Officials Feared Runaway Wildfire Had Potential to Reach Coast<br />

■ Porter Ranch Blaze Was Headed Southwest until Wind Changes Altered Its Behavior<br />

had already whipped one<br />

wildfire into an uncontrollable<br />

frenzy when a second fire<br />

broke out Monday morning on<br />

Oat Mountain above Porter<br />

Ranch and quickly grew as <strong>35</strong> to<br />

45 mph winds, with gusts as high<br />

as 70 mph, fanned <strong>the</strong> flames.<br />

Malibuites who know <strong>the</strong> <strong>community</strong>’s<br />

fire history joined county<br />

fire officials in recalling <strong>the</strong><br />

Wright and Clampitt fires that<br />

also started near Oat Mountain<br />

and traveled over two mountain<br />

ranges, through Chatsworth to <strong>the</strong><br />

ocean, in September 1970. That<br />

wildfire claimed 1<strong>35</strong>,000 acres<br />

and destroyed 226 structures.<br />

As <strong>the</strong> Malibu Surfside News<br />

went to press, <strong>the</strong> fire had claimed<br />

over 13,000 acres and at least 20<br />

structures. More than 3000 people<br />

had been evacuated from hundreds<br />

of homes. The fire is not yet<br />

under control, but containment is<br />

expected by Saturday, as long as<br />

<strong>the</strong> wind and wea<strong>the</strong>r cooperate.<br />

An all-out aerial assault, including<br />

<strong>the</strong> leased SuperScoopers that<br />

had just arrived in Los Angeles<br />

County, helicopters, and <strong>the</strong> DC-<br />

10, and intensely focused ground<br />

crews kept losses down.<br />

A shift in winds Tuesday reduced<br />

<strong>the</strong> risk <strong>the</strong> Sesnon Fire in<br />

<strong>the</strong> Porter Ranch area would follow<br />

its 1970 predecessor. The fire,<br />

described in its first few hours as<br />

“a blowtorch we can’t get in front<br />

of” by a county fire official, took<br />

turns inland ra<strong>the</strong>r than march to<br />

<strong>the</strong> sea. A flare-up west toward<br />

Simi Valley was an unknown variable<br />

as The News went to press.<br />

Though Malibu was 20 miles<br />

away from <strong>the</strong> flames, smoke and<br />

ash followed <strong>the</strong> southwest thrust<br />

of <strong>the</strong> Santa Anas before nature<br />

came to <strong>the</strong> rescue of weary fire<br />

crews and Monday night’s winds<br />

fell short of 60-plus mph forecasts.<br />

The seriousness of <strong>the</strong> potential<br />

danger to Malibu from <strong>the</strong> Sesnon<br />

blaze was reiterated by Los Angeles<br />

County Fire Chief P. Michael<br />

Freeman at press conferences<br />

at 4:40 and 6:30 p.m. on Monday.<br />

Freeman said, “This fire has <strong>the</strong><br />

real potential of moving all <strong>the</strong><br />

way down to <strong>the</strong> 101 freeway and<br />

perhaps even as far as Pacific<br />

Coast [Highway].”<br />

“[The fire] can go from here to<br />

<strong>the</strong> ocean in a matter of two to<br />

three hours,” said Los Angeles<br />

County Supervisor Zev Yaroslav-<br />

Water Fight Could Lead to<br />

‘Septic System Prohibition’<br />

■ City and Regional Board at Odds<br />

Afight has broken out between<br />

<strong>the</strong> City of Malibu<br />

and <strong>the</strong> Regional Water<br />

Quality Control Board over <strong>the</strong><br />

city’s oversight of its Lumber<br />

Yard shopping center. In what is<br />

considered a punitive action, <strong>the</strong><br />

board, at a meeting on Nov. 13, is<br />

expected to consider rescinding a<br />

memo of understanding that<br />

gives <strong>the</strong> city waste discharge<br />

permitting power.<br />

The tentative resolution, if<br />

adopted by <strong>the</strong> board next month,<br />

could result in <strong>the</strong> board directing<br />

<strong>the</strong> staff to prepare a septic system<br />

prohibition.<br />

At <strong>the</strong> least, it could delay <strong>the</strong><br />

opening of <strong>the</strong> shopping center<br />

by months, if not longer. and impact<br />

o<strong>the</strong>r commercial permits.<br />

In September, <strong>the</strong> city notified<br />

<strong>the</strong> regional board of its intent to<br />

regulate its own discharge of <strong>the</strong><br />

shopping center under <strong>the</strong> MOU.<br />

Shortly <strong>the</strong>reafter, <strong>the</strong> board notified<br />

<strong>the</strong> city and Richard Weintraub,<br />

who is building <strong>the</strong> center,<br />

of its intent to issue waste discharge<br />

requirements for non-restaurant<br />

flows less than 3200 gallons<br />

per day and advised both parties<br />

that should <strong>the</strong> shopping center<br />

open without its requirements,<br />

<strong>the</strong> board might take enforcement<br />

action for illegal discharge.<br />

A week later, <strong>the</strong> city told <strong>the</strong><br />

state agency it intended to issue a<br />

permit for <strong>the</strong> shopping plaza<br />

under <strong>the</strong> MOU. Ano<strong>the</strong>r week<br />

went by, and <strong>the</strong> board issued a<br />

30-days notice letter informing<br />

<strong>the</strong> city of its intent to terminate<br />

<strong>the</strong> MOU. The city has continued<br />

overseeing <strong>the</strong> construction and<br />

permiting for <strong>the</strong> shopping center,<br />

according to RWQCB.<br />

The give and take between <strong>the</strong><br />

board and <strong>the</strong> city goes back sev-<br />

southwest-moving Sesnon Fire,<br />

as well as one at Camp 8.<br />

A fourth firefighter was assigned<br />

to Malibu Stations 70, 72<br />

and 99 to assure added personnel<br />

if <strong>the</strong> crews were called out. Grycan<br />

said patrols staffed with a<br />

captain and a firefighter reconnoitered<br />

<strong>the</strong> coastal area on Monday<br />

when <strong>the</strong> danger was most acute.<br />

Local residents were urged by<br />

