<strong>Deerfield</strong> Citgo Becomes First Green Gas Station In America<br />

David Welch is concerned about his community toda y and the world he will leave to his 9 year<br />

old daughter Ina. Dave is also an indepe ndent owner <strong>of</strong> a Citgo gas station in <strong>Deerfield</strong>, Illinois.<br />

He thought it was an oxymoron to have a Green gas station . Then Dave met Izzy Kharasch a<br />

Certified Green Consultant and owner <strong>of</strong> Green Hospitality Certified which is under the auspices<br />

<strong>of</strong> the Green Business League.<br />

Izzy was able to show Dave that becoming a Certified Green Business was not about the<br />

product that he sold but more about the day-to-day practices that impact the health <strong>of</strong> his<br />

customers and his community.<br />

Dave and Izzy worked hard to lessen the carbon footprint <strong>of</strong> the <strong>Deerfield</strong> Citgo station. First,<br />

Dave does not use any chemicals to power wash his property. This means, unlike other gas<br />

stations he is not sending any toxins into his community water system . Many days Dave won 't<br />

use any community water to clean or water his plants . This is because his Citgo station now has<br />

two rain barrels that collect much <strong>of</strong> the water he uses for these functions.<br />

The <strong>Deerfield</strong> Citgo now does indoor air quality tests every 6 months to detect any potential<br />

problems such as mold . When the gas station needed painting on the interior they utilized low<br />

vac paints. To cut down on electricity Dave insta lled a programmable thermostat that cuts out<br />

8 hours <strong>of</strong> air conditioning per day in the summer and lowers the heat 8 hours a day in the<br />

winter. Another way to control the energy used was by installing insulated glass windows.<br />

During the assessment Izzy noticed that the bathroom light was on all day and that there were<br />

times when customers left water running in the sink. Dave installed motion detectors so that<br />

lights are only on when customers actually go into the bath room and the sink is also on a<br />

motion detector so that when customers finish washing their hands the water goes <strong>of</strong>f<br />

automatically.<br />

Dave got rid <strong>of</strong> any toxic cleaning agents and now only utilizes safe, green products. As Dave<br />

moves forward all <strong>of</strong> the light bulbs will be changed low wattage which will utilize 80-90% less<br />

electricity. All carry out material will be biodegradable; all paper goods non-chlorine processed<br />

and even the frozen Coke machine is on a timer to insure that it uses less electricity.<br />

Dave Welch is making a statement to his community and that is that even if you own a gas<br />

station you can still be a respons ible steward <strong>of</strong> earth, change our carbon foot print, use less<br />

energy and create a healthier environment for our customers and families .

The regular meeting <strong>of</strong> the Board <strong>of</strong> Trustees <strong>of</strong> the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong> was called to<br />

order by Mayor Harriet Rosenthal in the Council Chambers <strong>of</strong> the <strong>Village</strong> Hall on Monday,<br />

October 5, 2009 at 7:30 p.m. The Clerk called the roll and announced that the following were:<br />

and that a quorum was present and in attendance. Also present were <strong>Village</strong> Attorney Peter<br />

Coblentz and Kent Street, <strong>Village</strong> Manager.<br />

PLEDGE OF ALLEGIANCE Robert Speckmann, Chairman <strong>of</strong> the Board <strong>of</strong><br />

Zoning Appeals, led those in attendance in reciting<br />

the Pledge <strong>of</strong> Allegiance.<br />

MINUTES OF PREVIOUS MEETING Trustee Oppenheim made a motion to approve the<br />

minutes from the September 21, 2009 Board <strong>of</strong><br />

Trustees meeting. Trustee Jester seconded the motion. The motion passed unanimously.<br />

BILLS AND PAYROLL Trustee Seiden made a motion to approve the Bills<br />

and Payroll dated October 5, 2009. Trustee<br />

Oppenheim seconded the motion. The motion passed by the following vote:<br />

PUBLIC COMMENT Aaron and Ura Eisenberg, 330 Landis, showed a<br />

PowerPoint presentation which explained what has<br />

occurred with their purchase <strong>of</strong> the property at 1010 Warrington. Mr. Eisenberg reiterated they<br />

believe they have done everything right, yet despite their efforts they find themselves in a very<br />

unfortunate situation. They are requesting a fair, equitable and timely resolution to the problem<br />

so they can build their home at 1010 Warrington. They are asking for continued cooperation<br />

from the <strong>Village</strong>, including help in expediting the IEPA request in any way possible. They<br />

request the Trustees bring this matter to a formal vote at the October 19 Board <strong>of</strong> Trustees<br />

meeting. Mr. Eisenberg also requested the <strong>Village</strong> pay 100% <strong>of</strong> the remediation costs associated<br />

with the repair/reroute <strong>of</strong> the sewer.<br />

Mayor Rosenthal thanked the Eisenbergs for their report. She understands it is a difficult<br />

situation and gave her assurance that the Board would move as quickly as possible to do what is<br />

fair for both the Eisenbergs and the <strong>Village</strong>. Trustee Seiden noted the <strong>Village</strong> does not take this<br />

situation lightly.

Oscar Adler, 50 Eastwood, reported that Lake County Administrator Barry Burton is his guest<br />

this month on Adler’s Alley.<br />

REPORT ON DEPARTMENTAL Principal Planner Jeff Ryckaert presented highlights<br />

OBJECTIVES – BUILDING AND from the Planning Department’s semi-annual report.<br />

PLANNING DIVISIONS Mr. Ryckaert noed that the 2010 census is coming<br />

up quickly. Questionnaires will have 10 questions<br />

and are easy to complete. The information is completely confidential. Mr. Ryckaert stressed<br />

that it is important for every household to participate. He noted that the Planning Department<br />

has continued to work with the census bureau on the accuracy <strong>of</strong> addresses.<br />

Mr. Ryckaert mentioned the two year period for compliance with the window signage ordinance<br />

has expired. Most businesses within the <strong>Village</strong> are in compliance. The few that are not in<br />

compliance have been notified. The department is working with businesses to keep an attractive<br />

business district in <strong>Deerfield</strong>.<br />

Mr. Ryckaert noted that Kathy Von Ohlen is on the Lake County Wind Energy Task Force.<br />

They are working on sustainability issues and are working to complete a draft ordinance on wind<br />

energy systems. The Takeda Phase II project is a major sustainability project in <strong>Deerfield</strong>.<br />

Staff has taken an inventory <strong>of</strong> available sites in the <strong>Village</strong> and given the list to Lake County<br />

Partners. Anyone looking for space in the County will have access to the list. Staff will also<br />

meet with Jack Frigo soon to further discuss the options.<br />

Mr. Ryckaert mentioned there has been a lot <strong>of</strong> commission activity within the past six months.<br />

