Some of the key initiatives undertaken to fulfill

our advocacy mandate include discussions with

the Finance and National Planning Committee of

the Parliament of Kenya to address key concerns

in the Finance Bill, 2023.

It gives me great pleasure to share with you the Q2

issue of the KPDA Developers Digest! As we dive

into the theme, “A Developer’s Guide: Navigating

Emerging Markets in Africa,” we embark on an

exciting journey together to explore the immense

opportunities that lie within the dynamic landscape

of our continent.

In the 2nd quarter, KPDA has been relentless in its

pursuit of advancing the property development

sector in Kenya. Our dedicated team has worked

tirelessly to achieve remarkable milestones and

create a favorable environment for growth and

innovation in property development. Here are some

highlights of our accomplishments:

1. Advocacy and Policy Influence: We have actively

engaged with key stakeholders and policymakers,

influencing decisions that directly impact our

• Deductions into the National Housing

Development Fund: KPDA emphasized the

need for clarity and a well-defined framework

to avoid adverse effects on the economy.

• Appointment of agents for rental tax: While

supporting tax compliance, KPDA proposed

a more reasonable timeline to alleviate

the compliance burden on taxpayers and

minimize administrative difficulties.

• Import Declaration Fee (IDF) on affordable

housing: KPDA urged the government to

reconsider scrapping the reduced IDF rate

to support the construction and building

material value chain.

• Excise duty on cement clinkers: KPDA

highlighted the potential cost increase for

housing and advocated for the deletion or

reduction of this provision.

2. Knowledge-Sharing Initiatives: KPDA has

organized a series of insightful webinars,

workshops and networking events, fostering

collaboration among our members.

Notable events we have held across Q2 include:

• A tour of the first-ever Mass-timber prototype

in Kenya at Build X Studio. This site visit

allowed our members to learn first-hand

the benefits of mass timber construction,

including its strength, speed of construction

and ability to reduce waste and carbon

emissions.

• A CEO’s Morning Learning Session in

collaboration with Mabati Rolling Mills to

equip our members with necessary insights

to support them navigate the current state of

the fluctuating steel costs.

• EDGE Certification Discovery Workshop in

collaboration with International Finance

Corporation (IFC). The workshop was an

exclusive an opportunity for members to

discover the investment potential for EDGEcertified

green buildings and to learn more

about the benefits of designing and building

green. The workshop proved to be a valuable

experience for our members and we are

encouraged by the positive impact such

trainings have on the real estate sector in

Kenya.

• KPDA Mid-Year Corporate Networking Event.

The event was an unparalleled opportunity

for industry professionals to converge

and engage in meaningful conversations.

From developers, architects, contractors to

financiers, legal experts, real estate agents

and government representatives, the event

attracted a diverse range of individuals

passionate about the built environment

sector. The event was an opportunity to

ignite collaborations, paving the way for

future partnerships.

3. Strengthening Partnerships: We have forged

strategic alliances with reputable organizations

and industry leaders, both locally and

internationally. These partnerships enable us

to leverage collective expertise, explore new

markets and establish a strong foothold in

emerging African economies. It was an honor

to accept my appointment as board member

at Kenya Private Sector Alliance (KEPSA). This

appointment will amplify KPDA’s voice and

enable us to engage in strategic collaborations

that drive economic development, promote

investment opportunities and champion

an enabling business environment for all

stakeholders.

Looking ahead, our focus remains firmly fixed on

propelling the property development sector to

new heights. For the remainder of the year, we

have an exciting lineup of initiatives planned:

1. Capacity Building Programs: We will continue

to invest in your professional development

by organizing targeted training programs,

workshops and networking opportunities.

2. Market Research and Insights: KPDA is

committed to providing you with accurate

and up-to-date market intelligence.

3. Networking and Collaboration: We remain

unrelentless in offering be-spoke networking

platforms and foster collaboration among our

members, creating an ecosystem where ideas

flourish, partnerships thrive and collective

progress is achieved.

Hotelisation of offices: How

hospitality design and approach

is increasingly becoming

entrenched into the corporate

offices within Africa

of staying in a hotel. The ultimate aim is to create

an inviting and enjoyable workplace that promotes

productivity, creativity, and employee satisfaction.

