When no other designation is made by the<br />

Commissioner of Police or by a superior officer,<br />

the sen ior member 0 f the prevail ing<br />

rank shall be in <strong>com</strong>mand. Seniority shall be<br />

determined : first, by rank, and, second, by<br />

continuous service within the rank.<br />

Among personnel of eQua.l rank appointed<br />

or p.romot ed a t the same time, posi tion on<br />

original appointment or promotional lists,<br />

whichever shall be the latest, will be the<br />

deciding factor in establishing senior officer<br />

in <strong>com</strong>mand.<br />

RULE I C9t4l4lsSISUER OF POLICE. The Commissioner<br />

of Police shall manage and control the<br />

Police Department, its officers, members, and<br />

employees.<br />

RULE 2 DEPUTY TO THE eOMMISSI6KEft. The<br />

Deputy to the Commissioner shall have such<br />

powers and perform such duties as are deSignated<br />

by the Commissioner of Police.<br />

RULE 3 AIDE TO THE -6&MI+ISSIOMi-R. The Aide<br />

to the Commissioner shall report directly to<br />

the Commissioner of Police and <strong>com</strong>mand all<br />

personnel conducting special or confidential<br />

investigations for the Commissioner, and shall<br />

perform such other duties as may be prescribed<br />

by the Commissioner of Police.<br />

RULE lj. ADMIN I STRATIVE ASSISTANT. The Administrative<br />

Assistant shall report directly to<br />

the Commissioner of Police and shall be responsible<br />

for the administrative activities of<br />

the Commissioner's office.<br />

<strong>com</strong>plaints and charges brought against members<br />

of tbe Detective Di vision. He shall have such<br />

other duties, powers and responsibi lities as<br />

shall be designated by the Deputy to the Commissioner<br />

for Field Forces.<br />

RULE II GRAVE CRI MES. The Chief of Detec­<br />

·tives shall, when circumstar;ces require it,<br />

personally visit the scenes of crimes of unusual<br />

character or great magnitude and acquaint<br />

himself with the location and conditions<br />

in order that he may better direct their<br />

investigation. He shall cause photographs to<br />

be taken, charts drafted, latent fingerprints<br />

recorded and other useful evidence preserved<br />

at the scene of the crime whenever they may be<br />

used to detect the offender or to prosecute<br />

the case in court. He shall cause statements<br />

to be taken from principal witnesses and persons<br />

suspected or involved in serious crimes.<br />

RULE 12 SPECIAL UNITS AND DETAILS. The Chief<br />

of Detectives, upon authority of the Commissioner<br />

of Police, shall organize such special<br />

un its and details as are necessary to perform<br />

the duties assigned to the division.<br />

DEPUTY CHIEF OF THE DETECTIVE DIVISION<br />

RULE 13 RESPONSI 81 LI TIES. The Deputy Chief<br />

of the Detective Division shall be responsible<br />

to and report directly to the Chief of the Detective<br />

Division. He shall assist the Chief<br />

of the Detective Division in the performance·<br />

of his duties; shall perform such other duties<br />

as are assigned to him by the Chief of the Detective<br />

Division, and shall assume the duties<br />

and responsibilities of the Chief of the Detective<br />

Division during his absence.<br />

RULE 27 EVIDENCE - PRESERVATION AND EXAMINA­<br />

TION OF. The <strong>com</strong>manding office r of the Crime<br />

Detection Laboratory shall be respon s ibl e for<br />

the proper care and preserv ation of all evidence<br />

submitted to the laboratory. He shall<br />

not accept requests for the examination of _<br />

eVidence from anyone not a member or employee _<br />

of the department unless the r equest ha s been<br />

approved by the Chief of Detectives.<br />

. RULE 28 SUBJECTS - EXAMINATION OF. The co mmanding<br />

officer of the Crime Detection Laboratory<br />

shall not accept persons for detection of<br />

deception examinations when such persons are<br />

not in pol ice custody or if in police cu s tody<br />

are of juvenile age, unless the request for<br />

such examination has been approved by the<br />

Chief of Detectives.<br />

COMMANDING OFFICER<br />

RULE 29 COMMANDING OFFICER'S RESPONSIBILI­<br />

TIES. A member of the department serving as a<br />

<strong>com</strong>manding officer shall be responsible for<br />

the enforcement wi thin his <strong>com</strong>mand of al I laws<br />

and ordinances, department rules a.nd regulations,<br />

all procedu res and orders of the department<br />

or by which the department is bound.<br />

He shall be responsible for the discipline,<br />

punctual i ty, good order and efficiency of all<br />

members and employees of his <strong>com</strong>mand.<br />

RULE 30 COOPERATION. A <strong>com</strong>manding officer<br />

shall be responsible for the proper and efficient<br />

coopera.tion of his <strong>com</strong>mand with other<br />

units of the department, other police departments,<br />

and other City agencies.<br />

RULE 31 REPORTS - CHANNELING OF. A <strong>com</strong>manding<br />

officer shall cause to be prepared, transmitted,<br />

filed, used, and preserved,all official<br />

<strong>com</strong>munications, reports, and other correspondence<br />

received by or forwarded from his<br />

<strong>com</strong>mand. .<br />

RULE 32 DEPARTMENT EQUIPMENT. A <strong>com</strong>manding<br />

officer sball make a weekly inspection of all<br />

department buildings and equipment within bis<br />

<strong>com</strong>mand to determine their good order. He<br />

shall see that all department equipment is being<br />

properl y used and he shall noti fy maintenance<br />

authori ties when repairs or replacements<br />

are needed.<br />

RULE 33 CUSTODY, CHARGING AND CARE OF PRISON­<br />

ERS. A <strong>com</strong>manding officer shall be responsible<br />

for the proper custody, charging and care<br />

of all prisoners held or processed by members<br />

of his <strong>com</strong>mand. When a prisoner is in need of<br />

medical attention it shall be afforded him<br />

without unnecessary delay.<br />

RULE 3q SICK, INJURED OR UNCONSCIOUS PERSONS.<br />

A <strong>com</strong>manding officer shall not permit the confinement<br />

of any sick, injured or unconscious<br />

prisoner in any cell or lock-up under his <strong>com</strong>mand.<br />

He shall provide for an examination of<br />

such person by a physician.<br />

RULE 35 INSPECT! ON OF BOOKS AND RECORDS. A<br />

<strong>com</strong>manding officer shall make a daily examination<br />

and inspection of all books and records<br />

required to be kept by his <strong>com</strong>mand and shall<br />

see that the proper entries are made therein.<br />

RULE 36 PROPER PERFORMANCE OF DUTY. A <strong>com</strong>manding<br />

officer shall see th at each member of<br />

his <strong>com</strong>mand is instructed as to the proper<br />

performance of his assigned duties and that<br />

said members are performing such duties properly<br />

and efficiently. He shall re<strong>com</strong>mend to<br />

procedures. He shall be held responsible for<br />

the accuracy of the reports and records sublIIitted<br />

and maintained by any lIIelllber or elllp<br />

RULE 55 PROBATIONERS - TO OBSERVE. A district<br />

<strong>com</strong>mander shall maintain a strict<br />

scrutiny of all melllbers and elllployees of his<br />

cOlllmand serving their probationary period to<br />

ascertain their fitness or the position they<br />

·occupy. He shall submit a wri tten report to<br />

the Comlllissioner of Police explaining his<br />

findings regarding the probationers. This report<br />

shall be ma.de not later than seven days<br />

prior to the termination of the probationary<br />

period.<br />

RULE 56 ABSENCE OF A MEMBER - TO INVESTIGATE.<br />

A district <strong>com</strong>mander shall assign an officer<br />

of higher ranR to visit a. member or employee<br />

of his <strong>com</strong>mand who is unable to report for<br />

duty in order to determine the validity and<br />

justification for such absence. If the member<br />

or employee resides in a district other than<br />

the one in which he worRs, the <strong>com</strong>manding officer<br />

shall arrange th rough the <strong>com</strong>manding 0 fficer<br />

of the district in which the member or<br />

employee resides to have a superior officer of<br />

his co.mmand make the visit.<br />

In all si tu ations invol ving "inj ury on<br />

duty" the <strong>com</strong>manding officer of the injured<br />

lIIember or employee shall require the vi siting<br />

officer to deterllline the cause of the injury.<br />

If there appears any indication or su spicion<br />

that such member or employee is fei gning sick- #!!!!::.<br />

ness, or that his disabi lity is a resul t of W<br />

indulgence in intoxicants, or other improper<br />

practice, a police physician shall be noti fied<br />

immediately so that a medical investigation<br />

can be made without delay.<br />

If the member or employee is to be placed<br />

