TREE TRIBULATION—Just last year, this pink-blossomed floss silk tree in the Civic Center area was surrounded by scorched terrain from
a wildfire that took a major toll a few weeks earlier. This week, almost a year to the date, smoke and ash swirled around its branches as two
major northern wildfires raged out of control. The tree has survived wildfires dating back to the 1940s, according to Malibu oldtimers who
say it has never failed to put on a floral display at a time of year when Santa Ana winds put Malibu at nature’s mercy. MSN/Frank Lamonea
Officials Feared Runaway Wildfire Had Potential to Reach Coast
■ Porter Ranch Blaze Was Headed Southwest until Wind Changes Altered Its Behavior
Powerful Santa Ana winds
had already whipped one
wildfire into an uncontrollable
frenzy when a second fire
broke out Monday morning on
Oat Mountain above Porter
Ranch and quickly grew as 35 to
45 mph winds, with gusts as high
as 70 mph, fanned the flames.
Malibuites who know the community’s
fire history joined county
fire officials in recalling the
Wright and Clampitt fires that
also started near Oat Mountain
and traveled over two mountain
ranges, through Chatsworth to the
ocean, in September 1970. That
wildfire claimed 135,000 acres
and destroyed 226 structures.
As the Malibu Surfside News
went to press, the fire had claimed
over 13,000 acres and at least 20
structures. More than 3000 people
had been evacuated from hundreds
of homes. The fire is not yet
under control, but containment is
expected by Saturday, as long as
the wind and weather cooperate.
An all-out aerial assault, including
the leased SuperScoopers that
had just arrived in Los Angeles
County, helicopters, and the DC-
10, and intensely focused ground
crews kept losses down.
A shift in winds Tuesday reduced
the risk the Sesnon Fire in
the Porter Ranch area would follow
its 1970 predecessor. The fire,
described in its first few hours as
“a blowtorch we can’t get in front
of” by a county fire official, took
turns inland rather than march to
the sea. A flare-up west toward
Simi Valley was an unknown variable
as The News went to press.
Though Malibu was 20 miles
away from the flames, smoke and
ash followed the southwest thrust
of the Santa Anas before nature
came to the rescue of weary fire
crews and Monday night’s winds
fell short of 60-plus mph forecasts.
The seriousness of the potential
danger to Malibu from the Sesnon
blaze was reiterated by Los Angeles
County Fire Chief P. Michael
Freeman at press conferences
at 4:40 and 6:30 p.m. on Monday.
Freeman said, “This fire has the
real potential of moving all the
way down to the 101 freeway and
perhaps even as far as Pacific
Coast [Highway].”
“[The fire] can go from here to
the ocean in a matter of two to
three hours,” said Los Angeles
County Supervisor Zev Yaroslav-
■ City and Regional Board at Odds
Afight has broken out between
the City of Malibu
and the Regional Water
Quality Control Board over the
city’s oversight of its Lumber
Yard shopping center. In what is
considered a punitive action, the
board, at a meeting on Nov. 13, is
expected to consider rescinding a
memo of understanding that
gives the city waste discharge
permitting power.
The tentative resolution, if
adopted by the board next month,
could result in the board directing
the staff to prepare a septic system
prohibition.
At the least, it could delay the
opening of the shopping center
by months, if not longer. and impact
other commercial permits.
In September, the city notified
the regional board of its intent to
regulate its own discharge of the
shopping center under the MOU.
Shortly thereafter, the board notified
the city and Richard Weintraub,
who is building the center,
of its intent to issue waste discharge
requirements for non-restaurant
flows less than 3200 gallons
per day and advised both parties
that should the shopping center
open without its requirements,
the board might take enforcement
action for illegal discharge.
A week later, the city told the
state agency it intended to issue a
permit for the shopping plaza
under the MOU. Another week
went by, and the board issued a
30-days notice letter informing
the city of its intent to terminate
the MOU. The city has continued
overseeing the construction and
permiting for the shopping center,
according to RWQCB.
Kanan Fire that burned 25,000
acres and 230 homes in its twoand-a-half
hour push from Ladyface
Mountain to Broad Beach.
The threat from Sesnon kept
local fire crews on alert. County
fire department spokesperson
Maria Grycan said Malibu had received
augmented staffing as soon
as Santa Anas were forecast.
An additional strike team was
staged at Pepperdine University,
another in Agoura Hills, which
could have been in the path of a
southwest-moving Sesnon Fire,
as well as one at Camp 8.
A fourth firefighter was assigned
to Malibu Stations 70, 72
and 99 to assure added personnel
if the crews were called out. Grycan
said patrols staffed with a
captain and a firefighter reconnoitered
the coastal area on Monday
when the danger was most acute.
Local residents were urged by
county officials to monitor news
reports on the fire and be prepared
to take appropriate action if fire
lines began to travel down traditional
paths through the Santa
Monicas to the ocean.
Although the Marek Fire in the
East Valley posed no evident danger
to the local coast before its
near containment, it was a classic
example of a wind-driven blaze
that took its toll before firefighters
could meet it head on. One fire
official at the scene said, “Wind is
ON ALERT—Santa Ana winds registering over 80 mph in some
areas meant local firefighters, including the crew at Station 99 at
The twin blazes, the first conflagrations
of Southern California’s
autumn wildfire season, were the
largest of several that erupted across
the state this week, burning
over 27,000 acres from San Diego
County to San Francisco Bay.
Malibu’s most devastating
blaze last year, the Corral Fire,
occurred in November, and many
of the scars are still healing.
Local wildfires used to occur
once every five or six years, even
as far apart as a decade or more.
