Affalterbach nach Sindelfingen und nehmen an einer Führung durch die Produktionsstätte des 

Mercedes-Benz SLS AMG teil. Zurück in Affalterbach wird sich die Faszination noch einmal 

steigern: Sie können unmittelbar miterleben, wie AMG Motoren in meisterlicher Handarbeit 

gefertigt werden. Anschließend besichtigen Sie das AMG Performance Studio und den 

„gläsernen Prüfstand“. 

Using the vehicles provided, among them naturally a couple of SLS AMGs, you will drive from 

Affalterbach to Sindelfingen and go on a tour around the Mercedes-Benz SLS AMG factory. 

Back in Affalterbach, your enthusiasm will be inspired once again as you are able to see for

Von dort fahren Sie geführt in bereitgestellten AMG Fahrzeugen bis an die Schweizer Grenze. 

Der folgende Tag führt Sie nach Montreux, wo Sie den Nachmittag beim Empfang im Chalet 

des Festival-Begründers genießen. Abends lockt das Montreux Jazz Festival direkt an den Genfer 

See. Am Sonntag können Sie auf der Rückfahrt nach Affalterbach noch einmal ausgiebig das 

Fahr vergnügen am Steuer eines AMG Mercedes genießen. 

This weekend begins with a fascinating tour of the AMG factory. From there, you will drive the 

AMG vehicles provided to the Swiss border. The following day will lead you to Montreux, where 

you will enjoy the afternoon at the reception at the festival founder’s chalet. In the evening, the 

Montreux Jazz Festival beckons on the banks of Lake Geneva. On Sunday, you can enjoy once 

again the feeling of being at the wheel of an AMG Mercedes on the way back to Affalterbach.

Eröffnet wird dieses sportive Wochenende mit einer Werksführung in Affalterbach, bei der Sie 

hautnah die Entstehung eines AMG Mercedes miterleben. Gemeinsam fahren Sie mit diversen 

Modellen der AMG Produktpalette nach München, wo Sie am zweiten Tag an einem Golftraining 

mit Robert Baker, dem bekannten südafrikanischen Trainer, teilnehmen werden. Am Abschlusstag 

laden wir Sie zu einer lockeren 9-Loch-Runde ein – nach der es in AMG Fahrzeugen zurück nach 

Affalterbach geht.

get first-hand experience of how an AMG Mercedes comes together. You then drive as a group 

in various AMG models to Munich, where, on the second day, you take part in a golf training 

course led by Robert Baker, the famous South-African coach. On the final day, we invite you to 

play a relaxed 9-hole round before driving back to Affalterbach in the AMG vehicles.

and around the Sachsenring. Whilst the fundamental theory work is completed 

on the first day, on the second day you will begin to learn everything about 

the interaction between driver and vehicle during the basic training provided 

by our competent instructors – with slaloming, lane changing, braking or 

oversteer and understeer. After the advanced training, you can live out your 

passion for sporty driving on the handling course and with the guided drives.

For two and a half days, your world revolves around one of these legendary racetracks. Under 

professional instruction, you will be trained in an AMG Mercedes provided for you or, on the Nürburgring 

Nordschleife, in your own or in a rented vehicle. During this intensive racetrack training 

course, you will learn to control the limits of AMG vehicles in any situation. And a ride in the 

AMG Racing Taxi is guaranteed to quicken the pulse.

In winter, everybody who is anybody tests their prototypes under extreme 

conditions in Arjeplog near the polar circle. Minus 30 degrees Celsius and 

vast ice-covered surfaces are perfect conditions for the participants of 

the AMG Driving Academy to learn a lot about driving safety and driving

This training course with a limited number of participants is the continuation 

of the AMG Winter Sporting ADVANCED course. After the basic training on 

the first day, you will experience three highly-concentrated days during the 

Winter Sporting PRO course: theory phases are rounded off with advanced 

training with personal one-to-one coaching and intensive data recording with 

meticulous assessment. During the course, you will be able to perfect your 

driving technique in the AMG vehicles provided for you and be able to prove

und Sitzprobe im SLS AMG GT3 ein gezieltes Training statt: Sie absolvieren 

auf Sportreifen aktive Fahrübungen, bei denen Handling, Beschleunigen, 

Bremsen, Schalten und Überholen auf dem Programm stehen. Eine Teilnahme 

im eigenen Fahrzeug ist möglich. Teilnahmevoraussetzung: entweder eine 

absolvierte SLS AMG GT3 EXPERIENCE, eine Teilnahme an einem AMG 

ADVANCED- oder PRO-Training oder die Teilnahme an der AMG MASTERS

Even at the second level, targeted training takes place after theoretical 

instruction and a seating test in the SLS AMG GT3. You will complete

At the third level of the MASTERS event, you change from sport tires to slicks 

and be trained by your own personal instructor, something which you can 

book by the hour. With your instructor, you perfect the skills you have learnt 

in perfect braking and gear changing. Meticulous analysis of the telemetry 

and the video recordings will support your progress. After a driving skills 

test carried out by an independent instructor, you will be ready for the 

SLS AMG GT3 COMPETITION. You can also take part in your own vehicle.

Teilnahmebedingungen 

1. Art der Veranstaltungen 

a) Die Mercedes-AMG GmbH bietet den Teilnehmern Sicherheitslehrgänge auf einem während 

der Veranstaltung (Event) für den gewöhnlichen Individualverkehr gesperrten Gelände an. Dies 

gilt nicht für die Veranstaltungen der AMG EMOTION-Tour, welche auf öffentlichen, nicht ge- 

sperrten Verkehrswegen stattfinden. 

b) Die Veranstaltungen dienen der Verbesserung des Fahrkönnens und nicht der Erzielung 

von Höchstgeschwindigkeiten. 

2. Ziele der Veranstaltungen 

a) Verbesserung des Fahrkönnens 

b) Sichere Beherrschung des Fahrzeugs (Zusammenspiel Mensch – Auto – Straße) 

c) Förderung des Sicherheitsbewusstseins 

d) Erweiterung der technischen Kenntnisse 

e) Verbesserung des Fahrkönnens bei winterlichen Witterungsbedingungen 

(nur bei Teilnahme am AMG Winter Sporting ADVANCED und AMG Winter Sporting PRO) 

3. Anmeldung zur Teilnahme 

a) Mit der Anmeldung bietet der Teilnehmer der Mercedes-AMG GmbH den Abschluss des Rei- 

severtrages verbindlich an. Die Anmeldung kann nur mit dem beigefügten Anmeldeformular 

erfolgen. Der Reisevertrag kommt mit der Annahme durch die Mercedes-AMG GmbH zustande. 

Die Annahme erfolgt binnen zwei Wochen durch Zusendung der schriftlichen Reisebestätigung. 

