Hotelvertragsbedingungen<br />
§ 5 Rücktritt vom Beherbergungsvertrag<br />
(1) Bis spätestens drei Monate vor dem vereinbarten Ankunftstag des Gastes kann der Beherbergungsvertrag<br />
ohne Entrichtung einer <strong>St</strong>ornogebühr von beiden Vertragspartnern<br />
durch einseitige Erklärung aufgelöst werden. Die <strong>St</strong>ornoerklärung muss bis spätestens<br />
drei Monate vo dem vereinbarten Ankunftstag des Gastes in den Händen des Vertragspartners<br />
sein.<br />
(2) Bis spätestens einen Monat vor dem vereinbarten Ankunftstag des Gastes kann der<br />
Beherbergungsvertrag von beiden Vertragspartnern durch einseitige Erklärung aufgelöst<br />
werden, es ist jedoch eine <strong>St</strong>ornogebühr im Ausmaß des Zimmerpreises für drei Tage zu<br />
bezahlen. Die <strong>St</strong>ornoerklärung muss bis spätestens einen Monat vor dem vereinbarten<br />
Ankunftstag des Gastes in den Händen des Vertragspartners sein.<br />
(3) Der Beherberger hat das Recht, für den Fall, dass der Gast bis 18 Uhr des vereinbarten<br />
Ankunftstages nicht erscheint, vom Vertrag zurückzutreten, es sei denn, dass ein späterer<br />
Ankunftszeitpunkt vereinbart wurde.<br />
(4) Hat der Gast eine Anzahlung geleistet, so bleibt (bleiben) dagegen der Raum (Räume)<br />
bis spätestens 12 Uhr des folgenden Tages reserviert.<br />
(5) Auch wenn der Gast die bestellten Räume bzw. die Pensionsleistung nicht in Anspruch<br />
nimmt, ist er dem Beherberger gegenüber zur Bezahlung des vereinbarten Entgeltes<br />
verpflichtet. Der Beherberger muss jedoch in Abzug bringen, was er sich infolge<br />
Nichtinanspruchnahme seines Leistungsangebots erspart oder was er durch anderweitige<br />
Vermietung der bestellten Räume erhalten hat. Erfahrungsgemäß werden in den meisten<br />
Fällen die Ersparungen des Betriebes infolge des Unterbleibens der Leistung 20 Prozent<br />
des Zimmerpreises sowie 30 Prozent des Verpflegungspreises betragen.<br />
(6) Dem Beherberger obliegt es, sich um eine Vermietung der nicht in Anspruch genommenen<br />
Räume den Umständen entsprechend zu bemühen (§ 1107 ABGB).<br />
§ 6 Beistellung einer Ersatzunterkunft<br />
(1) Der Beherberger kann dem Gast eine adäquate Ersatzunterkunft zur Verfügung stellen,<br />
wenn dies dem Gast zumutbar ist, besonders wenn die Abweichung geringfügig und<br />
sachlich gerechtfertigt ist.<br />
(2) Eine sachliche Rechtfertigung ist beispielsweise dann gegeben, wenn der Raum (die<br />
Räume) unbenützbar geworden sind, bereits einquartierte Gäste ihren Aufenthalt verlängern<br />
oder sonstige wichtige Maßnahmen diesen Schritt bedingen.<br />
(3) Allfällige Mehraufwendungen für das Ersatzquartier gehen auf Kosten des Beherbergers.<br />
§ 7 Rechte des Gastes<br />
(1) Durch den Abschluß eines Beherbergungsvertrages erwirbt der Gast das Recht auf<br />
den üblichen Gebrauch der gemieteten Räume, der Errichtungen des Beherbergungsbetriebes,<br />
die üblicherweise und ohne besondere Bedingungen den Gästen zur Benützung<br />
zugänglich sind, und auf die übliche Bedienung.<br />
(2) Ist Vollpension oder Halbpension vereinbart, so hat der Gast das Recht, für Mahlzeiten,<br />
die er nicht in Anspruch nimmt, eine angemessene Ersatzverpflegung (Lunchpaket)<br />
oder einen Bon zu verlangen, soferne er dies rechtzeitig, das ist bis 18 Uhr des Vortages,<br />
gemeldet hat.<br />
(3) Sonst hat der Gast bei Leistungsbereitschaft des Beherbergers, wenn er die vereinbarten<br />
Mahlzeiten nicht innerhalb der üblichen Tageszeiten und in den hiefür bestimmten<br />
Räumlichkeiten in Anspruch nimmt, keinen Ersatzanspruch.<br />
§ 14 Beendigung der Beherbergung<br />
(4) Die gemieteten Räume sind durch den Gast <strong>am</strong> Tag der Abreise bis 12 Uhr (bei Appartements<br />
bis 10 Uhr) freizumachen.<br />
F Clauses du contrat hôtelier<br />
§ 5 Résolution du contrat d’hébergement<br />
