The use <strong>of</strong> contractor employees to perform functions previously performed<br />
by government employees combined with consolidation in many sectors<br />
<strong>of</strong> the contractor community has increased the potential for organizational<br />
conflicts <strong>of</strong> interest.<br />
.As.explained.above,.the.potential.for.OCIs.has.increased.significantly.in.recent.years ..<br />
The.contracting.community.needs.more.expansive.and.detailed.guidance.for.identifying,.<br />
evaluating,.and.mitigating.OCIs ..The.current.FAR.language.provides.significant.leeway.to.<br />
contracting.<strong>of</strong>ficers.to.address.OCIs,.but.recent.decisions.by.the.GAO.and.the.courts.indicate.that,.in.many.instances,.appropriate.investigation.and/or.analysis.is.not.performed<br />

This.has.created.a.substantial,.negative.impact.on.agency.performance.and.on.the.public’s.<br />
impression.<strong>of</strong>.the.procurement.process ..<br />
Finding 7:<br />
There is a need to assure that the increase in contractor involvement in<br />
agency activities does not undermine the integrity <strong>of</strong> the government’s decision-making<br />
processes.<br />
Just.as.the.trend.toward.more.reliance.on.contractors.poses.a.threat.to.the.government’s.long-term.ability.to.perform.its.mission,.the.trend.raises.the.possibility.that.the.<br />
government’s.decision-making.processes.can.be.undermined .<br />
For.example,.it.is.now.commonplace.for.agencies.to.utilize.contractors.to.perform.<br />
activities.historically.performed.by.federal.contract.specialists ..Although.these.contractors.are.not.authorized.to.obligate.the.United.States,<br />

analysis,.market.research,.and.other.acquisition.support.to.the.federal.decision.makers ..<br />
Unless.the.contractor.employees.performing.these.tasks.are.focused.upon.the.interests.<strong>of</strong>.<br />
the.United.States,.as.opposed.to.their.personal.interests.or.those.<strong>of</strong>.the.contractor.who.<br />
employs.them,.there.is.a.risk.that.inappropriate.decisions.will.be.made ..Commenting.on.<br />

There are numerous statutory and regulatory provisions that control the<br />
activities <strong>of</strong> government employees. These measures are designed to protect<br />
the integrity <strong>of</strong> the government’s decision-making process. Recent,<br />
highly publicized violations <strong>of</strong> these laws and regulations by government<br />
employees were adequately dealt with through existing legal remedies and<br />
