Waste management<br />

<strong>Greywater</strong> <strong>and</strong> <strong>sewage</strong> <strong>in</strong> <strong>the</strong> <strong>Environmental</strong> <strong>Protection</strong> <strong>Act</strong><br />

This <strong>in</strong>formation sheet outl<strong>in</strong>es <strong>the</strong> relationship between greywater <strong>and</strong> <strong>sewage</strong> <strong>and</strong> how <strong>the</strong> <strong>Environmental</strong> <strong>Protection</strong> <strong>Act</strong><br />

1994 relates to <strong>the</strong> Plumb<strong>in</strong>g <strong>and</strong> Dra<strong>in</strong>age <strong>Act</strong> 2002 <strong>in</strong> deal<strong>in</strong>g with <strong>the</strong>m.<br />

Background<br />

Sewage treatment works with a peak design capacity of 21 equivalent persons or more are licensable as<br />

environmentally relevant activity (ERA) 63 — <strong>sewage</strong> treatment — under schedule 2 of <strong>the</strong> <strong>Environmental</strong><br />

<strong>Protection</strong> Regulation 2008. These <strong>sewage</strong> treatment works will be referred to as ‘ERA 63 STW’.<br />

The Plumb<strong>in</strong>g <strong>and</strong> Dra<strong>in</strong>age <strong>Act</strong> 2002 (PD <strong>Act</strong>) creates a process for regulat<strong>in</strong>g on-site <strong>sewage</strong> facilities (on-site<br />

<strong>sewage</strong> treatment for less than 21 equivalent persons — i.e. <strong>sewage</strong> treatment that is not ERA 63) <strong>and</strong><br />

greywater disposal or use.<br />

Def<strong>in</strong>itions<br />

The PD <strong>Act</strong> conta<strong>in</strong>s <strong>the</strong> follow<strong>in</strong>g def<strong>in</strong>itions:<br />

� <strong>sewage</strong> means household <strong>and</strong> commercial wastewater that conta<strong>in</strong>s, or may conta<strong>in</strong>, faecal, ur<strong>in</strong>ary or<br />

o<strong>the</strong>r human waste<br />

� greywater means wastewater from a bath, bas<strong>in</strong>, kitchen, laundry or shower, whe<strong>the</strong>r or not <strong>the</strong><br />

wastewater is contam<strong>in</strong>ated with human waste<br />

� blackwater means:<br />

a) waste discharged from a human body <strong>in</strong>to a toilet<br />

b) water used for <strong>the</strong> discharge<br />

� sewered area means a service area for a sewerage service under <strong>the</strong> Water <strong>Act</strong> 2000.<br />

Relationship between greywater <strong>and</strong> <strong>sewage</strong><br />

<strong>Greywater</strong> is a component of <strong>sewage</strong>. <strong>Greywater</strong> can be collected <strong>and</strong> disposed of separately to <strong>sewage</strong>. The<br />

PD <strong>Act</strong> makes a dist<strong>in</strong>ction between kitchen greywater (greywater from <strong>the</strong> kitchen or greywater that conta<strong>in</strong>s a<br />

lot of oil) <strong>and</strong> greywater o<strong>the</strong>r than kitchen greywater (OTK greywater).<br />

Under s. 128L of <strong>the</strong> PD <strong>Act</strong>, kitchen greywater must be discharged:<br />

� to sewer <strong>in</strong> a sewered area<br />

� to an onsite sewerage facility, ERA 63 STW or a greywater use facility that <strong>in</strong>cludes a greywater<br />

treatment plant <strong>in</strong> an unsewered area.


Under s. 128M of <strong>the</strong> PD <strong>Act</strong>, OTK greywater can be:<br />

� used untreated on-site for water<strong>in</strong>g of gardens <strong>and</strong> lawns by bucket or hose <strong>in</strong> a sewered or unsewered<br />

area<br />

� discharged to sewer <strong>in</strong> a sewered area<br />

� discharged to a greywater use facility <strong>in</strong> a sewered or unsewered area<br />

or<br />

� discharged to an ERA 63 STW or an on-site sewerage facility <strong>in</strong> an unsewered area.<br />

Under s. 128K of <strong>the</strong> PD <strong>Act</strong>, Blackwater must be discharged:<br />

� to sewer or an on-site sewerage facility approved for test<strong>in</strong>g purposes <strong>in</strong> a sewered area<br />

or<br />

� to an on-site sewerage facility, a dry vault toilet or an ERA 63 STW <strong>in</strong> an unsewered area.<br />

Relationship between <strong>the</strong> <strong>Environmental</strong> <strong>Protection</strong> <strong>Act</strong> 1994 <strong>and</strong> <strong>the</strong> Plumb<strong>in</strong>g <strong>and</strong><br />

Dra<strong>in</strong>age <strong>Act</strong> 2002<br />

The <strong>Environmental</strong> <strong>Protection</strong> <strong>Act</strong> 1994 only deals with greywater when it is a component of <strong>sewage</strong> <strong>and</strong> <strong>the</strong><br />

treatment works has a peak design capacity of 21 equivalent persons or more.<br />

The PD <strong>Act</strong> deals with <strong>sewage</strong> for treatment plants with a capacity of less than 21 equivalent persons.<br />

The PD <strong>Act</strong> also deals with greywater treatment <strong>and</strong>/or use.<br />

Sections 85B <strong>and</strong> 85C of <strong>the</strong> PD <strong>Act</strong> restrict when a compliance permit can be issued for a greywater use<br />

facility <strong>in</strong> a sewered <strong>and</strong> unsewered area respectively. In a sewered area a compliance permit cannot be issued<br />

at premises that will generate less than three kilolitres of greywater a day.<br />
