SIK-Holzgestaltungs GmbH is a family-run 

craftsmanship business with 230 employees. 

Since 1988 we are developing and building 

in Langenlipsdorf, Germany, individual playground 

equipment made of creative ideas and 

robinia wood. Our mission statement is the

We are interested in better and free play! 

Over 30 years we have been collecting experiences from theory and 

best practice. This helped us to understand the movement, the play 

instinct, the value of play and the physical and mental development 

of all human beings better. We use this knowledge to develop and 

continually improve our play space concepts. 

We offer everything from one source! 

With us, you will find all company divisions consolidated – from on-site 

consulting to playground planning, construction and production of 

playground equipment and even assembly and on-site service.

The playground 

Playgrounds are places where people of all ages 

can come together, no matter whether they 

are in densely populated cities or in the countryside. 

Children and teenagers can meet here, 

young parents can swap experiences, older people 

can watch the children playing and maintain 

their social contacts. When it comes to the design 

of playgrounds, there are many good ideas 

and plans that are neither suitable for children 

nor user-friendly. 

In 1971, the requirements for good playground 

planning were compiled in DIN 18034. A review 

is conducted every five years to assess whether 

this standard needs revising. It has to be revised 

every ten years. The aim of this is to design 

playgrounds in such a way that they are fun and 

inclusive for all users.

Two-senses principle: 

By appealing to two senses (sight, 

sound, touch, taste) when designing a 

playground, this increases the number 

of user groups and length of stay. 

Participation: 

In terms of user participation, it is 

important that the demographic 

structure is adequately reflected to 

consider the interests of children of 

different ages and abilities, different 

social classes as well as boys and girls. 

Two-way principle: 

Play equipment and items should be 

accessible from at least two different 

locations. At least one location 

should be easily accessible. 

Accessibility: 

Playgrounds should be accessible 

for everyone to avoid unnecessary 

obstructions. Playing and interaction 

between different users can be 

achieved by participating and using 

different abilities and skills, as well as 

the choice of subsequent play equipment. 

Signage: 

A signage system for the individual 

play areas through sight, sound, 

touch, taste, smell or body awareness 

makes all users orient themselves 

around the playground easily.

Orchestra- 

Playground 

Mohnheim: In memory of the great composer Johann 

Sebastian Bach, the playground on the street named after 

him has been redesigned in Mohnheim. At the centre 

is a combined play equipment with the look of a big contrabass 

for climbing over, crawling into it and sliding down. 

Climbing ropes in the form of staves connect the contrabass 

with a piano for balancing. A small sand construction 

site in the form of two large drums offers creative 

and persistent play opportunities. Two flutes and a clarinet 

make up the silhouette for a swing and a seesaw. The 

stable green scaffolding and a seating suite make the 

playground an attractive family gathering in the quarter.

Playground Wippen projects ‹ Wippen ‹ SIK-Holz ® 09 

Ghost- 

Playground 

Dortmund: The playground is dominated by a ghost 

train which connects the single play areas as a nonstop 

playable tangent. It starts at an abandoned castle that 

encourages integrative play with sandpits and sensory 

play. Next, the ghost train winds through a creepy forest 

with different climbing and balancing equipments up to 

a height of 2.9 m. Spiders, bats and a hissing cat accompany 

passengers on the ghost train. It continues past a 

ghost bedroom to an integrative swing offer for lots of 

children in a small area. The final stop of the ghost train 

invites to a ghost break in two stabled ghost wagons. 

After a short break it is time to get back to the ghost 

train again – only backwards.

Swing park 

Rotenburg an der Fulda: Under ancient beech and 

chestnut trees in the fairy-tale palace garden in Rotenburg 

an der Fulda, Germany’s first swing park is open for 

children to swing together. Eight swings with eleven different 

swinging seats are connected via an accessible route. 

The red posts indicate swings designed for children and 

adults, while the blue posts indicate swings that can be 

used by people with physical disabilities and with the assistance 

of others. The swinging motion back and forth and 

a slight breeze on the face creates a relaxed feeling of freedom. 

Children, families, friends and colleagues can move 

in the fresh air, let their thoughts wander, laugh together 

and have fun, whether after school, during lunch breaks, 

after work or in the evening.

