Forms 1099 and Withholding
Rules Featured in August digiTAX
Recent law changes have dramatically
changed federal and California information
reporting and withholding on independent
contractors, nonresidents and
merchants, effective in 2011 and 2012.
Changes include corporate reporting, reporting
for goods as well as services and
merchant reporting (New 1099K). Every
business organization will need a TIN
solicitation procedure and a "B" Notice
procedure for implementation of federal
and California backup withholding when
required. Additionally, California requires
withholding on nonresident independent
contractors, partners, LLC members and
S corporation shareholders. Failure to
comply with regulations could result in
substantial penalties.
Board Installed and Awards Presented at Annual Meeting
Hosted by the San Gabriel Valley Chapter and led by Program Committee Chairman
Jamie Gibson, CSEA’s 35th Annual Meeting held June 20-24, 2011 at the Hilton Pasadena
was truly a “red carpet” event to remember. The week featured education events
covering compelling tax topics and social events that provided an opportunity for fellowship
such as the Jim Reed Memorial Golf Tournament and a bowling tournament at
the very upscale 300 Pasadena Bowling Alley.
More than 100 Members attended the General Session on June 23 where they voted
to adopt bylaw amendments that give the Society the ability to conduct electronic or
mail balloting for any election specified in the Bylaws or called for by the Board. After
adopting bylaw amendments, the delegates considered the 2011-2012 slate of officers
as presented by the Nominating Committee. Receiving no nominations from the floor,
the 2011-2012 CSEA officers were elected as follows: Jean Nelsen, EA as President;
Raven Deerwater, EA as First Vice President; Patricia Kappen, EA as Second Vice
President; Cap Porterfield, EA as Treasurer; and Andrew Stamatelatos, EA as Secretary.
The delegation briefly discussed bylaw changes that will come before the National Association
of Enrolled Agents (NAEA) during the Caucus meeting that followed General
Session. The business of the day concluded with a Town Hall meeting where Members
participated in an interactive discussion about the type of online educational programs
CSEA should consider offering. Feedback from the Town Hall will be used by the Education
Committee as CSEA implements online education over the next few years.
The day concluded with a magnificent Grand Banquet Celebration Dinner during which
incoming CSEA Officers and Board Members were formally installed by NAEA President
Sherrill Travato, EA. Outgoing President Kim Kastl, EA began the awards portion
of the program by announcing that the President’s Award would be bestowed upon
State Senator Mimi Walters for her work on legislation supporting the Enrolled Agent
profession. Several other state awards were the highlight of the evening, and CSEA
congratulates the following recipients:
• Professional Associate Service Award: Tim Elkins
• Public Information & Awareness Award: Peggy Hall, EA
• Chapter of the Year Award: South Bay Chapter
• Thomas P. Hess Award: Joanne Anderson, EA
• Enrolled Agent of the Year Award: Gary Anspach, EA
• Distinguished Service Award: Vicki Mulak, EA
CSEA Members gathered together
CSEA and IRS Partner on
“Federal Representation Workshop”
(Previously known as “Tax Practice & Procedures Seminar”
or “New EA Workshop”)
Representing clients before the IRS is one of the most challenging
and important roles an Enrolled Agent performs. CSEA and
the IRS are once again partnering to bring you a workshop that
focuses specifically on how to best represent your clients through
a better understanding of IRS compliance processes and procedures
as they relate to examinations, collections, appeals, and
offers in compromise. In addition, the IRS will share new developments
at the Service, and CSEA will share the practitioner perspective.
CSEA is pleased to announce that this all-day workshop
has been expanded to 4 convenient locations as follows:
• Monday, August 22, 2011 – Laguna Niguel
• Tuesday, August 23, 2011 – Los Angeles (north)
• Monday, August 29, 2011 – Oakland
• Monday, August 29, 2011 - Sacramento
This workshop provides 7 hours of CPE (CTEC# 1001-CE-6838).
Space is limited at each location and these workshops sold out
last year, so register online now to reserve your seat!
CSEA Collecting Questions for State Tax Agencies
The Society invites practitioners to submit questions that they
would like posed to any of California’s three state tax agencies
– the Board of Equalization (BOE), Employment Development
Department (EDD), and the Franchise Tax Board (FTB) – during
the State Tax Agencies Liaison meeting in September. The questions
should address issues that the practitioner believes may be
systemic in nature and that would benefit the tax community and
taxpayers. Please submit questions to Vicki Mulak, EA at Vicki@
AmericanFinancialTax.com by July 31, 2011.
State Tax Agencies Liaison Meeting
Designed to increase communication between California’s three
state tax agencies – the Board of Equalization (BOE), Employment
Development Department (EDD), and the Franchise Tax
Board (FTB) and tax practitioners, CSEA’s State Tax Agencies
issues or concerns that need to be addressed with state agencies.
The meeting provides an opportunity to get the latest state
tax agency news, elevate critical issues, provide feedback, meet
with agency representatives, and get the latest word on agency
situations;
• Gain insight into how CSEA can utilize this dialogue to identify
issues to bring before the Taxpayer Bill of Rights hearing
later in the year; and
• Become educated on how CSEA works closely with the state
agencies to make the tax system better for both taxpayers
CSEA legislative efforts have increased dramatically over the last
year and continuing our relationship-building with key legislators
is essential in serving CSEA Members and our profession.
Our advocacy has resulted in a significantly greater awareness
of the Enrolled Agent Profession, what EAs do and what issues
impact the tax profession, our clients and effective tax administration.
This workshop is a must for chapter legislative chairs, who will
be coordinating the district visits. Chapter Presidents and CSEA
directors are strongly encouraged to attend, since your leadership
and participation is invaluable in this effort.
Your Opinion Counts - Weigh in on Use Tax!
Board of Equalization (BOE) Member and former legislator
George Runner is seeking feedback regarding a controversial
new use tax collection program administered by the State Board
of Equalization (BOE). The BOE has identified more than 500,000
businesses as “qualified purchasers” and has automatically registered
many of them with a “use tax” account. A qualified purchaser
is defined as a service enterprise with more than $100,000 in
gross receipts per calendar year that is not already registered with
the Board of Equalization.
Business owners and entrepreneurs who have received a qualified
purchaser letter from the BOE as well as other interested parties
are encouraged to visit Mr. Runner’s website and take a brief
survey to provide feedback on this program: www.boe.ca.gov/