The Plan Commission has tackled a wide variety <strong>of</strong> projects, including the proposed <strong>Village</strong><br />

Green and the wastewater treatment facility. They also worked on the workforce housing issue.<br />

The Appearance Review Commission has met on 17 requests over the past six months. There<br />

are also two new retailers coming into the <strong>Village</strong>. The <strong>Village</strong> Center Development<br />

Commission held four meetings over the last six months. They had their annual walk <strong>of</strong><br />

Downtown <strong>Deerfield</strong> and have been kept informed on what is happening in the <strong>Village</strong> Center.<br />

Mr. Ryckaert mentioned the redesigned website is working out very well.<br />

Mr. Street thanked Mr. Ryckaert and Ms. Von Ohlen for their work on the website. Mayor<br />

Rosenthal thanked Mr. Ryckaert for the green initiatives that have been implemented within the<br />

Planning Department. She also reiterated the importance <strong>of</strong> having an accurate census.<br />

Enforcement Officer Clint Case presented highlights from the Building Department’s semiannual<br />

report. He noted that general construction statistics have substantially decreased from the<br />

same reporting period last year. There have been almost 150 fewer permits, but the amount <strong>of</strong><br />

revenue for fees and valuation increased slightly because <strong>of</strong> Takeda. Mr. Case mentioned the<br />

number <strong>of</strong> foreclosures has stabilized to approximately 30 units. Temporary permits are slow,<br />

with only 185 being issued over the past six months. The Performance Guarantee Ordinance was<br />

put in place, and it causes contractors to push permits more expeditiously.

Mr. Case mentioned the <strong>Village</strong>’s ISO rating increased by two points, which is substantial.<br />

Trustee Jester asked if that would improve insurance rates and Mr. Case replied affirmatively.<br />

Mr. Case also noted that the Department will be working on a comprehensive study <strong>of</strong> all fees<br />

within the Municipal Code.<br />

Mayor Rosenthal asked Mr. Case to keep the Trustees up to date on foreclosures in <strong>Deerfield</strong>.<br />

Mr. Case agreed to provide a written report on a monthly basis. Mayor Rosenthal asked how<br />

many homes are for sale in <strong>Deerfield</strong> and the average length <strong>of</strong> time it takes for a home to sell<br />

now versus two years prior. Mr. Case will provide a report with that information. Mr. Street<br />

added that the report should also include other communities for comparison. He also<br />

commended the Department on the ISO increase.<br />

REPORTS<br />

REPORT AND RECOMMENDATION The Board <strong>of</strong> Zoning Appeals held a Public Hearing<br />

OF BZA RE SIDEYARD VARIATION on September 1st to consider the request for a side<br />

FOR 654 CAROLINA COURT yard variation for the property located at 654<br />

Carolina Court. The proposed garage would<br />

encroach 2.166 feet into the required total side yard setback. The BZA voted 5-0 in favor <strong>of</strong><br />

sending a positive recommendation to the Trustees. BZA Chairman Speckmann and staff were<br />

available to answer questions from the Trustees.<br />

Trustee Seiden made a motion to accept the Report and Recommendation <strong>of</strong> the Board <strong>of</strong> Zoning<br />

Appeals. Trustee Jester seconded the motion. The motion passed by the following vote:<br />

AYES: Jester, Oppenheim, Seiden, Rosenthal (4)<br />

CONSENT AGENDA<br />

OLD BUSINESS<br />

ORDINANCE PROHIBITING VIDEO An Ordinance prohibiting video gaming within the<br />

GAMING WITHIN DEERFIELD <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong>. First Reading.<br />

Trustee Oppenheim wanted to let residents know that the <strong>Village</strong> considers all ways to raise<br />

revenues in <strong>Deerfield</strong> to take the burden <strong>of</strong>f tax payers, but she does not feel this is a worthwhile<br />

source <strong>of</strong> revenue, given the trade <strong>of</strong>fs. Mr. Street mentioned he received information from the<br />

Illinois Coin Machine Operators, who are in favor <strong>of</strong> the ordinance. He will distribute the<br />

information to the Trustees to review.

NEW BUSINESS<br />

AUTHORIZATION FOR <strong>Village</strong> Engineer Bob Phillips reported the design<br />

SUPPLEMENTAL ENGINEERING process is nearing completion. It includes a<br />

SERVICES FOR THE CARLISLE complete reconstruction <strong>of</strong> the existing roadway,<br />

AVENUE/CARRIAGE WAY AND water main replacement, sanitary and storm sewer<br />

HAZEL AVENUE/CHESTNUT STREET system repairs, etc. URS Corporation was<br />

INFRASTRUCTURE REPLACEMENT requested to revise project plans to expand possible<br />

PROJECTS low interest funding opportunities from ARRA and<br />

the IEPA. Additional services will cost $31,812.48.<br />

Mayor Rosenthal asked if the <strong>Village</strong> has a chance <strong>of</strong> getting ARRA funding. Mr. Phillips<br />

responder that there will be a second round <strong>of</strong> ARRA funding, and he believes having the<br />

projects shovel ready would help the <strong>Village</strong>’s chances. He thinks the <strong>Village</strong> has a good chance<br />

for both sources <strong>of</strong> funding. Mr. Street added the <strong>Village</strong> would not have any chance if the<br />

revised project plans are not done. He believes it is worth the investment to avail the <strong>Village</strong> <strong>of</strong><br />

these funding opportunities. Trustee Oppenheim ensured that money the <strong>Village</strong> would receive<br />

is in excess <strong>of</strong> the amount they would invest on revised plans. She asked what the timing would<br />

be. Mr. Street responded that engineering will be completed now so that projects will be ready<br />

for the funding.<br />

Trustee Jester made a motion to authorize supplemental engineering services for the Carlisle<br />

Avenue/Carriage Way and Hazel Avenue/Chestnut Street infrastructure replacement projects in<br />

an amount not to exceed $31,812.48. Trustee Oppenheim seconded the motion. The motion<br />

passed by the following vote:<br />

AUTHORIZATION TO PURCHASE ONE The Director <strong>of</strong> Public Works and Engineering<br />

2010 TRUCK WITH DUMP BODY AND reported that at the August 17, 2009 Board <strong>of</strong><br />

SALT SPREADER WITH PRE-WETTING Trustees meeting, the Board voted to authorize the<br />

SYSTEM (REPLACEMENT FOR purchase <strong>of</strong> one 2010 truck with dump body and<br />

PREVIOUS AWARD) salt spreader with pre-wetting system from the<br />

authorized State <strong>of</strong> Illinois truck supplier. It was<br />

later determined that the International Truck Company that was awarded the contract was not the<br />

authorized State <strong>of</strong> Illinois bidder. Staff directly solicited bids for the replacement vehicle<br />

because the previous award was null and void. Three bids for the truck were received. Chicago<br />

International Truck was the low bidder. The truck met required specifications. In the last five<br />

years, the <strong>Village</strong> has purchased parts and service from Chicago International Truck. The<br />

Director <strong>of</strong> Public Works and Engineering recommends the Board authorize the purchase <strong>of</strong> one<br />

2010 International 36,220 GVWP dump truck with plow and salt spreader with pre-wetting<br />

system from Chicago International Truck in a net amount not to exceed $106,446 including trade<br />

in. Mayor Rosenthal noted the <strong>Village</strong> had not known the original award was not made under<br />

the State contract.