Farm- 

Playground 

Riedberg: In the east of the Altkönigsblick district in 

Riedberg, a large playground and grassy area have been created 

from around 7 ha of farmland. Along with wild flowers 

and a large variety of insects, children can run around the 

integrated playground which is based on a farm theme. 

The entrance features an accessible playhouse combination 

with sandpits and sensory games as well as seats. Next 

to it, a giant climbing tractor with a hay cart invites children 

to climb, slide and role playing games. The area for older 

children begins behind a hedge. The large windmill with 

slide is the eye-catching feature. From the top you can enjoy 

a great view. Behind the windmill is a wooden crop field 

with balancing and climbing equipments as well as a belt 

bridge. A dual cable rider that follows along the sloping 

terrain finishes off the play area.

Sweden- 

Playground 

Kaarst: A shrimp boat lies in the harbor of a fishermen’s 

village. A birch forest bears behind it. Also, a full-sized 

moose is the eye catcher of the playground. The shrimp 

boat and the fishermen’s village are specially meant for 

pre-school and primary school aged children. Here are 

many climbing and hiding possibilities and offers for role 

playing – and sensory games. The birch forest is conceived 

for older children. There are many balancing and climbing 

possibilities to find in the widely ramified climbing 

forest. They all have different levels of difficulties. The big 

hanging nets invite to chill and they are also beloved meeting 

places on summer nights.

Spreewald- 

Playground 

Lübbenau: A Spreewald kingdom opens behind the 

entrance gate of the same name in front of the old town 

of Lübbenau. The playground depicts typical aspects 

of the Spreewald and offers a rich area of activity for all 

age groups. An underwater world lies behind the entrance 

gate with climbing fish for small children and a water 

play unit. The main feature of the playground is the net 

and fish trap paradise. High and low Spreewald houses 

are connected by a maze of tunnels, bridges, ropes and 

nets. A stork sits in a nest on a roof, barrels for crawling 

through and hiding lie beneath the houses with a hammock 

between them for relaxing. Additional swings can 

be found separately in the play area. Besides the large 

play area, three themed playhouses, a linseed oil stall, 

gherkin stall and a large boat repair shop provide plenty 

ofspace for quiet role playing games and sensory games 

as well as space to sit and relax.

Viking- 

Playground 

Hamburg: A large, 16 metre-long Viking ship lies near the 

river Bille in Hamburg’s Bergedorf district. Behind it lies a 

small settlement with typical dragon heads on the houses, 

designed to protect the Vikings’ homes from enemies. The 

ship has many sections for climbing, balancing and hiding 

both inside and outside, and was designed for older children 

with role playing games in mind. You can hear their 

commands from a distance, suggesting a turbulent seafaring. 

Two approximately 6 metre-long rope bridges connect 

the ship to a tower with a slide. The location of the tower 

on top of a hill extends the length of the slide and increases 

its appeal. The Viking house on the other side of the hill 

provides an option for different, somewhat calmer play. 

Even accompanying people can find seating possibilities 

here, which can be used as baking tables too.


Flowers- 

Playground 

Heilbronn: The dynamic altitude of the blossom panorama 

differs clearly from the contour of the Cuban architecture 

of the garden center. Big colored blossoms raise 

the profile. It seems that everything is moving in the wind 

in the same way. The liveliness continues when you enter 

the play area. Through the inviting archway, you first reach 

the toddlers area over an invalid roll chair ramp. Here 

meadow and city come together. Carved beetle, seesawing 

caterpillar and bees wait for the children. The play area 

invites to cooperative play with water and sand and will 

shaded by yellow brightly awnings. The main attraction is 

a climbing garden designed as a flower meadow. It climbs 

up to four meters high, through filigree stainless steel 

tunnels, into calyxes, through leaves, grasses and buds. 

The multicolored acrylic panels in the calyxes create surprising 

light effects in which the perception of the room 

and the outside world changes and appears in a new light.

Rocking 

equipment 

Children feel their own body weight when using 

a seesaw. The sensation of their weight constantly 

shifting can feel almost like hovering. 