county officials to monitor news<br />

reports on <strong>the</strong> fire and be prepared<br />

to take appropriate action if fire<br />

lines began to travel down traditional<br />

paths through <strong>the</strong> Santa<br />

Monicas to <strong>the</strong> ocean.<br />

Although <strong>the</strong> Marek Fire in <strong>the</strong><br />

East Valley posed no evident danger<br />

to <strong>the</strong> local coast before its<br />

near containment, it was a classic<br />

example of a wind-driven blaze<br />

that took its toll before firefighters<br />

could meet it head on. One fire<br />

official at <strong>the</strong> scene said, “Wind is<br />

The twin blazes, <strong>the</strong> first conflagrations<br />

of Sou<strong>the</strong>rn California’s<br />

autumn wildfire season, were <strong>the</strong><br />

largest of several that erupted across<br />

<strong>the</strong> state this week, burning<br />

over 27,000 acres from San Diego<br />

County to San Francisco Bay.<br />

Malibu’s most devastating<br />

blaze last year, <strong>the</strong> Corral Fire,<br />

occurred in November, and many<br />

of <strong>the</strong> scars are still healing.<br />

Local wildfires used to occur<br />

once every five or six years, even<br />

as far apart as a decade or more.<br />

They now are becoming multiple<br />

annual events in <strong>the</strong> Southland.<br />

Malibu and o<strong>the</strong>r fire-prone<br />

areas desperately need rain, but<br />

most long-range forecasts are<br />

grim. Add <strong>the</strong> drought conditions<br />

to <strong>the</strong> increased frequency of<br />

Santa Ana winds, and <strong>the</strong>re is <strong>the</strong><br />

formula for repeat performances<br />

of a drama that no one wants to<br />

watch, let alone try to withstand.<br />

City Finances Subject to Nation’s Volatility<br />

called on <strong>the</strong> council to consider<br />

halting spending money on<br />

discretionary studies until revenue<br />

from <strong>the</strong> Lumber Yard<br />

shopping center is collected.<br />

“We are committed to so many<br />

future projects. I would like to<br />

talk about holding in abeyance<br />

all discretionary studies until <strong>the</strong><br />

lumber yard is opened,” said<br />

Barovsky, who got council members<br />

to agree to put <strong>the</strong> matter on<br />

<strong>the</strong> next agenda for discussion.<br />

Since <strong>the</strong> city depends on<br />

much of its revenue from property<br />

tax and given <strong>the</strong> volatile markets<br />

including real estate, according<br />

to Barovsky, that steady revenue<br />

stream could suddenly drop<br />

if payments decline in some kind<br />

of dramatic fashion because of a<br />

reduction in property values.<br />

Special Ed Program Celebrates Proactive Approach<br />

■ Foundation’s First Back-to-School Night Brings Parents, Teachers and Staff Toge<strong>the</strong>r<br />

Parents of special education<br />

students had an opportunity<br />

to meet each o<strong>the</strong>r and visit<br />

with school administrators, special<br />

education teachers and support<br />

staff at <strong>the</strong> Malibu Special<br />

Education Foundation’s first backto-school<br />

night. The foundation,<br />

established in 2002, helps fund<br />

programs for children with disabilities<br />

and <strong>the</strong>ir parents and teachers<br />

in Malibu and Santa Monica.<br />

At <strong>the</strong> event, packets of information<br />

were handed out, parents were<br />

encouraged to join <strong>the</strong> organization’s<br />

parent support group, and<br />

tables were laden with special education<br />

resources. MSEF members<br />

were on hand to answer questions,<br />

toge<strong>the</strong>r with an assortment of district<br />

officials and guests, including<br />

crowd. Teachers and<br />

staff were greeted with cheers and<br />

applause in an evening punctuated<br />

with tears and laughter.<br />

“You are part of what makes<br />

Malibu Special Education so wonderful,”<br />

special education activist<br />

and MSEF board member Laureen<br />

Sills told <strong>the</strong> audience. “It’s <strong>the</strong><br />

gem of <strong>the</strong> district, and I’m honored<br />

and proud to be part of this.”<br />

Tim Cuneo, <strong>the</strong> district’s interim<br />

superintendent, had praise for <strong>the</strong><br />

program, which he described as a<br />

wonderful model. “We are going<br />

to be capturing many things you<br />

are doing here,” he said. “We really<br />

want to carefully look at <strong>the</strong> programs<br />

we’re offering and <strong>the</strong> way<br />

in which we are doing our business<br />

and continue to improve our program.<br />

We’re looking at many of<br />

<strong>the</strong> things you have here. We’ll be<br />

studying <strong>the</strong> entire special education<br />

program in our district.”<br />

Cuneo also had praise for <strong>the</strong><br />

parents. “What is really very<br />

unique are <strong>the</strong> parents who work<br />

with us toge<strong>the</strong>r to do what’s best<br />

for our children. Thank you for<br />

that. We will make sure to work<br />

very closely with you to make sure<br />

we deliver what’s best for all our<br />

children. It’s so important to have<br />

that kind of commitment.”<br />

Ruth Valadez, <strong>the</strong> districts special<br />

education director, also<br />

expressed appreciation to <strong>the</strong><br />

Malibu <strong>community</strong> and <strong>the</strong> MSEF<br />

parents for <strong>the</strong>ir support. She<br />

announced that, thanks to MSEF,<br />

Cabrillo Elementary school will<br />

soon have an occupational <strong>the</strong>rapy<br />

clinic, <strong>the</strong> second OTC for Malibu<br />

schools. She also invited Malibu<br />

parents to <strong>the</strong> SMMUSD’s PTA<br />

Council Fall Forum on Nov. 15 at<br />

disabled students an opportunity to engage in activities with “typical peers.” Recent<br />