Ms. Little reported that staff received bids from two International Truck distributors who<br />

submitted similar quotes to the State contractor. There was only one dealer that qualified for the<br />

award. Mr. Street confirmed the <strong>Village</strong> is saving almost $10,000 as a result <strong>of</strong> the process.<br />

Trustee Jester made a motion to authorize the purchase <strong>of</strong> one 2010 International 36,220 GVWP<br />

dump truck with plow and salt spreader with pre-wetting system from Chicago International<br />

Truck in a net amount not to exceed $106,446 including trade in. Trustee Oppenheim seconded<br />

the motion. The motion passed by the following vote:<br />

AUTHORIZATION TO PURCHASE ONE Ms. Little mentioned this is the same<br />

2010 TRUCK WITH DUMP BODY AND circumstance as the last award. Three bids were<br />

SNOW PLOW (REPLACEMENT FOR received and publicly read on September 28, 2009<br />

PREVIOUS AWARD) for one 2010 truck with dump body and snow plow.<br />

The low bidder was Chicago International Truck in<br />

the net amount <strong>of</strong> $86,691 including trade in.<br />

Trustee Seiden made a motion to authorize the purchase <strong>of</strong> one 2010 truck with dump body and<br />

snow plow from Chicago International Truck in a net amount not to exceed $86,691. Trustee<br />

Jester seconded the motion. The motion passed by the following vote:<br />

DISCUSSION<br />

LEAF PICK UP Mr. Street reported that leaf pick up will start the<br />

week <strong>of</strong> October 26.<br />

THANK YOU Mr. Street mentioned that Kendall Dean would be<br />

leaving her position as Administrative Intern to<br />

move to a full time position in Northbrook. He said she has been a terrific asset in the <strong>Village</strong><br />

and wished her well.<br />

Fifth month <strong>of</strong> the fiscal year. Sales tax and water/sewer revenues rebound somewhat. Total operating<br />

revenues still exceeding operating expenditures, although within sewer fund year to date revenues are<br />

lagging expenditures. Hotel tax dropped, and the full fiscal year projection has been reduced. The police<br />

retro was paid out in September, but overall expenditures are below expectation and budget. The bulk <strong>of</strong><br />

the second installment <strong>of</strong> Lake County taxes was received during the month.<br />

CASH AND INVESTMENTS<br />

As <strong>of</strong> September 30,2009, 100% <strong>of</strong> available cash was invested at an estimated average interest rate <strong>of</strong><br />

1.05% compared to an average rate <strong>of</strong> 0.12% for the 90-day Treasury bill.<br />

1010 Warrington Sewer Easement<br />

As the Board is aware, an existing <strong>Village</strong> sanitary sewer bisects the property at 1010<br />

Warrington Road under the current house built in the 1950's. The new owners <strong>of</strong>the<br />

property, Aaron and Leorah Eisenb erg, have submitted building plans to construct a new<br />

home on the property and desire to resolve conflicts resulting from the sewer's location.<br />

Pursuant to the Board 's direction to develop a recommendation to address the matter,<br />

staff and the <strong>Village</strong> attorney have worked to develop two viable options. Attached are a<br />

listing <strong>of</strong>each option's provisions, an exhibit depicting the property and correspondence<br />

from Mr. Eisenberg endorsing Option A.<br />

Options<br />

Under Option A, the sewer is kept in its present location, relined and tested by the <strong>Village</strong><br />

to verify its integrity and the owners will proceed to have the new home constructed<br />

using construction techniques approved by the <strong>Village</strong> that will protect the sewer. An<br />

easement formali zing the <strong>Village</strong>'s authority to clean and maintain the sewer, as well as a<br />

new easement to relocate the sewer ifnecessary in the future , would be granted to the<br />

<strong>Village</strong>. The cost to reline and test the sewer is estimated to be $10,000 and time to<br />

implement the sewer work is approximately 4 weeks .<br />

Under Option B, a new line would be constructed along the edge <strong>of</strong>the property<br />

according to a 50/50 cost sharing arrangement with the owner, and the existing line<br />

would be abandoned. An easement formalizing the <strong>Village</strong> authority for the sanitary<br />

sewer would be granted. The total cost to construct the new sewer and abandon the<br />

existing one is estimated to be $50,000 and the time to implement it is approximately 6<br />

weeks.<br />

Recommendation<br />

In view <strong>of</strong>the impacts, costs and trade-<strong>of</strong>fs <strong>of</strong>each option, it is recommended that Option<br />

A be approved and the Mayor and <strong>Village</strong> Attorney be authorized to execute the<br />

necessary easement documents consistent with the provisions <strong>of</strong>Option A. Staff and the<br />

1010 WARRINGTON<br />

EASEMENT PROPOSAL<br />

The <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong> proposes the following options for Owners' consideration to<br />

resolve the issues relating to the sanitary sewer and easement that currently bisects the property<br />

at 10lD Warrington Road:<br />

A. Leave Sanitary Sewer in Place.<br />

The <strong>Village</strong> is confident that the current sanitary sewer can be left in place without<br />

impairing or limiting the construction and use <strong>of</strong> a new single-family house on the subject<br />

property, or the continued use <strong>of</strong> the sanitary sewer. The following terms and conditions would<br />

apply to this option:<br />

1. Owners would grant an express easement to the <strong>Village</strong> covering the route <strong>of</strong> the<br />

current sewer, and a second easement to the <strong>Village</strong> covering the potential route<br />

<strong>of</strong> a replacement sewer corresponding to the easement proposed under Option B<br />

below.<br />

2. Owners would be allowed to proceed immediately with construction <strong>of</strong>a home on<br />

the subject property in accordance with the previously submitted building plans.<br />