on the medical roll or carried as "ordinary<br />

injury" the <strong>com</strong>manding officer shall so inform<br />

the Chief Surgeon on the required forms via<br />

the first police mail.<br />

The District Commander shall indicate by<br />

his personal signature that the classification<br />

of the cause of absence. whether "sickness" or<br />

"injured on duty", has been approved by him<br />

only after a thorough and <strong>com</strong>petent investigation.<br />

When doubt arises in connection with<br />

any "injury on duty" situation, the district<br />

<strong>com</strong>mander shall call upon his Supervisor for<br />

advice and counsel. They, either separately<br />

or together shall make an investigation and<br />

forward the circumstances and re<strong>com</strong>mendations<br />

to the Commi ssioner 0 f Pol ice.<br />

RULE 57 BAD CHARACTERS - FI LE OF. A district<br />

<strong>com</strong>mander shall cause to be maintained in his<br />

station-house a current file, of every person<br />

of known bad character residing in or frequenting<br />

his police district. The list will<br />

include: pickpockets, burgl ars, holdup, safe<br />

blowers, confidence men, vagrants, pimps,<br />

prosti tutes, persons who have operated gambling<br />

houses, houses of prostitution or assignation,<br />

and other such undesirable characters.<br />

Each record must be kept up to date and will<br />

consist 0 f names, addresses and aliases, personal<br />

descriptions, the baunts, habits, associates<br />

and known relatives of such individuals<br />

classified as being of bad character.<br />

A copy of each Bad Character record shall<br />

be forwarded to the Records and Communication<br />

Division, to the district in which the subject<br />

person resides, the district (S) in which he<br />

frequents, and to the district into which he<br />

moves and establishes residency. The records<br />

and Communication Division shall be notified<br />

of each residency or frequenting change.<br />

RULE 58 TRAFFIC - REGULATION OF. A district<br />

<strong>com</strong>mander shall cooperate wi th the Traffic<br />

Division in giving attention to the enforcement<br />

of traffic regulations in his district.<br />

RULE 59 ACCI DEI4TS. A di strict <strong>com</strong>mander<br />

shall be held ref'ponsible for the proper investigation<br />

of all accidents in his district.<br />

When notified of a serious accident in his<br />

district,he shall cause the Central Complaint<br />

Unit to be noti fled immedi ately.<br />

RULE 60 LICENSES - TO INVESTIGATE. A district<br />

<strong>com</strong>mander shall be furnished with a list<br />

of ci ty I icenses of which the pol ice department<br />

takes cognizance. He wi 11 have all persons<br />

in his district requiring such licenses<br />

to procure them. He wi 11 have a careful investigation<br />

made of all applicants and applications<br />

for such I icenses and shall report<br />

full particulars concerning the applicant, the<br />

type of business, and place of business as<br />

well as all other essential facts to the Commissioner<br />

of POlice. All such reports must be<br />

submitted to the Commissioner of Police in<br />

proper form, and signed by the district <strong>com</strong>mander<br />

in which such appl ication is investigated.<br />

RULE 61 ASSEMBLAGES. A district <strong>com</strong>mander<br />

shall keep himself fully and accurately informed<br />

on meetings and gatherings likely to<br />

attract I arge numbers of persons at particular<br />

places in his district, and he shall take<br />

such step s as may be necessary to insure<br />

proper pol ice service at such assembl ages.<br />

RU LE 77 PROPERTY - ECONOMI CAL USE OF. A<br />

lieutenant, when on duty in a station-house,<br />

shall assure himself that economy is observedin<br />

the use of water, fuel, gas and electrici ty<br />

at the station-house, consistent with the <strong>com</strong>fort<br />

of the occupants thereof, and be held responsible<br />

for the prudent use of oil, gasoline,<br />

stationery and other expendable property.<br />

- He sball see that property belonging to<br />

the city is not damaged, destroyed or used for<br />

private purposes.<br />

RULE 78 ORDERS - COUNTERMANDED. A lieutenant<br />

shall carry out the orders of his <strong>com</strong>manding<br />

officer. Such orders shall not be countermanded<br />

or set aside except when necessary in<br />

cases of emergency. Whenever such orders are<br />

countermanded, the lieutenant shall submit a<br />

written report to his <strong>com</strong>manding officer explaining<br />

the reasonS for such action.<br />

RULE 79 RESPONSIBI LIlY - GENERAL. A lieutenant,<br />

in the absence of the <strong>com</strong>manding officer,<br />

and unless otherwise provided, shall be subject<br />

to all the rules and regulations governing<br />

the <strong>com</strong>manding officer insofar as they are<br />

applicable and do not conflict with the specific<br />

rules prescribing the duties of a lieutenant.<br />

and shall perform all the duties of<br />

the district <strong>com</strong>mander insofar as police services<br />

require.<br />

DESK SERGEANT<br />

RULE 80 DUTIES - GENERAL. A desk sergeant<br />

assigned to a district station, or elsewhere<br />

in a similar capacity, shall be on active duty<br />

during such hours as may be prescribed. He<br />

shall be subject to all the rules and regulation<br />

s govern ing a p a tro 1 se rge an t i nso far as<br />

they are applicable and do not confl ict wi th<br />

the specific rules prescribing the duties of a<br />

legal fee. Each desk se rgeant shall be responsible<br />

for all bail monies or other monies<br />

<strong>com</strong>ing into his possession during his tour oJ<br />

duty.<br />

RULE 8q V IOLATI ONS - REPORTI NG. A desk sergeant<br />

shall report to his <strong>com</strong>manding officer<br />

any violation of the rules and regulations of<br />

the department, or any improper conduct by any<br />

member of the department, which may <strong>com</strong>e to<br />

hi s atten tion.<br />

RULE 85 IMPORTANT INFORMATION - REPORTING. A<br />

desk sergeant shall call the attention of his<br />

<strong>com</strong>manding officer to all matters of importance,<br />

s uch as unusual occurrences, important<br />

messages or condi tions requiri.ng his<br />

atten tion.<br />

RULE 86 MISSING PERSONS - REPORTIHG. Whenever<br />

a desk sergeant is notified of a missing<br />

person residing in his district he shall obtain<br />

a detailed desc ription of such person,<br />

including all particulars concerning the disappearance.<br />

This information sha,ll be <strong>com</strong>municated<br />

immediately to the Missing Persons<br />

Section. He shall cause to be made whatever<br />

s upplement a ry investi gations may be necessary,<br />

and shall cooperate wi th the Mi ssing Persons<br />

Section. Whenever the mis s ing person is a<br />

reside nt of another district, the desk sergeant<br />

shall obtain all pertinent information<br />

regarding the missing person and the particu­<br />

I ars concerning the di sappearance the same as<br />

if th e missing person were a res ident of his<br />

district. Under no circumstances shall he refer<br />

the <strong>com</strong>pl ainant to another district or<br />

bureau. He shall be responsible for promptly<br />

notifyin g the district concerned of all information<br />

concerning the disappearance. He shall<br />

keep a written report of the case for his<br />

fi Ie s.<br />

RULE 95 NEGLECT OF DUTY, ETC. - REPORTING. A<br />

patrol sergeant shall acquaint himself thoroughly<br />

with all the capabilities of patrolmen<br />

under his supervi sion, and imparti ally report<br />

in writing to hi s <strong>com</strong>manding offi ce r e very<br />

cause of in<strong>com</strong>petence, neglect of duty, or any<br />

violation of the rules and regulati ons by such<br />

patro lmen ,<br />

RULE 96 POSTS - EXTEND ING. Whenever, after a<br />

thorough search and i nvesti gation, a patrol<br />

sergeant cannot find a patrolman on his post<br />

he shall extend the adjoining posts until the<br />

post of the missing patrolman is cove r ed, and<br />

notify his <strong>com</strong>manding officer of the ac tion<br />

taken. I f he cannot cover such post from the<br />

adjoining terri tory, he shall r emain thereon<br />

until such post is covered or oth e rwi se protected.<br />

RULE 97 CONTACT WITH DISTRICT STATION. A<br />

patrol sergeant shall <strong>com</strong>municate wi th his<br />

district station at least once every hour at a<br />

specified time in order to ascertain whether<br />

there are any matters requiring his attention.<br />

If a patrolman is absent from his post or<br />

fails to make his hourly report, the patrol<br />

sergeant shall make a diligent investigation<br />

into the cause, and promptly report the resul t<br />

of the investigation to his <strong>com</strong>manding officer.<br />

In such a case he s hall also s ubmit a<br />

