a. Off-the-Shelf (OTS) Orthotics Exemption<br />

In section VII.G. of this final rule with comment period, we are expanding the<br />

exemptions from the CBP <strong>for</strong> certain OTS orthotics to physicians, other practitioners (as<br />

defined by the Secretary), or by hospitals if furnished to their own patients as part of their<br />

professional service.<br />

The exemption is a self-implementing mandate required by section 154(d) of<br />

MIPPA, which added section 1847(a)(7) of the Act. Section 1847(a)(7)(A) of the Act<br />

expanded the exemptions from the CBP <strong>for</strong> certain OTS orthotics to physicians, other<br />

practitioners (as defined by the Secretary), or hospitals if furnished to their own patients<br />

as part of their professional service. Section 1847(a)(7)(B) of the Act, as added by<br />

section 154(d) of MIPPA, also expanded the exemption from CBP <strong>for</strong> certain DME items<br />

(crutches, canes, walkers, folding manual wheelchairs, blood glucose monitors, and<br />

infusion pumps) when furnished by hospitals to the hospital's own patients during an<br />

admission or on the date of discharge.<br />

We believe this exemption will have a negligible impact on physicians, other<br />

practitioners, and hospitals. The exemption allows physicians, other practitioners, and<br />

hospitals to continue to provide these items to their own patients without submitting a bid<br />

and becoming a contract supplier. This exemption also allows continued access to these<br />

items <strong>for</strong> beneficiaries when these items are furnished by physicians, other practitioners,<br />

and hospitals to their own patients.<br />

b. Changes to Payment <strong>for</strong> Oxygen Equipment<br />

We are not finalizing our proposal pertaining to oxygen and oxygen equipment;<br />

and there<strong>for</strong>e, the impact analysis associated with this proposal is not being finalized.
