MEMBER SPOTLIGHT:<br />

I. CANNAN ELECTRIC<br />

Ireland Cannan is a licensed Electrical Contrac<strong>to</strong>r operating in <strong>the</strong> San Francisco<br />

Bay Area. Raised in <strong>Marin</strong> County, he has 20 years experience in <strong>the</strong> electrical<br />

field. Working initially as an apprentice electrician for Hannibal’s Inc. in San<br />

Rafael, Ireland learned <strong>to</strong> troubleshoot complex wiring problems. In time Ireland<br />

accepted a job with T.O.E.O.E. as a journeyman electrician working on several<br />

high-end residential projects.<br />

In 1997, he started his own electrical service business, I. Cannan Electric (ICE),<br />

specializing in residential projects, service upgrades, and electrical repairs. I.<br />

Cannan Electric is also Green Business Certified.<br />

By 2003, due <strong>to</strong> positive feedback and a growing network of referrals, Ireland<br />

decided <strong>to</strong> add a few highly skilled electricians <strong>to</strong> <strong>the</strong> payroll in order <strong>to</strong> satisfy<br />

increasing demand.<br />

Although <strong>the</strong> ICE has increased from its original single man operation, we still<br />

remain relatively small <strong>to</strong> ensure a level of quality and cus<strong>to</strong>mer satisfaction<br />

our cus<strong>to</strong>mers can depend on. Ireland has been an active member of <strong>the</strong> <strong>Marin</strong><br />

<strong>Builders</strong> Association since 2002 and appreciates <strong>the</strong> opportunities afforded him<br />

because of <strong>the</strong> services and benefits <strong>the</strong> Association provides.<br />

Our contact number still rings Ireland’s cell phone directly; he makes it a priority<br />

<strong>to</strong> respond quickly and personally <strong>to</strong> your requests.<br />

