After Harvey, the Army Corps of Engineers refused to take responsibility for
intentionally using Upstream properties to store storm water. After a hard-fought
courtroom battle in 2019, Judge Lettow issued his decision. He found the
government liable under the Fifth Amendment for the intentional flooding of
Upstream homes and businesses. In a landmark case, Judge Lettow ruled that
intentional government action was the sole cause of the Upstream flooding.

HELP HORNE ELEMENTARY!
An easy way to help our school is to turn trash into cash. Horne Elementary
participates in the Box Tops for Education program. Some of the grocery items
we use have Box Tops on them. Each Box Top is worth 10 cents for the school. You
would pick up a dime on street - so cut out the Box Tops and donate to Horne! You
can find the Box Tops logo on hundreds of products like Cheerios®, Hamburger
Helper® and Kleenex®, in almost every aisle of the store. To donate the Box Tops,
simply bring them to the reception desk at Horne, give them to a family with
children who attend Horne or contact this year’s coordinator, Rufina Bonilla, for

HOA ANNUAL MEETING
Our annual meeting is still scheduled to be held in early November when this
article is written (early Sept). Please look out for letter and proxy in the mail around
late October for details. Due to the pandemic, changes may occur and we will
always communicate updates in our TownSq app.
TRASH CANS AFTER TRASH PICK-UP
We continue to see a lot of garbage cans left on curbside or front yard of houses.
Please know that this is a deed violation. All garbage cans need to be put away from
street view by evening of trash day. If you continue to leave it on front yard, curbside
etc. (street views) we will have to spent money to send you violation citations and if
the problem continues, then legal action is to ensue. This is a rather simple action on
all of us who live here in our subdivision. All deed restrictions are created to enhance
the overall appearance and maintain our property values at the same time. We want
to thank those who always abide by the rules and try to do their best to make this a
pleasant neighborhood. And if you were not aware of this particular restriction, you
now understand that you need to put your garbage cans away after each pick-up
away from street view. We appreciate everyone’s cooperation.

MONTH OF OCTOBER
October is Breast Cancer awareness month. October 5 th is the last day to register
to vote this November. October is a good time to talk to your family doctor to get
your flu shot. It is particularly important to get the flu shot this year due to the
pandemic. October 10 th is world mental health day, while we try to take care of our
body, let’s not forget about our mental health fitness and those who are suffering
from mental health issues.
LAWN CARE TIPS FOR THE FALL
Fall is a time when we may finally have some tolerable temperature and is more
pleasant for us to spend some time outside taking care of our lawns and yards.
Here are some tips we can all use:
• Trim shrubs and hedges to maintain their shapes and appearances.
• Lawn mower blades may be lowered to 3” unless we have very hot days again
like we had in August.
• Check on your fall vegetable garden if you had started one earlier.
• Decorate your yard with fall colors and/or pumpkins.
• Garden Mums of wide array of colors will be in season throughout fall.

(BCS3) GARAGE SALES
At present, there are no plans to have a neighborhood wide garage sale for BCS3
this year. But the Bylaws allow for individual residents to have up to four garage
sales per year. If you are interested in having your own garage sale, please contact
any Board member to let them know you are planning to do this. Thank you for

Trash Pick-Up:

Please do not put the trash out until the night before trash pick-up. If trash is left
out, it is exposed to rodents.
Parked Cars on Streets Close Stop Signs, Commercial Vehicles & Trailers:
• We are still seeing cars parked on the street close to stop signs which becomes very
dangerous for drivers to maneuver around oncoming traffic. Please park cars safely on the
streets to avoid accidents. We love our residents and do not want to see anyone injured.
• There are several community parking areas around the park and patio homes in
the front of our subdivision. Please do not park there longer necessary. Please be
cognizant of our neighbors. If you haven’t seen tow signs already, these will be
posted soon. Cars parked in Charlestown Colony community parking spots longer
than necessary will be towed at the owner’s expense.
• IT IS A VIOLATION OF OUR DEED RESTRICTIONS TO PARK COMMERCIAL
VEHICLES, TRAILERS, ETC. IN PUBLIC VIEW FOR AN EXCESSIVE AMOUNT OF TIME.
The number of hours these vehicles can be parked on the street is limited. Please
refer to our deed restrictions. Harris County will be conducting a traffic study in our
area to determine where street tow signs will be posted.
2020 HOA Annual Assessments:
If you have not paid the annual HOA dues by now, it is delinquent!