solvers,” said MHS psychologist<br />

Juliette Boewe. “This is what<br />

works, all of us here tonight. For<br />

those of you at <strong>the</strong> elementary and<br />

preschool level that are here, I welcome<br />

you, and let you know this is<br />

your home in a few years. You’re<br />

going to be here with us and we’re<br />

so excited to be part of <strong>the</strong> education<br />

of your children. It’s a journey<br />

for all of us.”<br />

Kathy Wisnicki called MSEF “a<br />

true example of equality for all. “I<br />

have sat with you for <strong>the</strong> past four<br />

years and really listened to parents<br />

stories, listened to parents shedding<br />

tears over sometimes how difficult<br />

things can be and knowing<br />

that you come toge<strong>the</strong>r and support<br />

each o<strong>the</strong>r. You struggle, but<br />

you also share in your joy. I think<br />

that’s why we end up with a positive<br />

outcome. Parents have been in<br />

<strong>the</strong>re not only with resources<br />

financially but with a personal<br />

commitment of time.”<br />

“We want to make sure ever<br />

child who needs help receives it,”<br />

said Point Dume Elementary<br />

School’s Julie Siegel.<br />

“I think Santa Monica could<br />

learn a lot from Malibu’s example,<br />

particularly <strong>the</strong> Malibu Special Education<br />

Foundation,” school board<br />

It seems to me that Malibu tends to be reactive, instead of<br />

proactive when it comes to <strong>the</strong> yearly fires. After <strong>the</strong> Corral<br />

fire in ’07, my friend Tim Harvey took <strong>the</strong> time to investigate<br />

what it would cost to have an aircraft flown during red<br />

flag and Santa Ana conditions.<br />

The entire cost for <strong>the</strong> 24/7 surveillance would break<br />

down to approximately $200 an hour. When we see <strong>the</strong> devastation<br />

to our <strong>community</strong> members, it doesn’t seem so<br />

prohibitively expensive, does it?<br />

Perhaps our mayor or city council should make this happen.<br />

Is <strong>the</strong>re a “good Samaritan” out <strong>the</strong>re that would<br />

want to take this on?<br />

Does anyone else feel we in Malibu should be more proactive<br />

when it comes to <strong>the</strong>se yearly dangerous fire seasons?<br />

If <strong>the</strong>re is anyone out <strong>the</strong>re that feels this is important<br />

please contact our mayor, as this has been proposed but<br />

nothing has moved on it.<br />

I am thoroughly disgusted by <strong>the</strong> political advertisement<br />

“Yes on 8” featuring Pepperdine Professor Richard Peterson.<br />

What a sad commentary on Pepperdine. I realize Pepperdine<br />

is a Christian university, but I have been <strong>the</strong><br />

employer of many babysitters over <strong>the</strong> years from Pepperdine<br />

and my favorite “mannies” were gay and struggled<br />

incredibly with <strong>the</strong>ir Christian upbringing and <strong>the</strong> “reality”<br />

of <strong>the</strong>ir genetics. I held <strong>the</strong>ir hands as <strong>the</strong>y came to terms<br />

with who <strong>the</strong>y were as people and accepted <strong>the</strong> fact that<br />

<strong>the</strong>y could still love <strong>the</strong> Lord and be gay.<br />

I know that <strong>the</strong>re are some (I’ve heard many) gay students<br />

at Pepperdine, and I shudder to think of what kind of<br />

message this professor’s right wing tirade will send to <strong>the</strong>se<br />

young students. I shudder to think of <strong>the</strong> message <strong>the</strong>se ads<br />

send to my kids who have grown to know gay students<br />

from Pepperdine and accept <strong>the</strong>m without question. It was<br />

a great life lesson for my teenagers as <strong>the</strong>y became aware<br />

of <strong>the</strong> societal taboo one of <strong>the</strong>ir favorite sitters had to<br />

endure. My teenagers and <strong>the</strong>ir surfer dude friends learned<br />

to really like our gay sitters and will walk through <strong>the</strong> rest<br />

of <strong>the</strong>ir lives without <strong>the</strong> burden of intolerance fostered by<br />

ignorance.<br />

I called <strong>the</strong> university president’s office to voice my<br />

complaints and received an email with a press release stating<br />

that Pepperdine doesn’t endorse this professor’s comments<br />

and had succeeded in getting <strong>the</strong> commercial producers<br />

to take off Pepperdine’s name from Professor Peterson’s<br />

ignorant and intolerant comments.<br />

To close, I guess it is fair to say that if one supports equal<br />

rights for all Americans, women, men, black, white, disabled<br />

and, yes...gay, <strong>the</strong>y will vote no on 8. My teenager,<br />

who will be voting in his first election, will most certainly<br />

do so and proudly.<br />

FARM FIX<br />

I am pleased to see that Proposition 2 has opened up for<br />

discussion <strong>the</strong> treatment of farm animals, especially those in<br />

factory farms now owned by a handful of multinational corporations.<br />

The animals are now treated as commodities<br />

ra<strong>the</strong>r than living things. We must stop this inhumane and<br />

unhealthy system currently in place from conception to<br />

slaughterhouse. In doing so, we also save ourselves.<br />

Factory farm animals have altered genetic makeups (similar<br />

to inbreeding). These mono-breeding programs that escalate<br />

growth and milk and egg production take <strong>the</strong>ir toll,<br />

putting animals under great stress and pain (e.g. brittle<br />

bones, painful udders), pushing animals to <strong>the</strong>ir limits.<br />

Firefighters know that <strong>the</strong> wind rules. The courageous<br />

and skilled men and women who fly <strong>the</strong> aircraft<br />

and walk <strong>the</strong> fire lines know that nature decides<br />

<strong>the</strong> destiny of <strong>the</strong> infernos that ever more frequently<br />

remind us of our fragile hold on <strong>the</strong> environment<br />

in which we dwell. The Malibu autumn<br />

mantra has always been a variant of “If it’s October,<br />

<strong>the</strong> Santa Ana winds will blow; if <strong>the</strong> Santa Anas<br />

blow, sparks will fly; if sparks fly, wildfire will follow.”<br />

This is now a year-round litany, as climate<br />

change spurs <strong>the</strong> state’s drought conditions and<br />

intensive development in <strong>the</strong> wildland interface<br />

makes fire control increasingly problematic.<br />

However, even <strong>the</strong> most negligible incidents can<br />

illustrate <strong>the</strong> wind’s power. In what is now second<br />

nature during Santa Anas, I was out Sunday night<br />

and pre-dawn on Monday clocking winds that<br />

ranged from 25 to 60 mph. When I arrived at <strong>the</strong><br />

newspaper offices early Monday morning, my trusty<br />

pocket wea<strong>the</strong>r tracker and wind meter registered<br />

gusts in back of <strong>the</strong> building at 70 mph. The wind<br />

was strong, but I’ve held my ground in comparable<br />

conditions before. I have clocked gale force blasts of<br />

84 mph in <strong>the</strong> mountains from <strong>the</strong> safety of my car.<br />