Africa is a young continent, and so too is its

workforce. This will become even more

pronounced in years to come, with more

younger employees who often live independently.

The workplace becomes the primary place of social

interaction and colleagues are a valued source of

relationships. The office is needing to evolve in a way

to foster this, and any concerns around this being

counter-productive have proved to be misguided.

Rather, companies that focus on creating a culture

of social connections among employees have higher

levels of productivity.

The phrase ‘hotelisation of offices’ refers to the trend

of modern office spaces being designed and operated

more like hotels. This concept involves creating office

environments that are more comfortable, visually

appealing, and user-friendly – akin to the experience

The hotelisation trend is driven by the growing

demand for quality office spaces that cater to the

needs and preferences of modern workers. With

the increasing number of businesses and startups

operating in African cities, there is a need for office

spaces that provide more than just a desk and

chair, but also greater flexibility, fewer contractual

obligations, and access to amenities or services that

would otherwise require a (potentially prohibitive

capital outlay).

Employees want the convenience and flexibility

they can get from working at home, yet our DNA

requires the collaboration and sense of community

that comes from the traditional office space. The

hospitality sector is increasingly being drawn on for

inspiration when creating offices that cater to the

future of work. The focus of hotel design has always

been to create a destination that provides wellness,

productivity, and convenience. These factors are

no longer considered optional for employees and

corporates have realised the notable benefits of

incorporating them into the contemporary office.

This trend is not only limited to the physical design

and amenities but also the “guest experience”

personnel. Employees want to have the same

experience when being served in their office cafeteria

as they would in a hotel lobby restaurant. This has

been a success factor for many flex operators who

have realized the need for staff to be focused on

improving the guest experience.

Hotels in Africa have always been an important

workspace when travelling, and the inverse theme

is shaping hotel design as much as it is shaping the

office. Hotel lobbies are often the meeting venue of

choice, even for people not staying at a particular

hotel. We have also seen the rise of co-working within

hotels globally, as this symbiotic use of space is a

perfect annexe to the corporate guest experience,

with the same trend very much evident in Africa

with partnerships between Kasada and WOJO,

“The Works” by Latitude Hotels or Workshop 17 in

the VOCO Johannesburg in Rosebank. Often these

partners can provide meeting space more efficiently

to hotel guests than the traditional conferencing

facilities for a hotel.

In hospitality, every interaction is considered

to impact the guest experience. This involves

determining the areas of the property to emphasize,

typically areas with high foot traffic or special

features like a tenant lounge, café, or conference

and event centres. Landlords don’t need to

feel overwhelmed at the prospect of providing

these services, many can be catered for through

partnerships with specialists in this space.

By infusing these areas with hospitality experts

such as guest service representatives or community

managers instead of security and parking, you

can ensure a positive experience in these places

of impact. Africa is likely to see these trends

become particularly pronounced given the young,

technologically advanced working population. For

many, the cost of returning to the office is a lot higher

than other parts of the world. Higher transport costs

and commute time makes it more of an imperative

for the office to entice rather than force employees

into the office.

Space as a Service

Akin to the hotelisation of offices, is the growing

tendency toward offering ‘space as a service’. This

refers to a business model where companies or

individuals can rent physical space on a short-term

basis, rather than committing to a long-term lease.

The space as a service model is often associated

with co-working spaces, which provide shared office

facilities and services such as Wi-Fi, meeting rooms,

and printing facilities. However, the concept can also

apply to other types of spaces, such as retail stores,

event spaces, and even residential properties (i.e.

co-living).

The key feature of space as a service is the flexibility

it offers to its customers, and this is especially

applicable in the African context, where the tertiary

sector is still in its relative nascency. Rather than

investing in a fixed physical location, businesses or

individuals can access space on a temporary or needs

basis, allowing them to scale their operations up or

down as required.