3. The easement granted to the <strong>Village</strong> for the existing sewer would NOT allow the<br />

<strong>Village</strong> access to the easement and to the sewer running below the new house<br />

except through the pipe itself. The only exception is that the <strong>Village</strong> would have<br />

usual easement rights for an area 10 feet wide and 10 feet in length extending<br />

from the west property line <strong>of</strong>the subject property, centered on the sanitary sewer<br />

manhole and the underground sewer.<br />

4. Under the easement agreement the <strong>Village</strong> would agree to indemnify the Owners<br />

and all succeeding owners <strong>of</strong>the property for any and all personal injury or<br />

property damage relating to or arising out <strong>of</strong>the presence <strong>of</strong>the sanitary sewer<br />

running beneath the new house. So long as Owners construct their home in<br />

accordance with building plans approved by the <strong>Village</strong>, and exercise ordinary<br />

care in conducting their construction activities pursuant to such plans, <strong>Village</strong><br />

agrees that Owner will not be responsible or liable for any injury <strong>of</strong>damage to the<br />

sewer caused by the <strong>Village</strong> permitting Owner's house to be constructed above the<br />

route <strong>of</strong>the current sewer.<br />

5. If at any point in the future the <strong>Village</strong> needed or decided to enlarge, improve or<br />

replace the sanitary sewer, the sewer running underneath the house would be<br />

abandoned, and a new sewer would be constructed at <strong>Village</strong>'s expense within the<br />

confines <strong>of</strong> the alternate sanitary sewer easement described in Option B below.<br />

There would be no right to replace the sewer in its current location. This<br />

easement would be disclaimed at that time.


B. Relocation <strong>of</strong> Sanitary Sewer.<br />

1. If the property owners desire that the sewer be relocated at this time , a new<br />

sanitary sewer easement would be granted along a route that will be more<br />

particularly described at a later date, but generally along the route described in the<br />

sketch attached hereto.<br />

2. The specifications for the new sewer will be determined by the <strong>Village</strong><br />

Engineering Department.<br />

3. The <strong>Village</strong> will contribute 50% <strong>of</strong> the final actual cost, up to a maximum <strong>of</strong><br />

$25,000, <strong>of</strong> constructing the new sewer, including engineering fees incurred by<br />

the Owners.<br />

4. The sewer would be constructed by the Owners using a private contractor selected<br />

by Owners and approved by the <strong>Village</strong>. The construction would be under the<br />

general supervision <strong>of</strong>the <strong>Village</strong> Engineering Department.<br />

5. The <strong>Village</strong> will cause the existing sanitary sewer to be abandoned in place and<br />

will provide Owner with a disclaimer <strong>of</strong> any easement claim to the current<br />

sanitary sewer.<br />

c. Title Insurance.<br />

Owners.

First, I'd like to thank you for your continued efforts to help find a resolution t o our situation<br />

at 1010 Warrington. We have been very encouraged over the last week by the village's<br />

willingness to work dlrectly with us to find the right answer.<br />

We have rev iewed the Easement Proposal and Exhibit. At th is time, we strongly endorse<br />

and would like to move forward with Option A as described - leaving t he sanitary sewer in<br />

place and applying the epoxy-resin solution. We are willing to grant the village an<br />

easement for the existing sewer and an additional easement where one could potentially be<br />

in the fu ture in the event t hat it needs to get moved. We also app reciate the village's<br />

willingness to pay the cost associated with applying the epoxy-resin. This option is clearly<br />

the lowest cost, mos t expedient, and least intrusive way to fix the problem.<br />

Please note that we do not support Option B - relocation <strong>of</strong> t he sanitary sewer - as it is<br />

currently proposed. It would be very costly fo r us and the village, ta ke considerably more<br />

time, require the involvement <strong>of</strong> the EPA and our title company, and be highly disrupt ive to<br />

the neighborhood.<br />

We are very hopeful that this matter will reach a good outcome on Monday. Our hope is<br />

that Option A will be put to a vote and authorized by the board. We also hope that work on<br />

the sewer can beg in im mediately and t he appropria te bu ilding permits will be granted so<br />

t hat we can be in a position to beg in bulldlnq our home in November.<br />

WITHIN THE VILLAGE OF DEERFIELD<br />

WHEREAS, the Illinois Video Gaming Act (Public Act 96-0034) authorizes video gaming and<br />

the operation <strong>of</strong> video gaming terminals at certain types <strong>of</strong> establishments within the State <strong>of</strong> Illinois;<br />

and<br />

WHEREAS, Section 27 <strong>of</strong> the Illinois Video Gaming Act provides that a municipality may<br />

pass an ordinance prohibiting video gaming within the corporate limits <strong>of</strong> the municipality; and<br />

WHEREAS, the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong> is also a home rule unit <strong>of</strong> local government under the<br />

provisions <strong>of</strong> Article VII, Section 6 <strong>of</strong> the Illinois Constitution; and<br />

WHEREAS, except as limited pursuant to Article VII, Section 6, the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong>, as a<br />

home rule unit <strong>of</strong> local government, has the authority to exercise any power and perform any function<br />

pertaining to its government and affairs, including but not limited to the power to regulate for the<br />

protection <strong>of</strong> the public health, safety and welfare; and<br />

WHEREAS, the corporate authorities <strong>of</strong> the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong> find and determine that is in<br />

the best interests <strong>of</strong> the <strong>Village</strong> and its residents for the <strong>Village</strong> to prohibit video gaming within the<br />

<strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong>, and that the prohibition <strong>of</strong> video gaming in the <strong>Village</strong> as otherwise authorized by<br />

the Illinois Video Gaming Act will promote the public welfare and public safety; and<br />

WHEREAS, this ordinance is being enacted pursuant to both the statutory authority provided<br />

y Section 27 <strong>of</strong> the Illinois Video Gaming Act and also pursuant to the powers which the <strong>Village</strong> <strong>of</strong><br />

<strong>Deerfield</strong> has under the Illinois Constitution as a home rule unit <strong>of</strong> local government; and<br />

WHEREAS, it is the intent <strong>of</strong> the corporate authorities <strong>of</strong> the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong> in enacting<br />

this ordinance to prohibit video gaming and the operation <strong>of</strong> video gaming terminals within the<br />

corporate limits <strong>of</strong> the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong> as would otherwise be allowed under the Illinois Video<br />

Gaming Act.<br />

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF<br />

TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in<br />

the exercise <strong>of</strong> its home rule powers, as follows:<br />

SECTION 1: The recitals to this ordinance as set forth above are hereby incorporated into and<br />

made a part <strong>of</strong> this ordinance.<br />

SECTION 2: That Article 2 (Offenses Against Public Morals) <strong>of</strong> Chapter 15 (Morals and<br />