But I was caught off guard when I turned <strong>the</strong> corner<br />

of <strong>the</strong> building. As I reached for <strong>the</strong> door knob,<br />

a gale force blast of at least 78 to 80 mph knocked<br />

me to <strong>the</strong> ground. The wind meter landed at my<br />

side, and only swift reflexes kept it from being<br />

blown away. The two sacks of market supplies I<br />

was bringing to <strong>the</strong> office had been snatched from<br />

my left hand, and <strong>the</strong> bags and <strong>the</strong>ir contents were<br />

scattered across <strong>the</strong> parking lot. Some of <strong>the</strong>m were<br />

never recovered. The assumption is <strong>the</strong>y were carried<br />

over adjacent fences, never to be seen again.<br />

Still sitting on <strong>the</strong> ground, I turned my back to <strong>the</strong><br />

It’s All about <strong>the</strong> Wind Wind<br />

wind and tried to stand. The wind was just too<br />

strong. I would start to get up, only to be buffeted<br />

again. Fortunately, at that point, a colleague rounded<br />

<strong>the</strong> corner and got help. They provided a wind<br />

shield and assistance. After determining that <strong>the</strong><br />

worst of <strong>the</strong> damage was a sore shoulder, a scraped<br />

knee, and an aubergine bruise <strong>the</strong> size of a soccer<br />

ball, <strong>the</strong> realization sunk in that <strong>the</strong> removal of a<br />

huge old tree and shoulder-high hedges to facilitate<br />

construction below <strong>the</strong> building had transformed <strong>the</strong><br />

terminus of <strong>the</strong> Kanan Dume Road wind tunnel into<br />

a vortex. When one of <strong>the</strong> fire officials said this<br />

week, “Wind is king,” I humbly concurred.<br />

The city agreed to build a<br />

centralized plant in <strong>the</strong> Civic<br />

Center seven years ago and,<br />

after buying <strong>the</strong> Chili Cook-<br />

Off site, gave <strong>the</strong> RWQCB<br />

<strong>the</strong> impression it thought<br />

that would become what<br />

some at <strong>the</strong> time derisively<br />

named Leachfield Park.<br />

However, fur<strong>the</strong>r study<br />

found <strong>the</strong> site unsuitable for<br />

wastewater disposal, if <strong>the</strong><br />

city was going to use it for a<br />

stormwater storage facility<br />

and <strong>the</strong> city moved forward<br />

with stormwater treatment<br />

at that location.<br />

The wastewater component<br />

got put on hold while<br />

<strong>the</strong> city worked on lumber<br />

yard septic issues.<br />

Then <strong>the</strong> city decided to<br />

discharge lumber yard effluent<br />

at Legacy Park and that<br />

led to fur<strong>the</strong>r scrutiny by <strong>the</strong><br />

RWQCB.<br />

City officials originally<br />

thought <strong>the</strong>y had an agreement<br />

with RWQCB officials<br />

that if <strong>the</strong>y did a $<strong>50</strong>0,000<br />

groundwater monitoring<br />

study, <strong>the</strong>y could proceed<br />

with <strong>the</strong> lumber yard permitting.<br />

fault with <strong>the</strong> elements dealing<br />

with groundwater discharge<br />

pertaining to <strong>the</strong><br />

lumber yard and told city<br />

officials <strong>the</strong>re were no studies<br />

about overall water quality<br />

impacts since <strong>the</strong> city<br />

indicated it was delaying a<br />

wastewater treatment plant<br />

now says that despite <strong>the</strong><br />

meetings between regional<br />

staff and <strong>the</strong> city, differences<br />

evolved about how that study<br />

would be conducted.<br />

The RWQCB staff subsequently<br />

met with Weintraub<br />

in an attempt to revise <strong>the</strong><br />

engineering designs for <strong>the</strong><br />

shopping center to comply<br />

with state and regional water<br />

quality plans.<br />

After an apparent agreement<br />

on <strong>the</strong> conditions required<br />

by <strong>the</strong> state agency<br />

for discharge, <strong>the</strong> RWQCB<br />

staff insists technical plans<br />

sent back to <strong>the</strong> regional<br />

staff did not meet all of <strong>the</strong><br />

requirements and <strong>the</strong> matter<br />

is considered incomplete.<br />

“assimilative capacity of <strong>the</strong><br />

Civic Center area is already<br />

exceeded under certain conditions.<br />

The existing onsite<br />

wastewater treatment commercial<br />

system in <strong>the</strong> Civic<br />

Center have systems which<br />

fail to adequately treat <strong>the</strong><br />

entire <strong>volume</strong> of waste treated<br />

and which do not maintain<br />

<strong>the</strong> minimum five feet<br />

of separation.”<br />

The tentative resolution<br />

states <strong>the</strong> city has failed to<br />

impose and enforce <strong>the</strong><br />

board’s requirements on<br />

several different counts and<br />

<strong>the</strong> MOU could be terminated<br />

without immediate renegotiation,<br />

and dischargers<br />

will be required to apply for<br />

permits for <strong>the</strong>ir discharges<br />

and may be subject to enforcement<br />

action if <strong>the</strong>ir<br />

effluent does not meet water<br />

quality objectives, if <strong>the</strong>y<br />

did not previously receive a<br />

permit from <strong>the</strong> board, or if<br />

<strong>the</strong> permit provided by <strong>the</strong><br />

city does not meet regional<br />

board standards.<br />

Free Arts for Abused Children Plans Benefit<br />

Craig Stuart Garfinkle celebrated <strong>the</strong>ir marriage on<br />

Aug. <strong>16</strong> “with our own version of a Malibu Mystery<br />

Tour,” according to Garfinkle. The ceremony took<br />

place at Pepperdine’s Stauffer Chapel, followed by a<br />

reception at Rancho Sol del Pacifico. Noone, a<br />

native of Galway, Ireland, had almost 80 of her<br />

She is a composer for film and television as<br />

Tidepool at <strong>the</strong> Wallflower Festival<br />

UP CLOSE AND PERSONAL—Children who attended<br />

<strong>the</strong> recent Malibu Chamber of Commerce’s<br />

Wallflower Festival were treated to a<br />

mobile tide pool. “The children touched sea stars,<br />

hermit crabs, sea urchins, fish, a brittle star, a sea<br />

slug, a sea cucumber and many o<strong>the</strong>r animals,”<br />

stated a press release. “It was one of <strong>the</strong> most<br />

popular booths at <strong>the</strong> show.” However, <strong>the</strong> Malibu<br />

