Deerfield Citgo Becomes First Green Gas Station In America
David Welch is concerned about his community toda y and the world he will leave to his 9 year
old daughter Ina. Dave is also an indepe ndent owner of a Citgo gas station in Deerfield, Illinois.
He thought it was an oxymoron to have a Green gas station . Then Dave met Izzy Kharasch a
Certified Green Consultant and owner of Green Hospitality Certified which is under the auspices
of the Green Business League.
Izzy was able to show Dave that becoming a Certified Green Business was not about the
product that he sold but more about the day-to-day practices that impact the health of his
customers and his community.
Dave and Izzy worked hard to lessen the carbon footprint of the Deerfield Citgo station. First,
Dave does not use any chemicals to power wash his property. This means, unlike other gas
stations he is not sending any toxins into his community water system . Many days Dave won 't
use any community water to clean or water his plants . This is because his Citgo station now has
two rain barrels that collect much of the water he uses for these functions.
The Deerfield Citgo now does indoor air quality tests every 6 months to detect any potential
problems such as mold . When the gas station needed painting on the interior they utilized low
vac paints. To cut down on electricity Dave insta lled a programmable thermostat that cuts out
8 hours of air conditioning per day in the summer and lowers the heat 8 hours a day in the
winter. Another way to control the energy used was by installing insulated glass windows.
During the assessment Izzy noticed that the bathroom light was on all day and that there were
times when customers left water running in the sink. Dave installed motion detectors so that
lights are only on when customers actually go into the bath room and the sink is also on a
motion detector so that when customers finish washing their hands the water goes off
automatically.
Dave got rid of any toxic cleaning agents and now only utilizes safe, green products. As Dave
moves forward all of the light bulbs will be changed low wattage which will utilize 80-90% less
electricity. All carry out material will be biodegradable; all paper goods non-chlorine processed
and even the frozen Coke machine is on a timer to insure that it uses less electricity.
Dave Welch is making a statement to his community and that is that even if you own a gas
station you can still be a respons ible steward of earth, change our carbon foot print, use less
energy and create a healthier environment for our customers and families .

PUBLIC COMMENT Aaron and Ura Eisenberg, 330 Landis, showed a
PowerPoint presentation which explained what has
occurred with their purchase of the property at 1010 Warrington. Mr. Eisenberg reiterated they
believe they have done everything right, yet despite their efforts they find themselves in a very
unfortunate situation. They are requesting a fair, equitable and timely resolution to the problem
so they can build their home at 1010 Warrington. They are asking for continued cooperation
from the Village, including help in expediting the IEPA request in any way possible. They
request the Trustees bring this matter to a formal vote at the October 19 Board of Trustees
meeting. Mr. Eisenberg also requested the Village pay 100% of the remediation costs associated
with the repair/reroute of the sewer.
Mayor Rosenthal thanked the Eisenbergs for their report. She understands it is a difficult
situation and gave her assurance that the Board would move as quickly as possible to do what is
fair for both the Eisenbergs and the Village. Trustee Seiden noted the Village does not take this
Oscar Adler, 50 Eastwood, reported that Lake County Administrator Barry Burton is his guest
this month on Adler’s Alley.
REPORT ON DEPARTMENTAL Principal Planner Jeff Ryckaert presented highlights
OBJECTIVES – BUILDING AND from the Planning Department’s semi-annual report.
PLANNING DIVISIONS Mr. Ryckaert noed that the 2010 census is coming
up quickly. Questionnaires will have 10 questions
and are easy to complete. The information is completely confidential. Mr. Ryckaert stressed
that it is important for every household to participate. He noted that the Planning Department
has continued to work with the census bureau on the accuracy of addresses.
Mr. Ryckaert mentioned the two year period for compliance with the window signage ordinance
has expired. Most businesses within the Village are in compliance. The few that are not in
compliance have been notified. The department is working with businesses to keep an attractive
business district in Deerfield.
Mr. Ryckaert noted that Kathy Von Ohlen is on the Lake County Wind Energy Task Force.
They are working on sustainability issues and are working to complete a draft ordinance on wind
energy systems. The Takeda Phase II project is a major sustainability project in Deerfield.
Staff has taken an inventory of available sites in the Village and given the list to Lake County
Partners. Anyone looking for space in the County will have access to the list. Staff will also
meet with Jack Frigo soon to further discuss the options.
Mr. Ryckaert mentioned there has been a lot of commission activity within the past six months.
The Plan Commission has tackled a wide variety of projects, including the proposed Village
Green and the wastewater treatment facility. They also worked on the workforce housing issue.