Die Annahme erfolgt unter dem Vorbehalt der Absage bei Nichterreichen der Mindestteilneh- 

merzahl (siehe 3.c). 

b) Die maximale Teilnehmerzahl für die Veranstaltungen ist auf die im Prospekt jeweils ange- 

gebene Zahl begrenzt. 

c) Voraussetzung für die Durchführung der Veranstaltung ist das Erreichen von mindestens 

70 % der im Prospekt jeweils angegebenen maximalen Teilnehmerzahl. Wird die jeweilige Min- 

destteilnehmerzahl bis spätestens 28 Tage vor Beginn der Veranstaltung nicht erreicht und die 

Veranstaltung daher abgesagt, wird die Mercedes-AMG GmbH die angemeldeten Teilnehmer 

unverzüglich hierüber informieren. In diesen Fällen erhalten die Teilnehmer unverzüglich einen 

etwa bereits bezahlten Reisepreis erstattet. 

4. Teilnahmevoraussetzungen 

a) Die Teilnahme an den im Prospekt genannten Veranstaltungen setzt die Vollendung des 

18. Lebensjahrs voraus. Abweichend davon setzt die Teilnahme an den Veranstaltungen der 

AMG EMOTION-Tour die Vollendung des 21. Lebensjahrs voraus. 

b) Die Teilnahme an den Veranstaltungen ist nur Inhabern einer gültigen Fahrerlaubnis gestattet. 

Abweichend davon ist die Teilnahme an Veranstaltungen der AMG EMOTION-Tour nur Personen 

gestattet, die bei Beginn der Veranstaltung seit mindestens drei Jahren Inhaber einer gültigen 

Fahrerlaubnis sind. Eine Rennlizenz befreit nicht von den vorgenannten Erfordernissen. 

c) Der Teilnehmer ist verpflichtet, vor Beginn der Veranstaltung Einsicht in seine Fahrerlaub- 

nis zu gewähren. 

Teilnehmer, die keinen EU-Führerschein besitzen, haben ihre Fahrerlaubnis durch einen 

Internationalen Führerschein oder ihren nationalen Führerschein und einer amtlichen Über- 

setzung nachzuweisen. 

d) Die Teilnahme am AMG Winter Sporting PRO erfordert zusätzlich die vorherige Teilnahme 

am AMG Winter Sporting ADVANCED. 

e) Die Teilnahme am SLS AMG GT3 Warm-Up erfordert zusätzlich die vorherige Teilnahme an 

der SLS AMG GT3 Experience, an einem ADVANCED Training oder einem PRO Training. 

f) Die Teilnahme am SLS AMG GT3 Training erfordert zusätzlich die vorherige Teilnahme am 

SLS AMG GT3 Warm-Up. 

g) Die weiteren Teilnahmevoraussetzungen für die jeweilige Veranstaltung sind im Prospekt genannt. 

5. Begleitpersonen und Haustiere 

a) Die Kosten für Begleitpersonen können dem Prospekt entnommen werden. 

b) Die Teilnahme als Begleitperson setzt bei allen Veranstaltungen die Vollendung des 18. Lebensjahrs 

voraus. Für Begleitpersonen gelten im Übrigen dieselben Bedingungen wie für die 

sonstigen Teilnehmer, sofern nichts anderes bestimmt ist. 

c) Begleitpersonen ist das Fahren sämtlicher Fahrzeuge untersagt. 

d) Das Mitbringen von Haustieren ist nicht gestattet. 

6. Bezahlung 

a) Die Preise für die einzelnen Veranstaltungen können dem Prospekt entnommen werden. Bei 

den Veranstaltungen erfolgt die Abrechnung ausschließlich nach der Margenbesteuerung gemäß 

§ 25 UStG. Dies bedeutet, dass in der Abrechnung die Umsatzsteuer nicht gesondert ausgewiesen 

wird. Bei dem ausgewiesenen Reisepreis handelt es sich somit um einen Bruttobetrag. 

Die Mercedes-AMG GmbH weist darauf hin, dass ein Vorsteuerabzug aufgrund der Margenbesteuerung 

nicht möglich ist. 

b) Die Mercedes-AMG GmbH ist nur berechtigt, die Zahlung des vereinbarten Reisepreises zu 

verlangen, wenn sichergestellt ist, dass dem Teilnehmer bei Ausfall von Leistungen infolge Zahlungsunfähigkeit 

oder der Eröffnung des Insolvenzverfahrens über das Vermögen der Mercedes- 

AMG GmbH der gezahlte Reisepreis und notwendige Aufwendungen für die Rückreise erstattet 

werden. Dementsprechend hat die Mercedes-AMG GmbH dieses Insolvenzrisiko bei der R + V 

Versicherung AG, Taunusstraße 1, 65193 Wiesbaden, abgesichert. Der Teilnehmer erhält frühestens 

zusammen mit der Reisebestätigung an die von ihm angegebene Anschrift eine Rechnung 

über den Reisepreis und den Sicherungsschein. Zahlungen auf den Reisepreis vor der Veranstaltung 

dürfen nur nach Aushändigung des Sicherungsscheines erfolgen (§ 651k Abs. 3 BGB). 

c) Der Reisepreis wird nach Erhalt der Rechnung fällig, sofern der Sicherungsschein ausgehändigt 

wurde (siehe 6.b). Der Reisepreis ist, einen rechtzeitigen Zugang des Sicherungsscheins 

sowie der Rechnung vorausgesetzt, so rechtzeitig unter Angabe der Rechnungsnummer auf das 

angegebene Bankkonto zu überweisen, dass er 21 Tage vor Beginn der Veranstaltung bei der 

Mercedes-AMG GmbH eingeht. 

Bei Veranstaltungen, die ab dem 21. Tag vor Veranstaltungsbeginn gebucht werden, ist die 

Mercedes-AMG GmbH berechtigt, gegen Aushändigung des Sicherungsscheines den Reisepreis 

sofort zu verlangen. 

Geht die Zahlung nicht fristgerecht und vollständig bei der Mercedes-AMG GmbH ein und wird auch innerhalb 

der mit der Mahnung gesetzten Frist nicht bezahlt, kann die Mercedes-AMG GmbH vom Vertrag 

zurücktreten und die unter 7.c (Stornierung) genannten Ausfallpauschalen geltend machen. 

Weitergehende Ansprüche der Mercedes-AMG GmbH bleiben hiervon unberührt. 

7. Stornierung 

a) Vor Beginn der Veranstaltung kann der Teilnehmer jederzeit vom Vertrag zurück treten 

(Stornierung). Die Stornierung der Anmeldung soll schriftlich oder per Telefax erfolgen. Die 

Rechtzeitigkeit der Stornierung bestimmt sich nach deren Eingang; sofern die Stornierung per 

Telefax erfolgt, soll die Sendung an die auf dem beigefügten Anmeldeformular sowie im Pro- 

spekt genannte Faxnummer erfolgen. 

b) Ersatzteilnehmer können gemäß § 651b BGB benannt werden, sofern sie ebenfalls die Teil- 

nahmevoraussetzungen (4.) erfüllen. Der stornierende Teilnehmer und der Ersatzteilnehmer 

haften für den Reisepreis und die durch den Eintritt des Ersatzteilnehmers entstehenden Mehr- 

kosten als Gesamtschuldner. 

c) Sollte der Teilnehmer seine Anmeldung stornieren oder sollte die Mercedes-AMG GmbH (gem. 