(1) Le contrat d’hébergement peut être, au plus tard trois mois avant la date convenue<br />
d’arrivée du client, résilié par les deux parties contractantes, sans paiement de frais<br />
d’annulation et moyennant une déclaration unilatérale. La déclaration d’annulation doit<br />
être entre les mains de la partie contractante au plus tard trois mois avant la date convenue<br />
d’arrivée du client.<br />
(2) Le contrat d’hébergement peut être résilié par les deux parties contractantes, au plus<br />
tard un mois avant la date convenue d’arrivée du client, moyennant une déclaration unilatérale<br />
et le paiement toutefois de frais d’annulation équivalant au prix de la ch<strong>am</strong>bre pour<br />
3 jours. La déclaration d’annulation doit être entre les mains de la partie contractante au<br />
plus tard un mois avant la date convenue d’arrivée du client.<br />
(3) L’établissement hôtelier est en droit de résilier le contrat au cas où le client<br />
n’apparaîtrait pas jusqu’à 18 heures, à la date convenue de son arrivée, à moins qu’une<br />
heure plus tardive n’ait été convenue.<br />
(4) Lorsque le client a versé des arrhes, la (les) ch<strong>am</strong>bres reste(nt) par contre réservées au<br />
plus tard jusqu’au lendemain 12 heures.<br />
(5) A supposer que le client n’occupe pas les ch<strong>am</strong>bres réservées, respectivement ne profite<br />
pas des prestations comprises dans le prix de la pension, il n’en reste pas moins tenu<br />
de verser à l’établissement hôtelier le montant convenu. L’établissement hôtelier est toutefois<br />
tenu de déduire les économies qu’il a pu réaliser du fait de la non-fourniture des<br />
prestations ou encore le montant encaissé du fait de la location par ailleurs des ch<strong>am</strong>bres<br />
réservées. Les économies réalisées par l’établissement hôtelier pour non-fourniture de<br />
prestations, se chiffrent, par expérience, dans la plupart des cas à 20 pour-cent du prix de<br />
la ch<strong>am</strong>bre et à 30 pour-cent du prix de la restauration.<br />
(6) L’établissement hôtelier est tenu, dans la mesure du possible, de s’efforcer de louer<br />
par ailleurs les ch<strong>am</strong>bres non occupées (§ 1107 ABGB).<br />
§ 6 Mise à la disposition de ch<strong>am</strong>bres de remplacement<br />
(1) L’établissement hôtelier est en droit de fournir au client une ch<strong>am</strong>bre de remplacement<br />
appropriée, à condition que ce soit acceptable pour le client, not<strong>am</strong>ment lorsque la<br />
différence est minime et que cela se justifie objectivement.<br />
(2) Citons par exemple comme type de justification objective, lorsqu’une ch<strong>am</strong>bre (des<br />
ch<strong>am</strong>bres) est (sont) devenue(s) inutilisables, lorsque des clients d’ores et déjà installés<br />
décident de prolonger leur séjour ou que d’autres mesures importantes nécessitent semblable<br />
démarche.<br />
(3) Un éventuel surcroît de frais occasionné par la nouvelle ch<strong>am</strong>bre est à la charge de<br />
l’établissement hôtelier.<br />
§ 7 Droits du client<br />
(1) La conclusion du contrat d’hébergement confère au client le droit de faire l’usage habituel<br />
des ch<strong>am</strong>bres louées, des installations de l’établissement hôtelier qui sont de manière<br />
générale mises à la disposition du client, sans réserves spéciales, et de bénéficier des services<br />
usuels.<br />
(2) Lorsqu’une pension complète respectivement une demi-pension ont été convenues,<br />
le client a le droit d’exiger pour les repas non consommés un repas équivalent (panierrepas)<br />
ou un bon, à condition qu’il le fasse savoir à temps, autrement dit jusqu’à la veille<br />
18 heures.<br />
(3) Si toutefois le client ne prend pas les repas que sert l’établissement hôtelier aux heures<br />
