n January 26, <strong>2023</strong>, <strong>WWBA</strong> member and cochair<br />

of the Criminal Law and Programs Committees,<br />

Amy S. Puerto, was sworn in as a Justice<br />

of the Supreme Court, Ninth Judicial District, before<br />

her family, professional colleagues, elected officials and<br />

community leaders, and other district and appellate court<br />

judges. Honorable Anne E. Minihan, Administrative Judge<br />

of the Ninth Judicial District, presided over the ceremony<br />

in the Westchester County Courthouse, at which there<br />

were five inductees who were elected in November 2022.<br />

Also inducted as Justices of the Supreme Court were Honorable<br />

Keri A. Fiore, Honorable Elena Goldberg<br />

Velazquez, and Honorable David J. Squirrell. Honorable<br />

<strong>WWBA</strong> MEMBER SPOTLIGHT:<br />

Amy S. Puerto Inducted as Justice of the<br />

Supreme Court, Ninth Judicial District<br />

Maurice Dean Williams was inducted as Judge of the Westchester County Court.<br />

The induction ceremony opened with the Presentation of Colors performed by the<br />

New York State Courts Pipes and Drums, the Pledge of Allegiance led by the inductees’<br />

children, and the National Anthem sung by Judge Puerto’s daughter, Alexandra.<br />

By artful analogy, Judge Minihan welcomed the new laborers to the vineyard in the<br />

Ninth and recognized the special occasion as the one time when the judiciary and<br />

political worlds would operate and occupy the same space together. Judge Minihan<br />

reaching 400<br />

members who<br />

joined or renewed their membership<br />

between October 1, 2022 and<br />

January 31, <strong>2023</strong>. Thanks to<br />

everyone’s efforts, we successfully<br />

maintained our voting status and<br />

number of delegates as the second<br />

largest chapter of the Women’s Bar<br />

Association of the State of New York<br />

(WBASNY), the largest statewide<br />

women’s bar association in the<br />

country. A special thank you to our<br />

wonderful Membership Committee<br />

co-chairs, Sherry Bishko and Joanna<br />

Tulman, who led us in reaching our<br />

goal. Your hard work and dedication<br />

is recognized and greatly appreciated!<br />

Not only have we increased our<br />

membership numbers, but also we<br />

continue to expand our presence in<br />

the legal community. February<br />

brought several programs in which<br />

we collaborated with other affinity<br />

bar associations. On February 7,<br />

Grievance/ Ethics and Corporate and<br />

Commercial Law Committees presented<br />

an Ethics CLE co-sponsored by<br />

the Westchester County Bar Association,<br />

the White Plains Bar Association,<br />

the Yonkers Bar Association, the Hudson<br />

Valley Hispanic Bar Association, and<br />

the Westchester Black Bar Association.<br />

On February 27, <strong>2023</strong>, the<br />

Westchester Women’s Bar Association<br />

co-sponsored a Black History Month<br />

Event with the Westchester Black Bar Association,<br />

Black Law Students Association,<br />

White Plains-Greenburgh NAACP,<br />

and the NYS Judicial Institute. Additionally,<br />

on February 16, <strong>2023</strong>, the<br />

<strong>WWBA</strong>’s Mentor, Matrimonial and<br />

Families, Children and the Courts Committees<br />

presented a CLE at the Elisabeth<br />

Haub School of Law at Pace University<br />

titled, “Family/ Matrimonial Law<br />

Overview: Diverse Perspectives From<br />

Current Practitioners.”<br />

With <strong>March</strong> now upon us, in celebration<br />

of Women’s History Month, I<br />

say thank you to our members for all<br />

that you have done and continue to<br />

NEWSLETTER SUBMISSIONS<br />

❑ Deadline for newsletter submissions is the 10th of the month prior to publication (submissions<br />

received after the deadline are subject to the discretion of the editor).<br />

❑ Send submissions as email attachments to Jill Oziemblewski at jill_oziemblewski@yahoo.com.<br />

❑ Articles should be 1,000 words or fewer. Remove all pagination, headers, footers or other<br />

formatting, other than bold, underline or italics. Authors are encouraged to submit photographs<br />

for publication with their submissions and include a short biographical statement with<br />

their submissions.<br />

❑ Materials submitted allow the <strong>WWBA</strong> a limited copyright and full permission to reprint the<br />

material in any <strong>WWBA</strong> publication or on its website without additional consent.<br />