The Appearance Review Commission has met on 17 requests over the past six months. There
are also two new retailers coming into the Village. The Village Center Development
Commission held four meetings over the last six months. They had their annual walk of
Downtown Deerfield and have been kept informed on what is happening in the Village Center.
Mr. Ryckaert mentioned the redesigned website is working out very well.
Mr. Street thanked Mr. Ryckaert and Ms. Von Ohlen for their work on the website. Mayor
Rosenthal thanked Mr. Ryckaert for the green initiatives that have been implemented within the
Planning Department. She also reiterated the importance of having an accurate census.
Enforcement Officer Clint Case presented highlights from the Building Department’s semiannual
report. He noted that general construction statistics have substantially decreased from the
same reporting period last year. There have been almost 150 fewer permits, but the amount of
revenue for fees and valuation increased slightly because of Takeda. Mr. Case mentioned the
number of foreclosures has stabilized to approximately 30 units. Temporary permits are slow,
with only 185 being issued over the past six months. The Performance Guarantee Ordinance was
put in place, and it causes contractors to push permits more expeditiously.
Board of Trustees meeting
Mr. Case mentioned the Village’s ISO rating increased by two points, which is substantial.
Trustee Jester asked if that would improve insurance rates and Mr. Case replied affirmatively.
Mr. Case also noted that the Department will be working on a comprehensive study of all fees
within the Municipal Code.
Mayor Rosenthal asked Mr. Case to keep the Trustees up to date on foreclosures in Deerfield.
Mr. Case agreed to provide a written report on a monthly basis. Mayor Rosenthal asked how
many homes are for sale in Deerfield and the average length of time it takes for a home to sell
now versus two years prior. Mr. Case will provide a report with that information. Mr. Street
added that the report should also include other communities for comparison. He also
commended the Department on the ISO increase.
REPORTS
ORDINANCE PROHIBITING VIDEO An Ordinance prohibiting video gaming within the
GAMING WITHIN DEERFIELD Village of Deerfield. First Reading.
Trustee Oppenheim wanted to let residents know that the Village considers all ways to raise
revenues in Deerfield to take the burden off tax payers, but she does not feel this is a worthwhile
source of revenue, given the trade offs. Mr. Street mentioned he received information from the
Illinois Coin Machine Operators, who are in favor of the ordinance. He will distribute the
information to the Trustees to review.

AUTHORIZATION FOR Village Engineer Bob Phillips reported the design
SUPPLEMENTAL ENGINEERING process is nearing completion. It includes a
SERVICES FOR THE CARLISLE complete reconstruction of the existing roadway,
AVENUE/CARRIAGE WAY AND water main replacement, sanitary and storm sewer
HAZEL AVENUE/CHESTNUT STREET system repairs, etc. URS Corporation was
INFRASTRUCTURE REPLACEMENT requested to revise project plans to expand possible
PROJECTS low interest funding opportunities from ARRA and
the IEPA. Additional services will cost $31,812.48.
Mayor Rosenthal asked if the Village has a chance of getting ARRA funding. Mr. Phillips
responder that there will be a second round of ARRA funding, and he believes having the
projects shovel ready would help the Village’s chances. He thinks the Village has a good chance
for both sources of funding. Mr. Street added the Village would not have any chance if the
revised project plans are not done. He believes it is worth the investment to avail the Village of
these funding opportunities. Trustee Oppenheim ensured that money the Village would receive
is in excess of the amount they would invest on revised plans. She asked what the timing would
be. Mr. Street responded that engineering will be completed now so that projects will be ready
for the funding.
Trustee Jester made a motion to authorize supplemental engineering services for the Carlisle
Avenue/Carriage Way and Hazel Avenue/Chestnut Street infrastructure replacement projects in
an amount not to exceed $31,812.48. Trustee Oppenheim seconded the motion. The motion
passed by the following vote:
AUTHORIZATION TO PURCHASE ONE The Director of Public Works and Engineering
2010 TRUCK WITH DUMP BODY AND reported that at the August 17, 2009 Board of
SALT SPREADER WITH PRE-WETTING Trustees meeting, the Board voted to authorize the
SYSTEM (REPLACEMENT FOR purchase of one 2010 truck with dump body and
PREVIOUS AWARD) salt spreader with pre-wetting system from the
authorized State of Illinois truck supplier. It was
later determined that the International Truck Company that was awarded the contract was not the
authorized State of Illinois bidder. Staff directly solicited bids for the replacement vehicle
because the previous award was null and void. Three bids for the truck were received. Chicago
International Truck was the low bidder. The truck met required specifications. In the last five
years, the Village has purchased parts and service from Chicago International Truck. The
Director of Public Works and Engineering recommends the Board authorize the purchase of one
2010 International 36,220 GVWP dump truck with plow and salt spreader with pre-wetting
system from Chicago International Truck in a net amount not to exceed $106,446 including trade
in. Mayor Rosenthal noted the Village had not known the original award was not made under
the State contract.