Conduct) <strong>of</strong> the Municipal Code <strong>of</strong> the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong> be and the same is hereby amended to add<br />

the following as Section 15-19.1 there<strong>of</strong>:<br />

Sec. 15-19.1. Video Gaming Prohibited.<br />

(a) Video gaming is prohibited within the corporate limits <strong>of</strong> the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong>. For<br />

purposes <strong>of</strong> this ordinance, video gaming means the possession, use or operation <strong>of</strong> any<br />

electronic video game machine that, upon insertion <strong>of</strong> cash, is available to play or simulate the<br />

play <strong>of</strong> a video game, including but not limited to video poker, line up, and blackjack, utilizing<br />

a video display and microprocessors in which the player may receive free games or credits that<br />

can be redeemed for cash.<br />

(b) No person shall possess, or maintain any video gaming terminal within the corporate<br />

limits <strong>of</strong> the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong>, except that a person may possess a video gaming terminal if<br />

the terminal is in the process <strong>of</strong> being transported to a location outside the corporate limits <strong>of</strong><br />

the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong>.<br />

(c) Terms used in this Section 15-19.1 that are also used in the Video Gaming Act (Public<br />

Act 96-0034) shall have the same meaning in this ordinance as in the Video Gaming Act.<br />

(d) Any person convicted <strong>of</strong> violating this Section 15-19.1 shall be subject to a fine <strong>of</strong> not<br />

less than $75.00 or more than $500.00 for each <strong>of</strong>fense. A separate <strong>of</strong>fense shall be committed<br />

each time a person operates a video gaming terminal in a manner that violates Section 15-<br />

19.1(a) <strong>of</strong> this ordinance. A separate <strong>of</strong>fense shall be committed each 24 hour period, or part<br />

there<strong>of</strong>, that a person is in possession <strong>of</strong> or maintains a video gaming terminal in violation <strong>of</strong><br />

Section 15-19.1(b) <strong>of</strong> this ordinance or is in possession <strong>of</strong> any other electronic gaming machine<br />

that can be used for video gaming in violation <strong>of</strong> Section 15-19.1(a) <strong>of</strong> this ordinance.<br />

(e) Any video gaming terminal and any other electronic gaming machine that can be used<br />

for video gaming that is the subject <strong>of</strong> a violation <strong>of</strong> Section 15-19.1 <strong>of</strong> this Ordinance shall be<br />

subject to seizure and shall be subject to forfeiture upon a finding <strong>of</strong> guilty <strong>of</strong> any person for a<br />

violation <strong>of</strong> this ordinance. Upon appropriate order <strong>of</strong> court or administrative hearing <strong>of</strong>ficer,<br />

said video gaming terminal or other electronic gaming machine shall be destroyed.<br />

SECTION 3: If any section, subsection, paragraph, sentence, clause, phrase or provision <strong>of</strong><br />

this Ordinance or the application there<strong>of</strong> to any person or circumstance is, for any reason, held invalid<br />

or unconstitutional by any court <strong>of</strong> competent jurisdiction, such portion shall be deemed to be a<br />

separate, distinct and independent provision and such holding shall not affect the validity <strong>of</strong> the<br />

remaining portions <strong>of</strong> this ordinance or the application <strong>of</strong> such portion to other persons or<br />

circumstances.<br />

SECTION 4: This ordinance and each <strong>of</strong> its terms shall be the effective legislative act <strong>of</strong> a<br />

home rule municipality without regard to whether such ordinance should (a) contain terms contrary to<br />

the provisions <strong>of</strong> current or subsequent non-preemptive state law, or (b) legislate in a manner or<br />

regarding a matter not delegated to municipalities by state law. It is the intent <strong>of</strong> the corporate<br />

authorities <strong>of</strong> the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong> that to the extent that the terms <strong>of</strong> this ordinance should be<br />

inconsistent with any non-preemptive state law, that this ordinance shall supersede state law in that<br />

regard within its jurisdiction.<br />

SECTION 5: This ordinance shall be in full force and effect upon its passage and approval<br />

and shall subsequently be published in pamphlet form as provided by law.<br />

VIDEO GAMING: MYTHS VS. REALITIES<br />

MYTH: T hc bill a llowing vidco ga ming was r ushc d through th c Icgislaturc.<br />

REALITY: In fact, the Illinois legislature, which has worked on thc bill for a number <strong>of</strong> years,<br />

acted carefully and prudently. Five different publi c hearings were held this year for which more<br />

than 100 witness slips were filed, allowing for comment from interested parties on both sides <strong>of</strong><br />

the issue.<br />

MYTH: T he Illinois Gam ing Boa rd docs not h avc th e capacity to regula te vidc o ga m ing.<br />

REALITY: The Illinois Gaming Board (1GB) has earned high marks for its ability to regulate<br />

other legalized gaming industries in Illinois and is current ly draft ing its plans to oversee and<br />

regulate video gaming opera tions and the licensees who install the machines.<br />

MYTH: Vide o ga ming will bring socia l problem s like pathological ga mbling a nd highcr<br />

cri mc rates to communitics that a llow video gaming.<br />

REALITY: The U.S. Government Accou ntability Office (GAO) reports it has found no evidence<br />

<strong>of</strong>a link between convenience gambling and path ological gambling, bankruptcy , crime rates or an<br />

inercase in social problems in states where convenience gambling is legal.<br />

MYTH: Vide o gam iug under th c new rulcs opens th e door to erimiual influeuee.<br />

REALITY: Just the opposite: The law requires extensive criminal and financial background<br />

investigation <strong>of</strong> manufacturers, distributors and operators, all <strong>of</strong> whom must be licensed. Th ere<br />

can be no cross-ownership. These measures will eliminate any potential criminal influence.<br />

Legalizing video gaming also should hclp discourage the illegal gambling that already exists and<br />

that <strong>of</strong>ten docs have tics to organized crime. The 1GB will have the right to turn <strong>of</strong>f any gam es<br />

operated by a location or terminal operator that docs not confirm to the rules and regulations.<br />

This will insure that all licensees will abide by the laws and guidelines <strong>of</strong>age control, payment<br />

<strong>of</strong> taxes or other rules put into effect.