They now are becoming multiple
annual events in the Southland.
Malibu and other fire-prone
areas desperately need rain, but
most long-range forecasts are
grim. Add the drought conditions
to the increased frequency of
Santa Ana winds, and there is the
formula for repeat performances
of a drama that no one wants to
watch, let alone try to withstand.
City Finances Subject to Nation’s Volatility
■ Council Members to Consider Halting Optional Studies
While Malibu city officials
questioned whether the
taxpayers’ money was
safe and secure given the financial
news of the past few weeks,
Councilmember Sharon Barovsky
called on the council to consider
halting spending money on
discretionary studies until revenue
from the Lumber Yard
shopping center is collected.
“We are committed to so many
future projects. I would like to
talk about holding in abeyance
all discretionary studies until the
lumber yard is opened,” said
Barovsky, who got council members
to agree to put the matter on
the next agenda for discussion.
Since the city depends on
much of its revenue from property
tax and given the volatile markets
including real estate, according
to Barovsky, that steady revenue
stream could suddenly drop
if payments decline in some kind
of dramatic fashion because of a
reduction in property values.
Monday night’s council meeting. Loo grew up in Malibu and
attended local schools. Urging yes votes for Loo are Andy Stern,
Earlier, council members had
called on Reva Feldman, the
city’s administrative services
director, for a briefing on the status
of the municipality’s money
in terms of what kind of financial
shape the city is in.
“We are in pretty good shape,”
replied Feldman, who explained
that the city banks with Bank of
Special Ed Program Celebrates Proactive Approach
■ Foundation’s First Back-to-School Night Brings Parents, Teachers and Staff Together
Parents of special education
students had an opportunity
to meet each other and visit
with school administrators, special
education teachers and support
staff at the Malibu Special
Education Foundation’s first backto-school
night. The foundation,
established in 2002, helps fund
programs for children with disabilities
and their parents and teachers
in Malibu and Santa Monica.
At the event, packets of information
were handed out, parents were
encouraged to join the organization’s
parent support group, and
tables were laden with special education
resources. MSEF members
were on hand to answer questions,
together with an assortment of district
officials and guests, including
Interim Superintendent Tim
Cuneo, Director of Special Education
Ruth Valadez, board of education
members Kathy Wisnicki
and Maria Leon-Vazquez, and
board candidate Ben Allen.
A dinner, served al fresco in the
quad at Malibu High School, was
followed by speeches in the library,
delivered to a standingroom-only
crowd. Teachers and
staff were greeted with cheers and
applause in an evening punctuated
with tears and laughter.
“You are part of what makes
Malibu Special Education so wonderful,”
special education activist
and MSEF board member Laureen
Sills told the audience. “It’s the
gem of the district, and I’m honored
and proud to be part of this.”
Tim Cuneo, the district’s interim
superintendent, had praise for the
program, which he described as a
wonderful model. “We are going
to be capturing many things you
are doing here,” he said. “We really
want to carefully look at the programs
we’re offering and the way
in which we are doing our business
and continue to improve our program.
We’re looking at many of
the things you have here. We’ll be
studying the entire special education
program in our district.”
Cuneo also had praise for the
parents. “What is really very
unique are the parents who work
with us together to do what’s best
for our children. Thank you for
that. We will make sure to work
very closely with you to make sure
we deliver what’s best for all our
children. It’s so important to have
that kind of commitment.”
Ruth Valadez, the districts special
education director, also
expressed appreciation to the
Malibu community and the MSEF
parents for their support. She
announced that, thanks to MSEF,
Cabrillo Elementary school will
the opportunity to review the
district’s new special education
handbook, which was developed
in response to last year’s special
education report and subsequent
controversy.
“We’re a room of problem
Juliette Boewe. “This is what
works, all of us here tonight. For
those of you at the elementary and
you, and let you know this is
your home in a few years. You’re
going to be here with us and we’re
so excited to be part of the education
of your children. It’s a journey
for all of us.”
Board of education member
Kathy Wisnicki called MSEF “a
true example of equality for all. “I
have sat with you for the past four
years and really listened to parents
stories, listened to parents shedding
tears over sometimes how difficult
things can be and knowing
that you come together and support
each other. You struggle, but
you also share in your joy. I think
that’s why we end up with a positive
outcome. Parents have been in
there not only with resources
financially but with a personal
commitment of time.”
“We want to make sure ever
child who needs help receives it,”
said Point Dume Elementary
FIRE FLIGHT
Editor:
It seems to me that Malibu tends to be reactive, instead of
proactive when it comes to the yearly fires. After the Corral
fire in ’07, my friend Tim Harvey took the time to investigate
what it would cost to have an aircraft flown during red
flag and Santa Ana conditions.
The entire cost for the 24/7 surveillance would break
down to approximately $200 an hour. When we see the devastation
to our community members, it doesn’t seem so
prohibitively expensive, does it?
Perhaps our mayor or city council should make this happen.
Is there a “good Samaritan” out there that would
want to take this on?
Does anyone else feel we in Malibu should be more proactive
when it comes to these yearly dangerous fire seasons?
If there is anyone out there that feels this is important
please contact our mayor, as this has been proposed but
nothing has moved on it.
Editor:
I am thoroughly disgusted by the political advertisement
“Yes on 8” featuring Pepperdine Professor Richard Peterson.
What a sad commentary on Pepperdine. I realize Pepperdine
is a Christian university, but I have been the
employer of many babysitters over the years from Pepperdine
and my favorite “mannies” were gay and struggled
incredibly with their Christian upbringing and the “reality”
of their genetics. I held their hands as they came to terms
with who they were as people and accepted the fact that
they could still love the Lord and be gay.