Chamber of Commerce erroneously reported in a<br />

press release promoting <strong>the</strong> event that <strong>the</strong> tide<br />

pool was from Aquarium of <strong>the</strong> Pacific, when, in<br />

fact it was from Mobile Marine Labs and was<br />

funded by donations from Michael Novotny of<br />

Prudential Malibu Realty and Valleycrest Landscape<br />

Councilmember Warns City Finances Are Subject to Nation’s Volatility<br />

“It is not an area where we<br />

in addition to its investments<br />

at <strong>the</strong> LAIF, according<br />

to Feldman. The first<br />

investment of $3 million<br />

lot, dog park, onsite wastewater<br />

treatment system and<br />

grading in excess of 1000<br />

cubic yards on about 13<br />

acres located along Trancas<br />

Canyon Road.<br />

Next week, <strong>the</strong> council is<br />

scheduled to consider an<br />

amendment to <strong>the</strong> consultants'<br />

contract for ano<strong>the</strong>r<br />

Loan Bank is set to mature<br />

on April 2, 2009 and will<br />

yield three percent. The<br />

second investment of $2<br />

million with <strong>the</strong> FHLB is<br />

set to mature on June 24,<br />

2009 and will also yield<br />

three percent.<br />

Feldman indicated that<br />

while those investments are<br />

not collateralized, “it is<br />

implied that <strong>the</strong> FHLB is<br />

backed by <strong>the</strong> federal government<br />

and <strong>the</strong> risk of loss<br />

is minimal.”<br />

The majority of <strong>the</strong> city’s<br />

funds are held at LAIF,<br />

which is part of <strong>the</strong> state’s<br />

pooled money investment<br />

account. As of Sept. 30,<br />

<strong>2008</strong> <strong>the</strong> balance of city<br />

funds at LAIF was<br />

$19,817,803. The yield is<br />

2.779 percent.<br />

In a staff report to subcommittee<br />

$85,000 for a total of<br />

Wagner said he wanted<br />

to apologize to any one<br />

who might have taken<br />

offense at a remark he<br />

made that was recently<br />

published in a local newspaper.<br />

After what many considered<br />

hearing, Wagner told reporters,<br />

“Tonight was just like<br />

any advisories,” said a Los<br />

Angeles County lifeguard,<br />

in response to queries<br />

about <strong>the</strong> fouled water.<br />

possible explanation. “We<br />

have had a <strong>number</strong> of high<br />

tides coupled with waves<br />

and that can sometimes<br />

wreak havoc on septic systems,”<br />

creeks are dried up by now,<br />

OBITUARY<br />

Arthur London<br />

Arthur London,<br />

longtime Malibu resident,<br />

passed away<br />

on September 26,<br />

three days before his<br />

82nd birthday. He<br />

moved to Malibu in<br />

1968 and soon became<br />

a passionate<br />

activist, working to<br />

protect Malibu’s natural<br />

environment and<br />

rural character.<br />

Art later met his<br />

beloved wife, Lois,<br />

in 1972 after a mutual friend brought <strong>the</strong>m<br />

toge<strong>the</strong>r as tennis partners. Since <strong>the</strong>n, <strong>the</strong> two<br />

frequented Pasquale’s Jazz Club on <strong>the</strong> beach<br />

almost every week until it closed, played tennis,<br />

attended <strong>the</strong>ater, jazz and cultural events<br />

continually and traveled <strong>the</strong> world. Art saw<br />

<strong>the</strong>ir cherished home on Carbon Mesa<br />

threatened by wildfires several times, until it<br />

was finally lost in <strong>the</strong> Malibu fire of 1993. Never<br />

one to give up on Malibu, he rented several<br />

properties until finally buying a beautiful home<br />

high up Las Flores Canyon where he and Lois<br />

lived for <strong>the</strong> past 13 years.<br />

A professional attorney since graduating from<br />

Harvard Law School, Art worked tirelessly for<br />

Malibu. In <strong>the</strong> pre-cityhood days, he opposed<br />

Caltrans proposed expansion of PCH to <strong>the</strong><br />

current four lane highway and opposed L.A.<br />

County attempts to impose sewers on Malibu.<br />

He actively supported Malibu cityhood campaigns<br />

as a member of MTC and MCI. Once<br />

Malibu became a city, his many volunteer<br />

activities included active roles as a member of<br />

<strong>the</strong> Transportation and Natural Resources<br />

Study Groups, Single Family Building Criteria<br />

Task Force and General Plan Task Force (Land<br />

Use, Conservation, Open Space and Recreation<br />

and Safety and Health Sub-Committees).<br />

Born in Los Angeles to Russian immigrant<br />

parents in 1926, and raised in <strong>the</strong> Boyle Heights<br />

district, Art remembered seeing movies in <strong>the</strong><br />

spectacular movie palaces on Broadway for a<br />

quarter and taking <strong>the</strong> Red Line cable car all<br />

<strong>the</strong> way to Venice Beach. He graduated with<br />

a B.S. in Chemical Engineering from <strong>the</strong><br />

University of Illinois in 1949 and received his<br />

law degree from Harvard Law School in 1952.<br />

He is survived by his loving wife, Lois London,<br />

son Stephen London, daughters Hildy Gal and<br />

Susan London, step-daughters Cheryl Yaney<br />

and Marina Yaney and eleven grandchildren.