❑ Photographs must be high-resolution (150 dpi or more) and the subject and all persons in<br />

each photograph must be fully identified.<br />

PROGRAM SCHEDULING<br />

❑ First visit the <strong>WWBA</strong> website: www.wwbany.org and click on the calendar at the home page to<br />

view scheduled programs. Conflicts in scheduling will be assessed on a case by case basis, with<br />

priority for early submissions.<br />

❑ Contact Natanya Briendel at tanyabriendel@gmail.com or Amy Puerto at<br />

amy.puerto@yahoo.com to schedule a <strong>WWBA</strong> sponsored or co-sponsored program, including<br />

committee meetings, CLE programs, etc.<br />

❑ Once you have reserved the date with Executive Director, Elisabeth Campos, proceed with<br />

planning your program and creating your flyer.<br />

❑ Flyers must be approved by the Programs Committee. In advance of the 10th of the month,<br />

please send your flyer to the Program Committee Co-chairs for review and copy the Executive<br />

Director. Once approved, please send your final flyer to the Executive Director, Elisabeth Campos<br />

and the President for publication on the website calendar and the newsletter calendar. The<br />

final flyer will also be emailed to the membership.<br />

❑ We will also consider publicizing programs from outside organizations that may be of interest<br />

to our members.<br />

❑ Post-event: You may report on the success of your program and provide photographs of the<br />

speakers and participants that can be included in an upcoming newsletter. Send your submission<br />

traits necessary to perform the<br />

unique role of a judge, which<br />

were emphasized by several<br />

were legal ability, courtroom experience,<br />

integrity, empathy, social<br />

justice and community commitment,<br />

judicial temperament,<br />

stamina, and the ability to be<br />

On the evening of February 8, <strong>2023</strong>,<br />

the <strong>WWBA</strong> Grievance/Ethics Committee<br />

Ethical Issues When Attorneys Are Fiduciaries,<br />

to a full conference room of about<br />

40 attendees. The program was cosponsored<br />

The speakers were the Honorable Peter<br />

Kelly, Queens County Surrogate, the<br />

and Deborah A. Scalise, Esq., of Scalise<br />

& Hamilton P.C.<br />

The program was structured around<br />

a hypothetical fact pattern involving attorneys<br />

of the Wit Law Firm, whose acts of<br />

misconduct encompassed everything from<br />

misrepresentation in advertising, to delegating<br />

fiduciary obligations to non-attorneys,<br />

to accepting a settlement offer without<br />

their client’s consent and falsifying their<br />

client’s signature on the relevant documents,<br />

and, ultimately, to cashing the settlement<br />

checks without any estate proceedings<br />

after it turned out the client had passed<br />

away.<br />

The panelists addressed questions<br />

about the fact pattern in turn, giving them<br />

each a platform to identify the problematic<br />

issue, articulate and discuss the applicable<br />

rule, and provide references to case law<br />

and advisory opinions.<br />

The program concluded with a review<br />

of recent changes to the rules governing<br />

notary publics, whereby a new law, NY<br />

Executive Law Section 135-c, creates a new<br />

of the Domestic Violence Bureau<br />

Attorney’s Office, where<br />

Judge Puerto worked from 2000<br />

to 2015. Judge Stone commented<br />

that Judge Puerto already<br />

had a reputation as a<br />

advocating to obtain justice for<br />

crime victims or supporting the<br />

work of the Adolescent Diversion<br />

Part, and Judge Stone remarked<br />

that this experience and<br />

care will provide a platform for<br />

<strong>WWBA</strong> at the inaugural Pace<br />

University Wellbeing Fair. Pace<br />

held the Wellbeing Fair at all<br />

three of its campuses, including<br />

the Elisabeth Haub School<br />

of Law in White Plains. The<br />

event was conceived to mark<br />

the school’s adoption of the<br />

Okanagan Charter, which was<br />

created in June 2015 to provide<br />

institutions internationally<br />

with a common language, principles,<br />

and framework for promoting<br />

health and wellness on<br />

campuses. The Okanagan<br />

Charter has two calls to action:<br />

(1) to embed health into all aspects<br />

of campus culture, across<br />

the administration, operations,<br />

and academic mandates; and<br />

(2) to lead health promotion<br />

action and collaboration locally<br />

Investment Fiduciary Best<br />

Practices and New Regulations<br />

The SEC’s Regulation Best Interest (Reg BI) imposes a new<br />

standard, beyond existing suitability obligations, requiring brokerdealers<br />

and their agents to act in the best interest of the retail<br />

customer when recommending a securities transaction or investment<br />

strategy involving securities. They must also not place their<br />

financial or other interests ahead of the interests of the retail customers.<br />