I know that there are some (I’ve heard many) gay students
at Pepperdine, and I shudder to think of what kind of
message this professor’s right wing tirade will send to these
young students. I shudder to think of the message these ads
send to my kids who have grown to know gay students
from Pepperdine and accept them without question. It was
a great life lesson for my teenagers as they became aware
of the societal taboo one of their favorite sitters had to
endure. My teenagers and their surfer dude friends learned
to really like our gay sitters and will walk through the rest
of their lives without the burden of intolerance fostered by
ignorance.
I called the university president’s office to voice my
complaints and received an email with a press release stating
that Pepperdine doesn’t endorse this professor’s comments
and had succeeded in getting the commercial producers
FARM FIX
Editor:
I am pleased to see that Proposition 2 has opened up for
discussion the treatment of farm animals, especially those in
factory farms now owned by a handful of multinational corporations.
The animals are now treated as commodities
rather than living things. We must stop this inhumane and
unhealthy system currently in place from conception to
slaughterhouse. In doing so, we also save ourselves.
Factory farm animals have altered genetic makeups (similar
to inbreeding). These mono-breeding programs that escalate
growth and milk and egg production take their toll,
putting animals under great stress and pain (e.g. brittle
bones, painful udders), pushing animals to their limits.
(Letters are continued on page 15)
You know the Santa
Anas are going to be
bad when you can’t
stay on your feet
during the gusts!
Publisher’s NOTEBOOK
Firefighters know that the wind rules. The courageous
and skilled men and women who fly the aircraft
and walk the fire lines know that nature decides
the destiny of the infernos that ever more frequently
remind us of our fragile hold on the environment
in which we dwell. The Malibu autumn
mantra has always been a variant of “If it’s October,
the Santa Ana winds will blow; if the Santa Anas
blow, sparks will fly; if sparks fly, wildfire will follow.”
This is now a year-round litany, as climate
change spurs the state’s drought conditions and
intensive development in the wildland interface
makes fire control increasingly problematic.
However, even the most negligible incidents can
illustrate the wind’s power. In what is now second
nature during Santa Anas, I was out Sunday night
and pre-dawn on Monday clocking winds that
ranged from 25 to 60 mph. When I arrived at the
newspaper offices early Monday morning, my trusty
pocket weather tracker and wind meter registered
gusts in back of the building at 70 mph. The wind
was strong, but I’ve held my ground in comparable
conditions before. I have clocked gale force blasts of
84 mph in the mountains from the safety of my car.
But I was caught off guard when I turned the corner
of the building. As I reached for the door knob,
a gale force blast of at least 78 to 80 mph knocked
me to the ground. The wind meter landed at my
side, and only swift reflexes kept it from being
blown away. The two sacks of market supplies I
was bringing to the office had been snatched from
my left hand, and the bags and their contents were
scattered across the parking lot. Some of them were
never recovered. The assumption is they were carried
over adjacent fences, never to be seen again.
Still sitting on the ground, I turned my back to the
You think that’s bad!
What is it about the
plumes of smoke and
raining ash that you
don’t understand?
It’s All about the Wind Wind
wind and tried to stand. The wind was just too
strong. I would start to get up, only to be buffeted
again. Fortunately, at that point, a colleague rounded
the corner and got help. They provided a wind
shield and assistance. After determining that the
worst of the damage was a sore shoulder, a scraped
knee, and an aubergine bruise the size of a soccer
ball, the realization sunk in that the removal of a
huge old tree and shoulder-high hedges to facilitate
construction below the building had transformed the
terminus of the Kanan Dume Road wind tunnel into
a vortex. When one of the fire officials said this
week, “Wind is king,” I humbly concurred.
The city agreed to build a
after buying the Chili Cook-
the impression it thought
that would become what
wastewater disposal, if the
city was going to use it for a
stormwater storage facility
and the city moved forward
with stormwater treatment
at that location.
The wastewater component
got put on hold while
the city worked on lumber
yard septic issues.
Then the city decided to
discharge lumber yard effluent
at Legacy Park and that
led to further scrutiny by the
RWQCB.
City officials originally
thought they had an agreement
with RWQCB officials
that if they did a $500,000
the city complained that the
shopping center would not
open as planned in October
2008. That is when the city
reaffirmed it was going to
issue a permit for the shopping
Now the regional board
staff says it found that the
“assimilative capacity of the
Civic Center area is already
exceeded under certain conditions.
The existing onsite
wastewater treatment commercial
system in the Civic
fail to adequately treat the
The tentative resolution
states the city has failed to
impose and enforce the
board’s requirements on
several different counts and
the MOU could be terminated
without immediate renegotiation,
will be required to apply for
and may be subject to enforcement
action if their
effluent does not meet water
quality objectives, if they
did not previously receive a
the permit provided by the
city does not meet regional
Commission is scheduled
to hold a public hearing on
the final plans and documents
for Trancas Canyon
Park at its meeting on
Tuesday, Nov. 4.
The planning panel will
consider the final Environmental
Impact Report,
coastal permit, conditional
use permit and other entitlements
for the public park,
which includes a multi-use
sport field, picnic area, tot
lot, dog park, onsite wastewater
treatment system and
grading in excess of 1000
cubic yards on about 13
acres located along Trancas
Canyon Road.
Next week, the council is
scheduled to consider an
amendment to the consultants'
contract for another
Loan Bank is set to mature
on April 2, 2009 and will
yield three percent. The
second investment of $2
million with the FHLB is
set to mature on June 24,
2009 and will also yield
three percent.
Feldman indicated that
while those investments are
not collateralized, “it is
implied that the FHLB is
backed by the federal government
and the risk of loss
is minimal.”
