Maurice Dean Williams was inducted as Judge of the Westchester County Court.
The induction ceremony opened with the Presentation of Colors performed by the
New York State Courts Pipes and Drums, the Pledge of Allegiance led by the inductees’
children, and the National Anthem sung by Judge Puerto’s daughter, Alexandra.
By artful analogy, Judge Minihan welcomed the new laborers to the vineyard in the
Ninth and recognized the special occasion as the one time when the judiciary and
PRESIDENT’S
MESSAGE
I am thrilled to
report that the
Westchester
Women’s Bar Association
not only
achieved but also
exceeded its membership
goal of
reaching 400
Elizabeth Z.
members who
joined or renewed their membership
between October 1, 2022 and
January 31, 2023. Thanks to
everyone’s efforts, we successfully
maintained our voting status and
number of delegates as the second
largest chapter of the Women’s Bar
Association of the State of New York
(WBASNY), the largest statewide
women’s bar association in the
country. A special thank you to our
wonderful Membership Committee
co-chairs, Sherry Bishko and Joanna
Tulman, who led us in reaching our
goal. Your hard work and dedication
is recognized and greatly appreciated!
Not only have we increased our
membership numbers, but also we
continue to expand our presence in
the legal community. February
brought several programs in which
we collaborated with other affinity
bar associations. On February 7,
2023, the Westchester Women’ Bar
Association’s Real Property Committee
presented a CLE in collaboration
further remarked that, on that
day, the inductees’ journeys
would turn in a different direction
from the politics that
brought them there. Among the
traits necessary to perform the
unique role of a judge, which
were emphasized by several
speakers during the ceremony,
and reflected in the inductees,
were legal ability, courtroom experience,
integrity, empathy, social
justice and community commitment,
judicial temperament,
stamina, and the ability to be
fair and just.
On the evening of February 8, 2023,
the WWBA Grievance/Ethics Committee
and Corporate and Commercial Law Committees
presented a CLE program, entitled
Ethical Issues When Attorneys Are Fiduciaries,
to a full conference room of about
40 attendees. The program was cosponsored
by the Westchester County Bar Association,
the White Plains Bar Association,
the Yonkers Bar Association, the
Hudson Valley Hispanic Bar Association,
and the Westchester Black Bar Association-presidents
from most of those associations
were in attendance.
The speakers were the Honorable Peter
Kelly, Queens County Surrogate, the
Honorable Brandon Sall, Westchester
County Surrogate, Lisa M. Bluestein, Esq.,
of the Law Offices of Lisa M. Bluestein, LLC,
and Deborah A. Scalise, Esq., of Scalise
& Hamilton P.C.
The program was structured around
a hypothetical fact pattern involving attorneys
of the Wit Law Firm, whose acts of
misconduct encompassed everything from
misrepresentation in advertising, to delegating
fiduciary obligations to non-attorneys,
to accepting a settlement offer without
their client’s consent and falsifying their
client’s signature on the relevant documents,
and, ultimately, to cashing the settlement
checks without any estate proceedings
after it turned out the client had passed
away.
The panelists addressed questions
about the fact pattern in turn, giving them
each a platform to identify the problematic
issue, articulate and discuss the applicable
rule, and provide references to case law
and advisory opinions.
The program concluded with a review
of recent changes to the rules governing
notary publics, whereby a new law, NY
WWBA Present at Pace University’s First Wellbeing Fair
On the afternoon of February
Kim Berg, WWBA Past President
and co-chair of the Mentor
Committee, and Wellness
Committee co-chairs Jennifer
Netrosio Johnson and Jill
WWBA at the inaugural Pace
University Wellbeing Fair. Pace
held the Wellbeing Fair at all
three of its campuses, including
the Elisabeth Haub School
of Law in White Plains. The
event was conceived to mark
the school’s adoption of the
Okanagan Charter, which was
created in June 2015 to provide
institutions internationally
with a common language, principles,
and framework for promoting
health and wellness on
campuses. The Okanagan
Charter has two calls to action:
(1) to embed health into all aspects
of campus culture, across
the administration, operations,
and academic mandates; and
(2) to lead health promotion
action and collaboration locally
Investment Fiduciary Best
Practices and New Regulations
Joseph Soricelli, Senior Financial Consultant
The SEC’s Regulation Best Interest (Reg BI) imposes a new
standard, beyond existing suitability obligations, requiring brokerdealers
and their agents to act in the best interest of the retail
customer when recommending a securities transaction or investment
strategy involving securities. They must also not place their
financial or other interests ahead of the interests of the retail customers.