There are four key components of Reg BI that you’ll need to<br />

act upon when providing investment recommendations or strategies<br />

to retail customers in brokerage:<br />

❑ Duty of care: Brokers must act in the best interest of the retail<br />

customer when making a recommendation in a brokerage account<br />

without placing your financial or other interests ahead of the<br />

customer.<br />

❑ Disclosure and Relationship Summary:<br />

~ Broker-dealers must deliver a new disclosure (in writing)<br />

that discloses services, fees, compensation, and conflicts. It’s usually<br />

referred to as the Brokerage Compensation and Conflicts<br />

Disclosure (BCCD).<br />

~ Only investment adviser representatives (IARs) can refer to<br />

themselves as “advisors” or “advisers” in their titles or DBA names.<br />

The Wellbeing Fair was<br />

highly anticipated and did not<br />

disappoint. During the two<br />

hours a steady stream of law<br />

students stopped at information<br />

tables in the Tudor Room, where<br />

the mood stayed celebratory<br />

with healthy pre- or post-class<br />

refreshments, swag giveaways,<br />

and music. The <strong>WWBA</strong> distributed<br />

stress balls, self-care<br />

intention setting and tracker<br />

forms, and information about<br />

our organization. At least 20<br />

students, if not more, said they<br />

were interested in joining the<br />

<strong>WWBA</strong> and having a mentor.<br />

came together on a brisk, February<br />

evening to aid Hillside<br />

Food Outreach in filling their<br />

stockroom with donated food.<br />

Every few months, Hillside receives<br />

a huge shipment of donated<br />

food from Shop-Rite that<br />

must be stacked in the two<br />

storerooms of the Pantry’s new<br />

location in Mt. Kisco. However,<br />

the doorways to the storerooms<br />

are not wide enough for<br />

the pallets of food to fit through.<br />

Enter, sixteen Westchester<br />

Women’s Bar Association and<br />

Pace Women in Law Society<br />

volunteers who unloaded all the<br />

food from the pallets, which<br />

were temporarily left in a long<br />

hallway, onto Uboats and into<br />

rolling bins. The volunteers<br />

then moved these into the storerooms<br />

and again unloaded the<br />

cases of food-including heavy<br />

boxes of syrup and jars of apple<br />

sauce!-onto new pallets where<br />

they will remain until needed in<br />

the main pantry.<br />

Besides the backbreaking<br />

lifting and stacking, this particular<br />

job posed myriad logistical<br />

problems due to the narrowness<br />

of the hallway that<br />

barely left room for the rolling<br />

bins and Uboats, much less sixteen<br />

sweaty bodies! But the<br />

volunteers worked together<br />

seamlessly and the job was finished<br />

in roughly two hours.<br />

In addition, our littlest volunteers<br />

did some serious shelf<br />

stocking, covering their assigned<br />

pantry shelves with cans<br />

of soup and tomato sauce. No<br />

one is too young to begin a life<br />

of community service!<br />

Hillside Food Outreach<br />

serves those in need by delivering<br />

food to homebound clients<br />

who otherwise would not<br />

be able to get to a food pantry.<br />

Plains, and wanted to<br />

began my involvement<br />

with the <strong>WWBA</strong> a few<br />

years ago after hearing<br />

of its reputation as a<br />

strong association with<br />

great members. I attended<br />

a Westchester<br />

Women’s Bar Association<br />

happy hour where I met<br />

Lisa Denig, and learned<br />

more about the chapter,<br />

and the rest is history!<br />

Q: Which activities and<br />

positions of the<br />

Association have you participated<br />

in?<br />

A: I’ve been a co-chair<br />

of the Criminal Law<br />

Committee since I started<br />

with the <strong>WWBA</strong>. We put<br />

together a virtual meetand-greet<br />

with the then<br />

newly elected Westchester<br />

District Attorney, Mimi<br />

Rocah, where members<br />

were given the opportunity<br />

to ask questions<br />

about her vision and<br />

goals as District Attorney.<br />

Then, in the fall of 2022,<br />

the Committee sponsored<br />

a CLE in conjunction with<br />

the Women’s Bar Association<br />

of the State of New<br />

York (WBASNY) Criminal<br />

Law Committee, on the<br />

Second Amendment in<br />

the wake of the United<br />

“[F]ind someone interesting to work for, even<br />

if the position is not your dream job. Having<br />

interesting colleagues and supervisors can<br />

make nearly any kind of work seem very<br />

interesting! And . . . you never know what<br />

opportunities will come from it.<br />