The majority of the city’s
funds are held at LAIF,
which is part of the state’s
pooled money investment
account. As of Sept. 30,
2008 the balance of city
funds at LAIF was
$19,817,803. The yield is
2.779 percent.
In a staff report to subcommittee
members, Feld-
$85,000 for a total of
$307,000.
The proposal got bogged
down in controversy when
neighbors battled organized
sports enthusiasts on
the kind of sports fields
and uses that should be
considered for the community
park.
Sports proponents wanted
more than practice
fields and demanded that
the amount of money being
spent on the park warranted
such use.
Nearby homeowners
especially in Malibu West
where the proposed park is
located said the extra burden
of more traffic and
more intensive use would
cause them to oppose the
park altogether.
how PMIA money is
invested by the state treasurer.
The PMIA portfolio
consists of loans, commercial
paper, time deposits,
CDs, mortgages and treasuries.
Councilmember John
Sibert, who sits on the
council’s Administrative
and Finance Subcommittee
with Barovsky, said, “Still
there is a lot of uncertainty.
True, we don’t depend on
sales taxes from big box
stores.”
RWQCB INVITE
The council agreed unanimously
to form a stormwater
and wastewater ad
hoc committee comprised
of Sibert and Barovsky to
make overtures to the
Regional Water Quality
Control Board.
Planning Commission to Air
Trancas Canyon Park Plans
the fight on several occasions
and entered the fray
directly when its Parks and
Recreation Commission
voted by a slim margin to
recommend placing no
restrictions on the kinds of
sports play allowed.
Municipal officials were
accused of going back on
their word and a truce of
sorts was informally brokered
when a majority of
council members reassured
park neighbors the playing
field would remain for
practice only.
BY BILL KOENEKER
Mayor Pamela Conley
Ulich, who brought the
matter before the council,
said at various municipal
meetings some staffers suggested
that city officials
collaborate with them.
“I requested a meeting
with board members, but
the executive officer Tracy
Egoscue said I could not
speak to them because of
ex parte communication
rules,” she said.
The mayor indicated she
thought it might facilitate
matters to form an ad hoc
committee to try to deal
with the matter.
The city and RWQCB
have been at odds lately,
and the state agency is considering
rescinding a memo
of understanding with the
city about oversight of discharge
permits. Currently,
Once again the ocean
waters where Solstice Creek
empties into the Pacific
scored a flunking grade on
Heal the Bay's weekly
beach report card, when it
garnered a D grade.
While almost all of the
rest of the Malibu coastline
was awarded A plus or A
grades, the new hot spot of
pollution seems to be
where the stream water
from Solstice Canyon
pours out at Dan Blocker
County Beach. For the past
several weeks, the outlet
has been getting flunking
grades.
City council members
and others have hinted the
arrival of Egoscue, formerly
the head of Santa Monica
Baykeeper, has helped create
a rocky relationship with
the board given her previous
advocacy position.
APOLOGY
Councilmember Jefferson
Wagner said he wanted
to apologize to any one
who might have taken
offense at a remark he
made that was recently
published in a local newspaper.
After what many considered
a grueling city council
hearing, Wagner told reporters,
“Tonight was just like
any advisories,” said a Los
Angeles County lifeguard,
in response to queries
about the fouled water.
He added by way of a
possible explanation. “We
have had a number of high
tides coupled with waves
and that can sometimes
wreak havoc on septic systems,”
he said.
Solstice is one of the few
streams that run year
round, even in drought
years, while most coastal
creeks are dried up by now,
much like Corral Creek
just down the beach from
the Solstice Creek outlet.
The only other location
Wagner now says the comment
was made in jest. “I
said it as humor,” he told
his colleagues and others
this week.
Tammany Hall is the
popular term for the historic
influence the Democratic
Party political machine
had in dominating
New York City politics in
the late 19th and early 20th
centuries. The expression is
sometimes used as a
derogatory term.
Barovsky said, with
laughter, the mayor did not
even know who or what it
was. “I thought you meant
me. I’m the only one that
smokes,” she quipped,
referring to the smokefilled
back rooms of Tammany
Hall.
OBITUARY
Arthur London
Arthur London,
longtime Malibu resident,
passed away
on September 26,
three days before his
82nd birthday. He
moved to Malibu in
1968 and soon became
a passionate
activist, working to
protect Malibu’s natural
environment and
rural character.
Art later met his
beloved wife, Lois,
in 1972 after a mutual friend brought them
together as tennis partners. Since then, the two
frequented Pasquale’s Jazz Club on the beach
almost every week until it closed, played tennis,
attended theater, jazz and cultural events
continually and traveled the world. Art saw
their cherished home on Carbon Mesa
threatened by wildfires several times, until it
was finally lost in the Malibu fire of 1993. Never
one to give up on Malibu, he rented several
properties until finally buying a beautiful home
high up Las Flores Canyon where he and Lois
lived for the past 13 years.
A professional attorney since graduating from
Harvard Law School, Art worked tirelessly for
Malibu. In the pre-cityhood days, he opposed
Caltrans proposed expansion of PCH to the
current four lane highway and opposed L.A.
County attempts to impose sewers on Malibu.
He actively supported Malibu cityhood campaigns
as a member of MTC and MCI. Once
Malibu became a city, his many volunteer
activities included active roles as a member of
the Transportation and Natural Resources
Study Groups, Single Family Building Criteria
Task Force and General Plan Task Force (Land
Use, Conservation, Open Space and Recreation
and Safety and Health Sub-Committees).