Trustee Jester made a motion to authorize the purchase of one 2010 International 36,220 GVWP
dump truck with plow and salt spreader with pre-wetting system from Chicago International
Fifth month of the fiscal year. Sales tax and water/sewer revenues rebound somewhat. Total operating
revenues still exceeding operating expenditures, although within sewer fund year to date revenues are
lagging expenditures. Hotel tax dropped, and the full fiscal year projection has been reduced. The police
retro was paid out in September, but overall expenditures are below expectation and budget. The bulk of
the second installment of Lake County taxes was received during the month.
CASH AND INVESTMENTS
As of September 30,2009, 100% of available cash was invested at an estimated average interest rate of
1.05% compared to an average rate of 0.12% for the 90-day Treasury bill.
INTERDEPARTMENTAL MEMORANDUM
Mayor Rosenthal and Board ofTrustees
Kent S. Street, Village Manager
October 15,2009
1010 Warrington Sewer Easement
As the Board is aware, an existing Village sanitary sewer bisects the property at 1010
Warrington Road under the current house built in the 1950's. The new owners ofthe
property, Aaron and Leorah Eisenb erg, have submitted building plans to construct a new
home on the property and desire to resolve conflicts resulting from the sewer's location.
Pursuant to the Board 's direction to develop a recommendation to address the matter,
staff and the Village attorney have worked to develop two viable options. Attached are a
listing ofeach option's provisions, an exhibit depicting the property and correspondence
from Mr. Eisenberg endorsing Option A.
Options
Under Option A, the sewer is kept in its present location, relined and tested by the Village
to verify its integrity and the owners will proceed to have the new home constructed
using construction techniques approved by the Village that will protect the sewer. An
easement formali zing the Village's authority to clean and maintain the sewer, as well as a
new easement to relocate the sewer ifnecessary in the future , would be granted to the
Village. The cost to reline and test the sewer is estimated to be $10,000 and time to
implement the sewer work is approximately 4 weeks .
Under Option B, a new line would be constructed along the edge ofthe property
according to a 50/50 cost sharing arrangement with the owner, and the existing line
would be abandoned. An easement formalizing the Village authority for the sanitary
sewer would be granted. The total cost to construct the new sewer and abandon the
existing one is estimated to be $50,000 and the time to implement it is approximately 6
weeks.
Recommendation
In view ofthe impacts, costs and trade-offs ofeach option, it is recommended that Option
A be approved and the Mayor and Village Attorney be authorized to execute the
necessary easement documents consistent with the provisions ofOption A. Staff and the
Village Attorney will be available to review the matter and respond to questions at the
October 19,2009 Village Board meeting.
EASEMENT PROPOSAL
The Village of Deerfield proposes the following options for Owners' consideration to
resolve the issues relating to the sanitary sewer and easement that currently bisects the property
at 10lD Warrington Road:
A. Leave Sanitary Sewer in Place.
The Village is confident that the current sanitary sewer can be left in place without
impairing or limiting the construction and use of a new single-family house on the subject
property, or the continued use of the sanitary sewer. The following terms and conditions would
apply to this option:
Page 1 of2
10-14-09
1. Owners would grant an express easement to the Village covering the route of the
current sewer, and a second easement to the Village covering the potential route
of a replacement sewer corresponding to the easement proposed under Option B
below.
2. Owners would be allowed to proceed immediately with construction ofa home on
the subject property in accordance with the previously submitted building plans.
3. The easement granted to the Village for the existing sewer would NOT allow the
Village access to the easement and to the sewer running below the new house
except through the pipe itself. The only exception is that the Village would have
usual easement rights for an area 10 feet wide and 10 feet in length extending
from the west property line ofthe subject property, centered on the sanitary sewer
manhole and the underground sewer.