The management company is using a new application which is much more robust
than the previous online website. To register for the application, the HOA account
number and an email address is needed. Within the application, HOA dues can
be paid, messages can be sent to the management company, other requests for
home improvement projects etc. can also be done by click or swipe.
Annual Dues Payment: Thank you to all who have paid your HOA dues!
Since the Board has not increased the HOA dues for 2020, there should
be no excuse for paying delinquent! February 1 st , unpaid annual dues are
considered delinquent and subject to late fees and penalties. Our management
company has new policies and procedures in place to collect on past due HOA
assessments. If these have not been paid yet, please make every effort to pay
or make a payment arrangement. The Board worked diligently to maintain our
HOA dues at $330 for 2020.

(CC) ANNUAL DUES PAYMENTS
Thank you to all those who have paid their annual assessment dues to the Concord
Colony HOA. A reminder for those who have not, a late fee and interest will be
added to your outstanding balance every month the dues balance is not paid off.
Dropping off your payment at the PMG office does not expedite the posting of
the payment. The PMG office can only take your check and mail it for you - the late
fees and interest are still applied. If you would like to arrange for a payment plan,
please contact Shannon Abernathy, our management company representative, at
281-367-8137 immediately or at s.abernathy@pmghouston.com.

If you have already signed up for TownSq, you can log in to the app and check your
balance. We encourage all homeowners to check their balance in case an error has
been made and, if present, to contact Shannon Abernathy to resolve the error as
soon as possible. TownSq Documents is the location for deed restrictions, by-laws
and other documents pertaining to Concord Colony.
(CC) MONTHLY BOARD MEETINGS
Due to the CDC Coronavirus (COVID-19) guidelines and recommendations, the
Concord Colony HOA Board has postponed the annual election meeting until
October. Currently, the Board is reviewing digital meeting options in place of
the face-to-face monthly meetings. Updates on these changes will be released
when available. Meeting changes will be published on TownSq under My
Community.

(CC) DEED RESTRICTIONS
Since the CDC Coronavirus (COVID-19) guidelines and recommendations are in
place, you may be using this time to make major changes to your property or
yard. Please remember that deed restrictions are strongly enforced. Any outside
construction or major landscaping changes to your home or yard must be
approved by the Architectural Control Committee (ACC). This includes reroofing
your home. You can download the ACC form through TownSq. It is under the
documents section on the left side of the screen. Complete the ACC form and
include a paint chip, if necessary. The paint ‘chip’ and the ACC form can be mailed
to the address listed on the bottom of the form or emailed with a scanned copy of
the paint chip to the address also on the bottom of the form.
The ACC committee will review your request. The committee has up to a month to
act on your request. PMGHouston will notify the homeowner on the outcome of
the request. The approved colors are Sherwin Williams colors and color numbers.
To view the actual colors:
1. Google Sherwin Williams Paint Colors.
2. Scroll down to Paint Colors - Sherwin Williams.
3. In that list, Select Sherwin Williams Paint Colors.
4. The Digital Color Wall screen appears with a grid of all the colors available.
5. The first box on the left, above the color grid, is SEARCH COLOR.
6. Select that.
7. Another screen appears with a box that says Search by color name or number.
8. Put in the color you want. A selection of all the colors with that name will appear.
Other brands of paint may be selected. However, the selected paint color must
match the Sherwin Williams color. • Please remember a paint ‘chip’ needs to be
provided for any painting or repainting being requested. • Please note that a
shingle sample must be provided if you are reroofing your home.

practice the recommended protective measures by social distancing and wearing
you’re mask where needed. Stay safe, then be sorry.
(GC1) COVID-19 AND HALLOWEEN
Is Trick-or-Treating safe amid the Covid pademic? If you’ve been paying attention,
you already know what to do. It’s not magic. Avoid crowds, use good hand
hygiene, stay away from big indoor parties and wear masks - the safety kind - even
outdoors, in many cases. You can keep many of your favorite Halloween traditions
- but the coronavirus dictates caveats. Do the right thing and take precautions.
(GC1) CURRENT BOARD MEMBERSHIP UPDATE
Since the last annual meeting, several Board members have made the personal
decision to resign from their positions. The current Board membership can be
found in the Import Numbers section of the newsletter. In next year’s 2021 annual
meeting (March 2021), the current Board of Director’s membership will be further
reduced due to a change in state law. We would love to work with interested
homeowners who like to join the Board, please consider serving your community
as next year’s annual meeting approaches.
(GC1) GEORGETOWN I BOARD MEETINGS
Due to Covid-19, there will be no face to face meetings at the MUD building. These will be
virtual via zoom and be held Quarterly. As the Georgetown Colony POA annual budget
planning session is scheduled for early October the Board of Directors encourages
every homeowner to attend the open meeting as we discuss fiscal budget items and
make a decision regarding our annual HOA assessment rate issued to homeowners for
Y2021. Virtual meeting date and login details will be posted via the community board.

community and homeowners are restricted from running home based businesses.

