A. INSTRUCTIONS TO TENDERERS PUBLICATION REF.: EuropeAid/132448/D/SUP/XK/supply of spare parts and maintenance of vehicles (PROC/339/12) In submitting a tender, the tenderer accepts in full and without restriction the special and general conditions governing the contract as the sole basis of this tendering procedure, whatever its own conditions of sale may be, which it hereby waives. Tenderers are expected to examine carefully and comply with all instructions, forms, contract provisions and specifications contained in this tender dossier. Failure to submit a tender containing all the required information and documentation within the deadline specified will lead to the rejection of the tender. No account can be taken of any reservation in the tender as regards the tender dossier; any reservation may result in the immediate rejection of the tender without further evaluation. These Instructions set out the rules for the submission, selection and implementation of contracts financed under this call for tenders, in conformity with the provisions of the Practical Guide to contract procedures for EU external actions, which is applicable to the present call (available on the Internet at this address: http://ec.europa.eu/europeaid/work/procedures/index_en.htm). 1. Supplies to be provided 1.1 The subject of the framework contract is the supply and delivery of spare parts for vehicles, as well as the performance of some ancillary services (installation of spare parts, maintenance, repair of vehicles, etc.) by the Contractor (see the draft contract, special clauses, and Annex II and III of the Tender Dossier for the relevant description of the items and ancillary services and the estimated quantities for 2 (two) years that may be ordered during the duration of the framework contract): in 6 (six) lots at EULEX Kosovo, Pristina, DAP 2 . Lot 1 Toyota Lot 2 Volkswagen group Lot 3 Nissan Lot 4 Mercedes Lot 5 Heavy, Special Vehicles & Other Makes Lot 6 Spare parts for armoured vehicles (No Maintenance) The signature of the framework contract imposes no obligation on the Contracting Authority to purchase the quantities as estimated in Annex II and III. Deliveries of spare parts and performance of ancillary services shall ONLY take place following the issuance of “purchase orders” to be issued by the Contracting Authority during the duration of this framework contract. Deliveries of spare parts shall take place within 15 (fifteen) working days after the receipt by the contractor of a “purchase order”.