These same factory farms cause huge amounts of pollution<br />

due to overcrowding, claustrophobic and foul-smelling<br />

conditions. One hog can produce as much waste as eight<br />

people, yet <strong>the</strong>se premises are not required to have sewage<br />

treatment facilities. This waste pollutes water systems,<br />

killing fish and wildlife. Also, what has been found in analyzed<br />

feed samples for many factory farm animals is noxious,<br />

including blood meal, hydrolyzed fea<strong>the</strong>r meal, animal<br />

hair, chemicals, cardboard, candy, dried poultry<br />

manure and cattle manure.<br />

Although Proposition 2 is not perfectly written, it is a<br />

start. I would also demand that more legislation be added<br />

later so that any out-of-state food brought into California<br />

would be certified with <strong>the</strong> same standards as outlined in<br />

Proposition 2. Fur<strong>the</strong>rmore, any chemicals, drugs, hormones<br />

or compounds given to animals and humans should<br />

be considered toxic until proven safe—not <strong>the</strong> o<strong>the</strong>r way<br />

around.<br />

The consequences of doing nothing are staggering. This<br />

is not just a humane issue, this is also a threat to human<br />

safety. Therefore, we must not only vote yes on Proposition<br />

2, but follow up as described above.<br />

PLAN PROMOTERS<br />

We are members of <strong>the</strong> Measure BB site committee at<br />

Malibu High School. We have been working hard to ensure<br />

that <strong>the</strong> Measure BB facility funds are spent appropriately<br />

and in a timely manner at our high school.<br />

It has been a long process and began 5 years ago as our<br />

school district worked to create a long range Facilities Master<br />

Plan for our <strong>community</strong>. Stakeholders from all segments<br />

of our <strong>community</strong> gave valuable input during those sessions<br />

to create a dynamic, forward looking vision for our schools.<br />

We are excited to finally see <strong>the</strong> outcome of all <strong>the</strong> hard<br />

work. Thanks must be passed around our <strong>community</strong> for its<br />

support of <strong>the</strong> groundbreaking Measure BB that has allowed<br />

<strong>the</strong> Master Plan to begin to be implemented at Malibu High,<br />

a school recently recognized as a top-100 school in <strong>the</strong> country.<br />

A new library with attached administration offices, middle<br />

school science labs and classrooms and sports facilitieswill<br />

only improve our strong programs. Intensive work<br />

and communication regarding traffic and parking have<br />

resulted in plans that will dramatically improve <strong>the</strong> traffic<br />

flow around our school.<br />

Our staff has designed a facility that uses sustainable<br />

design that lessens impacts to <strong>the</strong> neighborhood and promotes<br />

green building standards. Overall, <strong>the</strong> planning process<br />

always welcomes input from <strong>community</strong> members. We feel<br />

it is our function as members of <strong>the</strong> BB committee to ensure<br />

that accurate information is disseminated to all neighbors and<br />

stakeholders who will surely benefit from having a <strong>community</strong><br />

friendly public school in <strong>the</strong>ir neighborhood.<br />

We welcome input and suggestions and rely on valuable<br />

OBITUARY<br />

Es<strong>the</strong>r Ca<strong>the</strong>rine Lowry<br />

March 31, 1920 - October<br />

13, <strong>2008</strong>. A fifty-four year<br />

resident of Point Dume,<br />

Es<strong>the</strong>r Lowry passed<br />

away quietly in <strong>the</strong><br />

morning hours of October<br />

13. In her final days, she<br />

was surrounded by family<br />

from California, Michigan<br />

and Canada.<br />

The youngest of three<br />

children, Lowry was born<br />

and raised in Winnipeg, Manitoba, Canada. Single and<br />

enamored of a co-worker who had moved to Santa<br />

Monica, she took a risk and decided to give California<br />

a try. Her risk blossomed into a 37-year marriage to<br />

Harry Lowry. They purchased land and built <strong>the</strong>ir<br />

dream home on Point Dume.<br />

Lowry was a founding member of <strong>the</strong> Malibu<br />

Methodist Church and taught Sunday school. Initially,<br />

church services were held in <strong>the</strong> Lowry home.<br />

Lowry was an active member of <strong>the</strong> Malibu Garden<br />

Club and a former president.<br />

A generous woman to strangers as well as those<br />

she knew and loved, Lowry was a foster parent<br />

and worked with youth both here in <strong>the</strong> U.S. and<br />

abroad. She loved Malibu, her garden, and a<br />

menagerie of animals that kept her busy and<br />

young-at-heart.<br />

Lowry is survived by a large family and many<br />

friends. She was predeceased by her husband<br />

Harry, and son Gilbert. Es<strong>the</strong>r will be missed by<br />

many.<br />

Lowry’s relatives are grateful to Doug and his<br />

family, also Cathy and Carol for <strong>the</strong>ir loving care<br />

and support.<br />

A memorial service and celebration of Es<strong>the</strong>r<br />

Lowry’s life will be held at <strong>the</strong> Malibu United<br />

Methodist Church on Thursday, October <strong>16</strong>, at 2 p.m.<br />

A reception will follow in <strong>the</strong> church hall. In lieu of<br />

flowers, please make donations to <strong>the</strong> Humane<br />

Society of <strong>the</strong> U.S.<br />

Four: The Saturn/Uranus opposition<br />

continues to tighten its grip,<br />

and daily life continues to feel surreal—<br />

and for good reason. We’re in one of<br />

those life-changing phases of human<br />

history where individual reality, as well<br />

as collective reality, is busy being born.<br />

And while many of us feel powerless<br />

before <strong>the</strong> constant shifts and ceaseless<br />

tumult, we actually aren’t without <strong>the</strong><br />

tools to handle this crisis. Yet using<br />

those tools wisely means first being clear about what’s dying and<br />

<strong>the</strong>n, surrendering <strong>the</strong> need to resurrect <strong>the</strong> past. Clinging to life as<br />

it once was won’t work. Nei<strong>the</strong>r will unrealistic expectations about<br />

<strong>the</strong> future, which are, if you’re willing to look closely, mostly<br />

ano<strong>the</strong>r way of holding on to <strong>the</strong> past. Times like <strong>the</strong>se, times<br />

potent with power of change, require staying grounded in <strong>the</strong> now.<br />

