<strong>of</strong> contractor employees (e.g., hiring, approval <strong>of</strong> leave, promotion, performance<br />

ratings, etc.) should be retained.<br />

The.Panel.recognized.that,.despite.the.existing.prohibition.<strong>of</strong>.PSCs.in.the.FAR,.many.<br />

(if.not.all).agencies.have.contractors.performing.activities.that.fit.within.the.prohibition.as.<br />

it.is.currently.defined,.in.part.because.it.would.be.very.inefficient.to.structure.the.workplace.<br />

to.preclude.direct.instructions.to.contractor.personnel ..When.service.contractor.personnel.and.federal.employees.are.working.together.on.a.program.or.project,.there.is.no.good.<br />

reason.to.prohibit.the.federal.employee.in.charge.from.giving.directions.or.assignments.<br />

directly.to.contractor.personnel.so.they.can.work.as.a.true.team ..For.example,.contractors.<br />

and.agency.personnel.routinely.work.in.integrated.project.teams.in.technical.areas ..It.is.<br />

unrealistic.to.expect.that.in.such.situations,.government.employees.will.not.provide.technical.direction,.and.it.would.be.inefficient.to.impose.such.a.prohibition<br />

..<br />

.Even.apart.from.efficiency.concerns,.it.is.antithetical.to.good.government.practices.to.<br />

have.regulations.in.place.that.cannot.realistically.be.complied.with.and.thus.are.routinely.<br />

violated.and.not.enforced ..<br />

Under.the.Panel’s.recommendation,.federal.employees.would.still.be.precluded.from.<br />

involvement.in.personnel.decisions.regarding.contractor.employees,.such.as.hiring,.promotions,.bonuses,.and.performance.ratings<br />

..<br />

Although.there.is.no.express.statutory.prohibition,.the.prohibition.has.been.in.place.<br />

for.so.long,.and.there.have.been.so.many.rationales.for.it,.the.Panel.concluded.that.Congress.should.clearly.and.unambiguously.resolve.the.issue.through.statute,.rather.than.await.<br />

a.regulatory.revision ..<br />

Recommendation 4:<br />

Consistent with action to remove the prohibition on personal services contracts,<br />

the Office <strong>of</strong> Federal Procurement Policy should provide specific<br />

policy guidance which defines where, to what extent, under which circumstances,<br />

and how agencies may procure personal services by contract.<br />

Within five years <strong>of</strong> adoption <strong>of</strong> this policy, the <strong>Government</strong> Accountability<br />

Office should study the results <strong>of</strong> this change.<br />

The.Panel.recognized.that.it.was.possible.that.some.types.<strong>of</strong>.service.contracts.should.<br />

still.be.prohibited;.therefore,.it.recommended.that.OFPP.provide.specific.guidance.to.agencies,.consistent.<strong>of</strong>.course.with.whatever.limitations.Congress.might.impose<br />

..<br />

For.example,.an.agency.Inspector.General.(“IG”).or.Chief.Financial.Officer.(“CFO”).<br />

should.not.be.able.to.direct.the.performance.<strong>of</strong>.a.contractor.hired.to.audit.the.agency’s.<br />

records.and.practices ..In.a.performance-based.contract,.the.contractor.should.have.full.<br />

authority.to.determine.how.best.to.achieve.the.required.performance ..And.there.are.circumstances.in.which.it.would.not.be.appropriate.for.government.managers.to.micro-manage.contractor.activities<br />

..<br />

The.Panel.also.recognized.that.not.every.federal.employee.should.be.authorized.to.provide.direction.to.contractor.personnel<br />

..<br />

Since.the.recommended.changes.in.this.area.would.reverse.prohibitions.that.had.been.<br />

in.place.for.decades,.the.Panel.concluded.that.GAO.should.conduct.a.study.within.five.years.<br />