convenues des repas et dans les locaux prévus à cet effet, il n’a droit à aucune indemnité<br />
compensatrice.<br />
§ 14 Fin de l’hébergement<br />
(4) Les ch<strong>am</strong>bres louées par le client doivent être libérées jusqu’à 12 heures (10 heures<br />
pour les appartements) le jour du départ,<br />

§ 5 Cancellation of a lodging contract<br />
(1) Three months at the latest before the guest’s agreed arrival date, the lodging contract<br />
may be cancelled by either of the parties unilaterally, without entailing any cancellation fee.<br />
Notification of cancellation must reach the other party to the contract three months at the latest<br />
before the guest’s agreed arrival date.<br />
(2) Up to one month at the latest before the guest’s agreed arrival date, the lodging contract<br />
can be cancelled by either of the two parties unilaterally; however, a cancellation fee,<br />
equivalent to the room for three days, will be charged. Notification of cancellation must reach<br />
the other party to the contract one month at the latest before the guest’s agreed arrival<br />
date.<br />
(3) If the guest has not arrived by 6 p.m. on the agreed arrival day, the hotelier is entitled to<br />
withdraw from the contract, unless a later arrival time has been agreed upon.<br />
(4) If the guest has paid a deposit, the room (rooms) remains reserved until 12 o’clock on<br />
the next day at the latest.<br />
(5) Even if the guest does not make use of the reserved rooms or requested board, he is<br />
obliged to pay the agreed remuneration to the hotelier. Nevertheless, the hotelier must deduct<br />
the sum he has saved through the non-provision of the services offered, or the sum he<br />
has earned by renting the reserved rooms to another party.<br />
Experience has shown that in most cases the hotel saves 20 percent of the price of the<br />
room and 30 percent of the price of board as a result of the non-provision of services offered.<br />
(6) It is the hotelier’s duty to make the necessary efforts, as appropriate, to rent the unused<br />
rooms to another party.<br />
§ 6 Provision of alternative accommodation<br />
(1) The hotelier can provide the guest with alternative accommodation within reasonable<br />
limits, especially if the difference is negligible and the change of arrangements is objectively<br />
justifable.<br />
(2) An objective justification exists, for ex<strong>am</strong>ple, if the room(s) has (have) become unusable,<br />
if guests already occupying the room(s) prolong their stay, or if other important logistical<br />
factors make this step necessary.<br />
(3) Any extra costs entailed by the provision of alternative accommodation must be covered<br />
by the hotelier.<br />
§ 7 Right of the guest<br />
(1) The conclusion of a lodging contract entitles the guest to normal usage of the rented<br />
rooms, of installations belonging to the hotel which are normally and without any special<br />
conditions available for use by the guests, and to the usual range of services.<br />
(2) If half or full board has been agreed upon, the guest has the right to demand an adequate<br />
substitute (lunch pack) or a voucher for meals that he/she does not take, as long as<br />
the appropriate request has been submitted in due time, i. e. by 6 p.m. on the previous day.<br />
(3) Otherwise, in the event that the hotelier provides the stipulated services, the guest has<br />
no claim to substitute catering if he/she does not take the meals agreed upon during the<br />
usual meal hours and in the rooms appointed for this purpose.<br />
§ 14 End of lodging<br />
(4) Rooms rented are to be vacated by the guest on the day of his/her departure by 12<br />
o’clock (10 o’clock in the case of an apartment).<br />
I Condizioni contrattuali alberghiere<br />
§ 5 Recesso dal contratto di alloggio<br />