written report concerning such delinquency<br />

with a re<strong>com</strong>mendation for disciplinary action<br />

when warranted to his <strong>com</strong>manding officer at<br />

th e e x p irati 0 n 0 f his to u r 0 f d u t y •<br />

RULE 98 EMERGENCY - ACTION IN. Up o n arriving<br />

at the scene of any fire, riot, crime or other<br />

im[lortant emergency, the patrol sergeant shall<br />

immediately send or <strong>com</strong>municate information<br />

concerning .the emergency to the <strong>com</strong>manding officer<br />

of the district in which the emergency<br />

occurred and t ak e such othe r action as the<br />

si tuation requires.<br />

RULE 99 BUI LDI HG PERMITS. A patrol sergeant<br />

shall, whenever the erection, enlargement, alteration,<br />

repair or removal of any building is<br />

<strong>com</strong>menced on his post, require the person in<br />

charge thereof to exhibit a permi t. If he<br />

have no permit or refuse to exhibit same, said<br />

work shall be stopped and promptly reported to<br />

the station-house so that the Department of<br />

Buildings may be noti fied.<br />

DETECTIVE<br />

RULE 100 DUTIES. A member of the department<br />

assigned as a detective shall be primarily responsible<br />

for the investigation of crimes and<br />

incidents which are brought to his attention.<br />

He shall investigate any area or type of crime<br />

over which this department has jurisdiction.<br />

In addition, he shall obtain detailed information<br />

and physical evidence leading to the<br />

identification and arrest of offenders.<br />

RULE 101 COMMANDI NG OFF ICER TO BE INFORMED.<br />

A member of the department assigned as a detective<br />

shall keep his <strong>com</strong>manding officer<br />

properly informed, by means of reports, of all<br />

matters and developments in cases to which he<br />

is assigned.<br />

RULE 102 FOLLOW THROUGH INVESTIGATIONS. Unless<br />

the case has been officia,lly closed, a<br />

detective shall consult with witnesses and<br />

<strong>com</strong>plainants from time to time concern ing the<br />

status of the case especially with the view of<br />

uncovering new evidence. He shall follow up<br />

each case assigned until final disposition or<br />

until re-assigned. In cases of reassignment,<br />

he shall turn over all reports and essential<br />

information in his possession, to the officer<br />

assigned to take over such case.<br />

RULE 108 PATROL - ALERTNESS ON. A police officer<br />

shall not lounge, loaf or otherwise idle<br />

on his post. He shall not sit down unless his<br />

assignment requires it; lean against walls,<br />

posts, or trees; or conduct himself in any<br />

manner other than as a responsible official<br />

exposed to publ ic observation and critiCism,<br />

with impor tant work to do.<br />

RULE 109 ENTER ING BU I LDIHG. A patrolman, on<br />

duty, shall not enter any house, theatre, or<br />

other such pI ace except when authorized, or in<br />

the strict discha,rge of his duties.<br />

RULE 110 TELEPHONE REPORTS. A patrolman<br />

shall famil iarize h imsel f with the location<br />

of fire and pol ice signal boxes and all telephones<br />

on his post avail able to his use. Duri<br />

ng his hours of patrol duty, he sha.ll report<br />

to the police telephone operator from the<br />

p olice signal box at such times and places as<br />

may be designated by his district <strong>com</strong>mander.<br />

If the pol ice signal box is out of order,<br />

or condi tions prevent the use 0 f the sign al<br />

box, he shall make his report by means of the<br />

nearest public telephone. Whenever assignments<br />

or conditions prevent a prescribed report<br />

from a signal box at the scheduled time,<br />

the officer shall submit a written explanation<br />

of the circumstances to his <strong>com</strong>manding officer<br />

at the end of his tour of duty.<br />

Except in cases of ew.ergency, a patrolman<br />

shall not submit signal reports from the same<br />

box on two successi ve calls when there are two<br />

or more signal boxes within his post.<br />

Patrolmen assigned to school, church or<br />

hazardous crossings shall be excused from making<br />

signal reports while attending such crossing.<br />

However, they are required to make such<br />

eports immediately before and immediately<br />

after leaving such crossing.<br />

RULE III LICENSED BUSINESS. A patrolman<br />

shall take notice of all persons, pI aces and<br />

devices on his post engaging in any business<br />

or activity which requires a license, and<br />

shall take proper action when any Violation<br />

concerning such persons, places or devices are<br />

observed or called to his attention.<br />

RULE 112 DESTITUTION - RELIEF OF. A patrolman<br />

is directed to remove persons found begging<br />

on the public way. If inquiry discloses<br />

that such persons are found proper subjects<br />

for reI ie f, the appropriate authorities shall<br />

be notified. I f they are imposters or vagrants,<br />

they shall be deal t with according 'to<br />

the I aw. He sh all send all penn il ess and<br />

homeless persons to the station-house.<br />

RULE 113 CHI LOREN - TRUANT. A patrolman<br />

shall observe all children of school age who<br />

are not in school during proper school hours,<br />

making inquiries as to the reasons for such<br />

absence, and notify his <strong>com</strong>manding officer of<br />

any cases of truancy which may <strong>com</strong>e to his atten<br />

tion.<br />

RULE 114 VIGILANCE. At night, and during the<br />

time that business houses are closed, a patrolman<br />

shall exercise the greatest vigilance,<br />

frequently examining and trying accessible<br />

doors and windows of business or pu blic<br />

pI aces, and vacant or unoccupied houses on his<br />

post, inves·tigating all suspicious circumstances<br />

that present themselves.<br />

RULE 115 ENTRANCES - TO OBSERVE. A patrolman<br />

shall be held responsible for the failure to<br />

discover and report any doors or wi ndows of<br />

business houses broken open or unsecured on<br />

his post during his tour of duty. If any<br />

windows or doors are found broken open or unsecured,<br />

he shall promptly report the fact to<br />

his superior officer who shall immediately<br />

notify the owner, tenant, or responsible agent<br />

of such premises. The patro lman shall summon<br />

assistance if necessary, and safeguard such<br />

prem i ses.<br />

RULE 116 DWELLINGS - TO OBSERVE, A patrolman<br />

shall pay particular attention to residences<br />

of famil ies, within his post, who are temporarily<br />

out of the city.<br />

RULE 117 TRAFFIC - REGULATION OF. When any<br />

thoroughfare be<strong>com</strong>es blocked with traffic, a<br />

patrolman shall restore normal traffic flow.<br />

When the stream of traffic is continuous he<br />

shall open the way for pedestrians wishing to<br />

cross, attend children and aged or infirm persons<br />

who would otherwise be exposed to traffic<br />

danger.<br />

RULE 118 HAZARDS - NUISANCES. While on duty,<br />

a patrolman shall note and remove, whenever<br />

possibl e, all street and sidewalk obstructions,<br />

and defects from which accidents may<br />

occur. He shall visit all places where temporary<br />

bui lding pe rm its are granted, where<br />

open ings and excavati ons are made, and see<br />

that suitable ac<strong>com</strong>modations are provided for<br />

public travel. He shall observe all coal<br />

holes left exposed or insecure , all street<br />

lamps not I ighted or that are in need of repair,<br />

as well as all nuisances and other matt<br />

e r s affecting the safety fl.nd convenience of<br />

the public or the inte res t of the City. He<br />

shall s ubmit a written report of all such<br />

findings to his <strong>com</strong>mfl.nding officer. When conditions<br />

are discovered which are immediately<br />

dan gerous to I ife and I imb, he shall noti fy<br />

his station-house and do all in his power to<br />

remedy the conditions and remove the hazard.<br />

RULE 119 BUILDING PERMITS. Wh enever the<br />

erec tion. enl a r geme nt. alteration, r epair, o r<br />

removal of any building is <strong>com</strong>menced on his<br />

post. a patrolman shall require the persons in<br />

charge of such work to exhibit their pe rmit.<br />

If they do not have such a permit or refuse to<br />

exhibit it. the patrolman s h a ll dir ec t that ..<br />

all work be sto pped. He shall promptly r eport _<br />

the conditions to the desk sergeant so that<br />

the Departme nt of Buildings may be notified.<br />

RULE 120 ABSENCE - TO REPORT CONCERNING. A<br />

patrolman shall not le a ve his post except for<br />

some police or personal necessity. If required<br />

to absent himself f rorn his post. he<br />

shall record the necessity . time of departure<br />

and return, as soon as circumstances permit.<br />

He shall <strong>com</strong>municate to his <strong>com</strong>manding officer<br />