6.c) zurücktreten, werden anteilig vom Reisepreis folgende Ausfallpauschalen erhoben: 

– Bei Absage vor dem 50. Tag vor der Veranstaltung: 5 % 

– Bei Absage zwischen dem 50. Tag und dem 30. Tag vor der Veranstaltung: 20 % 



– Bei Absage innerhalb der letzten 2 Tage vor der Veranstaltung: 90 % 

Das Recht des absagenden Teilnehmers nachzuweisen, dass der Mercedes-AMG GmbH durch 

das Absagen ein Schaden überhaupt nicht oder aber ein wesentlich niedrigerer Schaden entstanden 

ist, bleibt unberührt. 

Wird die Veranstaltung wegen Nichterreichens der Mindestteilnehmerzahl nach 3.c abgesagt, werden 

keine Ausfallpauschalen erhoben. Eventuell geleistete Zahlungen werden unverzüglich erstattet. 

d) Im Falle einer Teilnahme unter Verwendung eines Gutscheines (AMG BASIC-Training Power 

& Passion) verfällt dieser ersatzlos, wenn der Teilnehmer seine Anmeldung innerhalb der letzten 

7 Tage vor der Veranstaltung storniert oder zu dieser nicht erscheint. 

8. Leistungen der Mercedes-AMG GmbH / Leistungsänderungen 

a) Der Umfang der vertraglichen Leistungen ergibt sich grundsätzlich aus dem Prospekt 

und der Reisebestätigung. 

b) Änderungen und Abweichungen einzelner Reiseleistungen von dem vereinbarten Inhalt des 

Reisevertrages, die nach Vertragsschluss notwendig werden und die von der Mercedes-AMG 

GmbH nicht wider Treu und Glauben herbeigeführt wurden, sind der Mercedes-AMG GmbH nur 

gestattet, soweit die Änderungen und Abweichungen nicht erheblich sind und den Gesamtzu- 

schnitt der gebuchten Reise nicht beeinträchtigen. Eventuelle Gewährleistungsansprüche blei- 

ben unberührt, soweit die geänderten Leistungen mit Mängeln behaftet sind. 

c) An- und Abreise sind – außer beim AMG Winter Sporting Advanced – von den Teilnehmern 

selbst zu organisieren. 

d) Bei Veranstaltungen, bei denen die Fahrzeuge von der Mercedes-AMG GmbH gestellt werden, 

haben die Teilnehmer die Möglichkeit im Lauf der Veranstaltung verschiedene Fahrzeuge zu 

fahren. Ein Anspruch auf ein bestimmtes Fahrzeug besteht nicht. 

Die Teilnehmer verpflichten sich, das Fahrzeug pfleglich zu behandeln. 

Unfälle sowie Schäden am Fahrzeug haben die Teilnehmer unverzüglich den Instruktoren anzuzeigen. 

Wann Fahrzeuge von der Mercedes-AMG GmbH gestellt werden, ist im jeweils aktuellen 

Prospekt geregelt. 

e) Im Fall der Teilnahme mit eigenem Fahrzeug ist dieses vom Teilnehmer selbst zu unterhalten. 

Bei technischen Problemen oder Schäden an den Fahrzeugen der Teilnehmer während der 

Veranstaltung können keine Ersatzfahrzeuge durch die Mercedes-AMG GmbH zur Verfügung 

gestellt werden. Wann eine Teilnahme mit eigenem Fahrzeug möglich oder vorgeschrieben ist, 

ist im jeweils aktuellen Prospekt geregelt. 

f) Im Fall der Anmietung von Fahrzeugen bei der Mercedes-AMG GmbH gegen gesondertes Entgelt 

ist der Abschluss eines separaten Mietvertrages erforderlich. Ein Muster des Mietvertrags 

kann jederzeit bei Mercedes-AMG GmbH angefordert werden. Im Schadensfalle während der 

Überlassungsdauer besteht kein Anspruch auf ein Ersatzfahrzeug. Wann eine Anmietung von 

Fahrzeugen möglich ist, ist im jeweils aktuellen Prospekt geregelt. 

9. Sicherheitsvorschriften / Weisungsrechte der Instruktoren /Ausschluss von der Teilnahme 

a) Die Teilnehmer sind verpflichtet, während der Fahrten ständig Sicherheitsgurte und Helme 

(je nach Veranstaltung) zu tragen. Die Mercedes-AMG GmbH stellt die Helme für die Teilneh- 

mer zur Verfügung. 

Den Anweisungen der Instruktoren ist unbedingt Folge zu leisten. 

Der Konsum von Alkohol und sonstigen Drogen ist vor und während des Trainings untersagt. 

Ebenso ist der Gebrauch von Mobilfunkgeräten während der Fahrt untersagt. 

b) Die Teilnehmer sind verpflichtet, sich bei der auf öffentlichen Verkehrswegen stattfindenden 

AMG EMOTION-Tour an alle Verkehrsregeln, insbesondere die Geschwindigkeitsbeschränkungen, 

zu halten. Bußgelder und Geldstrafen trägt allein der Teilnehmer. 

c) Die Mercedes-AMG GmbH behält sich vor, einzelne Teilnehmer von der Veranstaltung auszuschließen, 

wenn diese den Anweisungen der Instruktoren nicht Folge leisten oder in sonstiger 

Weise sich selbst oder Dritte gefährden. Eine Rückzahlung des Reisepreises erfolgt in diesen 

Fällen nicht. Eventuelle Mehrkosten trägt der Störer selbst. 

Die Mercedes-AMG GmbH muss sich jedoch den Wert der ersparten Aufwendungen sowie diejenigen 

Vorteile anrechnen lassen, die sie aus einer anderweitigen Verwendung der nicht in 

Anspruch genommenen Leistungen erlangt, einschließlich der ihr von den Leistungsträgern 

gutgebrachten Beträge. Leistungsträger sind gemäß § 651a Abs. 2 BGB diejenigen Personen, 

welche die einzelnen Reiseleistungen ausführen. 

10. Aufhebung des Vertrages wegen höherer Gewalt / Rücktritt wegen Unzumutbarkeit 

der Durchführung 

a) Wird die Veranstaltung infolge bei Vertragsschluss nicht voraussehbarer höherer Gewalt erheblich 

erschwert, gefährdet oder beeinträchtigt, so können sowohl die Mercedes-AMG GmbH 

als auch der Teilnehmer gemäß § 651j BGB den Vertrag kündigen.