There are four key components of Reg BI that you’ll need to
act upon when providing investment recommendations or strategies
to retail customers in brokerage:
❑ Duty of care: Brokers must act in the best interest of the retail
customer when making a recommendation in a brokerage account
without placing your financial or other interests ahead of the
customer.
❑ Disclosure and Relationship Summary:
~ Broker-dealers must deliver a new disclosure (in writing)
that discloses services, fees, compensation, and conflicts. It’s usually
The Wellbeing Fair was
highly anticipated and did not
disappoint. During the two
hours a steady stream of law
students stopped at information
tables in the Tudor Room, where
the mood stayed celebratory
with healthy pre- or post-class
refreshments, swag giveaways,
and music. The WWBA distributed
stress balls, self-care
intention setting and tracker
forms, and information about
our organization. At least 20
students, if not more, said they
were interested in joining the
WWBA and having a mentor.
Among other attendees hosted
by Pace at this great community
event were the New York
City Bar Association Lawyer
Assistance Program, the Pace
Women’s Justice Center, and
the law firm of Black Marjieh &
Sanford LLP. ◗
Making Sound Ethical
Decisions as Fiduciaries
type of notary-an electronic
notary public-and allows notarization
without the principal
seeking to perform electronic
notarial acts must first register
were able to start registering
The panelists offered remarks
on the best practices for
notaries in general-i.e., to learn
the proper rules and requirements
for notaries moving forward,
to develop a procedure
based on those rules, and to
adhere to that procedure consistently.
Overall, the program emphasized
the essentiality of
knowing the rules and maintaining
our wits in order to make
sound ethical decisions. Program
attendees earned two CLE
credit hours in Ethics and Professionalism.
WWBA and WILS Volunteers
Stock Local Pantry
Lisa M. Denig
WWBA and WILS members
came together on a brisk, February
evening to aid Hillside
Food Outreach in filling their
stockroom with donated food.
Every few months, Hillside receives
a huge shipment of donated
food from Shop-Rite that
must be stacked in the two
storerooms of the Pantry’s new
location in Mt. Kisco. However,
the doorways to the storerooms
are not wide enough for
the pallets of food to fit through.
Enter, sixteen Westchester
Women’s Bar Association and
Pace Women in Law Society
volunteers who unloaded all the
food from the pallets, which
were temporarily left in a long
hallway, onto Uboats and into
rolling bins. The volunteers
then moved these into the storerooms
and again unloaded the
cases of food-including heavy
boxes of syrup and jars of apple
sauce!-onto new pallets where
they will remain until needed in
the main pantry.
Besides the backbreaking
lifting and stacking, this particular
job posed myriad logistical
problems due to the narrowness
of the hallway that
barely left room for the rolling
bins and Uboats, much less sixteen
sweaty bodies! But the
volunteers worked together
seamlessly and the job was finished
in roughly two hours.
In addition, our littlest volunteers
did some serious shelf
stocking, covering their assigned
pantry shelves with cans
of soup and tomato sauce. No
one is too young to begin a life
of community service!
Hillside Food Outreach
serves those in need by delivering
food to homebound clients
who otherwise would not
be able to get to a food pantry.
and its mission, please visit
An Interview with Elizabeth Gazay
Susan L. Pollet
Chair of the Archive and
Historian Committee
Q: When and why did
you become involved in
the Westchester Women’s
Bar Association?