4. Under the easement agreement the Village would agree to indemnify the Owners
and all succeeding owners ofthe property for any and all personal injury or
property damage relating to or arising out ofthe presence ofthe sanitary sewer
running beneath the new house. So long as Owners construct their home in
accordance with building plans approved by the Village, and exercise ordinary
care in conducting their construction activities pursuant to such plans, Village
agrees that Owner will not be responsible or liable for any injury ofdamage to the
sewer caused by the Village permitting Owner's house to be constructed above the
route ofthe current sewer.
5. If at any point in the future the Village needed or decided to enlarge, improve or
replace the sanitary sewer, the sewer running underneath the house would be
abandoned, and a new sewer would be constructed at Village's expense within the
confines of the alternate sanitary sewer easement described in Option B below.
There would be no right to replace the sewer in its current location. This
easement would be disclaimed at that time.
B. Relocation of Sanitary Sewer.
1. If the property owners desire that the sewer be relocated at this time , a new
sanitary sewer easement would be granted along a route that will be more
particularly described at a later date, but generally along the route described in the
sketch attached hereto.
2. The specifications for the new sewer will be determined by the Village
Engineering Department.
3. The Village will contribute 50% of the final actual cost, up to a maximum of
$25,000, of constructing the new sewer, including engineering fees incurred by
the Owners.
4. The sewer would be constructed by the Owners using a private contractor selected
by Owners and approved by the Village. The construction would be under the
general supervision ofthe Village Engineering Department.
5. The Village will cause the existing sanitary sewer to be abandoned in place and
will provide Owner with a disclaimer of any easement claim to the current
sanitary sewer.
c. Title Insurance.
Page 2 of2
10-14-09
1. Any title insurance proceeds recovered by Owners shall belong exclusively to the
Owners.

Subject RE: Easement Proposal Outline
First, I'd like to thank you for your continued efforts to help find a resolution t o our situation
at 1010 Warrington. We have been very encouraged over the last week by the village's
willingness to work dlrectly with us to find the right answer.
We have rev iewed the Easement Proposal and Exhibit. At th is time, we strongly endorse
and would like to move forward with Option A as described - leaving t he sanitary sewer in
place and applying the epoxy-resin solution. We are willing to grant the village an
easement for the existing sewer and an additional easement where one could potentially be
in the fu ture in the event t hat it needs to get moved. We also app reciate the village's
willingness to pay the cost associated with applying the epoxy-resin. This option is clearly
the lowest cost, mos t expedient, and least intrusive way to fix the problem.
Please note that we do not support Option B - relocation of t he sanitary sewer - as it is
currently proposed. It would be very costly fo r us and the village, ta ke considerably more
time, require the involvement of the EPA and our title company, and be highly disrupt ive to
the neighborhood.
We are very hopeful that this matter will reach a good outcome on Monday. Our hope is
that Option A will be put to a vote and authorized by the board. We also hope that work on
the sewer can beg in im mediately and t he appropria te bu ilding permits will be granted so
t hat we can be in a position to beg in bulldlnq our home in November.
Thank you again for your help.
regulate video gaming opera tions and the licensees who install the machines.
MYTH: Vide o ga ming will bring socia l problem s like pathological ga mbling a nd highcr
cri mc rates to communitics that a llow video gaming.
REALITY: The U.S. Government Accou ntability Office (GAO) reports it has found no evidence
ofa link between convenience gambling and path ological gambling, bankruptcy , crime rates or an
inercase in social problems in states where convenience gambling is legal.
MYTH: Vide o gam iug under th c new rulcs opens th e door to erimiual influeuee.
REALITY: Just the opposite: The law requires extensive criminal and financial background
investigation of manufacturers, distributors and operators, all of whom must be licensed. Th ere
can be no cross-ownership. These measures will eliminate any potential criminal influence.
Legalizing video gaming also should hclp discourage the illegal gambling that already exists and
that often docs have tics to organized crime. The 1GB will have the right to turn off any gam es
operated by a location or terminal operator that docs not confirm to the rules and regulations.
This will insure that all licensees will abide by the laws and guidelines ofage control, payment
of taxes or other rules put into effect.

" If everybody opts out, then you have no infrastructure. You have no roads, no bridges, no
schools, no parks. You have nothing. You can't opt out and say, •I want all the benefits.' That's
truly unfair. If you don't want the money, you're not going to get the rewards ofpeople raising
money and say, 'I'm gonna take your money.' If you don't think that money is worth your while
to fix your schools and you have other ways of doing it, you should not penalize people who
need the money."
Chicago Mayor Richard M. Daley
Chicago Sun-Times, July 28,2009
"The anti-video gaming comments mostly cite a general moral opposition to allowing the
(video) gaming machines. They're morally opposed to gambling, but also wary ofthe social ills
that come with it. Our police department has not seen data that correlates gambling with
increased crime."