My react ion in general about the ban on internet gambling is that it is very hard to have a prohibitionist<br />

regulatory mechanism that works. The fact <strong>of</strong> the matter is that in the United States the vast majority <strong>of</strong><br />

people according to recent surveys want to gamble . And they would like to be able to gamble online and<br />

in a democratic society that values liberty, most peop le think they should have the opportunity to<br />

gamble.<br />

You need to understand how people actually gamble online and what their behavior patterns are. We in<br />

fact have done that at the Division on Additions that have published the first study in the world that<br />

tracked actual gamblers in their actual gambling behavior patterns over a long period. When you study<br />

land based gamblers it is very hard to track all their gambling activity. But when you study online<br />

gamblers the computer actually tracks everything they do in all the cond itions under which they wager .<br />

The very first thing we learned which we didn't expect was that the vast majority <strong>of</strong> gamblers online<br />

gamble in a very moderate and mild way . In the scientific community there has been a long held model<br />

that increased exposure and accessibility to gambling would proportionately increase the amount <strong>of</strong><br />

gambling related problems. In fact, the scientific evidence does not support that. In the United States for<br />

example, in the middle 1970's the rate <strong>of</strong> gambling disorders was approximately 0.7%. Just under three<br />

quarters <strong>of</strong> one percent. Now more than 30 years later the new research done by var ious investigators<br />

suggests that it is closer to 0.6%, let's call it about the same. And that's despite the fact that gambling<br />

has expanded dramatically all across th is country. I don't think gambling proh ibition is going to work. I<br />

do think however that education, information, public awareness and other regulatory activity around<br />

truth in advert ising all can be very effective means to help people gamble in a reasonable and healthy<br />

way.<br />

Problem Gambling Expert Says<br />

Prohibition <strong>of</strong> Gaming Ineffective<br />

One <strong>of</strong> the top experts in problem gambling in the world asserted that<br />

prohibition <strong>of</strong> gambling does not work in preventing the disorder or lowering<br />

the number <strong>of</strong> victims.<br />

Joanna Franklin, president <strong>of</strong> the Institute on Problem Gambling, says<br />

treatment helps prevent problem gambling incidents, but prohibition <strong>of</strong><br />

gambling does not work. Franklin says compulsive gambling victims will find<br />

a way to gamble regardless <strong>of</strong> laws restricting gaming options.<br />

"Treatment, not prohibition, is the best way to treat problem gamblers," said<br />

Franklin. Franklin is noted for having designed clinical training programs for<br />

the treatment <strong>of</strong> problem gambling in 45 states, most Canadian provinces,<br />

and nine other countries.<br />

Franklin said a law such as the Illinois Video Gaming Act properly addresses<br />

the issue, by providing direct funding for treatment. The new law gives the<br />

Illinois Department <strong>of</strong> Human Resources $2.5 million annually to create and<br />

run treatment programs.<br />

Local governments in Illinois, relying on misleading information provided by<br />

anti-gambling factions, have had debates on whether to allow the video<br />

gambling mentioned in counties and municipalities. Some have called on<br />

rejection <strong>of</strong> the electronic gaming, which would fund a $30 billion state<br />

infrastructure overhaul, because <strong>of</strong> the mistaken belief that installing the<br />

machines would increase problem gambling.<br />

"We understand that gambling addiction is a serious problem," Tom Fiedler,<br />

president <strong>of</strong> the Illinois Coin Machine Operators Association told Reuters.<br />

"But it is one that affects only a small percentage <strong>of</strong> the population."<br />

Psychological Medicine magazine recently cited a study finding that problem<br />

gambling figures remain constant at less than three percent <strong>of</strong> the<br />

population, regardless <strong>of</strong> local gaming laws.

described herein (the “Subject Property”) have petitioned for a variation from the minimum interior<br />

side yard setback requirements <strong>of</strong> Article 4.03-F, Paragraph 3, Subparagraph b, <strong>of</strong> the Zoning<br />

Ordinance <strong>of</strong> the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong>, as amended, to permit the construction <strong>of</strong> an attached two-car<br />

garage addition extending the west wall <strong>of</strong> the existing structure 20.0 feet toward the west property<br />

WHEREAS, the Board <strong>of</strong> Zoning Appeal <strong>of</strong> the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong> held a public hearing<br />

on September 1, 2009 to consider said petition, said hearing being held pursuant to public notice<br />

duly given and published as required by statute and conforming in all respects, in both manner and<br />

form, with the statutes <strong>of</strong> the State <strong>of</strong> Illinois and the Zoning Ordinance <strong>of</strong> the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong>;<br />

and,<br />

WHEREAS, the Board <strong>of</strong> Zoning Appeals has filed its report with the President and Board<br />

<strong>of</strong> Trustees <strong>of</strong> the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong> containing its written findings that the requested variation<br />

conforms to the standards for variations set forth in Article 13.07-E <strong>of</strong> the Zoning Ordinance <strong>of</strong> the<br />

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF<br />

TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in<br />

the exercise <strong>of</strong> its home rule powers, as follows:<br />

SECTION 1: That the findings <strong>of</strong> fact and recommendations <strong>of</strong> the Board <strong>of</strong> Zoning<br />

Appeals are concurred in and adopted as the findings <strong>of</strong> fact <strong>of</strong> the President and Board <strong>of</strong> Trustees<br />

<strong>of</strong> the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong>.<br />

SECTION 2: That the Petitioners have proven to the satisfaction <strong>of</strong> the Board <strong>of</strong> Zoning<br />

Appeals and the Board <strong>of</strong> Trustees that strict performance <strong>of</strong> the requirements <strong>of</strong> Article 4.03-F,<br />

Paragraph 3, Subparagraph b, <strong>of</strong> the Zoning Ordinance <strong>of</strong> the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong> for a minimum<br />

combined total side yard width <strong>of</strong> not less than 20 feet will pose practical difficulty or unnecessary<br />

hardship as applied to the following described property (the “Subject Property”) unless varied as<br />

provided herein:<br />

Lot 4 <strong>of</strong> the resubdivision <strong>of</strong> lot A <strong>of</strong> Tallman’s subdivision, being a subdivision <strong>of</strong><br />

part <strong>of</strong> the SW 1/4 <strong>of</strong> Section 28, Township 43 North, range 12 east <strong>of</strong> the third<br />

principal meridian, in the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong>, according to the Plat <strong>of</strong> said<br />

resubdivision recorded July 25, 1962, as document 1156630, in book 37 <strong>of</strong> Plats<br />

page 44, Lake County, Illinois.<br />

SECTION 3: That a 2.166 foot variation from the strict provisions <strong>of</strong> Paragraph 3,<br />