Eye contact between the children and the 

unique sensation of moving up and down make 

this an activity that kids will want to repeat 

over and over again. Aside of our classic seesaws 

we also offer a range of other playground 

springers. These are all beautifully hand-sculpted 

in our own workshop. As well as being fun 

to ride on, our springers are also designed to reflect 

the diversity and beauty of nature.

Agility

Climbing, balancing, gymnastics, mastering monkey 

bars, even just sitting quietly and watching, 

are all essential elements of psychomotor development 

through play. Balancing on a narrow 

surface, learning to propel yourself along horizontal 

bars or looking down from the dizzying

in our wood-carving workshop. They 

can be free-standing, mounted on fence posts 

or installed in sandpits. Children can enjoy 

climbing on them or incorporating them into 

their role play. It is also quite common for

friends. They can also enrich children’s 

understanding of nature and can add value in 

teaching important values. The individual character

Sand and water are among the four elements. 

Having the opportunity to play with both of these 

in a play space should be a fundamental part 

of any child’s education. Playing with sand and 

other loose materials promotes the ability to 

create and make different shapes. The addition 

of water adds a further dimension to this type 

of play. Playing with sand and water is a pleasure 

enjoyed by young children right up until they 

start school and even beyond. A spacious sandpit 

should therefore be an essential feature in 

any playground. Small tables, platforms with 

mini sand lifts, and sand and water chutes all 

make this sort of play even more fun. It is important 

when planning sand and water play areas 

that they are installed in a sheltered location 

away from busy thoroughfares. It is also advisable 

to position them under the shade of trees or 

under a sun awning.

Spaces for play, free movement and exercise are 

key features for any local community and impact 

on quality of life. Therefore, the aim when planning 

these common spaces is to create attractive 

places where people will enjoy spending time. 

For example, we produce unusuallyshaped chairs, 

made especially with young people in mind, as

Material and quality ‹ SIK-Holz ®

Material anD Quality 

SIK-Holz ® playground equipment is made from 

local Robinia wood. It is the hardest European 

timber and can be used without chemical 

treatment as it belongs to resistance class 1–2 

of EN 350-2. Our Robinia wood is sourced 

from sustainably managed forests in Germany. 

These are managed as part of natural mixed 

cultivation. All wood residue is processed further. 

The wood moisture content is less than 

20 percent in sawn wood. 

We are certified according to the guidelines 

of PEFC and FSC ® . This certification 

allows us to verify the entire flow of material 

in our production chain. Upon request, we 

can provide different products with a PEFC or 

FSC ® certificate. 

Not only is the natural shape and 

structure of the wood taken into consideration 

when developing our playgrounds, sculptures 

and furniture for urban spaces; it also determines 

the character and effect of our products. 

Our playgrounds are developed manually and 

solidly constructed. All wooden components 

are bevelled and sharp edges and corners are 

rounded out. Wooden connections (e.g. reinforcements, 

timber extensions or crossings) are 

designed to be strong and interlocking. 

Nets and ropes consist of 4-strand Herkules material 

with a steel cable core. All fixings required 

for construction such as screws, bolts 

and brackets are galvanised. Protruding metal 

parts such as screw heads are rounded, nuts 

and similar are recessed and secured with 

plastic caps. Slides are made of 2.5 mm-thick 

full stainless steel. Horizontal bars and monkey 

bars are made from stainless steel pipes.

The robinia builts a distinctive coloured heartwood 

which differentiates from the narrow 

yellowish-white sapwood. Robinia wood is extremely 

heavy and hard and accordingly has 

good strength values that are significantly 

higher than those of the oak. It is tough, flexible 

and easy to bend. Robinia also is characterized 

by an above average resilience across the 

grain on dynamic stress. The heartwood has 

high natural resistance to wood-destroying 

fungi and insects. In terms of robustness 

robinia is superior to all other types of wood 

and even poor quality specimens can last on 

average at least 20 years in the ground. 

At a felling age of 40−50 years the 

robinia grown in Europe, reach a trunk hight 

of 20−25 m and a diamter of 30−40 cm. 

Traditional use, for example as fence posts, 

mine timber or fuel, becomes gradually less 

important. In recent years the wood has been 

used to manufacture high-quality products. 

