The lowcompliant group has been generally any program thathad any non-compliance or had 2 or more violations.When these two groups were compared to eachindividual rule utilizing the phi coefficient formula itwas found that a more accurate approach was toaccentuate or increase the difference between the highand low groups by eliminating the intervening violationsin following manner: high group of 0 violations; 1-4violations being eliminated; 5+ violations defined as thelow group. This additional bi-polarization of data helpedto accentuate the differences in calculating the phicoefficient and provided a more sensitive key indicatortool.Another data distribution issue that should be addressedhere that justifies the above cutoffs is that there is verylittle variance in licensing/regulatory data. Generally thefrequency distribution is 20 or less and the average set ofrules is over 200 rules. So the frequency distribution isextremely skewed within less than 10% of the potentialdata distribution. Also, the majority of programs are100% in compliance with all the rules. And an additionalcomplication is that the scoring of each rule is scored asif it had an equal risk value when in reality the rules canplace children at either great risk to relatively little risk iffound non-compliant. These measurement issues are117
very different than in other measurement systems such asERS or CLASS. The important message to take from thisis that rules are not a ruler, they do not measure thingsequally and cannot be analyzed or compared to othermeasurement systems that are more normally distributed.Although licensing is part of the program qualitycontinuum in establishing basic health and safetystandards for children, it is a system with measurementlimitations that can only be compared on a nominal basismaking several statistical adjustments as suggestedabove necessary.118
