The San Buenaventura (Ventura) City Council met in regular session in the City Hall Council
Chambers, 501 Poli Street, Ventura, at 6:05 p.m.

SPECIAL PRESENTATIONS AND ANNOUNCEMENTS
Ventura County Fairgrounds Public Relations and Marketing Director James Lockwood
introduced Junior Fair Board Member Kai Perez who presented the Ventura County Fair
Poster to the City Council.
Mayor Tracy presented a certificate of recognition to Jim White, Parks and Recreation
Commissioner, recognizing July as Parks and Recreation Month.
CLOSED SESSION REPORT
City Attorney Ariel Pierre Calonne stated that the City Council gave direction to initiate
litigation in two matteis by the following votes: 7 - 0 and 6 - 0 (Counciln1en1ber Brennan
abstaining). The actions, the defendants, and the other particulars of the cases will be
disclosed to any person upon inquiry once the cases are formally commenced.

CITY COUNCIL COMMUNICATIONS
Councilmember Monahan announced that the Ventura Regional Sanitation District received
a nearly $1 million grant from Southern California Edison Company for the electrical
generation project at the Toland Road landfill which consists of nine low-emission
microturbines that use compressed landfill gas to generate electricity.
Councilmember Morehouse stated that he participated in the Downtown Ventura cleanup on
June 30, 2012, and thanked all those who helped, with special thanks to Volunteer
Coordinator Rosie Ornelas; and offered thanks and congratulations to Parks, Recreation &
Community Partnerships Coordinator Michelle Godoy and her team for their dedication and
excellent work organizing the 4th of July Street Fair.
Councilmember Andrews requested that the meeting be adjourned in memory of Bruce
Robert Pulliam.
CouncilmemberWeir spoke about the success of the 4th of July Street Fair and thanked the
team of volunteers who worked on the fireworks display; and mentioned that the Ventura
Botanical Gardens group has begun to build walking trails and thanked all of the volunteers.
Deputy Mayor Heitmann expressed her appreciation of the 4th of July Street Fair;
acknowledged the upcoming departure of Ventura Visitors and Convention Bureau
Executive Director Jim Luttjohann; and reminded all that the Westside ArtWalk will be held
on July 21 and July 22, 2012.
Mayor Tracy mentioned that Simi Valley City Manager Mike Sedell was retiring after 17
years of service as city manager and spoke about his impact on County government.

2. Living Wage Janitorial Services Contract Amendments (88)
RECOMMENDATION
a. Authorize the City Manager or his designee to execute an amendment to
General Services Agreement No. GSA-100001284, GSA-100001268, GSA-
10001261, and GSA-100001303 in order to adjust the "Schedule of
Compensation" to comply with the Living Wage Ordinance.
b. Authorize the City Manager or his designee to execute subsequent
amendments on an annual basis, not to exceed three additional years, in
order to exercise the option for an agreed upon contract term of up to five
years, subject to future Council appropriations.
c. Authorize the Mayor or his designee to execute change orders to the annual
appropriation in an amount not to exceed $250,000 dollars.
d. Approve additional Fiscal Year 2012-2013 appropriations of $9,600 from
Facilities fund balance and authorize the Finance and Technology Department
to assign appropriations to the proper fund, project, and account.
Councilmember Brennan moved to approve the recommendation. Deputy Mayor Heitmann
seconded. The vote was as follows:

3. Saticoy Well No. 3 Well Drilling Project Award of Contract (123)
RECOMMENDATION
a. Approve the award of contract and authorize the Mayor to execute an
agreement with the lowest responsive and responsible bidder, Bakersfield
Well and Pump Company, for the Saticoy Well No. 3 Well Drilling Project,
Specification No. 2012-007, in the amount of $475,877.
b. Authoiize the encumbiance of contingency funds foi the pioject in the amount
of $47,588.

5. Local Groundwater Assistance Grant (31)
RECOMMENDATION
Approve the following actions authorizing Ventura Water to file a grant application:
a. Approve the Memorandum of Agreement between the City and participating
entities to apply for and execute a grant agreement if funded for the Upper
Ventura River Basin Surface Water/Groundwater Interaction Study.

Adopt a resolution authorizing the City to file an application to the California
Department of Water Resources to obtain a Local Groundwater Assistance
Grant to the Safe Drinking Water, Water Quality and Supply, Flood Control,
River and Coastal Protection Bond Act of 2006.
Authorize the Ventura Water General Manager to act as agent for the City to
conduct all negotiations and execute and submit all documents, including, but
not limited to, applications, agreements, annual reports including expenditure
reports and amendments necessary to accept the grant and secure payments
to support the Upper Ventura River Basin Surface Water/Groundwater
Interaction Study.
Adopt Fiscal Year 2012-2013 budget adjustments to increase appropriations
and revenues for the Memorandum of Agreement cost sharing to file the grant
application and authorize the Finance and Technology Department to assign
the increased appropriations and revenues to the proper funds, projects, and
accounts.

the municipal code pertaining to water and wastewater rates to establish
authority for pass-through charges for inflation adjustments.
b. Set the proposed ordinance for a second reading and adoption at the City
Council meeting of July 16, 2012.

Trust Fund Disbursement Repayment Based on Department of Finance Revised
Final Approved Enforceable Obligations Per Assembly Bill 1484 (80)
RECOMMENDATION
That the Successor Agency receive this notification of a Payment Under Protest and
make payment in the amount of $454,565 for a Redevelopment Property Tax Trust
Fund Disbursement Repayment based on Department of Finance's revised final
approved Enforceable Obligations per Assembly Bill 1484.

9. Workshop for Proposed Priority Workplan Projects for Fiscal Year 2012-2013

RECOMMENDATION
Review the proposed Priority Workplan list for the new fiscal year that focuses on the
delivery of results to address the City Council's four priorities: Prioritize Public Safety
and Core Service, Promote Prosperity/Economic Development, Maintain a Safe and
Clean Ventura, and Restore Public Confidence.

Councilmember Weir moved to: a) approve recommended project/goal nos. 1-24, and 26-
30; b) add provisional project no. 31 to eliminate encampments in Ventura River by March
2013, no. 32 to implement effective community based code enforcement by March 2013, no.
33 to initiate South Seaward and Hospital District business improvement strategies by
March 2013, and no. 361:.-ibrary strategic plan to the recommended project/goal list; c) retitle
no. 37 "Adopt Street Lighting District" and return to the Finance, Audit, and Budget
Comm·ittee for recommended focus, scope, and schedule; and d) retain project no. 35