(1) Fino ad almeno tre mesi prima del giorno di arrivo concordato il contratto di alloggio<br />
può essere cancellato da entr<strong>am</strong>be le parti contrattuali unilateralmente senza vers<strong>am</strong>ento<br />
della tassa di storno. La notifica della cancellazione deve pervenire all’altra parte contrattuale<br />
almeno tre mesi prima del giorno di arrivo concordato.<br />
(2) Fino ad almeno un mese prima del giorno di arrivo concordato il contratto di alloggio<br />
può essere recesso da entr<strong>am</strong>be le parti contrattuali unilateralmente, tuttavia in questo casa<br />
bisognerà corrispondere una tassa di storno corrispondente al prezzo della c<strong>am</strong>era per tre<br />
giorni. La notifica della cancellazione deve pervenire all’altra parte contrattuale almeno un<br />
mese prima del giorno di arrivo della parte ospitata.<br />
(3) L’albergatore ha il diritto di rescindere dal contratto nel caso in cui l’ospite non compaia<br />
entro le ore 18 del giorno di arrivo concordato, fatto salvo che non sia stato concordato un<br />
orario di arrivo successivo.<br />
(4) Nel caso in cui l’ospite abbia versato una caparra la c<strong>am</strong>era o le c<strong>am</strong>ere rimangono prenotate<br />
al massimo fino alle ore 12 del giorno successivo.<br />
(5) L’ospite è obbligato a versare all’albergatore il compenso pattuito anche quando non<br />
usufruisce delle c<strong>am</strong>ere e dei servizi prenotati. Tuttavia l’albergatore è tenuto a detrarre la<br />
somma da lui risparmiata in seguito alla fornitura dei servizi prenotati o la somma ricavata<br />
dalla concessione a terzi delle c<strong>am</strong>ere prenotate. L’esperienza ha dimostrato che nella maggior<br />
parte dei casi l’hotel per mancata fornitura dei servizi prenotati risparmia il 20 per centro<br />
del prezzo della c<strong>am</strong>era e il 30 per cento del prezzo del vitto.<br />
(6) L’albergatore è tenuto a fare il massimo sforzo per concedere a terzi le c<strong>am</strong>ere prenotate,<br />
ma non usufruite (§ 1107 ABGB).<br />
§ 6 Messa a disposizione di un alloggio sostituivo<br />
(1) L’albergatore può mettere a disposizione dell’ospite un alloggio sostitutivo adeguato<br />
nel caso in cui ciò sia accettabile per l’ospite e nel caso in cui la differenza sia insignificante<br />
e oggettiv<strong>am</strong>ente giustificata.<br />
(2) Una giustificazione oggettiva si ha per esempio nel caso in cui la c<strong>am</strong>era (le c<strong>am</strong>ere)<br />
sia (siano) diventate inutilizzabili, nel caso in cui ospiti già alloggiati abbiano deciso di prolungare<br />
il soggiorno oppure quando alti importanti fattori logistici rendano ciò necessario.<br />
(3) Eventuali supplementi di spesa per alloggio sostitutivo sono a carico dell’albergatore.<br />
§ 7 Diritti dell’ospite<br />
(1) Con la stipulazione del contratto di alloggio l’ospite acquisisce il diritto di utilizzare normalmente<br />
le c<strong>am</strong>ere prenotate, di usufruire degli impianti della struttura ricettiva che sono<br />
normalmente a disposizione degli ospiti senza particolari condizioni, nonché dell’usuale<br />
g<strong>am</strong>ma di servizi forniti.<br />
(2) Nel caso in cui venga concordato il tratt<strong>am</strong>ento di pensione completa o di mezza pensione,<br />
l’ospite ha il diritto, per i pasti che non consuma, di ottenere degli adeguati pasti sostitutivi<br />
(pacchetto lunch) oppure dei buoni, fatto salvo che abbia avvisato entro le ore 18 del<br />
giorno prima.<br />
(3) In caso contrario quando l’ospite non consuma i pasti alle ore previste e negli appositi<br />
locali, non ha alcun diritto a pasti sostitutivi.<br />
§ 14 Termine dell’alloggio<br />
(4) L’ospite il giorno della partenza è tenuto a lasciare la c<strong>am</strong>era entro le ore 12 (entro le<br />
ore 10 nel caso di appart<strong>am</strong>enti).