One of <strong>the</strong> best ways to do that is to be a spiritual warrior, an<br />

approach that assumes consciousness, courage, common sense,<br />

compassion, and honesty as guiding lights of behavior at all times,<br />

not just in times of crisis. Each of us is experiencing this opposition<br />

The PUZZLE<br />

ing on a personal point. Saturn, at 18 degrees Virgo, or Uranus, at<br />

18 degrees Pisces, may exactly conjunct someone’s Sun, Moon,<br />

ascendant, or o<strong>the</strong>r planet in <strong>the</strong>ir birth chart. Many of us are<br />

encountering <strong>the</strong> opposition as part of a generational shift. For<br />

example, those born in September/October 1920, or April-July<br />

1921, November/December 1949, January/February 19<strong>50</strong>, August<br />

19<strong>50</strong>, or September/October 1979 are all having this opposition as<br />

part of a Saturn return. Saturn returns signify a time of taking stock,<br />

which means those people currently in <strong>the</strong> midst of a Saturn return<br />

are going to take that inventory as part of an already intense process<br />

of evaluation. The generation born during <strong>the</strong> 1965-1967<br />

Saturn/Uranus opposition series will feel <strong>the</strong> current opposition<br />

quite keenly given that many of those people have a Saturn/Uranus<br />

opposition in <strong>the</strong>ir birth charts. Be aware, during <strong>the</strong> last<br />

Saturn/Uranus opposition series, <strong>the</strong>ir positions were reversed; Saturn<br />

was in Pisces and Uranus was in Virgo, conjunct Pluto, also in<br />

Virgo, which from an astrological perspective was ano<strong>the</strong>r reason<br />

why <strong>the</strong> world turned upside down. Not everyone born during that<br />

period had <strong>the</strong> Saturn/Uranus opposition at 18 degrees Virgo or<br />

Pisces, only those born at <strong>the</strong> end of February or <strong>the</strong> beginning of<br />

March 1966. But even though <strong>the</strong> o<strong>the</strong>r previous oppositions didn’t<br />

occur at <strong>the</strong> same degree as <strong>the</strong> first opposition of <strong>the</strong> current series,<br />

a deep resonance will be triggered in all those birth charts. What’s<br />

more, people born between October-December 1965, January-<br />

March 1966, and August/September 1966, are experiencing <strong>the</strong><br />

current Saturn/Uranus opposition as part of <strong>the</strong>ir astro-midlife crisis,<br />

a time when transiting Uranus opposes its natal position, triggering<br />

realizations about <strong>the</strong> passage of time—no longer young and<br />

not yet old—that tend to inspire dramatic changes. While <strong>the</strong>re’s<br />

more generational information, <strong>the</strong>re’s no room in this column to<br />

cover it all. So we will pick it up next week. Until <strong>the</strong>n, be thankful<br />

Mercury is Direct, and most importantly, be as kind to your fellow<br />

travelers as possible. Lots of us are in great need of a kindness.<br />

If you know your ascendant and/or your moon sign, read that too.<br />

Aries (March 21-April l9): Despite <strong>the</strong> erratic economic environment,<br />

your finances are stabilizing. Whe<strong>the</strong>r that’s from discipline<br />

or determination, it doesn’t matter. What does matter, is that you<br />

are prospering.<br />

Taurus (April 20-May 20): It’s crucial for you to believe in yourself,<br />

so ra<strong>the</strong>r than devolving into doubt, trust your decisions. And<br />

Remember, in times of trouble, a gentle touch and kind attitude will<br />

facilitate a much better response than harsh words.<br />

Libra (September 23-October 22): Allow your inner composure to<br />

inform your words and deeds, as well as you thoughts, and you’ll<br />

engender cooperation. Creating a positive environment will generate<br />

positive, long-term results.<br />

Scorpio (October 23-November 21): Try not to let intense interactions<br />

with partners, personal or professional, throw you off course.<br />

The brouhaha will pass with time and clear communication will be<br />

restored.<br />

Sagittarius (November 22-December 21): Staying optimistic in <strong>the</strong><br />

midst of so much turmoil takes a special effort even when optimism<br />

is your strong suit. So ra<strong>the</strong>r than despair, rely on your innately positive<br />

attitude, and you will emerge victorious.<br />

Capricorn (December 22-January 19): Take advantage of every<br />

Exotic Spurge Plant Has Become a Scourge<br />

■ Homeowners and Gardeners Are Urged to Eradicate It<br />

It may seem like a lovely<br />

plant to some—colorful<br />

lime green leaves with red<br />

stems and a delicate flower<br />

that is cupped within <strong>the</strong><br />

leaf.<br />

However, native plant<br />

enthusiasts and o<strong>the</strong>rs have<br />

nothing but bad things to<br />

say about <strong>the</strong> plant called<br />

terracina spurge, which<br />

<strong>the</strong>y call one of <strong>the</strong> newest<br />

problem plants of Sou<strong>the</strong>rn<br />

California.<br />

Recently, a brochure was<br />

sent to many residents asking<br />

homeowners and gardeners<br />

to help stop <strong>the</strong><br />

invasive plants from sprea<br />

Officially called Euphorbia<br />

terracina, <strong>the</strong> exotic<br />

specimen in <strong>the</strong> past several<br />

years has been very<br />

prominent in Malibu.<br />

Spurge seems to know<br />

no boundaries. It has been<br />

observed in numerous locations<br />

on National Park Service<br />

and State Park holdings.<br />

The toxic invader<br />

from Europe has been<br />

established in Malibu and<br />

various o<strong>the</strong>r coastal and<br />

inland areas. The plant’s<br />

worst habit, among many,<br />

according to native plant<br />

experts, is its ability to<br />

establish dense stands in<br />

<strong>the</strong> landscape excluding<br />

native plants and causing a<br />

potential public health hazard.<br />

Terracina is cited as a<br />

public health hazard because<br />

it is said to cause a<br />

<strong>number</strong> of problems for<br />

humans, including a toxic<br />

milky sap that can cause<br />

temporary blindness. Contact<br />

with its leaves and<br />

stems can cause a poisonoak<br />

like reaction in susceptible<br />

individuals.<br />

Experts say <strong>the</strong> toxic<br />

exotic offers poor forage<br />

and inferior habitats for<br />

animals such as deer, rabbits<br />

and birds. Its ability to<br />

eliminate all o<strong>the</strong>r vegetation<br />

also poses problems.<br />

Spurge makes a poor soil<br />

stabilizer, and it can eliminate<br />

<strong>the</strong> native plants that<br />

do help mitigate erosion<br />

problems.<br />

There are o<strong>the</strong>r spurges<br />

that can be found in <strong>the</strong><br />

garden and <strong>the</strong>re are native<br />

spurges that can cause less<br />

How Windy Was It in Malibu?<br />

Trancas Canyon area Monday, coating cars with ashes from combustion<br />

at Oat Mountain, 25 miles away. This old pine tree toppled, uprooting a<br />

NOXIOUS NEIGHBOR—Plant experts say this toxic exotic specimen has<br />

overrun parkland and o<strong>the</strong>r areas of Malibu and can represent a health<br />