The trend towards “space as a service” is driven by

several factors, including changes in technology,

the way people work, and the evolving needs of

businesses. The concept has been popularized

by the success of co-working spaces, which have

shown that there is a significant market for flexible

workspaces. As a result, many landlords and real

estate developers are now incorporating “flex” into

their portfolios to meet the needs of this growing

market. Co-working has gained traction in the African

market, appealing to established international

corporates who opt not to have a conventional lease

and to younger professionals and entrepreneurs who

benefit from the climate of collaboration.

Co-working and shared workspaces are becoming

increasingly popular in Africa, especially in larger

commercial centres. In Africa’s 36 largest cities

(excluding South Africa) there are over 500 estimated

co-working premises available, operated by wellknown

operators such as Regus, as well as many

regional platforms that have emerged.

These trends have also been found to influence the

design and location of offices. For example, as cities

become more congested there may be a greater

emphasis on locating offices in areas that are easily

accessible or closer to residential areas. Similarly,

urbanisation is leading to a greater emphasis on

sustainable and green buildings or building practices,

effectively influencing the design and construction of

commercial real estate.

Building a Sustainable

Future: Considerations when

Navigating Kenya's current

Real Estate Market

Introduction

In today’s global landscape, growing emphasis is

placed on Environmental, Social, and Governance

(ESG) implementation in real estate projects,

especially in the context of emerging markets.

Additionally, investors are becoming increasingly

concerned about the environmental and social

impacts associated with their investments. As a

result, developers are recognizing the importance

of integrating sustainability throughout the entire

lifecycle of their projects.

Sustainable development is development that

meets the needs of the present generation without

compromising the ability of future generations

to meet their needs by maintaining the carrying

capacity of supporting ecosystems. This calls for

action from various actors from state agencies,

private sector, communities, among others.

This article briefly delves into the relationship

between sustainable development and the law in

Legal Framework

• The Constitution of Kenya, 2010 forms the

foundation for environmental protection. Article

42 guarantees the right to a clean and healthy

environment - every person has the right to have

the environment protected for the benefit of

present and future generations. Article 69 tasks

the State to ensure sustainable exploitation,

utilisation, management and conservation of the

environment and natural resources.

• The Environmental Management and

Coordination Act (EMCA) of 1999 outlines a

framework for environmental management

and conservation by establishing the National

Environment Management Authority (NEMA)

and ensures projects adhere to environmental

safeguards and sustainable development

by implementing Environmental Impact

Assessments (EIA) and other measures. NEMA

has the authority to create rules, specify

requirements and guidelines, and issue directives

for the management and preservation of the

environment and natural resources.

• The Physical and Land Use Planning Act of 2019

addresses environmental considerations in land

use planning. Section 55 lists conservation and

protection of the environment as an objective of

development control.

• The Energy Act, 2019 promotes development

and utilization of renewable energy sources like

biodiesel, bioethanol, biomass, solar, wind, and

hydropower. Developers can take advantage of

the supportive framework provided by the Energy

Act

• The Water Act, 2016 requires the conduct of an

EIA before undertaking certain water-related

projects and contains standards to control water

pollution.

• The Public Procurement and Asset Disposal

Act, 2015 requires that public procurement

and asset disposal by state organs and public

entities be guided by promotion of local industry,

sustainable development and protection of the

environment. If developers want to be considered

for state projects, they should champion for

sustainability.

• The Climate Change Act of 2016 provides a

framework and guidelines for addressing climate

change challenges and transitioning to a lowcarbon,

climate-resilient future.

These provisions among others reflect Kenya’s

commitment to sustainable development and

environmental conservation.

Recommendations

• Community Engagement - Meaningful

community engagement and social responsibility

are essential in fostering sustainable

development. Engaging with local communities

fosters social cohesion, builds positive

relationships and mitigates potential conflicts

during and after project implementation.

• Monitoring and Reporting - Establishing

robust monitoring and reporting mechanisms

to track and assess the impact of projects on the

environment.

• Incorporation of Renewable Energy -

Integrating renewable energy sources, such as

solar panels or wind turbines, into development

projects to reduce reliance on fossil fuels.

• Energy Efficiency - Implementing intelligent

designs to allow for natural lighting and energyefficient

technologies in buildings, including

insulation, LED lighting, and energy-saving

appliances to reduces energy consumption.

