Terms and conditions of sale<br />

Th at nothing in these Terms and Conditions of <strong>Sale</strong> shall constitute terms, conditions,<br />

warranties, guarantees or representation in any contract between vendors and<br />

buyers, or between the selling agents and buyers, but shall constitute the contract<br />

between vendor and selling agents to the exclusion of all other terms, conditions,<br />

warranties, guarantees or representations.<br />

1. Th e entry of each lot for the sale provides the selling agent with sole and<br />

exclusive agency for the sale of such lot from the time of entry until<br />

December 27 2011. During that timeframe, the vendors agree not to sell<br />

such horse on his own behalf, but to pass on any enquiries regarding potential<br />

sales to the selling agent.<br />

2. A non-refundable entry fee of $220, inclusive of GST, is payable with<br />

each entry.<br />

3. Th e selling agent reserves the absolute right at its sole discretion to refuse<br />

any lot from the sale at any stage. If such occurs, the entry fee will be fully<br />

refundable.<br />

4. In order for any horse to be off ered for sale through the sale ring, the<br />

Selling Agent must have in its possession the Registration Papers,<br />

Naming Forms and Transfer of Ownership which has been signed by all<br />

owners.<br />

5. All sale entries are to be made available for identifi cation inspection<br />

purposes by representatives of the New South Wales Harness Racing<br />

Authority before such sale.<br />

6. Th e vendor is responsible for attending to and controlling all of their lots at the<br />

sales complex until the time of sale. Th e vendor is responsible for leading or<br />

providing a handler to lead any lots into the sale ring.<br />

7. Each lot shall be at the vendor’s risk for any damage or injury caused or suff ered,<br />

by whatever means, until the sale of that lot.<br />

8. Th e vendor is responsible to check the accuracy of all details contained in the<br />

catalogue concerning his lot, and shall be deemed to warrant the accuracy of<br />

any part thereof unless he advises the Selling Agent before the lot being off ered<br />

for sale. Th e vendor, or his authorised representative, shall be responsible to<br />

immediately correct any inaccuracy in the catalogue or made by the Auctioneer<br />

before or during the sale of that lot; failure to do so on the vendor’s behalf shall<br />

be deemed to be an authorisation of such statement by the Vendor.