A: I was working in New
York City, but live in White
Plains, and wanted to
find a professional community
closer to home. I
began my involvement
with the WWBA a few
years ago after hearing
of its reputation as a
strong association with
great members. I attended
a Westchester
Women’s Bar Association
happy hour where I met
Lisa Denig, and learned
more about the chapter,
and the rest is history!
Q: Which activities and
positions of the
Westchester Women’s Bar
Association have you participated
in?
A: I’ve been a co-chair
of the Criminal Law
Committee since I started
with the WWBA. We put
together a virtual meetand-greet
with the then
newly elected Westchester
District Attorney, Mimi
Rocah, where members
were given the opportunity
to ask questions
about her vision and
goals as District Attorney.
Then, in the fall of 2022,
the Committee sponsored
a CLE in conjunction with
the Women’s Bar Association
of the State of New
York (WBASNY) Criminal
Law Committee, on the
Second Amendment in
the wake of the United
“[F]ind someone interesting to work for, even
if the position is not your dream job. Having
interesting colleagues and supervisors can
make nearly any kind of work seem very
interesting! And . . . you never know what
opportunities will come from it.
States Supreme Court’s decision
in Bruen, and the New
York State Legislature’s response
with the Conceal
Carry Improvement Act.
Q: What would you like to
see the Westchester
Women’s Bar Association accomplish
in the future?
A: l would like to see the
Westchester Women’s Bar Association
continue its practice
of offering educational and
networking opportunities to
its members.
Q: Please tell us about your
legal career.
A: After graduating from college,
I took a job working as
an ESL teacher in a Japanese
public high school. I
stayed for three years, and
during my last year, I applied
to law schools in the United
States. After my contract
ended, and while my applications
were pending, I
moved to the Philippines and
spent time volunteering at a
non-profit. Soon after
ended, I started law school
in Boston. I felt like my calling
was to work with juveniles
in court, but after an internship
where I sat through a
criminal trial, my interests
changed.
My first job after graduating
from law school was
working at the Ninth Circuit
Court of Appeals in San
Francisco, as a staff attorney
in the criminal and habeas
unit. After five years, I
left and took six months to
travel, eventually landing in
New York City. For a short
while, I worked in temporary
positions at law firms until I
found a court attorney position
with a judge in the
New York State Supreme
Court, Criminal Division. I
was there for 13 years until
my judge retired, and then
worked as a court attorney
with a judge in Bronx Supreme
Court, Criminal Division,
for 3 years. In January
2023, I started working
as a court attorney in the
Ninth Judicial District for
newly elected judge and
fellow WWBA member, Amy
Puerto, and I am so excited!
Q: What advice do you
have for new lawyers entering
the profession?
A: First, be open to new opportunities,
because you
never know what will come
of them, and who you will
meet! Second, find someone
interesting to work for,
even if the position is not
your dream job. Having
interesting colleagues
and supervisors can make
nearly any kind of work
seem very interesting!
And again, you never
know what opportunities
will come from it.
Q: How have you balanced
family responsibilities
and your legal career?
A: I’m not sure I have
found that balance yet,
but I am working on it!
Q: When you are not lawyering,
which community
activities and other interests
do you sometimes like
to pursue?
A: My kids are still rather
young (9 and 7) so my
hobbies, for now, mostly
include shuttling them to
activities. My husband
and I both love traveling,
though, and we have
made many trips as a
family which has been
great. I have also been
a member of the Junior
League of Central
Westchester for seven
years, and that has been
a great place to give my
time and energy, and I’ve
met a number of amazing
women! ◗
is her first book of poetry. Its title is a play on words between haiku
and her first name. The first part, “SEEKING CONNECTION, HOW-
EVER TENUOUS,” contains poems which examine struggles within
relationships and in communications between people, as well as poems
which explore internal dialogues. The second part, “REDEMPTION AND RE-
NEWAL, ON OCCASION,” probes universal questions about existence, history, survival,
violence, beauty, love and more. Looking forward to a warm coffee and inspiration
in Susan’s poetry on a spring day.
