4.5.6.7.8.1.2.3.4.(1). Apabila NASABAH lalai memenuhi kewajiban menyetor Dana atau menyerahkan Efek pada waktu sebagaimana dimaksud ayat 1, dimana denganlewatnya waktu saja telah merupakan bukti yang cukup adanya kelalaian NASABAH, SINARMAS berhak :If CUSTOMERS neglacts to fulfill obligation to deposit Funds or to deliver Securities at the time as referred to in paragraph 1, where just with thepassing period of time has constituted a sufficient evidence of negligence of CUSTOMERS, SINARMAS is entitled to :a. Menjual sebagian atau seluruh Efek dalam Rekening Efek (forced sell) tanpa instruksi terlebih dahulu dari NASABAH pada saat jatuh tempopenyelesaian transaksi mulai (T+5); atauSell partly or entirely Securities in the Securities Account (forced sell) without prior instructions from CUSTOMERS at maturity transactionsettlement commenced (T+5); orb. Membeli Efek untuk kepentingan Rekening Efek NASABAH dengan tujuan untuk menutup saldo Efek negatif (short position) pada saat jatuhtempo penyelesaian transaksi sesuai dengan ketentuan Bursa dan dilakukan sesuai dengan ketentuan KSEI.Purchase Securities for the benefit Securities Account of the CUSTOMERS with the purpose to cover negative Securities balance (short position)at maturity date of transaction settlement reffered with Exchange provisions and will be execute accordance to the KSEI provisions.(2). SINARMAS berhak dan berwenang sepenuhnya untuk menetapkan tata cara dan pelaksanaan penjualan.SINARMAS is fully entitled and authorized to establish procedure and implementation of the sale of securities(3). Jika hasil penjualan dan atau pembelian tersebut tidak menutupi kewajiban NASABAH, maka NASABAH tetap wajib melunasi sisa kewajibantersebut kepada SINARMAS.If the proceeds of the said sales and or purchase does not cover liability of CUSTOMERS, then the CUSTOMERS remain is obliged to pay theremaining liabilities to SINARMAS.SINARMAS menyetorkan Dana dan atau Efek hasil Transaksi Efek tersebut ke Rekening Efek NASABAH pada tanggal jatuh tempo sebagaimana tercantumdalam Konfirmasi Transaksi.SINARMAS deposits Funds and or Securities as the result of the said Securities Transaction to Securities Account of CUSTOMERS on the maturity date asspecified in the Transaction Confirmation.Pesanan Beli dan Jual yang telah terjadi pada hari yang sama akan dikompensasikan (“netting”). Jika nilai pembelian lebih besar dari nilai penjualan makaNASABAH harus membayar pada T+3, sebaliknya jika nilai penjualan lebih besar dari nilai pembelian, SINARMAS akan membayar pada T+3.Purchase and sell orders that have occurred on the same day will be compensated ( “netting” ), If purchase value is greater than the sale value, thenCUSTOMERS must pay on T+3, on the contrary, if the sale value is greater than the purchase value, SINARMAS will pay on T + 3.Dalam hal Transaksi Beli dan Transaksi Jual yang penyelesaiannya (waktu jatuh tempo) bertepatan pada hari yang sama, maka NASABAH dapatmengkompensasikan pembayaran transaksinya dan menyelesaikan selisih dari kompensasi tersebut, dengan pemberitahuan minimal 2 (dua) hari bursasebelum tanggal jatuh tempo.In the case of Purchase Transaction and Sale Transaction which the settlement ( maturity date ) coincide on the same day, then CUSTOMERS cancompensate its transaction and settle the difference of such compensation, with a minimum notice of two (2) exchange days prior to maturity date.Segala kerugian akibat penjualan dan/atau pembelian tersebut sebagaimana yang dimaksud pada ayat 4 pasal ini yang dilakukan oleh SINARMAS akanmenjadi tanggung jawab NASABAH.Any losses as the result of such sales and/or purchase as referred to in paragraph 4 of this Article made by SINARMAS will become the responsibility ofCUSTOMERS.PASAL 7HAK DAN KEWAJIBAN NASABAHARTICLE 7RIGHTS AND OBLIGATION OF CUSTOMERSNASABAH berhak atas Konfirmasi Transaksi Pembelian, Penjualan dan Laporan Rekening (Dana dan Efek) yang ada di SINARMAS dan NASABAHsewaktu-waktu dengan persetujuan SINARMAS berhak meminta laporan dan/atau menguji kesesuaian antara saldo rekening Efek Nasabah dalampembukuan SINARMAS dengan saldo Efek NASABAH dalam Sub Rekening Efek.CUSTOMERS is entitled on the Transaction Confirmation of Purchase, Sale and Statement of Account (Funds and Securities ) existing at SINARMAS andCUSTOMERS anytime with approval from SINARMAS is entitled to request the Statement and/or to verify the conformity between Customers SecuritiesAccount’s balance in the bookkeeping of SINARMAS with the CUSTOMERS securities balance in the Sub Securities Account.NASABAH berhak mengajukan keluhan dengan melampirkan bukti (konfirmasi/laporan) yang dimiliki NASABAH yang bersangkutan.CUSTOMERS is entitled to submit a complaint by attaching the proof ( confirmation/report ) possesed by the CUSTOMERS concerned.NASABAH berhak atas semua dividen, bonus, rights dan waran yang melekat pada Saham di portfolionya serta wajib membayar segala pajak yang timbulbaik yang telah ada maupun yang akan ada.CUSTOMERS is entitled on all devidens, bonus, right and warrants attached to shares in their portfolio and shall pay all taxes that arise either existing or willbe there.NASABAH wajib mematuhi Tata-cara dan Peraturan Perdagangan Efek SINARMAS dan Bursa.CUSTOMERS shall comply with the procedures and Regulation of Securities Trading of SINARMAS and Exchange.16