It is particular useful for constructive applications 

outside which are biologically and 

mechanically demanding.

Colours can have either a positive or a negative 

effect on our optical sensory perception. Certain 

colour combinations direct the eye and draw 

attention to a particular situation or a location. 

The careful use of colours can add something 

to the look and composition of a playground. 

That means the planner is able to use colour 

in order to add a particular emphasis to the playground 

which can stimulate children’s play. 

For our coating system, we use an environmentally 

harmless, transparent wood varnish for 

all large playground equipment and certain 

large play equipment. Equipment with springs 

and smaller equipment are, according to their 

natural colouration, painted with opaque wood 

varnish. Our colours are saliva and sweatresistant 

and are particularly suited to children’s 

playground equipment due to their 

raw material composition. 

By default our equipment is coated in Robinia light, 

unless stated otherwise. We are happy to arrange wood 

stains and rope colours according to your wishes.

Assembly 

All our play equipment is pre-assembled in our 

workshops and, if necessary, dismantled for 

transportation with items clearly marked for reassembly. 

We supply full assembly instructions. 

For large and complex assemblies, we 

also have our own in-house installation team. 

Quotes for assembly are calculated on the basis 

of average ground conditions with a maximum 

depth of 1.0 m and soil class 3, as per DIN 18300. 

Access to the site for lorries up to 15 tons and 

adequate space for wheel loaders and cranes 

must be guaranteed. We carry out the measurement 

and installation of the equipment 

utilising available and statically sound anchoring 

support onsite. These must be guaranteed 

by the customer. 

Care and 

Maintnance 

Regular inspections and any maintenance work 

as a result, as well as documentation thereof, 

is a mandatory requirement for operators of public 

playgrounds. You will receive a checklist 

for regular maintenance with each delivery or 

acceptance of our equipment. Playground 

equipment care is not required by law. However, 

in terms of investment, regular playground 

care can extend its lifespan and positively 

impact the playground and area around 

it. Depending on the location of the equipment, 

deposits from the air, sun, frost and dryness 

can alter the surface of the wood. This requires 

care if you wish to get long-term joy out of

As a renewable raw material, wood is extremely 

important for our climate, our culture 

and the economy. Wood has virtually endless 

growth potential and therefore offers many 

ecological and economic advantages compared 

to fossil resources. Throughout their lifecycle, 

trees absorb carbon dioxide and water to generate 

oxygen as part of photosynthesis, which 

is vital for most living things. When a tree dies, 

it slowly decays and returns the carbon dioxide 

absorbed back into the atmosphere. The 

cycle then starts again from the beginning. 

There is no cycle when using fossil fuels and 

ores for energy production and producing 

metals and plastics. The carbon dioxide accumulated 

over millions of years is released 

directly into the atmosphere all at once, dramatically 

speeding up climate change. The 

intensifying greenhouse effect contributes to 

changes in the climate. Thus, the longer the 

wood undergoes its natural cycle of materials 

while decaying and as a result of combustion, 

or the more frequently it replaces fossil fuel materials, 

the more the carbon dioxide balance 

in our atmosphere improves. 

A particularly long life cycle and the associated 

storage of carbon is important for the environmental 

footprint of our products. Robinia wood 

inherently has excellent physical properties 

for the construction of playground equipment 

(p.158). If cared for properly, our playground 

equipment can be used for around 30 years or 

more. The use of robinia wood in children’s 

playgrounds is sustainable, economical and 

innovative.

§ 1 Scope – Integral parts of the contract 

1. Our General terms and conditions apply to the delivery of products and to 

other performances according to the contract which was made with the 

customer. 

2. Deviant of this, assemblies takes place according to the German construction 

contract procedures. Therefore the General terms and conditions only 

apply to assemblies if the German construction contract procedures was not 

(or not validly) arranged. 

3. Our General terms and conditions apply to the consumer and to the mercantilist, 

except there is a differentiation in the respective clause. The genus 

customer stands for consumer and mercantilist. 

4. Our General terms and conditions apply solely; we only accept deviant 

conditions, amendments, additional agreements or tendering according to 

the German construction contract procedures if they are written confirmed. 