(GC1) ACC APPLICATIONS FOR HOMEOWNER IMPROVEMENTS
Please remember when you are making modifications to the exterior of your
home or your property there are enforceable deed restrictions you must comply.
Please submit an ACC application for approval before the work begins. To submit
a request, log online to your homeowners portal at www.portal.scsmgmt.com
website and tab down to Architectural Request and from there you can submit
a request. Referenced deed restriction guidelines can be found under the
Association/Documents tab.

Yard signs are prohibited except for real estate and short term political signs
during our National Elections period. Be mindful of the deed restriction for yard
signs and help keep our neighborhood looking beautiful.

to keep their property maintained! It shows pride in your ownership and it keeps
all of our property values up! Before doing home improvements, please submit an
Architectural Review Form to the Board for approval prior beginning any exterior
work. The forms may be obtained from SCS Management at www.scsmngt.com

ANNUAL JAMESTOWN HOMEOWNERS MEETING - OCTOBER 20, 2020
The Jamestown Colony 2020 Annual Meeting will be held on Tuesday, October
20, 2020 at the Mud 102 Building (6710 Kentwick Drive). The homeowners will be
electing Board members for the 3 open positions. Please plan on attending. The
cost to print and mail the initial package to all property owners is roughly $2,000
(including the solicitation of candidates notice). Per our Bylaws, a 20% quorum of
homeowner ballots (basically 80+ Ballots) is required in order to hold the meeting.
AND if a quorum is not established, the Ballot/Proxy package must be mailed out
again at a cost of $1500 until a quorum is reached.
WHAT YOU CAN DO FOR ALL OF US! - Please fill out and return the Ballot/Proxy,
so a quorum can be established. Even if you just check the box for opinion #1 for
Quorum Only - this will be beneficial to OUR balance sheet.
MONTHLY HOA MEETINGS
With many of the meeting restrictions being lifted the Monthly HOA meeting
will continue to be held on the 3 rd Tuesday of the month at the Mud 102 building
including holding the meeting outside at the Mud District building or park.

ARCHITECTURAL & MODIFICATION REVIEWS
Any external improvements to your property needs to have a Home Improvement
Request Form sent to PMG Property Management before initiating the work. This
includes exterior painting, replacement of fence, roof, removing trees, etc.
To submit a request, log in to Townsq.io - Under DOCUMENTS, ASSOCIATION
DOCUMENTS, you will see the Jamestown Colony ACC form. The Jamestown Colony
ACC Guidelines can be found under DOCUMENTS, GOVERNING DOCUMENTS.

CYPRESS FALLS BAND FUNDRAISER
The Cypress Falls Golden Eagle Marching Band lined our neighborhood with
nearly 700 US flags recently through their Flags with Pride fundraiser. For
an annual fee of $40, band volunteers will deliver a 3’x5’ flag on a 10’ pole
and place it in front of your home on six patriotic holidays throughout the
year: Presidents Day, Memorial Day, Independence Day, Labor Day, Patriots
Day (9/11) and Veterans Day. The band is now taking orders for 2021 flag
service and is running a special promotion: new customers that sign up by
November 5 th will get a flag for Veterans Day 2020 included for free! Homes
must be in the Cypress Falls High School attendance

designed to give local charities the opportunity to generate contributions
through the Houston Open. 100% of your donation goes directly to the charity
of your choice. The Houston Open will also award the top three donationcollecting
charities and one randomly drawn charity with an additional
bonus. In 2019, the Houston Open distributed $615,000 to local nonprofits.
How can I participate in Birdies for Charity®? There are two ways to donate

The minimum birdie pledge is $.01 and the maximum pledge is $1. The

birdies were made at the Houston Open. FYI we are playing at a new
course this year.
2. Make a flat donation not tied to birdies. For flat donations, the minimum is