Subparagraph b, <strong>of</strong> Article 4.03-F <strong>of</strong> the Zoning Ordinance <strong>of</strong> the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong>, as amended,<br />

is hereby granted with respect to the Subject Property to permit the construction <strong>of</strong> an attached two-<br />

car garage addition extending the west wall <strong>of</strong> the existing one-story residence 20.0 feet toward the<br />

west property line, and within 9.083 feet <strong>of</strong> the west property line <strong>of</strong> the Subject Property to create a<br />

combined side yard setback <strong>of</strong> 17.833 feet in lieu <strong>of</strong> the requirement for a combined total side yard<br />

width <strong>of</strong> not less than 20 feet, provided that such addition shall be constructed and maintained in<br />

strict accordance with and to the extent provided by the following plans and supporting material<br />

submitted by Petitioner and describing the proposed addition: (i) sheet 1 <strong>of</strong> an undated sketch plan<br />

depicting a site plan for the existing house and garage addition, a side view <strong>of</strong> the proposed garage<br />

addition, a rear view <strong>of</strong> the proposed garage addition and construction details for the garage<br />

foundation, slab, wall and ro<strong>of</strong>; (ii) sheet 2 <strong>of</strong> an undated sketch plan depicting the front view <strong>of</strong> the<br />

existing one-story single-family residence with the new garage addition, and a floor plan for the<br />

existing one-story residence with the new garage addition; and, (iii) a plat <strong>of</strong> survey for the Subject<br />

Property by Northern Illinois Survey, Inc. dated November 17, 2008.<br />

SECTION 4: That the variation hereby granted is subject to Petitioner’s compliance with<br />

the requirements <strong>of</strong> this Ordinance, with all provisions <strong>of</strong> the Zoning Ordinance <strong>of</strong> the <strong>Village</strong> <strong>of</strong><br />

<strong>Deerfield</strong> and with all other applicable codes and ordinances <strong>of</strong> the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong>.<br />

SECTION 5: That this Ordinance, and each <strong>of</strong> its terms, shall be the effective legislative act<br />

<strong>of</strong> a home rule municipality without regard to whether such Ordinance should: (a) contain terms<br />

contrary to the provisions <strong>of</strong> current or subsequent non-preemptive state law; or, (b) legislate in a<br />

manner or regarding a matter not delegated to municipalities by state law. It is the intent <strong>of</strong> the<br />

corporate authorities <strong>of</strong> the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong> that to the extent that the terms <strong>of</strong> this Ordinance<br />

should be inconsistent with any non-preemptive state law, this Ordinance shall supersede state law<br />

in that regard within its jurisdiction.<br />

SECTION 6: That this Ordinance shall be in full force and effect from and after its passage,<br />

approval and publication in pamphlet form as provided by law.<br />

RESOLUTION NO. _<br />

A RESOLUTION APPROVING AND AUTHORIZING<br />

EXECUTION OF A FIRST AMENDED AND RESTATED DECLARATION OF TRUST<br />

WHEREAS, the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong>, Illinois (the " <strong>Village</strong> "), desires to participate in<br />

the joint investment <strong>of</strong> certain <strong>of</strong> its funds in accordance with the Constitution and laws <strong>of</strong> the<br />

State <strong>of</strong> Illinois (the "Slale"); and<br />

WHEREAS, Section I0 <strong>of</strong> Article VII <strong>of</strong> the Constitution <strong>of</strong> the State provides that the<br />

State shall encourage intergovernmental cooperation and use its technical and financial resources<br />

to assist intergovernmental activities among its units <strong>of</strong> local government; and<br />

WHEREAS, the Intergovernmental Cooperation Act , as amended, provides a statutory<br />

framework that supplements the constitutional grant <strong>of</strong> intergovernmental cooperation powers<br />

found in said Section 10 <strong>of</strong>Article VII ; and<br />

WHEREAS, Section 5 <strong>of</strong> the Intergovernmental Cooperation Act, as amended, provides<br />

that anyone or more municipalities may contract with anyone or more other municipalities to<br />

perform any governmental service, activity or undertaking which any <strong>of</strong>the municipalities<br />

entering into the contract is authorized by law to perform, provided that such contract shall be<br />

authorized by the corporate authorities <strong>of</strong>each party <strong>of</strong>the contract; and<br />

WHEREAS, such contract shall set forth fully the purposes, powers, rights, objectives<br />

and responsibilities <strong>of</strong>the contracting parties; and<br />

WHEREAS, Section 1-1-5 <strong>of</strong>the Illinois Municipal Code, as amended (the "Municipal<br />

Code "), provides among other things, that the corporate authorities <strong>of</strong>each municipality may<br />

exercise jointly, with one or more other municipal corporations or governmental subdivisions or<br />

districts, all <strong>of</strong>the powers set forth in the Municipal Code; and<br />

WHEREAS, Section 3.1-35-50 <strong>of</strong>the Municipal Code provides, among other things, that<br />

each municipal treasurer is permitted to join with other municipal treasurers or municipalities for<br />

the purpose <strong>of</strong> investing the municipal funds <strong>of</strong> which the treasurer has custody; and<br />

WHEREAS, treasurers <strong>of</strong>certain Illinois municipalities have established the Illinois<br />

Metropolitan Investment Fund (the "Fund"), with the assistance <strong>of</strong>the five metropolitan<br />

Chicago Councils <strong>of</strong>Government, for the purpose <strong>of</strong>combining their respective available<br />

investment funds so as to enhance the investment opportunities available to them and increase<br />

the investment earnings accruing to the benefit <strong>of</strong>the respective municipalities on behalf<strong>of</strong><br />

which they act; and


WHEREAS, the Fund's assets can onl y be invested in instruments authorized by the<br />

Public Funds Investment Act, as amended, and<br />

WHEREAS, pursuant to a Declaration <strong>of</strong>Trust, dated as <strong>of</strong> September 1, 1995 (the<br />

"Original Declaration ") certain municipal treasurers (known as " Participants") entered into an<br />

agreement establishing an entity for joint investment for the purpose <strong>of</strong> combining their<br />

respective available investment funds so as to enhance the investment opportunities available to<br />

them and increase the investment earnings acc ruing to the benefit <strong>of</strong> the respective municipalities<br />

on behalf <strong>of</strong> which they acted, pursuant to the aforementioned constitutional and statutory<br />

authority : and<br />

WHEREAS, the Original Declaration was amended and restated by adoption <strong>of</strong> that<br />

certain First Amended and Restated Declaration <strong>of</strong>Trust, dated as <strong>of</strong> July 1, 1996 and<br />

incorporating amendments dated January 28, 1999 , January 27 , 2000, March 22, 2002, March 18,<br />

2004, and May 9, 2007 (th e Original Declaration, as amended by the Amended and Restated<br />

Declaration <strong>of</strong>Trust, hereinafter referred to as the "Declaration <strong>of</strong> Trust ").<br />