• Sustainable Materials - Using eco-friendly

and locally sourced materials that have a lower

environmental impact.

• Recycling - Using recycled and reclaimed

materials such as reclaimed wood and recycled

metal.

• Water Conservation - Incorporating watersaving

features, such as low-flow fixtures,

rainwater harvesting systems and implementing

landscaping practices that reduce water needs

such as native gardening and efficient irrigation

systems.

• Green Space - Preserving existing green spaces

and creating new ones within developments

by incorporating landscaping that provides

habitats for native plant species. A few ways to

green buildings include vertical gardens, roof

gardens, living walls, atria with trees and plants,

courtyards and plazas. Green spaces improve

the lives of people and contribute to a more

sustainable environment.

• Waste Management - Implementing effective

waste management strategies, including

recycling programs and waste reduction

initiatives. Incorporating waste-to-energy

systems or composting facilities where feasible.

Conclusion

Promoting the use of sustainable materials in

construction projects can significantly reduce the

industry’s impact to the environmental. To navigate

the emerging real estate market, developers must

comply with environmental regulations and should

go the extra mile to incorporate sustainability thus

resulting in projects that thrive economically while

maintaining environmental integrity.

The Developer’s Conundrum

– Navigating the Turbulent

Real Estate Market in Kenya

In August 2018 I gave a presentation at the

KPDA CEO breakfast forum, my key take home

message was “Time is the new Money!” This

message holds true even more today than it did then.

As we all know, the real estate sector is primarily

driven by economic factors, so let’s examine what has

been going on. In the last twelve months USD/KES

has depreciated by 16% from 118.0 to 140.8. In the

same period, the Central Bank Rate (CBR) has moved

from 7.5% to 10.5%. This coupled with the global

economic crisis, inflation, cost of construction inputs

i.e., steel, cement/concrete and labour have been

on an exponential rise. In a nutshell, the slowing

down of the economy has resulted in a decrease in

disposable income in a shrinking middle class.

The real estate sector is currently experiencing what

I would like to call a “Developer’s Conundrum”,

which can simply be explained as all the traditional

cost drivers in development are rising at a fast rate

and the purchasing power of our homeowners

is diminishing due to a challenging economic

environment.

Today developers are paying a significant

premium due to economic and market uncertainty.

The elongation of time in project delivery is

exacerbating uncertainty and inevitably driving up

this development cost premium, meaning a lot of

Kenyan developers will face significant challenges on

delivering their projects successfully.

All hope is not lost though. A survey by Global Data

estimated the Kenyan construction market size

at $17.3 billion in 2022. The market is projected

to achieve an Average Annual Growth Rate

(AAGR) of more than 5% between 2024-2027. The

industry’s growth will be majorly supported by the

government’s focus on implementing public-private

partnership (PPP) projects and attracting private

investment.

Increasingly, green building solutions are the future.

A good example is Excellence in Design for Greater

Efficiencies (EDGE) an innovation by the International

Finance Corporation (IFC), whose principles are

embedded on energy and water efficiency thus

reducing the carbon footprint on the environment.

Moreso, this will allow developers to enjoy incentives

from banks through green financing which is more

cost effective compared to commercial financing.

Exploring Opportunities

Project performance remains in the spotlight in most

surveys, with only half of respondents completing

their projects on time. C - MAX Advanced Building

System offers a solution this dilemma. This green

building technology; has the advantage of quality

and affordability.

C-MAX Vs Traditional Building Case study

Over the past few years, we have been collecting data

on projects we have successfully delivered; below is a

case study of one of these projects with head-to-head

cost comparison between C-MAX Advanced Building

System and traditional building methodologies.

This project in Nairobi adopted the C-MAX slab panels

on their multi-storey residential apartment. Leading

to reduction of concrete and steel quantities in the

structure and a huge cost savings as detailed below:

In summary, there is no silver bullet for attacking

includes sourcing lower cost of funds, and using fast

and green build technologies like C-MAX Advanced

period and thus reduce the level of uncertainty and

the premium associated with it.