vi a the police signal box, at first opportunity,<br />

the fact of leaving his post and the reason<br />

therefor. UPon returning to his post he<br />

shall immediatel y inspect same to ascertain<br />

wheth e r any crime or depredation has been<br />

<strong>com</strong>mi tted during his abs ence.<br />

LOCK-UP KEEPER<br />

RULE 121 DUTI ES - GENERAL. A patrolman as ­<br />

signed to duty as a lock-up keeper shall safely<br />

keep and care for prisoners del ivered into<br />

his custody. He shall promptly report any<br />

matters <strong>com</strong> ing to h is a tten ti on wh i ch may r e ­<br />

quire investigation or action by his <strong>com</strong>manding<br />

officer. He shall not carry his revolver<br />

on h is person n o r permit a revolv er or any<br />

other weapon within the lock-u p .<br />

RULE 122 SEARCH PRISONERS. A lock-up keeper<br />

shall careful ly search each mal e pri soner in<br />

his lock-up and take everything from him which<br />

may be used in effecting an escape, or in<br />

injuring himself. likewi se a ll moni es ,<br />

into his custody. He shall check all prisoners<br />

when going on and off duty and turn over<br />

all records and prisoners to the lock-up keeper<br />

<strong>com</strong>ing on duty.<br />

RULE 127 CLEANLINESS. A lock-up keeper shall<br />

keep a record of prisoners'meals served and _<br />

all supplies received by him, and see that all _<br />

cell s are kept clean and in a sanitary condition<br />

.<br />

RADIO EQUIPPED VEHICLES<br />

RULE 128 VEH I CLES - CREWS. Radio equipped<br />

vehicles used for patrol duty, or by the traffic<br />

division, shall be manned by such number<br />

of uni formed patrolmen as the <strong>com</strong>manding officer<br />

designates, subject to the orders of the<br />

Commissioner of Police.<br />

RULE 129 ROLL CALL - REPORT AT. A patrolman<br />

assi gned to a radio equipped vehicl e shall report<br />

for roll call at his station at the time<br />

prescribed, unless otherwise directed. The<br />

vehicle to which he is assigned shall be<br />

turned over to him at the station, unless<br />

otherwise directed, and it shall be his duty<br />

to report to the desk sergeant whether or not<br />

his vehicle is available for patrol, or is<br />

otherwise assigned.<br />

RULE 130 DUTIES - GENERAL. A patrolman assigned<br />

to regular duty in a vehicle shall<br />

operate such vehicle at a moderate rate of<br />

speed and in such manner as wi 11 enable him to<br />

observe any conditions or occurrences which<br />

may require police attention. He shall adhere<br />

to the system of patrol prescribed for his<br />

regulation, and all rules and regulations prescri<br />

bed for foot pa tro lmen shall app ly to vehicle<br />

patrolmen when appropri ate and are not<br />

in conflict with the specific rules applying<br />

to vehicle patrolmen.<br />

PAWN SHOP SECTION<br />

RULE 170 SUPERVISION. The Pawn Shop Section<br />

shall be <strong>com</strong>manded by a member of the department<br />

who shall be known as the <strong>com</strong>manding officer<br />

and who shall have the immediate superviSion,<br />

subj ect to the orders of the <strong>com</strong>manding<br />

officer of the Records and Communications<br />

Division, of all members and employees of the<br />

department assigned to duty therein.<br />

RULE 171 RECORDS - TO KEEP. The Pawn Shop<br />

Section shall maintain classified records concerning<br />

all lost or stolen property, all property<br />

found or held by the department, and all<br />

property held, pledged or purchased by pawn<br />

brokers or held or purchased by second-hand<br />

dealers. These records shall be arranged and<br />

cl assi fi E. d in such a manne r as to allow<br />

articles classified in the lost or stolen<br />

property record to be identified in the<br />

records 0 f property repor ted as recovered,<br />

found, or held by the police. Sepa,rate<br />

records shall be maintained of all lost or<br />

stolen property which bears a number, name,<br />

initial or other definite me ans of identification.<br />

Simil ar records shall be maintained of<br />

all property recovered, found or he ld by the<br />

police.<br />

RULE 172 CUSTODI AN - CHECK WITH. The <strong>com</strong>manding<br />

officer of the Pawn Shop Section<br />

shall cause a daily check to be made of the<br />

records of property currently received by the<br />

Custodi an fo r the purpose 0 f iden ti fyin g<br />

property reported to the police as lost or<br />

stolen. Special utten tion shall be gi ven to<br />

property where the rightful owner is not<br />

known. It shall be the duty of the <strong>com</strong>manding<br />

officer of the Pawn Shop Section to see that<br />

every reasonable effort is made to discover<br />

and notify the righ tful owner of such recovered<br />

property.<br />

former occupation, date of appointment, promotions,<br />

reprimands, fines, suspensions, reinstatements,<br />

resignation s , deaths and such<br />

other data as may be necessary. Upon appl ica-tion<br />

for pension, by a member or employee, the<br />

Director of Personnel shall certify the time<br />

of service to the pension board.<br />

RULE 178 TIME RECORDS. The Director of Personnel<br />

shall be responsible for maintaining an<br />

up to date card record system showing the members<br />

of the department, alphabetically arranged,<br />

the district or unit to which assigned,<br />

a record of furloughs, time allowed<br />

and lost by members and employees of the department,<br />

and the record of daily attendance<br />

sheets submitted by districts and units.<br />

RULE 179 DEPARTMENT ORDERS. The Director of<br />

Personnel shall be responsible for maintaining<br />

a <strong>com</strong>plete file of all general, special and<br />

circular orders, <strong>com</strong>munications with the Civil<br />

Service Commission, correspondence with corporations<br />

and other inquiries concern ing members<br />

or employees 0 f the department, a file of<br />

all time cards, records of issuance of identification<br />

cards, insignia, official stars,<br />

batons, police and fire box keys, certification<br />

of records to the pension board and the<br />

notification of proper authori ties when automatic<br />

salary increases are due. Such other<br />

records and duties as are prescribed from time<br />

to time by Commissioner of Police al so shall<br />

be maintained or executed.<br />

RULE 180 I HFORMATI ON. The Personnel Records<br />

Section shall not transmit any official star<br />

numbe rs, photo graphs, name s, home addresses 0 r<br />

telephone numbers or other intimate histories<br />

concerning members or employees of the department.<br />

absent from duty because of such sickness or<br />

InjUry. He shall submit, through channel s, a<br />

written report of h is findings and conclusions<br />

of such examination to the Com missioner of<br />

Police .<br />

RULE 185 BILLS - SUBMISSION OF. All bills<br />

for medical expenses arising out of injuries<br />

sustained by a member or employee of the department<br />

must be presented to the Medical Section<br />

before or at the time the injured member<br />

or employee is returned to duty. The Chipf<br />

Surgeon shall forward all such bills to the<br />

injured member's or employee's <strong>com</strong>manding officer<br />

for proper investi gation and execution.<br />

RULE 186 HO SP I TAL CHARGES - APPROVAL 0 F. In<br />

case of injury incurred in the performance of<br />

duty. no nospi tal or other bills for professional<br />

services shall be contracted without<br />

the approval of the Chief Surgeon.<br />

RULE 187 CONSULTATION - APPROVAL OF. When<br />

consul tations are necessary to remedy injuries<br />

incurred in the performance of duty. the bill s<br />

and fees for such consultations will only be<br />

paid in cases where the Chief Surgeon has concurred<br />

in the re<strong>com</strong>mendation for such consultations.<br />

