OCTOBER 20, <strong>2020</strong><br />
The Jamestown Colony <strong>2020</strong> Annual Meeting will be held on Tuesday, <strong>October</strong><br />
20, <strong>2020</strong> at the Mud 102 Building (6710 Kentwick Drive). The homeowners will be<br />
electing Board members for the 3 open positions. Please plan on attending. The<br />
cost to print and mail the initial package to all property owners is roughly $2,000<br />
(including the solicitation of candidates notice). Per our Bylaws, a 20% quorum of<br />
homeowner ballots (basically 80+ Ballots) is required in order to hold the meeting.<br />
AND if a quorum is not established, the Ballot/Proxy package must be mailed out<br />
again at a cost of $1500 until a quorum is reached.<br />
WHAT YOU CAN DO FOR ALL OF US! - Please fill out and return the Ballot/Proxy,<br />
so a quorum can be established. Even if you just check the box for opinion #1 for<br />
Quorum Only - this will be beneficial to OUR balance sheet.<br />
MONTHLY HOA MEETINGS<br />
With many of the meeting restrictions being lifted the Monthly HOA meeting<br />
will continue to be held on the 3 rd Tuesday of the month at the Mud 102 building<br />
including holding the meeting outside at the Mud District building or park.<br />

CYPRESS FALLS BAND FUNDRAISER<br />
The Cypress Falls Golden Eagle Marching Band lined our neighborhood with<br />
nearly 700 US flags recently through their Flags with Pride fundraiser. For<br />
an annual fee of $40, band volunteers will deliver a 3’x5’ flag on a 10’ pole<br />
and place it in front of your home on six patriotic holidays throughout the<br />
year: Presidents Day, Memorial Day, Independence Day, Labor Day, Patriots<br />
Day (9/11) and Veterans Day. The band is now taking orders for 2021 flag<br />
service and is running a special promotion: new customers that sign up by<br />
November 5 th will get a flag for Veterans Day <strong>2020</strong> included for free! Homes<br />

through the Houston Open. 100% of your donation goes directly to the charity<br />
of your choice. The Houston Open will also award the top three donationcollecting<br />
charities and one randomly drawn charity with an additional<br />
bonus. In 2019, the Houston Open distributed $615,000 to local nonprofits.<br />
How can I participate in Birdies for Charity®? There are two ways to donate<br />

<strong>2020</strong> event, here are the totals for some typical pledge amounts:<br />
