Administratia impreuna cu sindicatul reprezentativ va constitui in acest sens comisii <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> examinare in functie <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> specificul<br />
fiecarei activitati, cu respectarea metodologiei agreate in cadrul consultarilor, iar <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng>partajarea in ve<st<strong>ro</strong>ng>de</st<strong>ro</strong>ng>rea concedierii se va<br />
efectua in baza notelor obtinute pana la limita structurii <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> personal necesare.<br />

<st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> consultare intre administratie si sindicat si va ap<strong>ro</strong>ba atat noua structura organizatorica si functionala a SRTV cat si<br />
organigrama <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> personal rezultata, sens in care va emite o hotarare.<br />

concediere, cu cel putin 30 <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> zile calendaristice inainte <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> emiterea <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng>ciziilor <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> concediere.<br />
De la data primiii notificarii privind intentia <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> concediere sindicatul poate p<strong>ro</strong>pune angajatorului masuri in ve<st<strong>ro</strong>ng>de</st<strong>ro</strong>ng>rea evitarii<br />
concedierilor ori diminuarii numarului salariatilor concediati, intr-un termen <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> minim 10 zile calendaristice <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> la data primirii<br />
notificarii, iar angajatorul are obligatia <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> a raspun<st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> in scris si motivat la p<strong>ro</strong>punerile formulate <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> sindicat in termen <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> 5 zile<br />
calendaristice <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> la primirea acestora, <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng>mersuri care se constituie in consultari intre partenerii sociali.<br />

Dupa momentul finalizarii p<strong>ro</strong>cesului <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> selectie si implicit <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> stabilire nominala a persoanelor care vor fi concediate pentru<br />
motive care nu tin <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> persoana salariatului se vor realiza si comunica notificarile <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> preaviz anterioare concedierii efective, cu<br />
respectarea preve<st<strong>ro</strong>ng>de</st<strong>ro</strong>ng>rilor prevazute in contractul colectiv <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> munca aplicabil atat in ceea ce priveste durata cat si a modului <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng><br />
executare a acestuia.<br />
Se recomanda ca <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng>mersul <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> comunicare a preavizelor sa se faca separat <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng>cizia <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> concediere, avand in ve<st<strong>ro</strong>ng>de</st<strong>ro</strong>ng>re ca exista<br />
posibilitatea ca in acest interval <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> timp sa apara cauze <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> suspendare <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> drept a contractelor individuale <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> munca care vor<br />
p<strong>ro</strong><strong>ro</strong>ga termenul la care va interveni concedierea dispusa prin <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng>cizie.<br />

maximum 10 zile calendaristice, in cazul in care aspectele legate <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> concedierea colectiva nu pot fi solutionate pâna la data<br />
prevazuta in notificarea intentiei ca fiind data emiterii <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng>ciziilor <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> concediere.<br />
Eventuala amanare a momentului emiterii <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng>ciziei <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng> concediere poate avansa data emiterii <st<strong>ro</strong>ng>de</st<strong>ro</strong>ng>ciziilor pentru data la care se<br />
implineste termenul la care s-a dispus amanarea.<br />
