Forms 1099 and Withholding<br />

Rules Featured in August digiTAX<br />

Recent law changes have dramatically<br />

changed federal and <strong>California</strong> information<br />

reporting and withholding on independent<br />

contractors, nonresidents and<br />

merchants, effective in 2011 and 2012.<br />

Changes include corporate reporting, reporting<br />

for goods as well as services and<br />

merchant reporting (New 1099K). Every<br />

business organization will need a TIN<br />

solicitation procedure and a "B" Notice<br />

procedure for implementation <strong>of</strong> federal<br />

and <strong>California</strong> backup withholding when<br />

required. Additionally, <strong>California</strong> requires<br />

withholding on nonresident independent<br />

contractors, partners, LLC members and<br />

S corporation shareholders. Failure to<br />

comply with regulations could result in<br />

substantial penalties.<br />

Board Installed and Awards Presented at Annual Meeting<br />

Hosted by the San Gabriel Valley Chapter and led by Program Committee Chairman<br />

Jamie Gibson, <strong>CSEA</strong>’s 35th Annual Meeting held June 20-24, 2011 at the Hilton Pasadena<br />

was truly a “red carpet” event to remember. The week featured education events<br />

covering compelling tax topics and social events that provided an opportunity for fellowship<br />

such as the Jim Reed Memorial Golf Tournament and a bowling tournament at<br />

the very upscale 300 Pasadena Bowling Alley.<br />

More than 100 Members attended the General Session on June 23 where they voted<br />

to adopt bylaw amendments that give the <strong>Society</strong> the ability to conduct electronic or<br />

mail balloting for any election specified in the Bylaws or called for by the Board. After<br />

adopting bylaw amendments, the delegates considered the 2011-2012 slate <strong>of</strong> <strong>of</strong>ficers<br />

as presented by the Nominating Committee. Receiving no nominations from the floor,<br />

the 2011-2012 <strong>CSEA</strong> <strong>of</strong>ficers were elected as follows: Jean Nelsen, EA as President;<br />

Raven Deerwater, EA as First Vice President; Patricia Kappen, EA as Second Vice<br />

President; Cap Porterfield, EA as Treasurer; and Andrew Stamatelatos, EA as Secretary.<br />

The delegation briefly discussed bylaw changes that will come before the National Association<br />

<strong>of</strong> <strong>Enrolled</strong> <strong>Agents</strong> (NAEA) during the Caucus meeting that followed General<br />

Session. The business <strong>of</strong> the day concluded with a Town Hall meeting where Members<br />

participated in an interactive discussion about the type <strong>of</strong> online educational programs<br />

<strong>CSEA</strong> should consider <strong>of</strong>fering. Feedback from the Town Hall will be used by the Education<br />

Committee as <strong>CSEA</strong> implements online education over the next few years.<br />

The day concluded with a magnificent Grand Banquet Celebration Dinner during which<br />

incoming <strong>CSEA</strong> Officers and Board Members were formally installed by NAEA President<br />

Sherrill Travato, EA. Outgoing President Kim Kastl, EA began the awards portion<br />

<strong>of</strong> the program by announcing that the President’s Award would be bestowed upon<br />

State Senator Mimi Walters for her work on legislation supporting the <strong>Enrolled</strong> Agent<br />

pr<strong>of</strong>ession. Several other state awards were the highlight <strong>of</strong> the evening, and <strong>CSEA</strong><br />

congratulates the following recipients:<br />

“Federal Representation Workshop”<br />

(Previously known as “Tax Practice & Procedures Seminar”<br />

or “New EA Workshop”)<br />

Representing clients before the IRS is one <strong>of</strong> the most challenging<br />

and important roles an <strong>Enrolled</strong> Agent performs. <strong>CSEA</strong> and<br />

the IRS are once again partnering to bring you a workshop that<br />

focuses specifically on how to best represent your clients through<br />

a better understanding <strong>of</strong> IRS compliance processes and procedures<br />

as they relate to examinations, collections, appeals, and<br />

<strong>of</strong>fers in compromise. In addition, the IRS will share new developments<br />