Born in Los Angeles to Russian immigrant
parents in 1926, and raised in the Boyle Heights
district, Art remembered seeing movies in the
spectacular movie palaces on Broadway for a
quarter and taking the Red Line cable car all
the way to Venice Beach. He graduated with
a B.S. in Chemical Engineering from the
University of Illinois in 1949 and received his
law degree from Harvard Law School in 1952.
He is survived by his loving wife, Lois London,
son Stephen London, daughters Hildy Gal and
Susan London, step-daughters Cheryl Yaney
and Marina Yaney and eleven grandchildren.

CHAMPS—For the second year in a row, Pepperdine women won both the
PCSC swimming and diving relay meet at the PSCSC Pentathlon meet. The
team’s coach Nick Rodionoff has singled out three swimmers Dani Kimmel,
Haley Wilson and Kayleen Hicks, all pictured above, for their performances.
Of the scoring teams, Pepperdine placed first in fourth meet, second in
seven, third in four, fourth in three, sixth in two, eighth in three and ninth in
Planning Panel
residents’ opposition, now
told the commission the
current arrangement could
be supported. Other beachfront
residents agreed.
There was reluctance on
the part of some commissioners.
“I am envisioning
a future where the
wealthiest on Carbon Beach
are wall to wall and everything
else is torn down. We
will start losing the less
magnificent portion and end
up with a Chinese wall,”
said Commissioner Jeff Jennings.
“It is like the billionaires
against the millionaires.”
Commissioner John
Mazza, who acknowledged
Morton’s generosity, said
he wanted to narrow down
the scope of the LCPA so
that it would be considered
special or unusual circumstances.
Mazza said he could
support the request by
placing restrictions, requirements
and conditions
on the permit, including
that the property to be used
for a view corridor must be
adjacent to public land.
House said she was
clear what happened most
recently.
That location for a good
part of the summertime had
been given Ds or Fs because
the stormwater treatment
plant was not working.
Other hotspots got good
grades, such as Surfrider
Beach at the Colony fence,
which garnered an A plus
hesitant about the matter
and questioned why the
view corridor requirement
and other conditions imposed
by the Coastal Commission
were not met.
Morton was also seeking
an after-the-fact permit for
an as-built, front yard, solid
concrete wall topped with
wood screen and two side
yard gates and modifications
to the previously
approved landscape plan.
House ultimately voted
against the commission’s
resolution despite the many
conditions placed on the
application.
“I see it as a stand-alone
LCP amendment without
your name on it. It is
tainted. If the intention is
good government, it might
not be the lot you provided,”
House said.
In other action, the
commission approved an
application for a conditional
use permit to allow
the re-opening of the preexisting,
1639-square-foot
gasoline service station and
convenience market located
at the corner of Pacific
Coast Highway and Webb
grade and Surfrider Beach
at the breach location
where an A grade was
awarded. The berm has not
been breached and consequently
no lagoon or creek
water has entered the ocean
for several months leading
to the improved grades.
All other locations where
water is tested for bacteria,
Way. The existing station,
which was built in 1957,
halted operations over two
years ago. Ben Poulder, of
Malibu Petroleum, Inc. the
applicant, who was not
able to prove that a CUP
had ever been issued,
sought the entitlements.
No new development is
proposed. Previously, 12
gasoline pumps operated
onsite under a 16-foot high
canopy along with a 358square-foot
convenience
market with two public
restrooms and three service
bays.
Plans call for operating
the market and gasoline
pumps 24 hours a day,
seven days a week. The
service bays will operate
between the hours of 7 a.m.
and 6 p.m., Monday
through Saturday.
A majority of the commission
also agreed to
schedule a full hearing for
a new wastewater system
for Malibu Country Mart
instead of allowing it to
proceed as an administrative
permit which
requires no hearing.
Repaving to Start
Malibu City officials have
announced that the repair
and overlay work planned
for Broad Beach Road is
scheduled to begin this
week. Streets to be impacted
include Broad Beach Road,
Bunnie Lane and Cottontail
Lane. One lane of traffic will
be open at all times, according
to municipal officials,
who noted that delays
of up to 30 minutes could be
encountered. Work on the
project will take place
Monday through Friday
from 7 a.m. to 4 p.m. The
estimated time of completion
is about 60-75 days.
The construction contract
for the repaving project went
to Security Paving Company.
The contract is worth a
little more than $400,000.
The project had been
delayed because municipal
officials wanted the upgrades
to the existing water line in
Broad Beach Road completed.
The water line project
was done in May 2008. The
contract calls for an asphaltrubber
hot mix paving
material which adds an
additional cost of $53,010.
The project involves removing
the existing pavement
surface and overlaying it with
the new pavement material.
After three years of development
by their website
development team, MalibuYokel
combines an
interactive forum for business,
real estate, and the
community. “MalibuYokel
was developed to provide a
modern approach for residents
and visitors to find
information and communicate
with each other,” says
Ken Fasola, president of
LokalYokel, LLC. “It’s
quick to use, entertaining,
and always relevant to the
community.”
Articles and information
are constantly changing,
and the users of MalibuYokel
supply much of
the information. “It’s de-
signed to be very participatory
and will keep growing
as people use it more,” says
Ashley Brauer, Director of
Development. Since its
launch in August, the site
has already landed more
than 12,000 visits. “Users
can locate any business in
Malibu, read articles, find
real estate, participate in
contests, post classifieds
and events, and find ‘Lokal
to use.”