RULE 188 SECONDARY OPERATIONS - APPROVAL OF.<br />

When secondary operations are performed to<br />

remedy injuries incurred in the performance of<br />

duty, the bills and fees for such secondary<br />

operations will be paid only in cases where<br />

the Chief Surgeon has concurred in the need<br />

for such secondary operation.<br />

RULE 189 CLAIMS - RECORDS AVAILABLE. Before<br />

any sick or injured member or employee may obtain<br />

benefits from the department, said member<br />

or employee must submit to the Chief Surgeon<br />

copies of records, reports and all other essential<br />

data pertinent to the injury or sickness.<br />

irRULE 190 MEDICAL ROLL. When the name of a<br />

member of employee appears on the medical roll<br />

it shall be carried the reon until a "Return to •<br />

Duty" notice is issued to said member or employee<br />

by the Medical Section.<br />

RULE 191 RETURN TO DUTY. A member or employee<br />

shall return to duty on the date specified<br />

on the "Return to Duty" notice or stand<br />

re-examination by the Medical Section.<br />

RULE 192 ADDRESS - IWTICE OF CHANGE. When a<br />

member or employee is carried on the medical<br />

roll he s hall confer with the Medical Section<br />

before changing h is address or hospi tal.<br />

RULE 193 LIGHT DUTY MEMBERS. The Chief Surgeon<br />

shall re<strong>com</strong>mend to the Director of Personnel<br />

members or employees for light duty assignments.<br />

Such members or employees shall be<br />

selected from those persons assigned to the<br />

medical roll. The Chief Surgeon shall designate<br />

the duties which such member or employee<br />

may safely and effectively perform. He shall<br />

maintain a card index file explaining the<br />

medica l history and light duty activities of<br />

each member or employee as aSSigned. The jurisdiction<br />

of the Chief Surgeon shall be<br />

restricted to the professional, medical a nd<br />

diagnos tic services of the member's or employee's<br />

disabilities and shall not extend to the<br />

pI acement of such persons to the ir assignment.<br />

RULE 194 EXAMIIlATION - PER 1001 C. The Chief<br />

Surgeon shall make, or cause to be made, a<br />

physical and medical examination incl uding a<br />

chemical and microscopic urinalysi s of all<br />

members and employees of the department. This<br />

examination sha.!l be given yearly if possible.<br />

The findings shall not be used for any other<br />

purpose than to improve or safeguard the<br />

he al th 0 f the membe rs and e mployees. All members<br />

and employees shall obtain treatment.<br />

when necessary, in accordance wi th the orders<br />

of the Chief Surgeon or file with him a certificate<br />

establ ishing that treatment is already<br />

being taken or is unnecessary.<br />

RULE 195 SUPPLI ES - ACCOUNT FOR. The Chief<br />

Surgeon shall cause to be issued all medical<br />

supp I ies required by Pol ice Surgeons, squadrol<br />

crews, and other police units entitled thereto,<br />

and shall account for each issue in a report<br />

of supplies received and issued, which is<br />

to be submitted monthly to the Commissioner of<br />

Poli ce o<br />

RULE 196 REPORT - ANNUAL. The Chief Surgeon<br />

shall render an annual r e port to the Commiss<br />

ioner of Pol ice showing the number of days<br />

lost by members and employees by reason of<br />

sickness, injury on duty, and ordinary injury.<br />

respectively, for the calendar year, and showing<br />

the average number of days lost per capita<br />

for each such reason, together with such other<br />

information as is pertinent or which the Commissioner<br />

01 Police may direct.<br />

HUMAN RELATIONS SECTION<br />

RULE 197 SUPERVISION, The HUman Relations<br />

Section shall be <strong>com</strong>manded by a member 0 f the<br />

department who shall be known as the <strong>com</strong>manding<br />

officer and shall have the immediate supervision<br />

and control of all membe rs and employees<br />

assigned the rein. He sh all report directly<br />

to and be subject to the orders of the<br />

Di rec tor 0 f Pe rsonn el.<br />

RULE 198 OUTI ES. The <strong>com</strong>manding officer of<br />

the Human R.elations Section shall be responsible<br />

for analyzing the ci ty' s various racial,<br />

eligious, and nationality concentrations, coordinate<br />

the department's human reI ations activities<br />

and maintain liaison between the department<br />

and racial, religious and nationality<br />

groups as well as various ci vic and social<br />

agenc ie s.<br />

RULE 199 RECORDS. The <strong>com</strong>manding officer<br />

shall be responsible for maintaining a <strong>com</strong>plete<br />

and current set of records concerning<br />

racial, reI i gious and national i ty incidents of<br />

which the department is concerned.<br />

OPERATIONS SECTION<br />

RULE 200 SUPERVISION. The Operations Section<br />

shall be <strong>com</strong>manded by a member who shall be<br />

known as the <strong>com</strong>manding officer and be responsible<br />

for the immediate supervision and<br />

control of all members and employees assigned<br />

therein. He sh all be subject to and report<br />

directly to the Director of Personnel.<br />

RULE 201 DUTIES. The <strong>com</strong>manding officer of<br />

the Operations Section shall be responsible<br />

for the preparation and development of plans,<br />

operational programs, tactics, procedures and<br />

techni ques. He shall be responsib Ie for designing<br />

and developing various charts, maps<br />

and graphs and for conducting essential and<br />

original research surveys to improve the<br />

functional operations of the department.<br />

SERVICES AND SUPPLIES DIVISION<br />

RULE 202 SUPERV I SION. The Services and SuppI<br />

ies Di vision shall be <strong>com</strong>manded by a member<br />

or employee who shall be known as the <strong>com</strong>manding<br />

officer and shall have the immediate supervision<br />

and control, subj ect to the orders<br />

of the Deputy to the Commissioner for Staff<br />

Se rv ice s, 0 f all me m b e r s an d em p loy e e s a s ­<br />

signed to duty therein.<br />

MOTOR SERVICE SECTION<br />

RULE 203 SUPERVISION. The Motor Se rvice Section<br />

shall be under the di r ect con trol o f a<br />

me mber or employee who shall be known as the<br />

<strong>com</strong>manding officer and shall h ave the immediate<br />

superv iSion, subj ect to the orders of the<br />

<strong>com</strong>manding officer of the Services and Supplie<br />

s Division, of all members and employees<br />

assigned to duty therein.<br />

RULE 201+ RESPONSI BI LI1Y. The <strong>com</strong>manding officer<br />

of the Motor Service Section shall be<br />

responsible for all maintenance and service<br />

record s , the repairs to department ve hicles<br />

and v e hi c ular equipment, the appraisal of<br />

damages and adj ustmen t of repair ch arges for<br />

such vehicles and vehicular equipment.<br />

RULE 205 DAMAGE TO EQUI PMEHT - INVESTI GATE.<br />

The <strong>com</strong>ma.nding office r o f the Motor Service<br />

Section shal l inve s tigate, or cause to be investigated,<br />

all accidents resul ting in damage<br />

to depa.rtment vehicle s and vehicular equipment<br />

and s hall himself appear, or be represe nted,<br />

in court in all cases involving damage to such<br />

equipment when placed in litigation.<br />

RULE 206 REPAIRS - AUTHORIZE. The <strong>com</strong>manding<br />

officer of the Motor Service Section shall<br />

authorize all repairs to department vehicles<br />

a. nd vehicular equipment in individu al instances<br />

in accord a nce with s uch general instructions<br />

as the Commi ss i one r of Police may<br />

i ss ue. Such mino r adjustments and repairs as<br />

the mechanics attached to this section are<br />

<strong>com</strong>petent t6 ac<strong>com</strong>plish s uccessfully and effici<br />