This is also valid if we unconditionally conduct the delivery aware of deviant 

instructions. 

§ 2 Offer – conclusion of the contract – bidding documents 

1. Our offers are without engagement. Changes of the models, the construction 

or the equipment are subjected. Illustrations and statements of the 

catalogue and brochures show only approximations and are not binding, 

except they are explicitly marked as binding by us. According to the condition 

of the goods applies only to our product description as agreed in the 

confirmation, except a special product description is made explicitly and 

written between us and the customer; public statements, advertisements 

or promotion of the SIK Holz are not considered as contractual declaration 

of the condition of the goods. 

2. The order of the customer is a binding order which we can accept by sending 

of a written confirmation or by delivery of the goods. 

3. In case a consumer orders goods by electronic way, we will confirm the 

receipt of the order immediately. The confirmation of the receipt is no binding 

acceptance of the order. In case of an electronic order by the consumer, 

the content of the contract is saved by us and will be sent to the customer 

by request, together with the present General terms and conditions, by 

electronic way (E-mail). 

4. The customer is responsible for the accuracy of the documents which have 

to be delivered by him as well as especially for examples and drawings. 

The assertion of any kind of claim for compensation against us because of 

products defects, which are due to incorrect documents of the customer, is 

impossible. 

5. Protective regulations are only delivered if it is regulated by law or explicitly 

stipulated. 

6. The ownership and the copyright of the illustrations, drawings, calculations 

and other documents is reserved to us. This also applies to written 

documents which are called as confidential. Before transferring to a third 

party the customer needs an explicitly written agreement of us. If trademark 

rights of a third party are infringed upon, during the making of the 

article of sale on the basis of drawings, examples or other indications of the 

orderer indemnifies our firm from all pretensions. 

§ 3 Prices and terms of payment 

1. The prices are calculated ex works and do not include packaging, freight, 

postage and safety of the value. The current VAT has to be added. The offers 

base on the price list which is valid to the time of the offer. 

2. In case the customer is consumer, price changes are acceptable, if there are 

more than 4 months between the conclusion of the contract and the agreed 

delivery date. If the wages or costs of materials change after the conclusion 

of the contract till the delivery, we are in the right to change the price adequate 

according to the cost increase or cost reduction. The customer is only 

entitled to abdicate if price increases transcend the cost of living between 

the order and the delivery gravely. 

3. In case the customer is mercantilist, the agreed price is valid. The higher 

price is valid if the price increased in the time of the service provision by 

changing of the market price or by increasing fees which are demanded of 

the third party which is included in the service provision. The customer is 

only entitled to abdicate if the price is at least 20 % higher than the agreed 

price and the resignation takes place promptly. 

4. All accounts for deliveries are payable without deduction during 30 days from 

account date on. All accounts for efforts are payable without deduction during 

14 days from accountdate on. 2 % discount is given if it is paid during 8 days as 

far as the orderer is not behind schedule with the payment of claims of goods. 

5. Notes our firm a grave deterioration of the capital ration of the orderer after 

the conclusion, of the contract, which put a risk on our claims to consideration, 

we can demand a accordant security till the time of his capacity. If 

the orderer does not meet our justifiable demand, we can withdraw from 

the contract or claim for compensation because of default. If the order gets 

in arrears with a partial performance, our firm can demand the total outstanding 

amount immediately. 

6. The customer has the right to set of only if its counterclaim is legally assessed, 

indisputable or accepted by us. Is the customer mercantilist, he is 

only authorised to execute the right of retention if his counterclaim is based 

on the contractual relationship. 

§ 4 Delivery and services 

1. The stated delivery time demonstrates only an approximate value and is 

not binding, except a special delivery date was explicitly binding agreed. 

2. The assertion of any claim for compensation is impossible, if a binding delivery 

time is not complied with, because of reasons which the customer has 

to be of, e. g. incomplete or non-fulfilment of his contractual obligation in 

time; especially incomplete and non-duly delivery of all needed permissions, 

documents, examples and drawings. 