MalibuYokel is the first of
a series of community websites
umbrella. Coming soon will
be Yokels in Calabasas,
These same factory farms cause huge amounts of pollution
due to overcrowding, claustrophobic and foul-smelling
conditions. One hog can produce as much waste as eight
people, yet these premises are not required to have sewage
treatment facilities. This waste pollutes water systems,
killing fish and wildlife. Also, what has been found in analyzed
feed samples for many factory farm animals is noxious,
including blood meal, hydrolyzed feather meal, animal
hair, chemicals, cardboard, candy, dried poultry
manure and cattle manure.
Although Proposition 2 is not perfectly written, it is a
start. I would also demand that more legislation be added
later so that any out-of-state food brought into California
would be certified with the same standards as outlined in
Proposition 2. Furthermore, any chemicals, drugs, hormones
or compounds given to animals and humans should
be considered toxic until proven safe—not the other way
around.
The consequences of doing nothing are staggering. This
is not just a humane issue, this is also a threat to human
safety. Therefore, we must not only vote yes on Proposition
2, but follow up as described above.
Editor:
We are members of the Measure BB site committee at
Malibu High School. We have been working hard to ensure
that the Measure BB facility funds are spent appropriately
and in a timely manner at our high school.
It has been a long process and began 5 years ago as our
school district worked to create a long range Facilities Master
Plan for our community. Stakeholders from all segments
of our community gave valuable input during those sessions
to create a dynamic, forward looking vision for our schools.
We are excited to finally see the outcome of all the hard
work. Thanks must be passed around our community for its
support of the groundbreaking Measure BB that has allowed
the Master Plan to begin to be implemented at Malibu High,
a school recently recognized as a top-100 school in the country.
A new library with attached administration offices, middle
school science labs and classrooms and sports facilitieswill
only improve our strong programs. Intensive work
and communication regarding traffic and parking have
resulted in plans that will dramatically improve the traffic
flow around our school.
Our staff has designed a facility that uses sustainable
design that lessens impacts to the neighborhood and promotes
green building standards. Overall, the planning process
always welcomes input from community members. We feel
it is our function as members of the BB committee to ensure
that accurate information is disseminated to all neighbors and
stakeholders who will surely benefit from having a community
friendly public school in their neighborhood.
We welcome input and suggestions and rely on valuable
help. Quality schools have a positive impact on the community
and Malibu High School is on its way to becoming the
world class facility that Malibu needs and deserves.
OBITUARY
Esther Catherine Lowry
March 31, 1920 - October
13, 2008. A fifty-four year
resident of Point Dume,
Esther Lowry passed
away quietly in the
morning hours of October
13. In her final days, she
was surrounded by family
from California, Michigan
and Canada.
The youngest of three
children, Lowry was born
and raised in Winnipeg, Manitoba, Canada. Single and
enamored of a co-worker who had moved to Santa
Monica, she took a risk and decided to give California
a try. Her risk blossomed into a 37-year marriage to
Harry Lowry. They purchased land and built their
dream home on Point Dume.
Lowry was a founding member of the Malibu
Methodist Church and taught Sunday school. Initially,
church services were held in the Lowry home.
Lowry was an active member of the Malibu Garden
Club and a former president.
A generous woman to strangers as well as those
she knew and loved, Lowry was a foster parent
and worked with youth both here in the U.S. and
abroad. She loved Malibu, her garden, and a
menagerie of animals that kept her busy and
young-at-heart.
Lowry is survived by a large family and many
friends. She was predeceased by her husband
Harry, and son Gilbert. Esther will be missed by
many.
Lowry’s relatives are grateful to Doug and his
family, also Cathy and Carol for their loving care
and support.
A memorial service and celebration of Esther
Lowry’s life will be held at the Malibu United
Methodist Church on Thursday, October 16, at 2 p.m.
A reception will follow in the church hall. In lieu of
flowers, please make donations to the Humane
Society of the U.S.
Saturn/Uranus Opposition, Part
Four: The Saturn/Uranus opposition
continues to tighten its grip,
and daily life continues to feel surreal—
and for good reason. We’re in one of
those life-changing phases of human
history where individual reality, as well
as collective reality, is busy being born.
And while many of us feel powerless
before the constant shifts and ceaseless
tumult, we actually aren’t without the
tools to handle this crisis. Yet using
those tools wisely means first being clear about what’s dying and
then, surrendering the need to resurrect the past. Clinging to life as
it once was won’t work. Neither will unrealistic expectations about
the future, which are, if you’re willing to look closely, mostly
another way of holding on to the past. Times like these, times
potent with power of change, require staying grounded in the now.
One of the best ways to do that is to be a spiritual warrior, an
approach that assumes consciousness, courage, common sense,
compassion, and honesty as guiding lights of behavior at all times,
not just in times of crisis. Each of us is experiencing this opposition
The PUZZLE
ing on a personal point. Saturn, at 18 degrees Virgo, or Uranus, at
18 degrees Pisces, may exactly conjunct someone’s Sun, Moon,
ascendant, or other planet in their birth chart. Many of us are
encountering the opposition as part of a generational shift. For
example, those born in September/October 1920, or April-July
1921, November/December 1949, January/February 1950, August
1950, or September/October 1979 are all having this opposition as
part of a Saturn return. Saturn returns signify a time of taking stock,
which means those people currently in the midst of a Saturn return
are going to take that inventory as part of an already intense process
of evaluation. The generation born during the 1965-1967
Saturn/Uranus opposition series will feel the current opposition
quite keenly given that many of those people have a Saturn/Uranus
opposition in their birth charts. Be aware, during the last
Saturn/Uranus opposition series, their positions were reversed; Saturn
was in Pisces and Uranus was in Virgo, conjunct Pluto, also in
Virgo, which from an astrological perspective was another reason
why the world turned upside down. Not everyone born during that
period had the Saturn/Uranus opposition at 18 degrees Virgo or
Pisces, only those born at the end of February or the beginning of
March 1966. But even though the other previous oppositions didn’t
occur at the same degree as the first opposition of the current series,
10/16/08
a deep resonance will be triggered in all those birth charts. What’s
more, people born between October-December 1965, January-
March 1966, and August/September 1966, are experiencing the
current Saturn/Uranus opposition as part of their astro-midlife crisis,
a time when transiting Uranus opposes its natal position, triggering
realizations about the passage of time—no longer young and
not yet old—that tend to inspire dramatic changes. While there’s
more generational information, there’s no room in this column to
cover it all. So we will pick it up next week. Until then, be thankful
Mercury is Direct, and most importantly, be as kind to your fellow
travelers as possible. Lots of us are in great need of a kindness.