en tly shall be made under th e direction of<br />

the <strong>com</strong>manding officer of the section.<br />

RULE 207 REPORTS - DAILY OPERATIONS. The<br />

<strong>com</strong>manding officer of the section shall receive,<br />

investigate and act upon all reports of<br />

equired adjustments and repairs to department<br />

vehicles and vehicul ar equipment submi tted by<br />

operators of such equipment on daily operator's<br />

reports prepared for the purpose.<br />

RULE 208 REPORTS - MONllILY. The <strong>com</strong>manding<br />

officer of the section shall prepare and submit<br />

through channels a monthly report of all<br />

maintenance and service costs of department<br />

vehicles and vehicular equipment to the Commissioner<br />

0 f Pol ice.<br />

RULE 209 INVENTORY - REPORT. The <strong>com</strong>manding<br />

officer of the section shall inventory, at<br />

least once each year, all vehicles and vehicu­<br />

I ar equipment oYllled or used by the department,<br />

and submi t a report, through ch annel s, to the<br />

Commissioner of Police, setting forth in as<br />

much detail as necessary his re<strong>com</strong>mendations<br />

for the provision of new equipment, replacement<br />

or recondi tioning of old, the type and<br />

make of equipment and any information calculated<br />

to produce maximum effectiveness and efficiency<br />

in this branch of the service.<br />

BUILDING MAINTENANCE SECTtON<br />

RULE 210 DUTI ES - GENERAL. The Building<br />

Maintenance Section shall be <strong>com</strong>manded by a<br />

member or employee who shall be responsible<br />

for the immediate supervi sion of such members<br />

and employees as are assigned to the section,<br />

under the direction of the <strong>com</strong>manding 0 fficer<br />

of the Services and Supplies Division. He<br />

shall be responsible for superintending such<br />

repairs and remodel ing of department buildings<br />

and their maintenance as shall be n ·ecessary<br />

for the health and safety of the occupants.<br />

RULE 211 REPORTS. The member or employee in<br />

charge shall submi t a report on or before the<br />

first of each year, or more frequently when<br />

all districts, divisions and other organizational<br />

units into Ylhich the department may be<br />

divided to assure himself that no hoarding of<br />

supp lie s ex i s ts.<br />

RULE 215 REQUISITION. All <strong>com</strong>manding officers<br />

shall make out a monthly Ylritten requisition<br />

based on thei r anticipated needs. This<br />

requisi tion is to be submi tted to the Storekeeper<br />

five days before the calendar month for<br />

which the requisitioned needs are to be drawn.<br />

Commanding officers must endeavor to enumerate<br />

all supply needs .<br />

No supplies shall be issued by the Storekeeper<br />

except through establ ished departme nt<br />

procedure. However, in emergencies, the<br />

Storek eeper may issue an i tern on the basis<br />

that the official requisition will be submi<br />

tted to him in the next police mail.<br />

RULE 216 RECORDS. The Storekeeper s hall<br />

maintain records in the manner set forth in<br />

the Manual of Procedure as adopted for use in<br />

all of the city's departments. He shall supervise<br />

the a.ctivities of the employees and<br />

members assigned to keeping 0 f the records and<br />

see th a t all required i terns are properly entered<br />

on the reco rds. He shall prepare and<br />

forward such r eports as may be directed by the<br />

Commissioner of Police.<br />

BUDGET CONTROL UNIT<br />

RULE 217 DUTI ES. The department's Budget<br />

Control Unit shall be <strong>com</strong>manded by a member or A<br />

employee 0 f the department who shall be under .,<br />

the immediate supervi sion of the Storekeeper.<br />

He shall maintain liaison between the Storekeeper<br />

and the Ci ty Purch asing Ag e n t. He<br />

shall prepare and forward through channels all<br />

equisitions to the Co mm issi oner of Po lice .<br />

He shall attach to a ll purchase r equi s itions a<br />

s lip exp l aining the account to which the purch<br />

ase is to be charged.<br />

ANIMAL SHELTER SECTION<br />

RULE 218 SUPERVISION. The Animal Shelter<br />

Sec tion shall be <strong>com</strong>manded by a me mbe r or employee<br />

of the department wh o sh all be known as<br />

the co mm anding officer and sh all have the immediate<br />

supe rvis i on and contro l o f all members<br />

and employees ass i gned to duty therein. He<br />

shall r eport di r ectly to a nd be subjec t to t he<br />

orders of t he <strong>com</strong>mand in g offi ce r of the Services<br />

and Suppl i es Div i sion.<br />

RULE 219 DUTIES - GENERAL. The <strong>com</strong>manding<br />

officer of the Animal Shelter Section shall be<br />

accountab l e for the enforcement of laws and<br />

ordinances reI ating t o animals and for the<br />

care and proper disposition of all ani ma l s at<br />

the she1 te r.<br />

RULE 220 UN I FORM - I N CHARGE. A pol ice Officer<br />

assigned to th e Shel t er shall be in<br />

uniform when the c ircumst ances permi t a n d<br />

shall at all t i mes wear th e cap and display<br />

the officia.l star indicative of his authority.<br />

catch dogs which are at l ar ge in violation of<br />

RULE 270 iMPROPER USE OF UNIFORM. Members of<br />

the department shall not wear any part of the<br />

official uniform while in civilian clothes.<br />

RULE 271 EQUIPMENT REMAINS CiTY PROPERTY.<br />

All equipment issued to a member of the department<br />

shall remain the property of the<br />

city. The member shall be responsible for the<br />

careful and proper use of all such property<br />

entrusted to his care. Anytime a member be<strong>com</strong>es<br />

temporarily or permanently separated<br />

from the department he/she shall be required<br />

to surrender all department equipment to their<br />