) Im Falle von sonstigen, nicht von der Mercedes-AMG GmbH zu vertretenden Umständen, die 

eine ordnungsgemäße Durchführung der Veranstaltung erheblich erschweren, gefährden oder 

beeinträchtigen (z. B. Witterungsbedingungen), kann sowohl die Mercedes-AMG GmbH als auch 

der Teilnehmer den Vertrag kündigen. 

c) Erfolgt seitens der Mercedes-AMG GmbH oder seitens des Teilnehmers gemäß 10.a oder 10.b 

eine Kündigung, so kann die Mercedes-AMG GmbH für die bereits erbrachten oder zur Beendigung 

der Veranstaltung noch zu erbringenden Leistungen eine angemessene Entschädigung verlangen. 

Die Mercedes-AMG GmbH ist verpflichtet, die notwendigen Maßnahmen zu treffen, insbesondere 

falls der Vertrag die Rückbeförderung umfasst, den Teilnehmer zurückzubefördern. 

Die Mehrkosten für die Rückbeförderung sind von dem Teilnehmer und der Mercedes-AMG 

GmbH je zur Hälfte zu tragen. Im Übrigen fallen die Mehrkosten dem Teilnehmer zur Last. 

11. Pass-, Visa-, Zoll-, Devisen- und Gesundheitsvorschriften 

Die Mercedes-AMG GmbH steht dafür ein, Staatsangehörige des Staates, in dem die Veranstaltung 

angeboten wird, über Bestimmungen von Pass-, Visa- und Gesundheitsvorschriften sowie 

deren eventuelle Änderung vor Beginn der Veranstaltung zu unterrichten. Für Angehörige anderer 

Staaten gibt das zuständige Konsulat Auskunft. Für die Einhaltung aller für die Durchführung 

der Veranstaltung wichtigen Vorschriften sind die Teilnehmer selbst verantwortlich. 

Alle Nachteile, die aus dem Nichtbefolgen dieser Vorschriften erwachsen, gehen zulasten der 

Teilnehmer, ausgenommen wenn sie durch schuldhafte fehlerhafte oder unzureichende Information 

der Mercedes-AMG GmbH bedingt sind. 

12. Gewährleistung 

a) Abhilfe und Mitwirkungspflichten 

Wird die Veranstaltung nicht vertragsgemäß erbracht, so kann der Teilnehmer Abhilfe verlangen. 

Die Mercedes-AMG GmbH kann die Abhilfe verweigern, wenn sie einen unverhältnismäßigen 

Aufwand erfordert. 

Der Teilnehmer ist verpflichtet, alles ihm Zumutbare zu tun, um zu einer Behebung der Störung 

beizutragen und eventuell entstehenden Schaden möglichst gering zu halten oder ganz 

zu vermeiden. Er ist insbesondere verpflichtet, die Beanstandungen unverzüglich gegenüber 

der Reiseleitung anzuzeigen. 

b) Minderung des Reisepreises 

Für die Dauer einer nicht vertragsgemäßen Erbringung der Veranstaltung mindert sich der 

Reisepreis. Die Minderung tritt nicht ein, soweit der Teilnehmer es schuldhaft unterlassen hat, 

den Mangel unverzüglich anzuzeigen, sofern bei einer rechtzeitigen Anzeige Abhilfe möglich 

gewesen wäre und die Anzeige auch aus sonstigen Gründen nicht entbehrlich war. 

c) Kündigung des Vertrages gemäß § 651e BGB 

Wird die Veranstaltung infolge eines Mangels erheblich beeinträchtigt, so kann der Teilnehmer 

im Rahmen der gesetzlichen Bestimmungen seine Teilnahme an der Veranstaltung kündigen. 

Dasselbe gilt, wenn dem Teilnehmer die Reise infolge eines solchen Mangels aus wichtigem, der 

Mercedes-AMG GmbH erkennbaren Grund nicht zuzumuten ist. Die Kündigung ist erst zulässig, 

wenn die Mercedes-AMG GmbH innerhalb einer ihr vom Teilnehmer gesetzten angemessenen 

Frist keine Abhilfe leistet. Einer Fristsetzung bedarf es nicht, wenn die Abhilfe unmöglich ist, 

von der Mercedes-AMG GmbH verweigert wird oder wenn eine sofortige Kündigung durch ein 

besonderes Interesse des Teilnehmers gerechtfertigt ist. Der Teilnehmer schuldet der Mercedes- 

AMG GmbH auch im Falle einer Kündigung den auf die in Anspruch genommenen Leistungen 

entfallenden Teil des Reisepreises; dies gilt nicht, soweit diese Leistungen infolge der Aufhebung 

(Kündigung) des Vertrages für den Teilnehmer kein Interesse haben. 

d) Schadensersatz 

Bei nicht vertragsgemäßer Erbringung der Reise kann der Teilnehmer unbeschadet der Minderung 

(12.b) oder der Kündigung (12.c) Schadensersatz verlangen, es sei denn, der Mangel der 

Reise beruht auf einem Umstand, den die Mercedes-AMG GmbH nicht zu vertreten hat. 

e) Die vertragliche Haftung der Mercedes-AMG GmbH für Schäden, die nicht Personenschäden 

sind, ist auf den dreifachen Reisepreis beschränkt 

1. soweit ein Schaden des Teilnehmers weder vorsätzlich noch grob fahrlässig von der Mercedes- 

AMG GmbH und / oder einem ihrer Erfüllungsgehilfen herbeigeführt worden ist und /oder 

2. soweit die Mercedes-AMG GmbH für einen dem Teilnehmer entstandenen Schaden allein 

wegen eines Verschuldens eines Leistungsträgers verantwortlich ist. 

Gelten für eine von einem Leistungsträger zu erbringende Reiseleistung internationale Übereinkommen 

oder auf solchen beruhende gesetzliche Vorschriften, nach denen ein Anspruch auf 

Schadensersatz nur unter bestimmten Voraussetzungen oder Beschränkungen entsteht oder geltend 

gemacht werden kann oder unter bestimmten Voraussetzungen ausgeschlossen ist, so kann 

sich auch die Mercedes-AMG GmbH gegenüber dem Teilnehmer hierauf berufen. 