WHEREAS, no municipal treasurer shall become a Participant in the Fund unless and<br />

until such <strong>of</strong>ficer has adopted the Declaration <strong>of</strong>Trust and identified the municipality with<br />

respect to the funds <strong>of</strong> which he is acting; and<br />

WHEREAS, the corporate authorities <strong>of</strong>each Participant's municipality mu st also<br />

authorize the Declaration <strong>of</strong>Trust; and<br />

WHEREAS, the <strong>Village</strong> <strong>of</strong><strong>Deerfield</strong> deems it necessary and in the best interests <strong>of</strong> the<br />

<strong>Village</strong> to participate in the Fund by having the <strong>Village</strong> become a Participant; and<br />

NOW, THEREFORE BE IT RESOLVED BY THE VILLAGE OF DEERFIELD,<br />

COUNTIES OF LAKE AND COOK, ILLINOIS, IN THE EXERCISE OF ITS POWERS,<br />

AS FOLLOWS:<br />

Section 1. The preambles to this Resolution are hereby found and determ ined to be<br />

true, correct and complete and are hereby incorporated into the text <strong>of</strong> this Resolution by this<br />

reference as set out herein at length.<br />

Section 2. The First Amended and Restated Declaration <strong>of</strong> Trust is attached hereto<br />

and by this reference incorporated herein and made a part here<strong>of</strong>: is hereby adopted, and the<br />

<strong>Village</strong>, is hereby authorized to become and additional Participant <strong>of</strong> the Fund.<br />

Section 3. Th e Mayor and <strong>Village</strong> Clerk and other <strong>of</strong>ficers or employees <strong>of</strong> the<br />

<strong>Village</strong> are hereby empowered and directed to execute and deli ver all documents, certificates and<br />

other instruments necessary to further the intent and purpose <strong>of</strong> this Resolution.<br />

The <strong>Village</strong> has received an <strong>of</strong>fer from <strong>Deerfield</strong> Shopper’s Court LLC to purchase 4,073 square feet <strong>of</strong><br />

<strong>Village</strong> property currently developed with parking spaces and landscaping at the rear <strong>of</strong> Shoppers Court<br />

located at 646-660 <strong>Deerfield</strong> Road. An independent appraisal was conducted that valued the property at<br />

$61,000. The $52,000 <strong>of</strong>fer requests that the improvements recently installed by <strong>Deerfield</strong> Shopper's Court<br />

on the subject parcel, valued at just over $16,000, be considered to partially <strong>of</strong>fset the appraisal value.<br />

The property was originally used by the <strong>Village</strong> in the 1970’s to host a recycling center drop-<strong>of</strong>f location<br />

and is no longer needed for <strong>Village</strong> operations.<br />

Based on the <strong>of</strong>fer meeting the independent appraisal value, including partial consideration for the recent<br />

on-site improvements, the <strong>Village</strong> Attorney was asked to prepare the necessary ordinance for sale <strong>of</strong> the<br />

property. It is recommended that a real estate sale contract, in keeping with the September 10, 2009 <strong>of</strong>fer<br />

letter from <strong>Deerfield</strong> Shopper’s Court LLC, be authorized for execution upon final adoption <strong>of</strong> the<br />

ordinance.<br />

WHEREAS, the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong> owns a parcel <strong>of</strong> real estate described by<br />

permanent real estate index number 16-28-300-015 (the “Subject Property”) that contains<br />

approximately 4,073 square feet, that is surrounded on three sides by the parking lot for<br />

<strong>Deerfield</strong> Shoppers Court, that is land locked on all sides and that has restricted access over the<br />

abutting parcels; and,<br />

WHEREAS, the corporate authorities <strong>of</strong> the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong> have determined that<br />

the Subject Property is no longer necessary, convenient or useful for the public purposes <strong>of</strong> the<br />

<strong>Village</strong>; and,<br />

WHEREAS, <strong>Deerfield</strong> Shoppers Court, LLC has submitted an <strong>of</strong>fer to purchase the<br />

Subject Property at a price <strong>of</strong> $52,000 on the terms set forth in the real estate sale contract<br />

attached hereto as Exhibit A for assemblage as part <strong>of</strong> the <strong>Deerfield</strong> Shoppers Court shopping<br />

center; and,<br />

WHEREAS, the corporate authorities <strong>of</strong> the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong> have determined that it<br />

is in the best interests <strong>of</strong> the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong> to sell and convey the Subject Property to<br />

<strong>Deerfield</strong> Shoppers Court LLC as provided herein;<br />

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF<br />

TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,<br />

ILLINOIS, in the exercise <strong>of</strong> its home rule powers, as follows:<br />

SECTION 1: That the above and foregoing recitals, being material to this Ordinance, are<br />

hereby incorporated and made a part <strong>of</strong> this ordinance as if fully set forth herein.<br />

SECTION 2: That the President and Board <strong>of</strong> Trustees <strong>of</strong> the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong> do<br />

hereby authorize and approve the sale <strong>of</strong> the Subject Property to <strong>Deerfield</strong> Shoppers Court, LLC<br />

on the terms and conditions stated in the Real Estate Sale Contract attached hereto as Exhibit A.<br />

SECTION 3: That the <strong>Village</strong> Manager is authorized and directed to execute said Real<br />

Estate Sale Contract for and on behalf <strong>of</strong> the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong>.<br />

SECTION 4: That the President, <strong>Village</strong> Clerk and <strong>Village</strong> Attorney <strong>of</strong> the <strong>Village</strong> <strong>of</strong><br />

<strong>Deerfield</strong> be and they are hereby authorized and directed to execute, attest and deliver such<br />

documents as may be necessary or appropriate to complete the conveyance <strong>of</strong> the Subject<br />

Property as provided in the Real Estate Sale Contract.<br />

SECTION 5: That this Ordinance, and each <strong>of</strong> its terms, shall be the effective legislative<br />

act <strong>of</strong> a home rule municipality without regard to whether such Ordinance should: (a) contain<br />

terms contrary to the provisions <strong>of</strong> current or subsequent non-preemptive state law; or, (b)<br />

legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the<br />

intent <strong>of</strong> the corporate authorities <strong>of</strong> the <strong>Village</strong> <strong>of</strong> <strong>Deerfield</strong> that to the extent that the terms <strong>of</strong><br />

this Ordinance should be inconsistent with any non-preemptive state law, this Ordinance shall<br />

supersede state law in that regard within its jurisdiction.<br />

SECTION 6: That this Ordinance shall be in full force and effect from and after its<br />

passage, approval and publication in pamphlet form as provided by law.<br />

The property was originally used by the <strong>Village</strong> in the 1970's to host a recycling center<br />

improved parking area for Shopper's Court and is not needed for <strong>Village</strong> operations.<br />