3. A time limit is considered as adhered: 

a] in case of delivery without assembly and installation, if the delivery is 

sent or picked up during an agreed period. Delays the delivery because of 

reasons the customer is of – the time limit is considered as adhered if the 

readiness for dispatch is announced. In case of a supplementary changing 

of the contract at the customer’s instance, which influence the delivery time, 

the delivery time can be elongated adequately. In this case the time limit is 

considered as adhered albeit the elongation. 

b] In case of delivery with assembly and installation as soon asit takes place 

during the agreed period. Is the non-compliance of the time limit based on 

unforeseen and non-justifiable happenings, strike, lock out, war, lack of 

energy and resourcesor acts of god, we are exempt from adherence of the 

delivery time and prices. If we default with our services because of reasons 

we have to be of, the customer can demand payment of compensation instead 

of services first if he set an adequate time limit and this extension of 

time elapsed unsuccessfully. Is the delivery or service delayed or cancelled 

at the request of the customer or because of reason which the customer has 

to be of, we are in the right to assert originated disbursement as damage 

to the customer and calculate originated costs in a reasonable amount, for 

example storage charge. 

§ 5 Cost for delivery and service, transfer of perlis 

1. The type of dispatch is elected in agreement with the customer. The customer 

bears the costs of the dispatch, contingent additional charges as 

well as possible extra costs for express goods, if there is not written agreed 

anything else. 

2. In case the customer is mercantilist – the danger of accidental demise and 

deterioration vests in the customer when the goods are released/ delivered 

to the forwarder, freight carrier or another person who is responsible 

for the dispatch. 

3. In case the customer is consumer – the danger of accidental demise and 

deterioration vests of the bought goods in the customer when the goods are 

released (even if theyare delivered). If the customer is behind the schedule 

it is equal to the release. 

4. In case of delivery with assembly and installation the danger vests in the 

customer from the time when the goods are accepted. 

5. We carry out delivery and service according to the usually necessary accuracy, 

except the customer gives a special instruction by the placing of order 

or conclusion of the contract. We are not liable for defects which are caused 

by the instructions of the customer. 

§ 6 Right of withdrawal and of return 

1. In case of a delivery/ service because of a distance selling contract 

(§ 312b German civil code) the customer has the right to withdraw 

his declaration of intent, which he made at the conclusion of the 

contract, in the space of two weeks. The cancellation does not need 

a statement and has to be written or to declare it the seller through a return; 

for the ensuring of the time limit is a duly dispatch sufficient.

are made according to customer’s specification. It is also a making according 

to customer’s specification if the consumer chooses its article out of a 

catalogue or brochure in creative type which is not shown and provided in 

the catalogue or brochure. The customer is obligated to return the goods if 

he uses his right to cancel in case the goods are able to send in a packet. In 

case the order value is up to € 40,- the consumer bears the cost of return 

except the delivered goods do not correspond to the ordered goods. Is the 

order value higher than € 40,- the customer has not to pay the costs for 

return. The consumer has to pay compensation for the degradation which 

is caused by the intended use. The consumer is allowed to check the goods 

carefully. The consumer has to bear the obsolescence which causes by the 

use of the goods, which exceed a check that they cannot be sold as ‹new›. 

§ 7 Liability for defects 

1. Is the customer consumer; we adhere according to the law in case of a 

defect as far as there are no reductions because of the subsequent. 

2. Is the customer mercantilist; we reserve the way of execution in case of a 

defect to us. 

3. Obvious defects have to be written announced to us by the customer in 

the time of 2 weeks after the incidence of the defect. Otherwise expire the 

right of warranty of the customer unless we concealed defects or accepted 

warranty for the character of the goods. 

4. If the customer is an entrepreneur, he may, if we refuse to seriously and 

conclusively or we refuse to remedy the defect and rework due to unusual 

costs, require only a reduction of the purchase price (reduction), or when 

building work is not for the complaint withdraw from the contract. 

5. Happens a delivery without assembly and installation, and is an instruction 

sheet, which we delivered, incorrect, we are just liable to deliver a correct 

instruction sheet and only if the mistake in the instruction sheet is opposed 

to a correct assembly. 

6. The right of compensation of defects of the consumer prescribe in case of 

a delivery of new goods after two years and in case of delivery of secondhand 

goods after one year. The time limit begins with the transfer of perils. 