<strong>CSEA</strong> Collecting Questions for State Tax Agencies<br />

The <strong>Society</strong> invites practitioners to submit questions that they<br />

would like posed to any <strong>of</strong> <strong>California</strong>’s three state tax agencies<br />

– the Board <strong>of</strong> Equalization (BOE), Employment Development<br />

Department (EDD), and the Franchise Tax Board (FTB) – during<br />

the State Tax Agencies Liaison meeting in September. The questions<br />

should address issues that the practitioner believes may be<br />

systemic in nature and that would benefit the tax community and<br />

Register Now for 2011<br />

State Tax Agencies Liaison Meeting<br />

Designed to increase communication between <strong>California</strong>’s three<br />

state tax agencies – the Board <strong>of</strong> Equalization (BOE), Employment<br />

Development Department (EDD), and the Franchise Tax<br />

Board (FTB) and tax practitioners, <strong>CSEA</strong>’s State Tax Agencies<br />

Liaison Meeting is a unique forum that allows participants to raise<br />

issues or concerns that need to be addressed with state agencies.<br />

The meeting provides an opportunity to get the latest state<br />

tax agency news, elevate critical issues, provide feedback, meet<br />

with agency representatives, and get the latest word on agency<br />

plans, policies, practices, and procedures. Anyone who prepares<br />

taxes should definitely attend this important meeting that also<br />

provides participants an opportunity to:<br />

• Develop relationships with key state agency personnel;<br />

• Learn about agency initiatives and legislative agendas for<br />

the upcoming session;<br />

• Obtain hard-to-find state agency contact information for key<br />

contacts who can give you the answers you need in a fraction<br />

<strong>of</strong> the time it would ordinarily take;<br />

• Network with other tax pr<strong>of</strong>essionals by sharing difficult situations<br />

and brainstorming ideas about how to resolve those<br />

situations;<br />

• Gain insight into how <strong>CSEA</strong> can utilize this dialogue to identify<br />

issues to bring before the Taxpayer Bill <strong>of</strong> Rights hearing<br />

later in the year; and<br />

• Become educated on how <strong>CSEA</strong> works closely with the state<br />

agencies to make the tax system better for both taxpayers<br />

and tax pr<strong>of</strong>essionals alike.<br />

This meeting will take place on Friday, September 23, 2011 from<br />

Volunteer Job-Alike Workshop Series<br />

<strong>CSEA</strong> is hosting a series <strong>of</strong> “job-alike” workshops to help Chapter<br />

volunteers become oriented with their new and/or continuing<br />

role at the Chapter. These workshops will review the volunteer’s<br />

responsibilities, give insight regarding timelines, and provide an<br />

opportunity to interact with counterparts at other Chapters. The<br />

workshops are scheduled as follows:<br />

Legislative Workshop Set for July 18<br />

The second annual online <strong>CSEA</strong> Legislative Workshop will be<br />

held July 18th from 10:00 – 12:00. This workshop is designed to<br />

provide “Better Tools and More Training” for any Member who is<br />

interested in legislative visits either in the District <strong>of</strong>fices or at the<br />

State Capitol in Sacramento.<br />

The workshop includes information on the legislative process,<br />

effective advocacy, tips for scheduling and attending legislative<br />

visits, alternative ways to participate and other related topics.<br />

<strong>CSEA</strong> provides agendas and comprehensive packets for these<br />

visits, which will be discussed at the workshop. There will be<br />

ample opportunities for questions and discussion.<br />

All <strong>CSEA</strong> Members are welcome. Anyone who would like to participate<br />

and who is not a <strong>CSEA</strong> Legislative Committee member,<br />

chapter President, chapter Legislative Committee chair or <strong>CSEA</strong><br />

Director should contact <strong>CSEA</strong> (asoy@csea.org), so the materials<br />

may be sent to you via email.<br />

<strong>CSEA</strong> legislative efforts have increased dramatically over the last<br />

year and continuing our relationship-building with key legislators<br />

is essential in serving <strong>CSEA</strong> Members and our pr<strong>of</strong>ession.<br />