In last week’s update, I wrote about<br />

<strong>the</strong> new hire law (which <strong>to</strong>ok effect<br />

on <strong>January</strong> 1st) and <strong>the</strong> problems it<br />

is causing employers. I just received<br />

confirmation of a conference call next<br />

Thursday morning between <strong>the</strong> Labor<br />

Commissioner’s office, myself, and<br />

all of my colleagues (including Bob<br />

Roginson) who have been working<br />

<strong>to</strong> resolve <strong>the</strong> problems. Keep your<br />

fingers crossed that next week’s call<br />

will find <strong>the</strong> solutions. As always,<br />

you’ll be <strong>the</strong> first <strong>to</strong> know and have<br />

<strong>the</strong> latest information at your finger<br />

tips. Stay tuned!<br />

New Bills Begin To Trickle In<br />

The commencement of <strong>the</strong> second<br />

year of <strong>the</strong> two-year session means<br />

that new bills are being introduced<br />

daily. Following are a couple<br />

that should get your attention!<br />

Remember, <strong>the</strong> introduction of a<br />

new bill only notes <strong>the</strong> ‘start of <strong>the</strong><br />

fun!’ While <strong>the</strong> first one, AB 1514<br />

is intended <strong>to</strong> ‘go after’ excava<strong>to</strong>rs<br />

that don’t call before excavating, <strong>the</strong><br />

second one, AB 1508 is trying <strong>to</strong><br />

go after metal <strong>the</strong>fts. Unfortunately,<br />

while well-intentioned, this could<br />

become a royal pain, <strong>to</strong>o! Your<br />

thoughts and suggestions would be<br />

appreciated.<br />

Summary Digest<br />

Existing law generally requires any<br />

person planning <strong>to</strong> conduct an<br />

excavation <strong>to</strong> contact a regional<br />

notification center prior <strong>to</strong><br />

excavation, and, if practical, <strong>to</strong><br />

delineate <strong>the</strong> areas <strong>to</strong> be<br />

excavated. Existing law authorizes<br />

<strong>the</strong> At<strong>to</strong>rney General, a district<br />

at<strong>to</strong>rney, or <strong>the</strong> state or a local agency<br />

that issued a permit <strong>to</strong><br />

excavate <strong>to</strong> bring an action for <strong>the</strong><br />

enforcement of a civil penalty<br />

against an opera<strong>to</strong>r or excava<strong>to</strong>r who<br />

negligently or knowingly and<br />

willfully violates <strong>the</strong>se and related<br />

provisions.<br />

This bill would also authorize <strong>the</strong><br />

Public Utilities Commission <strong>to</strong><br />

bring an action for enforcement<br />

pursuant <strong>to</strong> <strong>the</strong> provisions described<br />

above.<br />

THE PEOPLE OF THE STATE OF<br />

CALIFORNIA DO ENACT AS<br />

FOLLOWS:<br />

SECTION 1. Section 4216.6 of <strong>the</strong><br />

Government Code is amended <strong>to</strong><br />

read:<br />

4216.6.<br />

(a) (1) Any opera<strong>to</strong>r or excava<strong>to</strong>r<br />

who negligently violates this article<br />

is subject <strong>to</strong> a civil penalty in an<br />

amount not <strong>to</strong> exceed ten thousand<br />

dollars ($10,000).<br />

(2) Any opera<strong>to</strong>r or excava<strong>to</strong>r who<br />

knowingly and willfully violates<br />

any of <strong>the</strong> provisions of this article<br />

is subject <strong>to</strong> a civil penalty in an<br />

<strong>Marin</strong> <strong>Builders</strong> Association ◆ <strong>Weekly</strong> BulletIn ◆ Page 15

amount not <strong>to</strong> exceed fifty thousand dollars ($50,000).<br />

(3) Except as o<strong>the</strong>rwise specifically provided in this<br />

article, this section is not intended <strong>to</strong> affect any civil<br />

remedies o<strong>the</strong>rwise provided by law for personal injury or<br />

for property damage, including any damage <strong>to</strong> subsurface<br />

installations, nor is this section intended <strong>to</strong> create any new<br />

civil remedies for those injuries or that damage.<br />

(4) This article shall not be construed <strong>to</strong> limit any o<strong>the</strong>r<br />

provision of law granting governmental immunity <strong>to</strong> state<br />

or local agencies or <strong>to</strong> impose any liability or duty of care<br />

not o<strong>the</strong>rwise imposed by law upon any state or local<br />

agency.<br />

(b) An action may be brought by <strong>the</strong> At<strong>to</strong>rney General, <strong>the</strong><br />

district at<strong>to</strong>rney, <strong>the</strong> Public Utilities Commission, or <strong>the</strong><br />

local or state agency which issued <strong>the</strong> permit <strong>to</strong> excavate,<br />

for <strong>the</strong> enforcement of <strong>the</strong> civil penalty pursuant <strong>to</strong> this<br />

section. If penalties are collected as a result of a civil suit<br />

brought by a state or local agency for collection of those<br />

civil penalties, <strong>the</strong> penalties imposed shall be paid <strong>to</strong> <strong>the</strong><br />

general fund of <strong>the</strong> agency. If more than one agency is<br />

involved in enforcement, <strong>the</strong> penalties imposed shall be<br />

apportioned among <strong>the</strong>m by <strong>the</strong> court in a manner that<br />

will fairly offset <strong>the</strong> relative costs incurred by <strong>the</strong> state or<br />

local agencies, or both, in collecting <strong>the</strong>se fees.<br />

Summary Digest<br />

(1) Existing law authorizes <strong>the</strong> Department of <strong>the</strong><br />

California Highway Patrol <strong>to</strong> s<strong>to</strong>p a vehicle transporting<br />

timber products,lives<strong>to</strong>ck, poultry, farm produce, crude<br />

oil, petroleum products, or inedible kitchen grease and<br />

inspect certain documents <strong>to</strong> determine whe<strong>the</strong>r <strong>the</strong> driver<br />

is in legal possession of <strong>the</strong> load, and, upon reasonable<br />

belief that <strong>the</strong> driver of <strong>the</strong> vehicle is not in legal<br />

possession, <strong>to</strong> take cus<strong>to</strong>dy of <strong>the</strong> vehicle and load, as<br />

prescribed, and imposes duties on <strong>the</strong> sheriff with respect<br />

<strong>to</strong> <strong>the</strong> care and safekeeping of those products.<br />

