RESTRICTIONS ON USE
YOU MAY NOT:
• Reproduce, publish, distribute, sell or otherwise use any data retrieved from or software contained in the product in
any manner whatsoever which may infringe upon any copyright or other proprietary interest of Harte-Hanks Market
Intelligence, Inc. any third party supplier or any other third party.
• Use any portion of the product to create any mailing or telemarketing lists, marketing aid or other data compilation for
sale to any third party or use any portion of the product to compete directly with Harte-Hanks Market Intelligence, Inc.
• Distribute, rent, sublicense, lease, sell, transfer or assign the product to any third party including, but not limited to,
employees not located at the site or any other division, organization, entity or person including parent, subsidiary or
affiliated organizations.
• Decompile, disassemble, or otherwise reverse engineer the product or alter/translate.
You agree that any third-party supplier may enforce any right it may have which is violated by your breach of any of these
restrictions.
LIMITED WARRANTY
If the enclosed data files (on CD-ROM or tape) contain a defect in materials and workmanship under normal use and service during
the period of ninety days from the date of delivery as evidenced by a copy of the invoice, you may return the CD-ROMs or tapes to
Harte-Hanks Market Intelligence, Inc. and Harte-Hanks Market Intelligence, Inc. shall replace them. This constitutes your exclusive
remedy for any defect in the product. Further, Harte-Hanks Market Intelligence, Inc. hereby limits the duration of any implied
warranty on the diskette to the period stated above. Any replacement will be warranted for the remainder of the original warranty
period or thirty days, whichever is longer. If failure of the CD-ROMs or tapes has resulted from accident, abuse, or misapplication,
Harte-Hanks Market Intelligence, Inc. shall have no responsibility to replace the CD-ROMs or tapes.
Except as specifically provided above, the product is provided "as is," without warranty of any kind. Neither Harte-Hanks Market
Intelligence, Inc. nor any of the third-party suppliers makes any warranty or representation, either express or implied, with respect to
the product including, but not limited to its quality, performance, merchantability, or fitness for a particular purpose, and assumes no
responsibility for the accuracy or application of, or errors or omissions in, any data or software contained in the product. Further,
neither Harte-Hanks Market Intelligence, Inc. nor any of the third-party suppliers warrants, guarantees, or makes any
representations regarding the use, or the results of the use, of the product in terms of correctness, accuracy, reliability, currency, or
otherwise. The entire risk as to the results and performance of the product is assumed by you.
The warranty and remedies set forth above are exclusive and in lieu of all others, oral or written, express or implied. No Harte-Hanks
Market Intelligence, Inc. dealer, distributor, agent or employee is authorized to make any modification or addition to this warranty.