Our advocacy has resulted in a significantly greater awareness<br />

<strong>of</strong> the <strong>Enrolled</strong> Agent Pr<strong>of</strong>ession, what EAs do and what issues<br />

impact the tax pr<strong>of</strong>ession, our clients and effective tax administration.<br />

This workshop is a must for chapter legislative chairs, who will<br />

be coordinating the district visits. Chapter Presidents and <strong>CSEA</strong><br />

directors are strongly encouraged to attend, since your leadership<br />

and participation is invaluable in this effort.<br />

June 2011 Board <strong>News</strong> Update<br />

The June 2011 Board <strong>of</strong> Directors Meeting was led by recently<br />

elected President Jean Nelsen, EA. Some highlights include:<br />

• Board approval for <strong>CSEA</strong> to join the coalition led by CalTax in<br />

support <strong>of</strong> AB 1423;<br />

• Board approval <strong>of</strong> the 2011-2012 Nominating Committee, with<br />

Kim Kastl, EA, Chair; and<br />

• Board approval to complete the Executive Committee with the<br />

addition <strong>of</strong> two new Members.<br />

The next Board <strong>of</strong> Directors meeting will be held in Sacramento,<br />

CA, September 24-25, 2011.<br />

The June 2011 Board Meeting in Pasadena was extremely well<br />

attended.<br />

National Tax Practice Institute (NTPI)<br />

What's in it for you?<br />

The 2011 National Tax Practice Institute, August 7 - 10 the<br />

Mandalay Bay Resort and Hotel in Las Vegas, features a Tax<br />

Preparation/Practice Management track including a day to "Build<br />

Your Business" and an intensive Special Enrollment Exam (SEE)<br />

Review track for experienced tax preparers who have decided<br />

the time is right to become an EA.<br />

This event includes 6 tracks, each <strong>of</strong>fering 24 hours <strong>of</strong> education.<br />

Participants may also create their own program by picking and<br />

choosing individual classes from different tracks. Classes run<br />

from 8:00 a.m. to 4:40 p.m. on Sunday, Monday and Tuesday.<br />

Nationally recognized speakers include:<br />

• Beth Tucker, Deputy Commissioner for IRS Operations Support,<br />

speaking on behalf <strong>of</strong> IRS Commissioner Doug Shulman,<br />

share his perspective as the executive responsible for return<br />

The <strong>CSEA</strong> Education Foundation awards scholarships to candidates<br />

who wish to enhance their tax knowledge. This might be a<br />

scholarship to attend the National Tax Practice Institute (NTPI)<br />

may wish to seek a scholarship to take a SEE prep course as<br />

The 2011 IRS Nationwide Tax Forums are three-day events<br />

presented by IRS experts and partner organizations that <strong>of</strong>fer<br />

up-to-date information on federal and state tax issues. Tax pr<strong>of</strong>essionals<br />

that take advantage <strong>of</strong> early registration will receive a<br />

significant discount on the registration fee. Keep in mind that the<br />

early registration period closes two weeks prior to each forum.<br />

Your Opinion Counts - Weigh in on Use Tax!<br />

Board <strong>of</strong> Equalization (BOE) Member and former legislator<br />

George Runner is seeking feedback regarding a controversial<br />

new use tax collection program administered by the State Board<br />

<strong>of</strong> Equalization (BOE). The BOE has identified more than 500,000<br />

businesses as “qualified purchasers” and has automatically registered<br />

many <strong>of</strong> them with a “use tax” account. A qualified purchaser<br />

is defined as a service enterprise with more than $100,000 in<br />

gross receipts per calendar year that is not already registered with<br />

the Board <strong>of</strong> Equalization.<br />

Business owners and entrepreneurs who have received a qualified<br />

purchaser letter from the BOE as well as other interested parties<br />

are encouraged to visit Mr. Runner’s website and take a brief<br />