If you know your ascendant and/or your moon sign, read that too.
Aries (March 21-April l9): Despite the erratic economic environment,
your finances are stabilizing. Whether that’s from discipline
or determination, it doesn’t matter. What does matter, is that you
are prospering.
Taurus (April 20-May 20): It’s crucial for you to believe in yourself,
so rather than devolving into doubt, trust your decisions. And
don’t worry about mistakes—if you’re wrong, correct the situation,
and move on.
Gemini (May 21-June 21): You’re stretched beyond your capabilities
and adding anything else to the list will simply overload your
system and cause a meltdown. Take a break, give yourself some
much need rest, and you’ll restore your reserves.
Cancer (June 22-July 22): Positive, uplifting interactions with
friends offer relief from an otherwise packed work schedule, so
don’t put off having fun for later. All those responsibilities will be
right where you left them.
Leo (July 23-August 22): The pace of daily life increases exponentially,
so don’t put off until tomorrow what you should have done
yesterday. But also don’t worry—simply find a comfortable personal
pace and maintain your stride.
Virgo (August 23-September 22): Keep your head, as well as your
cool, and you’ll have an easier time handing most situations.
Remember, in times of trouble, a gentle touch and kind attitude will
facilitate a much better response than harsh words.
Libra (September 23-October 22): Allow your inner composure to
inform your words and deeds, as well as you thoughts, and you’ll
engender cooperation. Creating a positive environment will generate
positive, long-term results.
Scorpio (October 23-November 21): Try not to let intense interactions
with partners, personal or professional, throw you off course.
The brouhaha will pass with time and clear communication will be
restored.
Sagittarius (November 22-December 21): Staying optimistic in the
midst of so much turmoil takes a special effort even when optimism
is your strong suit. So rather than despair, rely on your innately positive
attitude, and you will emerge victorious.
Capricorn (December 22-January 19): Take advantage of every
opportunity to extend a helping hand to those in need, and you’ll
not only put positive energy in motion, you’ll also have a dramatic
impact on your immediate surroundings.
Aquarius (January 20-February 18): Avoid disputes over petty
details, and instead concentrate on prioritizing your time and energy.
There is more to do than you can possibly imagine, and you’ll
need all your energy to handle the load.
Pisces (February 19-March 20): Positive interactions with friends,
family, and partners (personal and professional) bolster your spirit.
So rather than brood about the future, keep yourself firmly planted
in the present.
Exotic Spurge Plant Has Become a Scourge
■ Homeowners and Gardeners Are Urged to Eradicate It
It may seem like a lovely
plant to some—colorful
lime green leaves with red
stems and a delicate flower
that is cupped within the
leaf.
However, native plant
enthusiasts and others have
nothing but bad things to
say about the plant called
terracina spurge, which
they call one of the newest
problem plants of Southern
California.
Recently, a brochure was
sent to many residents asking
homeowners and gardeners
to help stop the
invasive plants from sprea
Officially called Euphorbia
terracina, the exotic
specimen in the past several
years has been very
prominent in Malibu.
Spurge seems to know
no boundaries. It has been
observed in numerous locations
on National Park Service
and State Park holdings.
The toxic invader
from Europe has been
established in Malibu and
various other coastal and
inland areas. The plant’s
worst habit, among many,
according to native plant
experts, is its ability to
establish dense stands in
the landscape excluding
native plants and causing a
potential public health hazard.
Terracina is cited as a
public health hazard because
it is said to cause a
number of problems for
humans, including a toxic
milky sap that can cause
temporary blindness. Contact
with its leaves and
stems can cause a poisonoak
like reaction in susceptible
individuals.
Experts say the toxic
exotic offers poor forage
and inferior habitats for
animals such as deer, rabbits
and birds. Its ability to
eliminate all other vegetation
also poses problems.
Spurge makes a poor soil
stabilizer, and it can eliminate
the native plants that
do help mitigate erosion
problems.
There are other spurges
that can be found in the
garden and there are native
spurges that can cause less
How Windy Was It in Malibu?
GALE FORCE—Wind gusts estimated above 70 miles an hour raked the
Trancas Canyon area Monday, coating cars with ashes from combustion
at Oat Mountain, 25 miles away. This old pine tree toppled, uprooting a
fence but missing two houses. MSN/Hans Laetz
NOXIOUS NEIGHBOR—Plant experts say this toxic exotic specimen has
overrun parkland and other areas of Malibu and can represent a health
threat to humans because of a sap that can irritate, much like poison oak.
It also represents a threat to native plants and wildlife because it tends to
crowd out vegetation and makes a poor habitat for animals.
of a problem than the terracina,
according to experts.
One can separate a Terracina
spurge from other
spurges based on its size of
one to three feet and the
small serrations on its leaf
edge, which look like the
serrated edge of a steak
knife.