13. Haftung der Mercedes-AMG GmbH 

a) Für vertragliche Schadensersatzansprüche gelten die Regelungen in 12.d und e. 

b) Für alle gegen die Mercedes-AMG GmbH gerichteten außervertraglichen Schadensersatzansprüche, 

insbesondere aus unerlaubter Handlung, die nicht auf Vorsatz oder grober Fahrlässigkeit 

beruhen, haftet die Mercedes-AMG GmbH bis zur Höhe des dreifachen Reisepreises. 

c) Ausgeschlossen ist die persönliche Haftung der gesetzlichen Vertreter, Erfüllungsgehilfen 

und Betriebsangehörigen der Mercedes-AMG GmbH für die von ihnen durch einfache Fahrlässigkeit 

verursachten Schäden. 

d) Die vorgenannten Haftungsbeschränkungen gelten nicht im Falle von Personenschäden. 

e) Ein Schadensersatzanspruch gegen die Mercedes-AMG GmbH ist über die unter 13.b und 13.c 

genannten Haftungsbeschränkungen hinaus insoweit beschränkt oder ausgeschlossen, als aufgrund 

internationaler Übereinkommen oder auf solchen beruhenden gesetzlichen Vorschriften, die auf die 

von einem Leistungsträger zu erbringenden Leistungen anzuwenden sind, ein Anspruch auf Schadensersatz 

gegen den Leistungsträger nur unter bestimmten Voraussetzungen oder Beschränkungen 

geltend gemacht werden kann oder unter bestimmten Voraussetzungen ausgeschlossen ist. 

14. Ausschluss von Ansprüchen und Verjährung 

a) Vertragliche Ansprüche wegen nicht vertragsgemäßer Erbringung der Veranstaltung (siehe 

insbesondere unter 12.) müssen innerhalb eines Monats nach der vertraglich vorgesehenen Beendigung 

der Veranstaltung gegenüber der Mercedes-AMG GmbH oder der zet:project. GmbH 

geltend gemacht werden, ansonsten sind sie ausgeschlossen. Nach Ablauf der Frist können die 

vorgenannten Ansprüche nur dann geltend gemacht werden, wenn der Teilnehmer ohne Verschulden 

an der Einhaltung der Frist verhindert war. 

b) Die Gewährleistungsrechte und Schadensersatzansprüche sollten – zur Vermeidung von 

Beweisproblemen – in Ihrem Interesse schriftlich oder per Telefax gegenüber der Mercedes- 

AMG GmbH oder der zet:project. GmbH geltend gemacht werden. Die Reiseleitung sowie die 

zet:project. GmbH sind nicht befugt, Ansprüche anzuerkennen. 

c) Ansprüche aus diesem Vertrag verjähren in einem Jahr. Dies gilt nicht für Personenschäden, 

sowie vorsätzlich oder grob fahrlässig herbeigeführte Schäden. 

Die Verjährung beginnt mit dem Tag, an dem die Veranstaltung dem Vertrag nach enden sollte. 

15. Versicherung des Teilnehmers 

Für die Dauer der Veranstaltung tritt für die Teilnehmer (sowie für Begleitpersonen) eine Un- 

fallversicherung mit folgenden Leistungen ein: 

– Bei Tod des Teilnehmers (oder einer Begleitperson) 120.000,– EUR 

– Bei Invalidität des Teilnehmers (oder einer Begleitperson) 240.000,– EUR 

Für Beifahrer (Teilnehmer/Begleitperson) in einem Renntaxi betragen die Summen: 

– Bei Tod des Beifahrers 600.000,– EUR 

– Bei Invalidität des Beifahrers 600.000,– EUR 

Für weitergehenden Versicherungsschutz, insbesondere Krankenversicherung, hat der Teilnehmer 

selbst zu sorgen. 

16. Versicherung der Fahrzeuge und Regress 

a) Teilnahme mit eigenen Fahrzeugen 

Die Teilnehmer haben selbst für ausreichenden Versicherungsschutz für ihre Fahrzeuge zu 

sorgen. Seitens der Mercedes-AMG GmbH besteht für die Teilnehmer und deren Fahrzeuge 

während der Veranstaltung kein gesonderter Kfz-Versicherungsschutz. 

b) Teilnahme mit bei der Mercedes-AMG GmbH angemieteten Fahrzeugen 

Im Falle der Anmietung von Fahrzeugen bei der Mercedes-AMG GmbH gelten für den Versicherungsschutz 

der Teilnehmer die in dem zwischen ihm und der Mercedes-AMG GmbH gesondert abzuschließenden 

Mietvertrag geregelten Bedingungen; dieser ist vor Fahrtbeginn zu unterzeichnen. 

Ein Muster des Mietvertrags kann jederzeit bei der Mercedes-AMG GmbH angefordert werden. 

c) Teilnahme mit gestellten Fahrzeugen 

Die zur Verfügung gestellten Fahrzeuge sind für Fahrten auf der vom Instruktor vorgegebenen 

Strecke unter Anweisung der Instruktoren von Beginn bis zum Schluss der Veranstaltung haftpflicht- 

und vollkaskoversichert. Jegliche Schäden an Fahrzeugen sind unverzüglich dem zuständigen 

Instruktor oder Kursleiter zu melden. 

Im Falle eines vom Teilnehmer verschuldeten Schadens wird dem Teilnehmer ein Selbstbehalt 

in Höhe von 2.500 EUR in Rechnung gestellt. 

Abweichend davon beträgt der Selbstbehalt bei allen Veranstaltungen der AMG EMOTION-Tour 

1.000 EUR und bei allen SLS AMG GT3 Veranstaltungen 5.000 EUR. 

Eine (weitergehende) Regressnahme des Versicherers, insbesondere bei grob fahrlässigem Verhalten, 

Nichtbefolgen der Anweisungen der Instruktoren oder Kursleiter, bei Nichteinhalten der gesetzlichen 

Vorschriften oder der vorgeschriebenen Geschwindigkeiten bleibt hiervon unberührt. 

Die Mercedes-AMG GmbH behält sich bei schuldhaftem Handeln des Teilnehmers zudem vor, 

den Teilnehmer wegen eines der Mercedes-AMG GmbH nicht von ihrem Kasko-Versicherer 

ersetzten Schadens in Regress zu nehmen. Die Mercedes-AMG GmbH behält sich ferner vor, 

dem Fahrzeugnutzer bei schuldhaftem Verhalten die bei der Mercedes-AMG GmbH anfallenden 

Kosten für die Bearbeitung des Schadensfalles in Rechnung zu stellen. 

17. Anwendbares Recht 

Auf das Vertragsverhältnis zwischen dem Teilnehmer und der Mercedes-AMG GmbH findet ausschließlich 

deutsches materielles Recht Anwendung, insbesondere die §§ 651a ff. BGB. 

18. Gerichtsstand 

a) Gerichtsstand für sämtliche Ansprüche aus diesem Vertrag ist Affalterbach (Firmensitz der 

Mercedes-AMG GmbH), sofern der Teilnehmer Kaufmann im Sinne des HGB ist, unbeschadet des 

Rechts der Mercedes-AMG GmbH, auch an anderen Orten Klage zu erheben. Dies gilt auch für die 

Geltendmachung von außervertraglichen Ansprüchen, sofern diese zumindest teilidentisch mit 

den vertraglichen Ansprüchen sind (außer im Falle von vorsätzlichen unerlaubten Handlungen). 

b) Für Nichtkaufleute gilt: Gerichtsstand für sämtliche Ansprüche aus diesem Vertrag sowie für 

sämtliche außervertraglichen Ansprüche ist Affalterbach (Firmensitz der Mercedes-AMG GmbH), sofern 

der Teilnehmer keinen allgemeinen Gerichtsstand in Deutschland hat, nach Vertragsabschluss 

seinen Wohnsitz oder gewöhnlichen Aufenthaltsort aus dem Inland (Deutschland) verlegt oder sein 

Wohnsitz oder gewöhnlicher Aufenthaltsort zum Zeitpunkt der Klageerhebung nicht bekannt ist. 

