The PRESIDENT: Thank you, Judge Greenwood. I give the floor now to Judge Xue. You<br />

have the floor, Madam.<br />

Judge XUE: Thank you, Mr. Presi<strong>de</strong>nt. My question is addressed to both Parties.<br />

“One of the primary objectives of the Convention Against Torture and Other<br />

Cruel, Inhuman or Degrading Treatment or Punishment (Torture Convention) is to<br />

ensure that the perpetrator does not go unpunished; in other words, to eradicate<br />

impunity. I wish to seek the views of the Parties whether the obligation aut <strong>de</strong><strong>de</strong>re aut<br />

judicare, un<strong>de</strong>r Article 7, paragraph 1, of the Torture Convention, is an absolute<br />

obligation in the sense that it preclu<strong>de</strong>s any other jurisdiction than those of the State in<br />

whose territory the alleged perpetrator is present and the States requesting extradition<br />

un<strong>de</strong>r Article 5, paragraph 1, of the Torture Convention.”<br />

The PRESIDENT: Thank you, Judge Xue. I give the floor to Judge Donoghue. You have<br />

the floor Madam.<br />

Parties.<br />

Judge DONOGHUE: Thank you, Mr. Presi<strong>de</strong>nt. My two questions are addressed to both<br />

“First, do Senegal’s obligations un<strong>de</strong>r Article 7, paragraph 1, of the Convention<br />

Against Torture apply to offences alleged to have been committed before<br />

26 June 1987, when the Convention entered into force for Senegal?<br />

Second, in the circumstances of this case, do Senegal’s obligations un<strong>de</strong>r<br />

Article 7, paragraph 1, of the Convention Against Torture extend to offences alleged<br />

to have been committed prior to 25 July 1999, when the Convention entered into force<br />

for Belgium?”<br />

The PRESIDENT: Thank you, Judge Donoghue. Le texte <strong>de</strong>s questions sera communiqué<br />

aux Parties sous forme écrite dès que possible. Les Parties sont invitées à répondre oralement aux<br />

questions lors du second tour <strong>de</strong> plaidoiries. Il leur est cependant loisible, si c’est nécessaire, <strong>de</strong><br />

compléter par écrit toute réponse qu’elles auront fournies oralement. Un tel complément <strong>de</strong>vra être<br />

communiqué le mercredi 28 mars 2012, à 18 heures au plus tard. Des observations écrites sur les<br />

réponses <strong>de</strong> l’autre Partie pourront être présentées le mercredi 4 avril 2012 à 18 heures au plus tard.