"DuPage County Board Chairman Bob Schillerstrom's declaration that'It is clear that DuPage
County's quality oflife is not for sale' made me proud. Thank goodness the county board has
taken a stand to save us all from ourselves. ... That leaves only 27 off-track betting parlors, six
horse racing tracks, nine casinos and 13 different lottery games that can.be purchased at any gas
station or convenience store to worry about. In a time when county government is crying poor,
I'm sure that the board will come up with some new tax or increase an old one to make up for the
$350,000 the county will lose from the state-mandated revenue split. As for the lady who
deplores the idea that we can become wealthy by pushing a button, I have a suggestion for you:
Don't push the button and mind your own business."
Ralph Hruby, Warrenville, Letter to th e Editor
The Daily Herald, August 19, 2009
"The points Rev. Phil Blackwell presents in his letter are old and actually present absolutely no
reason for Illinois not to permit video gambling. Its hypocrisy is evide nt. What is actually being
said is he is morally against the state permitting something he is morally opposed to but offers no
suggestion as to an alternative to raising money for the state. ... Let the state revoke the taxexempt
status of religious institutions. The coffers would be full, our children would have
cutting-edge education that was well-funded and many other woes would disappear. Problem
gambling is no joke. However, if you're going to attack something, come up with a reasonable,
viable, alternative solution first."
"As it stands now, state law prohibits any [video gaming] machines from being used except for
'entertainment-only' ones that don't pay offmoney to customers. Enforcing the law the way it's
currently written can be challenging for police [Ifvideo gaming is passed], aside from these
authorized machines, all other [such] devices would be banned. It would be easier for us to
enforce, because it puts an outright ban on unlicensed machines."
"In the scientific community, there's been a long-held model that increased exposure and
accessibility to gambling would proportionately increase the amount of gambling-related
problems. In fact, the scientific evidence does not support that. I think that education,
information, public awareness and other regulatory activity ... can be very effective means to
help people gamble in a reasonable and effective way."
Howard Schaffer, Ph.D., Director ofAddictions
"Many proponents oflegalized video gambling, including some bar owners and machine makers,
say the law will simply regulate and tax gambling that is already going on illegally. They say
bringing the backroom gambling into the light will stimulate the economy, create jobs and make
it easier to identify gambling addicts."
"Critics urge state to reconsider video gambling expansion"
The Daily Herald, August 25,2009
"[Video gaming opponents] asking communities to give up new revenue at a time when every
government is short on money. They would also be taking money away from restaurants and
bars, which could spur those businesses to get organized in support ofvideopoker. It may be no
coincidence that ... the governments rejecting video poker aren't sacrificing much. The DuPage
County ban applies only to unincorporated areas ... so it affects only about three dozen
businesses."
"Town by town, critics fight video poker in Ill."
Associated Press, August 16,2009
"Aside from specific anecdotal examples linking social problems and convenience gambling, we
found no conclusive evidence showing whether or not convenience gambling caused increased
social problems in the three communities [studied]. Convenience gambling created some jobs
and tax revenues in the areas we visited, and provided funding for some community investment."
The U.S. General Accountability Office (GAO) Report to the House ofRepresentatives
["Opting out] torpedoes the financial arrangements the state is borrowing on. Ifmore and more
cities and counties keep pulling out of [video gaming], there won't be any money for
infrastructure whatsoever."
Chicago Mayor Richard M. Daley
Chicago Public Radio, August 4, 2009
Dr. Howard Shaffer - Director, Division on Addictions, Harvard School of Medicine
YouTube video where he discusses gambling addiction
My react ion in general about the ban on internet gambling is that it is very hard to have a prohibitionist
regulatory mechanism that works. The fact of the matter is that in the United States the vast majority of
people according to recent surveys want to gamble . And they would like to be able to gamble online and
in a democratic society that values liberty, most peop le think they should have the opportunity to
gamble.
You need to understand how people actually gamble online and what their behavior patterns are. We in
fact have done that at the Division on Additions that have published the first study in the world that
tracked actual gamblers in their actual gambling behavior patterns over a long period. When you study
land based gamblers it is very hard to track all their gambling activity. But when you study online
gamblers the computer actually tracks everything they do in all the cond itions under which they wager .