19. Unwirksamkeitsklausel 

Sollte eine Bestimmung des Vertrags einschließlich dieser Teilnahmebedingungen rechtsunwirksam 

sein oder werden, so wird dadurch der übrige Inhalt des Vertrages oder der Teilnahmebedingungen 

nicht berührt. In einem solchen Falle verpflichten sich die Vertragsparteien, die unwirksame 

Bestimmung durch eine neue, wirksame Bestimmung zu ersetzen, die dem wirtschaftlichen 

Zweck der unwirksamen Bestimmung am nächsten kommt. In gleicher Weise ist zu verfahren, 

wenn bei der Durchführung des Vertrages eine Lücke offenbar wird.

Conditions of Participation 

1. Type of events 

a) Mercedes-AMG GmbH offers participants safety training courses on a site closed to normal 

individual traffic during the event. This does not apply to the events of the AMG EMOTION tour, 

which take place on public roads that have not been closed off to normal traffic. 

b) The aim of the events is to improve driving skills, not to achieve top speeds. 

2. Goal of events

d) To improve drivers’ technical knowledge 

e) To improve driving skills in winter weather conditions 

(applies only to AMG Winter Sporting ADVANCED and AMG Winter Sporting PRO) 

3. Registration to participate 

a) With his registration, the participant offers Mercedes-AMG GmbH the binding conclusion of 

the travel agreement. Registration can only be carried out with the enclosed registration form. The 

travel agreement comes into effect with acceptance by Mercedes-AMG GmbH. Acceptance takes 

place within two weeks with the sending of the written confirmation of the travel arrangements. 

Acceptance shall be subject to cancellation if the minimum number of participants should not 

be reached (see 3.c). 

b) The maximum number of participants in the events is limited to the number stated in the 

brochures for each event. 

c) For the event to take place, at least 70% of the maximum number of participants stated in the 

brochure for each event must be reached. If the applicable minimum number of participants 

has not been reached 28 days before commencement of the event at the latest and the event is 

therefore cancelled, Mercedes-AMG GmbH will inform the registered participants of this without 

delay. In such cases, participants will promptly have any travel fees already paid reimbursed. 

4. Entry requirements 

a) Participation in the events referred to in the brochure requires that the participant be older 

than 18. Notwithstanding this, participation in the events of the AMG EMOTION tour requires 

that the participant be older than 21. 

b) Participation in the events is only open to persons in possession of a valid driving license. 

Notwithstanding this, participation in the events of the AMG EMOTION tour is permitted only 

to persons who hold a valid driving license for at least three years at the beginning of the event. 

A racing license does not exempt the participant from the above requirements. 

c) Participants must present their licenses for inspection prior to commencement of the event. 

Participants who do not have a EU driver’s license must prove their license to drive with an 

international driver’s license or their national driving license and an official translation. 

d) Participation in AMG Winter Sporting PRO additionally requires prior participation in AMG 

Winter Sporting ADVANCED. 

e) Participation in the SLS AMG GT3 Warm-Up also requires prior participation in the SLS AMG 

GT3 Experience, in an ADVANCED training or a PRO training. 

f) Participation in the SLS AMG GT3 training additionally requires prior participation in the 

SLS AMG GT3 Warm-Up. 

g) Additional participation requirements for each event are disclosed in the brochure. 

5. Companions and pets 

a) The costs for companions can be found in the brochure. 

b) For all events, participation as a companion requires that the companion be older than 18. 

Moreover, the same conditions apply for companions as for the other participants, if nothing 

to the contrary is specified. 

c) Companions are not permitted to drive any vehicle. 

d) It is not permitted to bring pets. 

6. Payment 

a) The prices for the individual events can be found in the brochure. Invoicing of the events 

is done exclusively under margin taxation in accordance with § 25 of the German VAT Law. 

This means that the VAT is not indicated separately in the invoice. The travel price invoiced 

is thus a gross amount. 

Mercedes-AMG GmbH points out that, because of margin taxation, deduction of input tax is 

not possible. 

b) Mercedes-AMG GmbH is only authorized to demand payment of the agreed travel price if it 

has been guaranteed that the participant will be reimbursed the travel price paid and necessary 

expenses for the return journey in the event of non-performance due to insolvency or the institution 

of insolvency proceedings with regard to the assets of Mercedes-AMG GmbH. Accordingly, 

Mercedes-AMG GmbH has insured against this risk of insolvency with R + V Versicherung AG, 

Taunusstrasse 1, 65193 Wiesbaden. Participants will receive an invoice for the travel price and 

the risk coverage certificate, sent to the address they provided, at the earliest together with the 

confirmation of travel. Payments of the travel price prior to the event may only be made after 

issue of the risk cover certificate (§ 651k (3) of the German Civil Code). 

c) The travel price is payable on receipt of the invoice if the risk coverage certificate has been 

issued (see 6.b). Assuming timely delivery of the risk coverage certificate and the invoice, payment 

of the travel price must be made to the stated bank account, quoting the invoice number, 

in sufficiently good time to ensure it is received by Mercedes-AMG GmbH 21 days prior to 

commencement of the event. 

If an event is booked less than 21 days before commencement of the event, Mercedes-AMG GmbH 

is entitled to request payment immediately, against issuance of the risk coverage certificate. 

Should the payment not be received on time and in full by Mercedes-AMG GmbH, and if payment 

is still not made within the term laid down in the reminder, Mercedes-AMG GmbH may rescind 

the contract, and the cancellation charges referred to in 7.c (Cancellation) may be imposed. 

Further claims by Mercedes-AMG remain unaffected by this. 

7. Cancellation 

a) Before commencement of the event, the participant can withdraw from the contract at any 

time (cancellation). Cancellation of the registration should be done in writing or by fax. The 

timeliness of the cancellation shall be determined by the time and date of receipt; if the cancellation 

is made by fax, the fax should be sent to the fax number specified in the enclosed 

registration form and in the brochure. 

b) Substitute participants may be named in accordance with § 651b of the German Civil Code 

provided that they also meet the conditions of participation (4.). The canceling participant and 

the substitute participant are jointly liable for the travel price and the additional costs arising 

through the entrance of the substitute participant. 

c) If the participant cancels his registration or if Mercedes-AMG GmbH withdraws from the contract 

(in accordance with 6.c), the following cancellation charges will be levied: 

– For cancellation up to 50 days prior to the event: 5% 

– For cancellation between the 50th day and the 30th day prior to the event: 20% 

– For cancellation between the 29th day and the 14th day prior to the event: 40% 

– For cancellation between the 13th day and the 3rd day prior to the event: 70% 

– For cancellation within the last 2 days prior to the event: 90% 

The right of the canceling participant to prove that the cancellation results in significantly less 

damage (if any) to Mercedes-AMG GmbH is not affected. 