d Information<br />
Alle Preise sind in Euro (e) pro Person und Tag im Doppel zimmer<br />
angegeben. Sie beinhalten Bedienungsgeld, Aufenthaltsabgabe<br />
und Mehrwertsteuer. Ausnahme: Die Preise für Ferienwohnungen<br />
verstehen sich pro Wohnung und Tag bei Normalbelegung. Eventuell<br />
kommt noch ein Betrag für die Endreinigung hinzu. Die angegebenen<br />
Preise sind Richtpreise, basierend auf einem Aufenthalt von<br />
mindestens drei Tagen. In jedem Fall muss der Preis mit dem Vermieter<br />
vereinbart werden. Die Preisberechnung zwischen Minimal-<br />
und Maximalpreis ist im Einzelfall abhängig von der Güte der Zimmer<br />
und der Dauer des Aufenthaltes. Es wird empfohlen, die Zimmerbestellung<br />
rechtzeitig und in schriftlicher Form vorzunehmen.<br />
Die Zimmerbestellung ist sowohl für den Gastgeber als auch für<br />
den Gast bzw. das Reisebüro verbindlich. Bei einer Buchung ist eine<br />
Anzahlung von drei Tagessätzen üblich. Für Nichtbezug bestellter<br />
Zimmer kann ein Schadenersatz gefordert werden. Für die Reservierung<br />
und bei eventuellen <strong>St</strong>ornierungen gelten, falls nicht anders<br />
vereinbart, die Österreichischen Hotelvertragsbedingungen (siehe<br />
Seite 6). Sie können Ihren Reservierungswunsch direkt an das<br />
Haus Ihrer Wahl richten. Wenn Sie eine Vermittlung bevorzugen,<br />

Gäste, die ohne Reservierung anreisen, finden bei der Ortseinfahrt<br />
Terminal Ost, beim Informationsbüro an der Umfahrungsstraße, bei<br />
der Ortseinfahrt <strong>St</strong>. Jakob sowie bei der Tankstelle Schnann und<br />
bei den Informationsbüros Pettneu und Flirsch eine elektronische<br />
Zimmerinformation, die 24 <strong>St</strong>unden in Betrieb ist.<br />
Die Preisliste wurde gemäß den Angaben unserer Gastgeber erstellt.<br />

F Information<br />
Nos prix s’entendent tous en euros (d), par personne et par jour<br />
dans la ch<strong>am</strong>bre double. Ils incluent les pourboires, la taxe de séjour<br />
et la T.V.A. Une exception toutefois: les prix des appartements<br />
de vacances s’entendent par appartement et par jour, calculés<br />
sur une occupation normale. Avec en plus, éventuellement une<br />
rétribution pour le nettoyage de fin de séjour. Il s’agit là de prix<br />
indicatifs qui sont calculés sur la base d’un séjour de trois jours<br />
minimum. Il faut n’importe comment que vous conveniez du prix<br />
avec votre logeur. La détermination du prix entre prix maximal et<br />
prix minimal dépend de la qualité de la ch<strong>am</strong>bre et de la durée du<br />
séjour. Nous vous recommandons de procéder à la réservation par<br />
écrit et de vous y prendre à temps. La réservation de la ch<strong>am</strong>bre lie<br />
les deux parties, aussi bien le logeur que l’hôte, respectivement<br />
l’agence de voyages. En cas de réservation, on a coutume de demander<br />
le versement d’arrhes équivalant au montant facturé pour<br />
trois jours. Si vous n’occupez pas la ch<strong>am</strong>bre, le logeur est en droit<br />
d’exiger des dommages-intérêts. En ce qui concerne les réservations<br />
et d’éventuelles annulations, ce sont les clauses du contrat<br />
hôtelier autrichiennes qui sont applicables à moins qu’il n’en ait<br />
été convenu autrement (voyez page 6).<br />