This bill would additionally authorize a member of a<br />

city police department or a member of a county sheriff’s<br />

office, whose primary responsibility is <strong>to</strong> conduct <strong>the</strong>ft<br />

investigations, <strong>to</strong> s<strong>to</strong>p any vehicle, and would make<br />

those provisions applicable with regard <strong>to</strong> a vehicle that<br />

is transporting metal products or metal alloy products.<br />

By imposing additional duties on a sheriff regarding <strong>the</strong><br />

care and safekeeping of metal products and metal alloy<br />

products, this bill would impose a state-mandated local<br />

program.<br />

The bill additionally would authorize a member of a city<br />

police department and a member of <strong>the</strong> county sheriff’s<br />

office, whose primary responsibility is <strong>to</strong> conduct <strong>the</strong>ft<br />

investigations, <strong>to</strong> s<strong>to</strong>p and inspect vehicles transporting<br />

any of those loads.<br />

(2) The California Constitution requires <strong>the</strong> state <strong>to</strong><br />

reimburse local agencies and school districts for certain<br />

costs mandated by <strong>the</strong> state. Statu<strong>to</strong>ry provisions establish<br />

procedures for making that reimbursement. This bill<br />

would provide that, if <strong>the</strong> Commission on State Mandates<br />

determines that <strong>the</strong> bill contains costs mandated by<br />

<strong>the</strong> state, reimbursement for those costs shall be made<br />

pursuant <strong>to</strong> <strong>the</strong>se statu<strong>to</strong>ry provisions.<br />

ENACT AS FOLLOWS:<br />

SECTION 1. Section 2810 of <strong>the</strong> Vehicle Code is<br />

amended <strong>to</strong> read:<br />

2810.<br />

(a) A member of <strong>the</strong> Department of <strong>the</strong> California<br />

Highway Patrol, a member of a city police department<br />

whose primary responsibility is <strong>to</strong> conduct <strong>the</strong>ft<br />

investigations, or a member of a county sheriff’s<br />

office whose primary responsibility is <strong>to</strong> conduct <strong>the</strong>ft<br />

investigations may s<strong>to</strong>p any vehicle transporting any<br />

timber products, lives<strong>to</strong>ck, poultry, farm produce, crude<br />

oil, petroleum products, metal products, metal alloy<br />

products, or inedible kitchen grease, and inspect <strong>the</strong> bills<br />

of lading, shipping or delivery papers, or o<strong>the</strong>r evidence<br />

<strong>to</strong> determine whe<strong>the</strong>r <strong>the</strong> driver is in legal possession of<br />

<strong>the</strong> load, and, upon reasonable belief that <strong>the</strong> driver of<br />

<strong>the</strong> vehicle is not in legal possession, shall take cus<strong>to</strong>dy<br />

of <strong>the</strong> vehicle and load and turn <strong>the</strong>m over <strong>to</strong> <strong>the</strong> cus<strong>to</strong>dy<br />

of <strong>the</strong> sheriff of <strong>the</strong> county in which <strong>the</strong> timber products,<br />

lives<strong>to</strong>ck, poultry, farm produce, crude oil, petroleum<br />

products, metal products, metal alloy products, or inedible<br />

kitchen grease, or any part <strong>the</strong>reof of those loads, is<br />

apprehended.<br />

(b) The sheriff shall receive and provide for <strong>the</strong> care<br />

and safekeeping of <strong>the</strong> apprehended timber products,<br />

lives<strong>to</strong>ck, poultry, farm produce, crude oil, petroleum<br />

products, metal products, metal alloy products, or inedible<br />

kitchen grease, or any part <strong>the</strong>reof of those loads, and<br />

immediately, in cooperation with <strong>the</strong> department, proceed<br />

with an investigation and its legal disposition.<br />

(c) Any expense incurred by <strong>the</strong> sheriff in <strong>the</strong> performance<br />

of his or her duties under this section shall be a legal<br />

charge against <strong>the</strong> county.<br />

SEC. 2.<br />

If <strong>the</strong> Commission on State Mandates determines that this<br />

act contains costs mandated by <strong>the</strong> state, reimbursement <strong>to</strong><br />

