declaration <strong>of</strong> his brother, which was<br />

published in full at the time.<br />

D. J. Brumley says he did not see<br />

anything till after the second shot. His<br />

further testimony about riding on the<br />

rear platform practically demolished<br />

the evidence <strong>of</strong> Robt. Hatzell, the<br />

only witness for the Commonwealth<br />

who claimed to have seen the whole<br />

affair from the beginning.<br />

Of course, each <strong>of</strong> these witnesses<br />

testified to many other facts. We have<br />

tried to give only the important<br />

points, or those over which there is<br />

any controversy.<br />

At the close <strong>of</strong> the evidence,<br />

arguments were made by Mr. Kohn<br />

and Judge Carroll, upon which Judge<br />

Daniel announced that in his opinion,<br />

the shooting was unjustifiable, and<br />

remanded the defendant to jail.<br />