Native plant enthusiasts
are calling for Malibuites
to help eliminate the weed
and say there are various
methods of removing the
pest. When the soil is soft,
plants can be yanked out
of the ground by hand.
Make sure to wear gloves
and a long-sleeved shirt.
Experts explain that plants
will not re-sprout as long as
the top three inches of the
root are removed. Plants can
also be eliminated by spray-
ing with a general herbicide,
although many gardeners are
hesitant to do so.
Terracina has a large
seedbank, with seeds lasting
in the soil for three to
five years, according to the
experts. Seed germination
can by prevented by applying
thick mulch on the
ground or by using landscape
cloth.
RE Spotlight
Coldwell Banker Launches National 10-Day Sales Event
Coldwell Banker Residential Brokerage has announced “an
innovative home sales event designed to bring homebuyers
and sellers together that may help jump-start the U.S. real
estate market,” a press release stated.
“The nation’s oldest residential real estate brand will kick-off
its first-ever national ‘10-Day Sales Event’—during which participating
home sellers from across the United States will reduce
the listing prices of their homes that may help jump-start the
U.S. real estate market.” The Coldwell Banker 10-Day Sales
Event will run nationally through Oct. 19, 2008.
“Here in Los Angeles, the 10-Day Sales Event is especially
timely. Our participating home sellers feel that a home
priced properly to sell will generate much more interest,”
said Betty Graham, president and COO of Coldwell Banker
Residential Brokerage Greater Los Angeles. “Plus, we’re
hearing loud and clear from many of our sellers that they’re
comfortable with lowering their listing prices if it means getting
offers and selling quickly.”
Graham states that participating sellers who have listed
their home with Coldwell Banker Residential Brokerage in
Los Angeles will drop their listing price by 10 percent or
more during the 10-Day Sales Event.
“Despite the difficult headlines regarding our overall economy,
the residential real estate market has been showing several
positive signs over recent months” said Graham.
“Because of higher inventory, buyers have more homes to
choose from and they can take advantage of near historically
low interest rates and affordability levels that are the best
they have been in years. The recent housing and economic
recovery legislation also provides first-time homebuyers with
the added incentive of a $7500 tax credit.”
Jim Gillespie, president and chief executive officer of Coldwell
Banker Real Estate LLC said, “our research and discussions
with our brokers and sales associates show that in many
markets sellers remain reluctant to list their homes at the proper
prices necessary to attract buyers. It’s our hope that the Coldwell
Banker 10-Day Sales Event will move buyers off the sidelines
and into the market. We are embarking on this initiative—
which has never been done before on a national basis—
because we believe it is critical for Coldwell Banker, as an
industry leader, to help serve the needs of those individuals listing
homes with a Coldwell Banker broker and to help move the
U.S. real estate market in the right direction.”
Gillespie said that in a recent survey of 3379 Coldwell
Banker real estate professionals in markets across the United
States, 56 percent said that listing prices in their market
remain above where they need to be to attract qualified buyers.
Additional findings from the survey include:
• 77 percent agreed that the majority of sellers in their
market still have unrealistic expectations regarding the initial
listing price for their homes.
• 79 percent agreed that homes in their market that are
priced appropriately are attracting more buyers and moving
more quickly.
• 76 percent feel that a 10 percent or less reduction in listing
prices in their area is all it will take to help push these
NEWLY PRICED NEWLY PRICED NEWLY PRICED
homes over the “tipping point” to a sale.
“Our brokers and sales associates agreed that, even in the
current climate, it will not take much movement to attract
those buyers who have been watching and waiting,” said
Gillespie. “Depending on the market, a price reduction of
just 10 percent or less just may make the difference in both
satisfying sellers and bringing buyers to the table.”
“Sellers participating in the 10-Day Sales Event will have
added promotional power from the Coldwell Banker brand
behind their listing. Those sellers’ listings will be specially promoted
through national and local radio, print and Web advertising.
The brand’s flagship Web site, coldwellbanker.com, will
feature participating listings. Home sellers will have the option
to maintain the reduced listing price for their properties following
the 10-Day Sales Event.”
Most of the Coldwell Banker Greater L.A. participating
listings are in these areas:
• Santa Barbara
• Ventura
• South Bay, e.g. Marina Del Rey
• North San Fernando Valley, e.g. Calabasas, Westlake
STARS of the WEEK
“ Dale ”
“ Misty ”
“ Brandy ”
My name is Dale. I am a little twoyear-old
Jack Russell terrier, only
15 pounds. Dale came to the shelter
with his best buddy Chip, but
Chip got adopted so poor Dale is
all alone. His heart is broken. Dale
is tons of fun, loves to play and
chase balls. A perfect little walker,
he would love a beach stroll. He’s
used to other dogs, come and
meet Dale, if you have any dogs
bring them, too! Adopt Dale at
#A3800325.
Oh, she is so gorgeous, our sweet
Misty. She is a beautiful nine-yearold
flame point Himalayan mix
with the bluest eyes this side of
Paul Newman. She has a sweet,
docile personality and loves people.
Look her in the eyes, pet her,
love her and she will steal your
heart. No doubt. Likes other cats
but LOVES humans even more.
What a doll. Adopt Missy at adoption
#A3851400.
Look at this sweet face! Brandy is
a young adorable pup, just two
years young. She is a total love
and adores people. Brandy loves
taking walks, playing in the grass
and spending getting as many
belly rubs as she can get. She’s
been here FAR too long, her life is
soon in danger. PLEASE don’t let
that happen. Come and meet
Brandy, she’s just a young pup
and has a whole loving life ahead
of her—if someone will only adopt
her! Adoption #A3848375.