If the event is canceled due to the minimum number of participants according to 3.c not being 

attained, no cancellation charges will be levied. Any payments that have been made will be 

refunded immediately. 

d) In the case of participation with a voucher (AMG Power & Passion BASIC training), the voucher 

loses its validity without replacement if the participant cancels his registration within the last 

7 days prior to the event or does not turn up. 

8. Services provided by Mercedes-AMG GmbH / Changes to services 

a) The extent of the contractual services is defined by the specifications in the brochure and 

the confirmation of travel. 

b) Changes and deviations of individual travel services from the agreed content of the travel 

agreement that become necessary after conclusion of the contract and which were not brought 

about by Mercedes-AMG GmbH in breach of good faith are only permitted by Mercedes-AMG 

GmbH if the changes and deviations are not substantial and do not detract from the overall 

arrangement of the booked travel. Potential warranty claims remain unaffected to the extent 

that the changed services are flawed. 

c) With the exception of the Winter Sporting Advanced event, travel to and from the event shall 

be organized by the participants themselves. 

d) At events where vehicles are provided by Mercedes-AMG GmbH, participants have the 

opportunity to drive a variety of different vehicles during the course of the event. There is 

no right to a particular vehicle. 

Participants undertake to treat the vehicle carefully. 

Participants must report accidents or damage to the vehicle to the instructors immediately. 

Conditions when vehicles are provided by Mercedes-AMG GmbH are specified in the appropriate 

current brochure. 

e) In the case of participation with their own vehicle, this must be maintained by the participant. 

In the case of technical problems or damage to participants’ vehicles during the event, no 

replacement vehicles can be provided by Mercedes-AMG GmbH. Conditions when participation 

with the participant’s own vehicle is permitted or required are specified in the appropriate 

current brochure. 

f) In the case when vehicles are rented from Mercedes-AMG GmbH for an additional payment, 

a separate rental agreement must be signed. A sample of the rental agreement can be requested 

from Mercedes-AMG GmbH at any time. In the event of damage during the rental term, there is 

no right to a replacement vehicle. Conditions when renting of vehicles is permitted are specified 

in the appropriate current brochure. 

9. Safety requirements / Rights of the instructors to issue directions / Exclusion from 

participation 

a) Seatbelts and helmets (depending on the event) must be worn by participants at all times 

when the vehicle is in motion. Mercedes-AMG GmbH will provide helmets for participants. 

The instructors’ directions absolutely must be followed. 

The consumption of alcohol and other drugs before or during the training session is prohibited. 

The use of cellular phones when the vehicle is in motion is also prohibited. 

b) During the AMG EMOTION tour, which takes place on public roads, participants are obliged 

to adhere to all traffic regulations, in particular speed limits. The payment of any fines received 

is the sole responsibility of the participant. 

c) Mercedes-AMG GmbH reserves the right to exclude individual participants from the event 

if they do not follow the instructors’ directions or endanger themselves or third parties in any 

other way. The travel price will not be refunded in such cases. Any additional costs will be the 

responsibility of the disruptive persons themselves. 

Mercedes-AMG GmbH must, however, offset the value of the expenses saved and the benefits 

it accrues from the alternative use of the services not made use of, including the amounts credited 

to it by the service providers. According to § 651a (2) of the German Civil Code, service 

providers are those persons who deliver the individual travel services. 

10. Cancellation of the contract due to force majeure / Cancellation due to unreasonable 

effort or expense of performance 

a) If the event is materially impeded, endangered or impaired as a result of force majeure 

not foreseeable at the time the contract was concluded, both Mercedes-AMG GmbH and 

the participant shall be entitled to terminate the contract in accordance with § 651j of the 

German Civil Code. 

b) In the event of other circumstances for which Mercedes-AMG GmbH is not responsible, which 

materially impede, endanger or impair the orderly conducting of the event (e.g. weather conditions), 

both Mercedes-AMG and the participant shall be entitled to rescind the contract.

c) If the contract is terminated by Mercedes-AMG GmbH or the participant in accordance with 

10.a or 10.b, Mercedes-AMG GmbH may demand reasonable compensation for the services already 

provided or required to be provided before the end of the event. Mercedes-AMG GmbH is obliged to 

take the necessary measures, in particular – if the contract includes return transport – providing 

return transport for the participant. 

The additional costs for the return transport are to be shared equally between the participant and 

Mercedes-AMG GmbH. All other additional costs shall be paid by the participant. 

11. Passport, visa, customs, currency and health requirements 

Mercedes-AMG GmbH shall be liable for ensuring that nationals of the country in which the 

event is offered are informed of passport, visa and health requirements and of any changes to 

these prior to the commencement of the event. For nationals of other countries, the competent 

consulate should be contacted for information. The participants themselves shall be responsible 

for compliance with all material rules and regulations for the performance of the event. 

The participant shall bear any disadvantage arising from failure to comply with these require- 

ments, unless such is due to incorrect information culpably supplied by Mercedes-AMG GmbH. 

12. Guaranty 

a) Remedy and duties to cooperate 

If the event is not carried out in accordance with the terms of the contract, the participant may 

demand a remedy. 

Mercedes-AMG GmbH can refuse the remedy if it requires unreasonable expense. 

Participants are obliged to do everything that can reasonably be expected of them to contribute to 

elimination of the disruption and to minimize or avoid altogether any potential loss or damages. 

They are obliged in particular to report any complaints without delay to the tour guides. 

b) Reduction of the travel price 

For any period during which the event is not being performed in accordance with the terms 

of the contract, the travel price will be reduced. No reduction shall be given if the participant 

has culpably failed to report the problem without undue delay, if a remedy would have been 

possible had the problem been reported promptly, and the complaint was also not superfluous 

for other reasons. 

c) Termination of the contract pursuant to § 651 e of the German Civil Code 

If the event is materially impaired as a result of a problem, the participant may terminate his 

participation in the event as provided for by legal regulations. 

The same applies if it can not be reasonably expected of the participant that he proceed with the 

tour as the result of such a defect for an important reason recognizable to Mercedes-AMG GmbH. 