local agencies and school districts for those costs shall be<br />

made pursuant <strong>to</strong> Part 7 (commencing with Section 17500)<br />

of Division 4 of Title 2 of <strong>the</strong> Government Code.<br />

Kalb's Q&A for Contrac<strong>to</strong>rs<br />

We have been busy at Capi<strong>to</strong>l Services helping contrac<strong>to</strong>rs<br />

discover new opportunity in Nevada and<br />

Arizona, a ‘rush’ that is reflected in recent news of<br />

<strong>the</strong>ir leading <strong>the</strong> nation in state population growth<br />

over <strong>the</strong> last decade. Meanwhile, licensed contrac<strong>to</strong>rs<br />

may find greater opportunity within <strong>the</strong> borders of<br />

California as government focuses on creating a ‘level’<br />

playing field by cracking down on <strong>the</strong> unlicensed<br />

opera<strong>to</strong>rs ‘bending’ <strong>the</strong> rules…<br />

The CSLB Enforcement Committee met in Sacramen<strong>to</strong><br />

last week <strong>to</strong> discuss a wide variety of <strong>to</strong>pics related <strong>to</strong><br />

contrac<strong>to</strong>rs and <strong>the</strong> construction industry. Of particular<br />

note was <strong>the</strong>ir emphasis on increasing proactive enforcement<br />

aimed at <strong>the</strong> underground economy.<br />

The Contrac<strong>to</strong>rs Board will be stepping up partnering<br />

with o<strong>the</strong>r state agencies including <strong>the</strong> Employment<br />

Development Department (EDD) and Department of<br />

Industrial Relations (DIR), among o<strong>the</strong>rs. The focal<br />

point will be <strong>the</strong> newly created DIR Labor Enforcement<br />

Task Force (LETF), which was launched on <strong>January</strong><br />

1st. According <strong>to</strong> <strong>the</strong> DIR, “this is a collaborative effort<br />

between state agencies <strong>to</strong> combat <strong>the</strong> underground<br />

economy and <strong>to</strong> improve California’s business environment<br />

where legitimate employers can thrive.”<br />

The primary partners of <strong>the</strong> LETF include DIR, <strong>the</strong> Employment<br />

Development Department, Contrac<strong>to</strong>r’s State<br />

License Board, Board of Equalization, and <strong>the</strong> Bureau<br />

of Au<strong>to</strong>motive Repair. “The goal of LETF is <strong>to</strong> ensure<br />

fair and safe working conditions in all workplaces and<br />

promote a level playing field for employers through<br />

education and enforcement of state laws,” said Labor<br />

and Workforce Agency Secretary Marty Morgenstern.<br />

“Labor law viola<strong>to</strong>rs endanger workers and have an unfair<br />

market advantage over law-abiding businesses”. The<br />

goals of <strong>the</strong> task force will be <strong>to</strong>:<br />

1) Ensure workers receive proper payment of wages<br />

and are provided a safe work environment; 2) Ensure<br />

California receives all employment taxes, fees, and<br />

fines due from employers; 3) Make efficient use of state<br />

and federal resources in carrying out <strong>the</strong> mission of <strong>the</strong><br />

Labor Enforcement Task Force; and 4) Eliminate unfair<br />

business competition by ‘leveling <strong>the</strong> playing field’ so<br />

that employers who comply with <strong>the</strong> law do not have <strong>to</strong><br />

compete with employers who break <strong>the</strong> law. According<br />

<strong>to</strong> DIR Direc<strong>to</strong>r, Christine Baker, “By joining forces<br />

with o<strong>the</strong>r agencies conducting inspections, we can<br />

have a greater impact on s<strong>to</strong>pping labor violations and<br />

<strong>the</strong> underground economy. Collaboration will also save<br />

time and money by avoiding overlapping inspections and<br />

focusing our efforts on <strong>the</strong> egregious viola<strong>to</strong>rs.”<br />

According <strong>to</strong> <strong>the</strong> DIR, and echoed by <strong>the</strong> CSLB, businesses<br />

operating underground typically violate many<br />

laws designed <strong>to</strong> protect workers and our state’s economy.<br />

These include: not paying income taxes, unemployment<br />

insurance or disability insurance; not carrying (or<br />

under-reporting) Workers Compensation coverage; not<br />

paying proper wages; and not registering for required<br />

licenses or permits. These underground opera<strong>to</strong>rs subsequently<br />

pay lower overhead costs, which give <strong>the</strong>m an<br />

unfair competitive advantage over legitimate, law-abiding<br />

businesses.<br />

In addition <strong>to</strong> discussing <strong>the</strong> goals of <strong>the</strong> LETF, <strong>the</strong><br />