The very first thing we learned which we didn't expect was that the vast majority of gamblers online
gamble in a very moderate and mild way . In the scientific community there has been a long held model
that increased exposure and accessibility to gambling would proportionately increase the amount of
gambling related problems. In fact, the scientific evidence does not support that. In the United States for
example, in the middle 1970's the rate of gambling disorders was approximately 0.7%. Just under three
quarters of one percent. Now more than 30 years later the new research done by var ious investigators
suggests that it is closer to 0.6%, let's call it about the same. And that's despite the fact that gambling
has expanded dramatically all across th is country. I don't think gambling proh ibition is going to work. I
do think however that education, information, public awareness and other regulatory activity around
truth in advert ising all can be very effective means to help people gamble in a reasonable and healthy
way.
Problem Gambling Expert Says
Prohibition of Gaming Ineffective
One of the top experts in problem gambling in the world asserted that
prohibition of gambling does not work in preventing the disorder or lowering
the number of victims.
Joanna Franklin, president of the Institute on Problem Gambling, says
treatment helps prevent problem gambling incidents, but prohibition of
gambling does not work. Franklin says compulsive gambling victims will find
a way to gamble regardless of laws restricting gaming options.
"Treatment, not prohibition, is the best way to treat problem gamblers," said
Franklin. Franklin is noted for having designed clinical training programs for
the treatment of problem gambling in 45 states, most Canadian provinces,
and nine other countries.
Franklin said a law such as the Illinois Video Gaming Act properly addresses
the issue, by providing direct funding for treatment. The new law gives the
Illinois Department of Human Resources $2.5 million annually to create and
run treatment programs.
Local governments in Illinois, relying on misleading information provided by
anti-gambling factions, have had debates on whether to allow the video
gambling mentioned in counties and municipalities. Some have called on
rejection of the electronic gaming, which would fund a $30 billion state
infrastructure overhaul, because of the mistaken belief that installing the
machines would increase problem gambling.
"We understand that gambling addiction is a serious problem," Tom Fiedler,
president of the Illinois Coin Machine Operators Association told Reuters.
"But it is one that affects only a small percentage of the population."
Psychological Medicine magazine recently cited a study finding that problem
gambling figures remain constant at less than three percent of the
population, regardless of local gaming laws.

Referred To: _________________________________________________________________________
Summary of Background and Reason for Request
The Village has received an offer from Deerfield Shopper’s Court LLC to purchase 4,073 square feet of
Village property currently developed with parking spaces and landscaping at the rear of Shoppers Court
located at 646-660 Deerfield Road. An independent appraisal was conducted that valued the property at
$61,000. The $52,000 offer requests that the improvements recently installed by Deerfield Shopper's Court
on the subject parcel, valued at just over $16,000, be considered to partially offset the appraisal value.
The property was originally used by the Village in the 1970’s to host a recycling center drop-off location
and is no longer needed for Village operations.
Based on the offer meeting the independent appraisal value, including partial consideration for the recent
on-site improvements, the Village Attorney was asked to prepare the necessary ordinance for sale of the
property. It is recommended that a real estate sale contract, in keeping with the September 10, 2009 offer
letter from Deerfield Shopper’s Court LLC, be authorized for execution upon final adoption of the
ordinance.
Staff and representatives of Shopper's Court LLC will be available to respond to questions.
Surplus Property Sale at 646-660 Deerfield Road
The Village has received an offer from Deerfield Shopper's Court LLC to purchase 4,073
square feet ofVillage property currently developed with parking spaces and landscaping
at the rear of Shoppers Court located at 646-660 Deerfield Road. An independent
appraisal was conducted (summary attached) that valued the property at $61,000. The
$52,000 offer requests that the improvements recently installed on the subject parcel,
valued at approximately $4/sq. ft or just over $16,000, be considered to partially offset
the appraisal value.
The property was originally used by the Village in the 1970's to host a recycling center
drop-off location. The Village retained the property even though the recycling center was
moved to the Water Tower in the early 1980's to increase capacity. Following the
initiation ofcurbside recycling as part ofthe residential service contract, a drop-off center
was no longer needed and the use discontinued. The subject property is now part ofthe
improved parking area for Shopper's Court and is not needed for Village operations.
Based on the offer meeting the independent apprais al value, including partial
consideration for the recent on-site improvements, the Village Attorney was asked to
prepare the necessary ordinance for sale ofthe property. It is recommended that a real
estate sale contract, in keeping with the September 10, 2009 offer letter from Deerfield
Shopper's Court LLC, be authorized for execution upon final adoption ofthe ordinance.
I look forward to reviewing this matter with you at the October 19, 2009 Village Board
meeting.