Withdrawal from the contract is only permissible if Mercedes-AMG GmbH does not provide a remedy 

within an appropriate term set by the participant. The participant is not required to grant an 

additional term if the remedy is impossible or is refused by Mercedes-AMG GmbH or if a particular 

interest of the participant justifies immediate termination. Even if the contract is terminated, the 

participant shall still be liable to compensate Mercedes-AMG GmbH for the portion of the travel 

price relating to the utilized part of the service; this shall not apply if these services were of no 

value to the participant as a result of the cancellation (termina tion) of the contract. 

d) Damages 

In the case of failure to provide the travel in accordance with the terms of the contract, without 

prejudice to the reduction (12.b) or termination (12.c) of the contract, the participant can claim 

damages, unless the defect in the travel results from a circumstance over which Mercedes-AMG 

GmbH has no control. 

e) The contractual liability of Mercedes-AMG GmbH for damages other than personal injury is 

limited to three times the travel price 

1. insofar as the participant’s damages have not been caused intentionally or through the gross 

negligence of Mercedes-AMG GmbH and/or one of its vicarious agents, and/or 

2. insofar as Mercedes-AMG GmbH is responsible for damages sustained by the participant 

solely due to fault on the part of a service provider. 

If international agreements or statutory provisions based on such international agreements are 

applicable for a travel service to be performed by a service provider, according to which a claim for 

damages can only be made under certain conditions or restrictions or is excluded under certain 

conditions, Mercedes-AMG GmbH can also invoke these with regard to the participant. 

13. Liability of Mercedes-AMG GmbH 

a) For claims of contractual damages, the provisions in 12.d and e apply. 

b) For all non-contractual damage claims against Mercedes-AMG GmbH, particularly those under 

tort, which are not the result of intent or gross negligence, Mercedes-AMG GmbH’s liability shall 

be limited to a maximum of three times the travel price. 

c) No personal liability shall attach to the statutory representatives, vicarious agents and employees 

of Mercedes-AMG GmbH for loss caused through their simple negligence. 

d) The aforementioned limitations to liability do not apply in the case of damage to persons. 

e) A claim for damages against Mercedes-AMG GmbH over and above the liability limitations mentioned 

under 13.b and 13.c is restricted or excluded to the extent that, because of international agreements 

or statutory provisions based on such international agreements applicable to the services 

to be performed by a service provider, a claim for damages against the service provider can only be 

made under certain conditions or restrictions or is excluded under certain conditions. 

14. Exclusion of claims and period of limitation 

a) Claims arising from the failure to perform the event in accordance with the terms of the contract 

(see in particular under 12.) must be asserted against Mercedes-AMG GmbH or zet:project. 

GmbH within one month of the end of the event as specified in the contract. Otherwise they shall 

be excluded. After the end of this period, the aforementioned claims may only be asserted if the 

participant was prevented from complying with the term through no fault of his own. 

b) In your own interest, to avoid problems of proof, the assertion of warranty rights and damages 

claims should be made to Mercedes-AMG GmbH or zet:project. GmbH in writing or by fax. The 

tour guides and zet:project. GmbH are not permitted to recognize claims. 

c) Claims arising from this contract shall become statute-barred after one year. This does not 

apply to personal injuries and damages induced intentionally or by gross neglect. 

The period of limitation begins on the day on which the event should have ended under the 

terms of the contract. 

15. Insurance of the participant 

For the duration of the event, participants (and their companions) will be covered by accident 

insurance with the following benefits: 

– Death of the participant (or a companion): EUR 120,000.00 

– Invalidity of the participant (or a companion): EUR 240,000.00 

The following sums apply to passengers (participant/companion) in a race taxi: 

– Death of the passenger: EUR 600,000.00 

– Invalidity of the passenger: EUR 600,000.00 

The participant is responsible for more extensive coverage, particularly health insurance. 

16. Insurance of vehicles and recourse 

a) Participation with own vehicles 

Participants must ensure they have adequate insurance coverage for their vehicle. Mercedes- 

AMG GmbH will not arrange any special vehicle insurance for participants and their vehicles 

during the event. 

b) Participation with vehicles rented from Mercedes-AMG GmbH 

If vehicles are rented from Mercedes-AMG GmbH, the conditions governed by the rental agreement 

concluded separately between participants and Mercedes-AMG GmbH shall additionally 

apply to the insurance coverage of participants; this is to be signed before the journey begins. A 

sample of the rental agreement can be requested from Mercedes-AMG GmbH at any time. 

c) Participation with supplied vehicles 

From the beginning to the end of the event, the vehicles provided are covered by third-party and 

full-liability insurance (Haftpflichtversicherung and Vollkaskoversicherung) for journeys along 

the routes stipulated by the instructor and under the direction of the instructors. Any damage to 

vehicles must be reported immediately to the responsible instructor or course leader. 

In the event of damage caused by a participant, a deductible of EUR 2,500 will be charged to 

the participant. 

Notwithstanding this, the deductible is EUR 1,000 at all events of the AMG EMOTION tour and 

EUR 5,000 for all SLS AMG GT3 events. 

This shall not prejudice any (more far reaching) recourse claim made by the insurer, in particular 

in the event of grossly negligent behavior, failure to follow the directions of the instructors or 

course leaders, failure to comply with the statutory requirements or the speed limits. 

In cases of culpable behavior of the participant, Mercedes-AMG GmbH reserves the right to take 

recourse against the participant regarding any loss not reimbursed to Mercedes-AMG GmbH by 

its comprehensive insurer. In the case of culpable behavior, Mercedes-AMG GmbH also reserves 

the right to invoice the vehicle user for the costs caused to Mercedes-AMG GmbH for processing 

the damage claim. 

17. Applicable law 

The contractual relationship between the participant and Mercedes-AMG GmbH shall be governed 

exclusively by German substantive law, in particular §§ 651a et seq. of the German Civil Code. 

18. Jurisdiction 

a) The courts of Affalterbach (the registered address of Mercedes-AMG GmbH) shall have jurisdiction 

over all claims arising from this contract, provided that the participant is acting in the 

course of business (is a Kaufmann as defined by the German Commercial Code (HGB)), without 

prejudice to the right of Mercedes-AMG GmbH to file suit at another venue. This also applies to 

the assertion of non-contractual claims, so far as these are at least partly identical to the contractual 

claims (with the exception of intentional illegal acts). 

b) For private individuals, the following applies: The courts with jurisdiction for Affalterbach 

(the registered address of Mercedes-AMG GmbH) shall have exclusive jurisdiction over all 

claims arising from this contract as well as for all non-contractual claims, provided that the 

participant has no general place of litigation within Germany, or moves his domicile or habitual 

place of residence abroad (from Germany) after the conclusion of the contract or if the domicile 

or habitual place of residence of the participant is not known at the time the suit is filed. 

19. Severability 

Should any provision of this contract, including these conditions of participation, be or become 

legally invalid, this shall not affect the remaining content of the contract or the conditions 

of participation. In such a case, the parties undertake to replace the invalid provision with 

a new, valid provision which accords most closely with the economic purpose of the invalid 

provision. The same procedure is to be followed if it becomes clear that there is an omission 

from the contract.