Enforcement Committee heard from <strong>the</strong> Chief of EDD’s<br />

Compliance Development Operations, Dan Kurttila,<br />

who emphasized <strong>the</strong>ir commitment <strong>to</strong> <strong>the</strong> construction<br />

industry and <strong>the</strong> Board’s strategic objective <strong>to</strong> combat <strong>the</strong><br />

underground economy.<br />

Like <strong>the</strong> ‘synching’ on your individual mobile, computer<br />

THREE-POINT CONTACT<br />

Maintain Three-Point Contact<br />

<strong>to</strong> Prevent Falls<br />

Mounting or dismounting a large truck or<br />

piece of equipment without hurting yourself<br />

seems simple, but many accidents<br />

involve this type of injury. The best way<br />

<strong>to</strong> prevent falling while getting in<strong>to</strong> or out<br />

of a truck, trac<strong>to</strong>r cab or heavy equipment<br />

is <strong>to</strong> follow <strong>the</strong> three-point contact<br />

system.<br />

The Three-Point Contact System<br />

Three-point contact is exactly that: three<br />

of your four limbs are in contact with<br />

<strong>the</strong> vehicle at all times. That can be two<br />

hands and one foot, or two feet and one<br />

hand.<br />

No matter what type of access system<br />

your vehicle or equipment has available,<br />

<strong>the</strong> three-point system will significantly<br />

reduce <strong>the</strong> chance of a slip or fall because<br />

it allows you <strong>to</strong> maintain maximum<br />

stability and support when entering and<br />

exiting <strong>the</strong> equipment. The three points<br />

work <strong>to</strong> form a triangle, distributing your<br />

body’s weight at <strong>the</strong> center.<br />

Remember, <strong>the</strong> only person who can prevent<br />

a fall is you. Here are some simple<br />

dos and don’ts <strong>to</strong> follow when entering or<br />

exiting a large vehicle or o<strong>the</strong>r construction<br />

equipment <strong>to</strong> avoid injury.<br />

Dos<br />

• Always exit and enter your vehicle<br />

facing <strong>the</strong> cab.<br />

• Slow down and use extra caution<br />

in bad wea<strong>the</strong>r.<br />

• Get a firm grip on rails or handles<br />

with your hands.<br />

• Use parts designed by <strong>the</strong><br />

manufacturer for mounting and dismounting.<br />

This includes steps, running boards,<br />

traction strips, footholds, handgrips, etc.<br />

• Look below for obstacles on <strong>the</strong><br />

ground before exiting.<br />

• Wear safe non-slip shoes with<br />

good support.<br />

• Clean your shoes off; mud,<br />

grease and oil can cause you <strong>to</strong> slip.<br />

• Inspect hand holds and ladders/<br />

rungs <strong>to</strong> ensure <strong>the</strong>y are in good condition.<br />

• Only climb on and off when <strong>the</strong><br />

equipment is stationary.<br />

Don’ts<br />

• Never carry anything with your<br />

free hand when mounting or dismounting.<br />

Put <strong>the</strong> object on <strong>the</strong> vehicle floor<br />

and reach up for it when you get down on<br />

<strong>the</strong> ground.<br />

• Don’t rush <strong>to</strong> climb out of your<br />

vehicle or machinery after a long period<br />

of sitting. Climb down slowly <strong>to</strong> avoid<br />

straining a muscle or losing your balance.<br />

• Never jump out of construction<br />

equipment or vehicles. You may land off<br />

balance or on an uneven surface and fall.<br />

• Don’t use tires, wheel hubs or<br />

machine tracks as a step surface.<br />

• Do not use door frames, door<br />

edges or door handles as a handhold.<br />

Familiarize yourself with <strong>the</strong>se dos and<br />

don’ts, and always maintain three-point<br />

contact when entering or exiting a large<br />

truck or heavy construction equipment.<br />