Q: Please tell us about your<br />

legal career.<br />

A: After graduating from college,<br />

I took a job working as<br />

an ESL teacher in a Japanese<br />

public high school. I<br />

stayed for three years, and<br />

during my last year, I applied<br />

to law schools in the United<br />

States. After my contract<br />

ended, and while my applications<br />

were pending, I<br />

moved to the Philippines and<br />

spent time volunteering at a<br />

non-profit. Soon after<br />

ended, I started law school<br />

in Boston. I felt like my calling<br />

was to work with juveniles<br />

in court, but after an internship<br />

where I sat through a<br />

criminal trial, my interests<br />

changed.<br />

My first job after graduating<br />

from law school was<br />

working at the Ninth Circuit<br />

Court of Appeals in San<br />

Francisco, as a staff attorney<br />

in the criminal and habeas<br />

unit. After five years, I<br />

left and took six months to<br />

travel, eventually landing in<br />

New York City. For a short<br />

while, I worked in temporary<br />

positions at law firms until I<br />

found a court attorney position<br />

with a judge in the<br />

New York State Supreme<br />

Court, Criminal Division. I<br />

was there for 13 years until<br />

my judge retired, and then<br />

worked as a court attorney<br />

with a judge in Bronx Supreme<br />

Court, Criminal Division,<br />

for 3 years. In January<br />

<strong>2023</strong>, I started working<br />

as a court attorney in the<br />

Ninth Judicial District for<br />

newly elected judge and<br />

fellow <strong>WWBA</strong> member, Amy<br />

Puerto, and I am so excited!<br />

Q: What advice do you<br />

have for new lawyers entering<br />

the profession?<br />

A: First, be open to new opportunities,<br />

because you<br />

never know what will come<br />

of them, and who you will<br />

meet! Second, find someone<br />

interesting to work for,<br />

even if the position is not<br />

your dream job. Having<br />

interesting colleagues<br />

and supervisors can make<br />

nearly any kind of work<br />

seem very interesting!<br />

And again, you never<br />

know what opportunities<br />

will come from it.<br />

Q: How have you balanced<br />

family responsibilities<br />

and your legal career?<br />

A: I’m not sure I have<br />

found that balance yet,<br />

but I am working on it!<br />

Q: When you are not lawyering,<br />

which community<br />

activities and other interests<br />

do you sometimes like<br />

to pursue?<br />

A: My kids are still rather<br />

young (9 and 7) so my<br />

hobbies, for now, mostly<br />

include shuttling them to<br />

activities. My husband<br />

and I both love traveling,<br />

though, and we have<br />

made many trips as a<br />

family which has been<br />

great. I have also been<br />

a member of the Junior<br />

League of Central<br />

Westchester for seven<br />

years, and that has been<br />

a great place to give my<br />

time and energy, and I’ve<br />

met a number of amazing<br />

Pollet<br />

ollet, has published a collection of poems in <strong>2023</strong>, entitled “Susiku,<br />

And More.” Susan has been writing poems daily for the last three<br />

years, and her poems have appeared in various publications, but this<br />

is her first book of poetry. Its title is a play on words between haiku<br />

and her first name. The first part, “SEEKING CONNECTION, HOW-<br />

EVER TENUOUS,” contains poems which examine struggles within<br />

relationships and in communications between people, as well as poems<br />

which explore internal dialogues. The second part, “REDEMPTION AND RE-<br />

NEWAL, ON OCCASION,” probes universal questions about existence, history, survival,<br />

violence, beauty, love and more. Looking forward to a warm coffee and inspiration<br />

in Susan’s poetry on a spring day.<br />

Judge Puerto offered eloquent thanks<br />

to all who have supported her in her life,<br />

legal career, and journey to the judiciary,<br />

including her mentors, professional colleagues,<br />

campaign staff and supporters,<br />

and friends and family. Additionally, she<br />

recognized her newly appointed Principal<br />

Law Clerk, Elizabeth Gazay, who Judge<br />

Puerto met through the <strong>WWBA</strong> as her cochair<br />

of the Criminal Law Committee.<br />

Judge Puerto was elected for a 14-year<br />

term. She is currently presiding in the Supreme<br />

Court, Rockland County, Civil Term.<br />

The Westchester Women’s Bar Association<br />

joins with Judge Puerto’s family and<br />

friends in offering sincere congratulations<br />

for her exceptional accomplishment, and<br />