threat to humans because of a sap that can irritate, much like poison oak.<br />

It also represents a threat to native plants and wildlife because it tends to<br />

crowd out vegetation and makes a poor habitat for animals.<br />

methods of removing <strong>the</strong><br />

pest. When <strong>the</strong> soil is soft,<br />

plants can be yanked out<br />

of <strong>the</strong> ground by hand.<br />

Make sure to wear gloves<br />

and a long-sleeved shirt.<br />

Experts explain that plants<br />

will not re-sprout as long as<br />

<strong>the</strong> top three inches of <strong>the</strong><br />

root are removed. Plants can<br />

also be eliminated by spray-<br />

ing with a general herbicide,<br />

although many gardeners are<br />

hesitant to do so.<br />

Terracina has a large<br />

seedbank, with seeds lasting<br />

in <strong>the</strong> soil for three to<br />

five years, according to <strong>the</strong><br />

experts. Seed germination<br />

can by prevented by applying<br />

thick mulch on <strong>the</strong><br />

ground or by using landscape<br />

cloth.<br />

Coldwell Banker Launches National 10-Day Sales Event<br />

Coldwell Banker Residential Brokerage has announced “an<br />

innovative home sales event designed to bring homebuyers<br />

and sellers toge<strong>the</strong>r that may help jump-start <strong>the</strong> U.S. real<br />

estate market,” a press release stated.<br />

“The nation’s oldest residential real estate brand will kick-off<br />

its first-ever national ‘10-Day Sales Event’—during which participating<br />

home sellers from across <strong>the</strong> United States will reduce<br />

<strong>the</strong> listing prices of <strong>the</strong>ir homes that may help jump-start <strong>the</strong><br />

U.S. real estate market.” The Coldwell Banker 10-Day Sales<br />

Event will run nationally through Oct. 19, <strong>2008</strong>.<br />

“Here in Los Angeles, <strong>the</strong> 10-Day Sales Event is especially<br />

timely. Our participating home sellers feel that a home<br />

priced properly to sell will generate much more interest,”<br />

said Betty Graham, president and COO of Coldwell Banker<br />

Residential Brokerage Greater Los Angeles. “Plus, we’re<br />

hearing loud and clear from many of our sellers that <strong>the</strong>y’re<br />

comfortable with lowering <strong>the</strong>ir listing prices if it means getting<br />

offers and selling quickly.”<br />

Graham states that participating sellers who have listed<br />

<strong>the</strong>ir home with Coldwell Banker Residential Brokerage in<br />

Los Angeles will drop <strong>the</strong>ir listing price by 10 percent or<br />

more during <strong>the</strong> 10-Day Sales Event.<br />

“Despite <strong>the</strong> difficult headlines regarding our overall economy,<br />

<strong>the</strong> residential real estate market has been showing several<br />

positive signs over recent months” said Graham.<br />

“Because of higher inventory, buyers have more homes to<br />

choose from and <strong>the</strong>y can take advantage of near historically<br />

low interest rates and affordability levels that are <strong>the</strong> best<br />

<strong>the</strong>y have been in years. The recent housing and economic<br />

recovery legislation also provides first-time homebuyers with<br />

<strong>the</strong> added incentive of a $7<strong>50</strong>0 tax credit.”<br />

Jim Gillespie, president and chief executive officer of Coldwell<br />

Banker Real Estate LLC said, “our research and discussions<br />

with our brokers and sales associates show that in many<br />

markets sellers remain reluctant to list <strong>the</strong>ir homes at <strong>the</strong> proper<br />

prices necessary to attract buyers. It’s our hope that <strong>the</strong> Coldwell<br />

Banker 10-Day Sales Event will move buyers off <strong>the</strong> sidelines<br />

and into <strong>the</strong> market. We are embarking on this initiative—<br />

which has never been done before on a national basis—<br />

because we believe it is critical for Coldwell Banker, as an<br />

industry leader, to help serve <strong>the</strong> needs of those individuals listing<br />

homes with a Coldwell Banker broker and to help move <strong>the</strong><br />

U.S. real estate market in <strong>the</strong> right direction.”<br />

Gillespie said that in a recent survey of 3379 Coldwell<br />

Banker real estate professionals in markets across <strong>the</strong> United<br />

States, 56 percent said that listing prices in <strong>the</strong>ir market<br />

remain above where <strong>the</strong>y need to be to attract qualified buyers.<br />

Additional findings from <strong>the</strong> survey include:<br />

<strong>•</strong> 77 percent agreed that <strong>the</strong> majority of sellers in <strong>the</strong>ir<br />

market still have unrealistic expectations regarding <strong>the</strong> initial<br />

listing price for <strong>the</strong>ir homes.<br />

<strong>•</strong> 79 percent agreed that homes in <strong>the</strong>ir market that are<br />

priced appropriately are attracting more buyers and moving<br />

more quickly.<br />

<strong>•</strong> 76 percent feel that a 10 percent or less reduction in listing<br />

prices in <strong>the</strong>ir area is all it will take to help push <strong>the</strong>se<br />

homes over <strong>the</strong> “tipping point” to a sale.<br />

“Our brokers and sales associates agreed that, even in <strong>the</strong><br />

current climate, it will not take much movement to attract<br />

those buyers who have been watching and waiting,” said<br />

Gillespie. “Depending on <strong>the</strong> market, a price reduction of<br />

just 10 percent or less just may make <strong>the</strong> difference in both<br />

satisfying sellers and bringing buyers to <strong>the</strong> table.”<br />
