2. The Minister shall also have the power conferred by subsection
39(5) of the Community Planning Act, in the event of
any breach of this Agreement or of the provisions of the Point
Lepreau Planning Area Rural Plan Regulation – Community
Planning Act (or breach of any regulation replacing the same)
by the Owner, or by their heirs, assigns or successors, to declare
this Agreement void, whereupon by operation of law the zoning
of the lands described in Schedule B1 shall revert to Mixed Use
Zone (M), and the Owner shall lose the rights to use the same
thereafter for any other purposes except as authorized by the
Point Lepreau Planning Area Rural Plan Regulation – Community
Planning Act for a Mixed Use Zone (M).
ALL NOTICES HEREUNDER shall be in writing and
shall be sufficiently given by personal delivery of or by prepaid
registered or certified mail to the following addresses:

notice so delivered shall be deemed to have been given seventytwo
(72) hours following the mailing thereof.

2. En vertu du paragraphe 39(5) de la Loi sur l’urbanisme, le
ministre peut, en cas du non-respect de la présente entente ou
des dispositions du Règlement du Plan rural du secteur d’aménagement
de Point Lepreau – Loi sur l’urbanisme (ou de la violation
de tout règlement remplaçant ce dernier) par le propriétaire
ou par ses héritiers, ayants droit ou successeurs, déclarer la
présente entente nulle, après quoi les terrains décrits à l’annexe
B1 redeviendront une zone d’usage mixte (M) et l’exploitant
perda les droits de les utiliser par la suite à toutes autres fins,
sauf celles autorisées dans une zone d’usage mixte (M) par le
Règlement du Plan rural du secteur d’aménagement de
Point Lepreau – Loi sur l’urbanisme.
TOUS LES AVIS doivent être par écrit et livrés en mains
propres ou par courrier recommandé ou certifié affranchi aux
adrésses suivantes :
