fi led a crim<strong>in</strong>al compla<strong>in</strong>t with the War Crimes Prosecutor’s Offi ce aga<strong>in</strong>st<br />

unknown journalists and persons who worked <strong>for</strong> RTV Belgrade, RTV Novi<br />

Sad, daily newspapers Politika, Vecernje novosti and others <strong>for</strong> the crim<strong>in</strong>al<br />

act of organiz<strong>in</strong>g and <strong>in</strong>stigat<strong>in</strong>g the commitment of genocide and war<br />

crimes, <strong>in</strong> accordance with Article 145 of the Crim<strong>in</strong>al Code of the Federal<br />

Republic of Yugoslavia. To support its crim<strong>in</strong>al compla<strong>in</strong>t, the NUNS submitted<br />

newspaper articles, sociological analyses and transcripts of television<br />

programmes.<br />

In its crim<strong>in</strong>al compla<strong>in</strong>t the NUNS states: “We hold that be<strong>for</strong>e the<br />

outbreak of armed confl ict <strong>in</strong> the territory of the <strong>for</strong>mer Yugoslavia, there<br />

were political and propaganda preparations <strong>for</strong> it <strong>in</strong> the media <strong>in</strong> that<br />

same territory, us<strong>in</strong>g hate language and spread<strong>in</strong>g false <strong>in</strong><strong>for</strong>mation <strong>in</strong><br />

order to conv<strong>in</strong>ce the public <strong>in</strong> the justifi ability of armed confl ict and, <strong>in</strong><br />

that context, a gross violation of the norms of <strong>in</strong>ternational humanitarian<br />

law. We also hold that those <strong>for</strong>ms of propaganda were legally impermissible<br />

and, thus, represented crim<strong>in</strong>al acts”. 666<br />

The President of the Journalists’ Association of <strong>Serbia</strong>, Ljiljana Smajlovic,<br />

regarded the crim<strong>in</strong>al compla<strong>in</strong>t fi led by the NUNS as “support to<br />

the War Crimes Prosecutor’s Offi ce, so that its <strong>in</strong>vestigation <strong>in</strong>to the war<br />

propaganda <strong>in</strong> the <strong>Serbia</strong>n media dur<strong>in</strong>g the 1990s, which started last<br />

month, could obta<strong>in</strong> legitimacy”. “It is hard <strong>for</strong> me to believe that the<br />

NUNS has noticed just now that the <strong>Serbia</strong>n and other media <strong>in</strong> the territory<br />

of the <strong>for</strong>mer Yugoslavia contributed to an <strong>in</strong>crease <strong>in</strong> <strong>in</strong>ter-ethnic<br />

<strong>in</strong>tolerance and hate on the eve of the country’s dis<strong>in</strong>tegration and dur<strong>in</strong>g<br />

the war, just as it is also hard <strong>for</strong> me to believe that the War Crimes<br />

Prosecutor’s Offi ce discovered all that only one month ago”. 667 In her op<strong>in</strong>ion,<br />

it is strange that the Prosecutor’s Offi ce has no professional assistance<br />