<strong>com</strong>manding officer.<br />

RULE 272 EQUIPMENT - IN CASE OF MEMBER'S<br />

DEATH. When a member of the department dies,<br />

the <strong>com</strong>manding officer shall submit a report<br />

to the Commissioner of Police explaining the<br />

cause of death and the circumstances surrounding<br />

the death. The <strong>com</strong>manding officer sball<br />

be responsible for gathering the department<br />

equipment assigned to the deceased and forwarding<br />

same to the Director of Personnel.<br />

RULE 273 HOT TO WEAR OFFICIAL UNIFORM. During<br />

the period of suspension a member 0 f the<br />

department shall not wear the official uniform<br />

either in whole or in part.<br />

GENERAL RULES<br />

RULE 27' GENERAL DUTIES, In carrying out the<br />

functions of the department, namely the prevention<br />

of crime, preservation of the public<br />

peace, protection of life and property, and<br />

the arrest and prosecution of violators of the<br />

law, and the enforcement of all laws, a police<br />

officer shall constant ly direct his/her best<br />

efforts to ac<strong>com</strong>plish that end and shall hold<br />

himsel f/herself in readiness at all times to<br />

obey the orders of superior officers. They<br />

RULE 279 SUBORDINATE TO BE SUSTAINED . A s uperi<br />

RULE 280 SUBORDINATE TO BE CORRECTED. A superior<br />

off i cer shall correct a subordinate<br />

member wh en he/she is acting i n confl ict of<br />

a ny l a w, ordinance o r the rules and regulations<br />

of the departme nt. Correction shou ld be<br />

made in a dignified manner in keeping with the<br />

decorum of the officer' s stati on . Whenever<br />

possible, censuring of s ubo rdinates s houl d be<br />

done in a pl ace apart from other me mbers of<br />

the department. Tyranni cal conduct or abusive<br />

1 anguage are not to be used by a superior when<br />

co rrec tin g a su bordinate.<br />

RULE 281 MEMBERS TO I DENTI FY THEMSELVES. A<br />

member 0 f the department shall co rrectly<br />

identify himself/ herself by givi ng his/he r<br />

n ame , rank and star number when so r equested<br />

e i the r by other members 0 f the depar tmen t or<br />

by a private citizen.<br />

RULE 282 ANSWERING THE TELEPHONE. Wh en<br />

answering e ither the pu blic o r PAX telephone,<br />

a member of the department shall state his<br />

di strict (bureau, sec tio n, unit) r ank and surname.<br />

RULE 329 REPORTING STOLEN AUTOMOBILES. When<br />

a pol ice officer is informed of the theft of<br />

an automobile he shall direct the <strong>com</strong>plainant<br />

to the appropriate station-house where appropri<br />

ate fo rms are a vai I able to record the <strong>com</strong>pI<br />

ain t. Only in si tuations whe re it is clearly<br />

impossible for the <strong>com</strong>pl ainant to go to the<br />

station-house, shall the police officer take<br />

such a report. In such situations, he shall<br />

obtain the name, address, and telephone number<br />

of the <strong>com</strong>plainant and the make, type, size,<br />

and color of the vehicle as well as the engine,<br />

serial and license numbers of the vehicle.<br />

He shall transmit this data to the appropriate<br />

district station-house or department<br />

uni t.<br />

RULE 330 VIC IOUS DOG. When a vicious dog is<br />

found running at large, it shall be taken to<br />

the nearest station-house and held there for<br />

the city poundmaster. If the animal cannot be<br />

safely taken, it shall be destroyed by the<br />

police officer at the scene. The necessary<br />

reports of action taken shall be submitted by<br />

the police officer to his superior officer.<br />

RULE 331 MENTALLY ILL PERSONS. A police officer<br />

shall promptly take into custody any<br />

mentally iII person who is dangerous to himself<br />

or to the <strong>com</strong>munity. When a non-violent<br />

person is taken into custody for <strong>com</strong>mi tment to<br />

the psychopathic hospital, an affidavit shall<br />

be submitted to a judge of the County Court<br />

upon blanks obtained from the Clerk of the<br />

Court. When a non-violent mentally ill person<br />

lives with relatives or friends, the police<br />

officer shall infonn such relatives or friends<br />

the proper action to pursue to effect <strong>com</strong>mi<br />

tmen t.<br />

without the approval of the Commissioner<br />

of Police shall be sufficient grounds<br />

for discharging such employee or member of the<br />

department regardless of the reason or justification<br />

for the solici tation.<br />

RULE 367 WARRANTS AGAINST POLICE OFFICERS.<br />

When a member or employee of tbe department is<br />

detailed as a warrant clerk he shall not draw<br />

up any <strong>com</strong>pl aint or warrant against a pol ice<br />

officer without first notifying the Commissioner<br />

of Pol ice.<br />

RULE 368 SUBORDINATE MAY MAKE COMPLAINT. A<br />

subordinate may file a <strong>com</strong>plaint against any<br />

member of the department for violation of a<br />

rule 0 f the department. The camp! aint shall<br />

take the form of a statemen.t given under oath<br />

together with the names and addresses of 1111<br />

witnesses to said violation. This statement<br />

and information shall be forwarded throu'gh<br />

channels to the Commissioner of Police.<br />

RULE 369 GRIEVANCES. A member or employee of<br />

the department who shall deem himsel f/herself<br />

aggrieved bas the right of redress through appro<br />

pri ate acti on throu gh b is/her co mm an din g<br />

officer and tbe Commissioner of Pol ice.<br />

RULE 370 CITIZEN'S COMPLAINTS. A citizen's<br />

<strong>com</strong>plaint against 8/ly employee or member shall<br />

be tboroughly and promptly investigated by a<br />

superior officer. The substance of all oral<br />

<strong>com</strong>plaints and copies of written <strong>com</strong>plaints<br />