Is the customer mercantilist, the period of warranty for the delivery of new 

and second-hand goods amounts always one year; the limitation period 

stays unaffected in the case of a delivery regress (§§ 478, 479 German civil 

right). 

7. The right of compensation because of defects are excluded from the stipulations 

of § 7. In this case § 8 is valid for all customers. 

8. The customer gets no warranty according to the law of us; this was explicit 

written agreed. 

§ 8 Adhesion for defects 

1. Our adhesion for compensation for contractual breach of duty as well as of 

delict is restricted to intent and gross fault. Notwithstanding we are liable 

for every degree of the faults of invasion of live, body and health of the 

customer and of invasion of cardinal obligation and compensation of damages 

caused by delay (§ 286 German civil right). 

2. The adhesion is limited, in case of a delivery delay, to 0.5 % of the delivery 

value for every accomplished week of the delay in the line with an agreed 

compensation for delay. The maximal limited adhesion is 0.5 % of the delivery 

value. The adhesion in case of an invasion of cardinal obligation is 

limited to the regular predictable defects. 

3. The aforementioned nonliability is also valid for slightly negligent breach of 

duty of our auxiliary person. 

4. As far as the adhesion of compensation is barred fromus or limited, the 

adhesion is also valid in the face of the personal adhesion of compensation 

of our appointees, employees, assistants, representatives and auxiliary 

persons. 

5. As far as an adhesion of defects, which are not based onthe invasion of 

life, body and health of the customer, is not barred for slight negligence, 

prescribe rights like these in the time of one year beginning with the development 

of the right or with the right of compensation because of a defect 

from the handing over of the goods on.

now until the performance of our demands. We are owner of the produced 

goods if they were made by converting of our goods, their alteration and 

their connexion with another thing. These are conditional goods. If the 

conditional goods will be assembled as essential part of the parcel/ building 

of the mercantilist, he assigns the claim amounting to the invoice value of 

the retention of title of the goods with all ancillary rights to us, which are 

caused by any possible sale of the parcel or of real estate property rights. 

Exceeds the value of safety our demands to the mercantilists by more than 

20 %, we have to decontrol, by request of the mercantilist, safeties at our 

own option inaccordant amount, which are entitled to us. 

3. The mercantilist commits to announce the names of his customers, to which 

our goods were disposed, in case of his illiquidity and by request. 

4. All customers have to inform us directly about actions of execution of a 

third party by presentation of the documents which are necessary for an 

intervention; this is also valid for vitiations on other lines. Notwithstanding 

all customer have to point the right in the goods out to third parties in 

advance. In case the customer is mercantilist, he has to refund the cost of 

intervention, as far as the third party has not the ability. 

§ 10 Limitation 

1. Our demands on payment of the purchase price and the wage prescribe 

after 5 years, notwithstanding § 195 German civil right. § 199 is valid concerning 

to the beginning of the limitation. 

§ 11 Place of ex ecution and jurisdiction, applicable law, effectively 

1. As far as there is nothing else arranged in the contract, the place of execution 

and jurisdiction is his address of record. This has no bearing on the 

legal regulation of the applicable law for the consumer. 

2. In case the customer is mercantilist, artificial person under public law or 

under separate estate of public law, exclusive jurisdiction for all disputes 

with the customer out of the contractual relationship (inclusive) is the court 

which is responsible for our place of business. The same is valid if the customer 

has no place of general jurisdiction in Germany or his residence or 

sojourn is not known at the moment when the suit was filed. 

3. This contract is subject to the German law as far as there are not special 

instructions of consumerism in the home country of the consumer, which 

is favourable (article 29 introductory law of the German civil right). The 

mercantilist is barred from the use of the CISG. 

4. Declarations and advertisements relevant to the issue, which the customers 

comment to us or to a third party, must be in written form. 

5. If one or more terms are or will be invalid, the affectivity of the other terms 

is not affected. 

§ 9 Retention of title 

1. The goods are our property until the whole payment of the purchase price 

is done, in case of contracts with the consumer. 

2. In case of contracts with mercantilists are the goods our property until all 

demands of an ongoing business connexion are paid. In event of resale/ 

leasing of the goods, the mercantilist assigns the demands on his customers