and statements as well as all investigations<br />

made in reference thereto, with re<strong>com</strong>mendations,<br />

shall be forwarded through channels to<br />

the Commissioner of Police.<br />

RULE 371 RECOMMENDING CHARGES. Any Superior<br />

GENERAL ORDER NO. 16<br />

DISCIPLINARY PROCEDURES<br />

A well disciplined Force is not a well punished<br />

one but, rather, a Force that voluntarily<br />

conforms to all Department Rules, Regulations,<br />

and Orders. It follows th at the best<br />

disciplined Force is least in need of punishment<br />

and therefore is the least punished<br />

Force,<br />

The violation of Rules, Regulations, and Orders<br />

nevertheless require s disciplinary action,<br />

In re<strong>com</strong>mending punishment, however,<br />

the motive of the offender will be considered.<br />

Was there an evil, dishonest, immoral, or<br />

selfish motive, or did the violation result<br />

inadvertently from a non-venal human fraility<br />

such as i gnorance, forgetfullness, oversight,<br />

or th e pressures of domestic life <strong>com</strong>plicated<br />

by the misfortunes to which we are all heir?<br />

Let Justice be tempered with Mercy when the<br />

Heart of the offender is Right.<br />

1. The purpose of this Order: To establish<br />

procedures that will assure the prompt ·and<br />

thorough investigation of alleged officer<br />

misconduct, in order to:<br />

a, Clear the innocent,<br />

b. Establish guilt, and<br />

c. Facilitate suitable disciplinary<br />

action.<br />

2, Incidents to be Investigated: Alleged or<br />

suspected violations of law, ordinance, or<br />

Department Rules, Regulations, or Orders.<br />

5. Discipl ine Register: A bound ledger. to<br />

be known as the Discipline Register, will<br />

be maintained at a constantly manned post<br />

in the Internal Investi gation Division.<br />

Spaces will be provided in the ledger for<br />

a Discipline Regi ster Numb e r; the name,<br />

rank, badge number and duty aSSignment of<br />

the alleged violator; the date and hour of<br />

receipt of the telephone report; the nature<br />

of the alleged violation; the name.<br />

rank, and badge number of the reporting<br />

officer; the date and hour of receipt of<br />

the first written report; the date the<br />

case was considered by the Department<br />

Disciplinary Board; and the date of final<br />

action by the Superintendent,<br />

6. Custodian of Discipl ine Register will, on<br />

receipt of a report, give to the reporting<br />

officer the Discipline Register Number of<br />

the case, make suitable entries in the<br />

regist.er, and immediately notify the officer<br />

in charge of the Complaint Investigation<br />

section.<br />

7. Security of Discipl ine Register. Owing to<br />

the fact that the names of some innocent<br />

officers will be recorded in it, the Discipline<br />

Register will be suitably safeguarded<br />

and none but the following will be<br />

permitted access to it: the Superintendent,<br />

the Superintendent's personal Aide,<br />

the Commander of the Bureau of Inspectional<br />

Services. the Departmen t In spector<br />

and Deputy Inspectors . the Commander of<br />

the Internal Investigation DiviSion. the<br />

head of the Complaint Inve stigation Section,<br />

and the Department Advocate.<br />

8. Reports to be Submitted<br />

a. All investigation reports and other<br />

documents relating to disciplinary<br />

9. Action by Commanding Officer<br />

a. When the investigation results in a<br />

determination of Unfounded,Exonerated.<br />

or Not Sustained, the Commanding Officer<br />

will so notify the accused person.<br />

informing him that the determination<br />

is subj ect to review, and continue<br />

him on duty. Should be have<br />

been excused from duty. he will be<br />

paid for this period of time as though<br />

he had worked.<br />

b. When the allegation is Sustained, and<br />

also when the investigation is to be<br />

continued (see paragraph 8-g). the<br />

Commanding Officer will take one of<br />

the following actions in reference to<br />

the duty status of the accused person:<br />

(1) Continue him on duty in his usual<br />

assignment.<br />

(2) Continue him on duty in some other<br />

assignment where (a) his presence<br />

will not be objectionable to<br />

citizens involved in the incident,<br />

or (b) he may be kept under<br />

closer supervision. such as at<br />

station tasks.<br />

(3) When the act <strong>com</strong>plained of is immoral,<br />

indecent, or brutal. or<br />

involves the actual or threatened<br />

physical mistreatment of another<br />

person. or when the accused person<br />

has been drinking, he will be<br />

excused from duty until further<br />

notice.<br />

(4) When the act <strong>com</strong>plained of is a<br />

crime and the evidence is such<br />

that had the action been by a<br />

d. The Department Advocate Section will<br />

prepare cases for presentation to the<br />

Givil Service Commission Trial Board,<br />

working in close cooperation with the<br />

Corporation Council. and perform the<br />

duties outlined in paragraph 16.<br />

12. Investigations by the Complaint lnvestigat<br />

i on Sec t i on<br />

a. An investigation will be made at the<br />

request oJ any member or employee of<br />

the Department who feels threatened in<br />

any manner. Such persons are authorized<br />

to report their situations<br />

direct to the head of the Complaint<br />

Investigation Section without report<br />

to their superiors.<br />

b. ASSistance will be given to Commanding<br />

Officers engaged in a disciplinary investigation,<br />

(1) on request and (2)<br />

when the Complaint Investigation Section<br />

concludes, on the basis of the<br />

information recorded in the Discipline<br />

Register or contained in reports submitted<br />

by the Commanding Officer in<br />

charge of an investigation, that assistance<br />

may be needed. The conclusion<br />

will be based on the seriousness<br />

of the alleged violation. the reputation<br />

of the accused person, and the<br />

investigative <strong>com</strong>petence and spirit of<br />

the <strong>com</strong>manding officer in charge of<br />

the investigation,<br />

c. On direct receipt of an alleged violation,<br />

the <strong>com</strong>plain Section may (1) refer<br />

it to the Commanding Officer of<br />

the accused direct or (2) make an independent<br />

investigation of the <strong>com</strong>plaint.<br />

The decision will be based on<br />

the factors mentioned in paragraph<br />

12-b.<br />

the Superintendent is summary punishment.<br />

he will notify by telephone<br />

the Captain who has jurisdiction over<br />

is to be made. and request him to inform<br />

the accused and give the latter<br />

24 hours in which to tequest a hearing<br />

before the Department Disciplinary<br />

Board.<br />

c. On receipt of telephone notice from<br />

the Captain that the accused has requested<br />

a Disciplinary Board hearing.<br />

the report will be sent to the Department<br />

Advocate for action.<br />

d. On receipt of telephone notice from<br />

the Captain that the accused has not<br />

requested a Board bearing within the<br />

prescribed 24 hours. the report. so<br />

noted. will be forwarded to the Superintendent<br />

for action.<br />

15. Discipl inary Board. There will be a Disciplinary<br />

Board appointed by the Superintendent<br />

<strong>com</strong>prised of tbree Area Supervisors.<br />

or officers of equivale.nt or higher<br />

rank. and six captains who are not<br />

serving under the <strong>com</strong>mand of one of the<br />

bigher ranking members.<br />

16. The Department Advocate will prepare cases<br />

for presentation to the Department Disciplinary<br />

Board. requesting additional investigation<br />

by the Complaint Investigation<br />

Section when needed. He will scbedule the<br />

cases and select a Panel from the Board to<br />

be <strong>com</strong>posed of two Captains and one offi­<br />

specific proposal as to disposition.<br />

e. g•• separation from the Department<br />

or suspension for a definite period in<br />

excess of 29 days. Thi s action should<br />

not be taken when the Disciplinary<br />

Board doubts that the case can be supported<br />

by convincing evidence. unless<br />

it believes such evidence can be obtained<br />

by further investigation. which<br />

it should then re<strong>com</strong>mend.<br />

19. The Superintendent will review the re<strong>com</strong>mendations<br />

of the Disciplinary Board.<br />

which will be advisory to him. and take<br />

such action as he considers appropriate.<br />

Nothing in this regulation will diminish<br />

his authori ty to order suspensions. or<br />

file charges with the Trial Board of the<br />

Civil Service Commission. at his own discretion.<br />

20. Suspensions. When an officer who has been<br />

excused from duty (paragraph 9-b (3» is<br />

suspended. his suspension will be effective<br />

the date the offender was excused<br />

from duty; when there is no suspension. or<br />

the suspension is for a shorter period<br />

that the total time the officer was excused<br />

from duty. he will be paid for the<br />

"excused" days in excess of the suspension.<br />

A member of the force arrested for<br />

a felony or graver misdemeanor will be excused<br />

forthwith and the incident reported<br />

at once to the Office of the Superintendent.<br />

21. Presiding Officers of Discipl inary Boards.<br />

The three ranking officers of the Board<br />

will meet once each month to discuss <strong>com</strong>mon<br />

problems. develop general standards to<br />

assure reasonable consistency. and propose<br />

modifications in the disciplinary procedures<br />

to the Superintendent.<br />

22. Distribution. This Order will be reproduced<br />

and a copy given to each member and<br />

employee of the Department.<br />

23. Effective Date. This Order will be<strong>com</strong>e<br />

effective 12: 01 a.m•• April 25, 1960.<br />
