VersteigerungsbedingungenConditions of Sale1. Diese Versteigerungsbedingungen werden im Auktionssaal ausgehängt;sie sind im Versteigerungskatalog abgedruckt, ggf. auchim Internet veröffentlicht. Mit Erteilung eines Auftrages oder Abgabeeines Gebotes erkennt der Käufer die Versteigerungs bedingungenund ihre Geltung für die Auktion ausdrücklich an.2. Die Versteigerung, die öffentlich i.S.v. §§ 383 III, 474 I 2 BGB ist,wird vorbereitet, durchgeführt und abgewickelt von der <strong>Karl</strong> & <strong>Faber</strong>Kunstauktionen GmbH (im Folgenden »<strong>Karl</strong> & <strong>Faber</strong>«). <strong>Karl</strong> &<strong>Faber</strong> versteigert die Kunstwerke grundsätzlich als Kom mis sionärim eigenen Namen für Rechnung des unbenannt bleibenden Einlieferers.Ein von <strong>Karl</strong> & <strong>Faber</strong> bestimmter Auk tionator leitet dieVersteigerung im Namen und für Rechnung von <strong>Karl</strong> & <strong>Faber</strong>; Ansprücheanlässlich der Versteigerung richten sich ausschließlichgegen <strong>Karl</strong> & <strong>Faber</strong> und nicht gegen den Auk tionator. Im Eigentumvon <strong>Karl</strong> & <strong>Faber</strong> befindliche Gegen stände (sog. Eigenware) sindmit „‡“ besonders gekennzeichnet.3. Alle Bieter haben ihren Namen und ihre Anschrift rechtzeitig vorder Auktion mitzuteilen. <strong>Karl</strong> & <strong>Faber</strong> behält sich vor, dem Hausunbekannte Bieter um die Vorlage eines gültigen Personalausweises,Reisepasses oder ähnlichen Personaldokumentes zubitten. Gegebenenfalls werden Bieternummern vergeben. Will einBieter Gebote im Namen eines Dritten abgeben, hat er dies vorVersteigerungsbeginn unter von Namen und Anschrift des Vertretenenund unter Vorlage einer schriftlichen Vollmacht mitzuteilen.Andernfalls kommt der Kaufvertrag bei Zuschlag mit dem Bieterzustande.4. Die im Katalog von <strong>Karl</strong> & <strong>Faber</strong> angegebenen Schätzpreise (ggf.unterer und oberer Schätzpreis) sind in Euro beziffert. Sie dienenals Anhaltspunkte für den Verkehrswert des Verstei ge r ungsgutes.Der Aufrufpreis wird vom Auktionator festgelegt; gesteigert wirdnach seinem Ermessen, im Regelfall um jeweils 10 % des vorangegangenenGebotes in Euro. <strong>Karl</strong> & <strong>Faber</strong> be hält sich vor, Katalognummernzu verbinden, zu trennen und, wenn ein besondererGrund vorliegt, in einer anderen als der im Kata log vorgesehenenReihenfolge aufzurufen oder zurückzuziehen.5. Gebote können auch schriftlich oder telefonisch abgegeben werden;Bieten über Internet ist nicht zulässig. Schriftliche oder telefonischeGebote werden nur zugelassen, wenn der Bieter mindestens24 Stunden vor Beginn der Versteigerung bei <strong>Karl</strong> & <strong>Faber</strong> ihreZulassung beantragt hat. Der Antrag muss das Kunst werk unterAufführung von Katalognummer und Katalog be zeichnung benennen.Im Zweifel ist die Katalognummer maßgeblich; Unklarheitengehen zu Lasten des Bieters. Telefonische Gebote werden erst abeinem Schätzpreis von € 1.000.- entgegengenommen. Mit demAntrag <strong>zum</strong> telefonischen Bieten erklärt sich der Bieter mit derAufzeichnung von Telefon ge sprächen einverstanden. Für die Bearbeitungvon schriftlichen oder telefonischen Geboten übernimmt<strong>Karl</strong> & <strong>Faber</strong> keinerlei Gewähr. Insbesondere haftet <strong>Karl</strong> & <strong>Faber</strong>nicht für Übermittlungsfehler oder das Zustandekommen und dieAufrechter hal tung von Telefonverbindungen. Dies gilt nicht, soweit<strong>Karl</strong> & <strong>Faber</strong> einen Fehler wegen Vorsatzes oder grober Fahrlässigkeitzu vertreten hat.6. Der Zuschlag wird erteilt, wenn nach dreimaligem Aufruf eines Gebotskein höheres Gebot (Übergebot) abgegeben wird. Wenn mehrerePersonen dasselbe Gebot abgeben und nach dreimaligemAufruf kein höheres Gebot erfolgt, entscheidet das Los. Ein Zuschlagkann in Einzelfällen unter Vorbehalt erteilt werden, auf dender Auktionator ausdrücklich hinweist. Ein solcher Zu schlag wird1. These Terms of Auction are displayed in the auction room; theyare published in each auction catalogue, and also on the Internet,if appropriate. By placing an order or making a bid, the buyer expresslyacknowledges these Terms of Auction and the validity thereoffor the auction.2. The auction, which is public as contem plated in §§ 383 III, 474 I2 BGB, is prepared, held and handled by <strong>Karl</strong> & <strong>Faber</strong> KunstauktionenGmbH (referred to hereinafter as „<strong>Karl</strong> & <strong>Faber</strong>“). As amatter of principle, <strong>Karl</strong> & <strong>Faber</strong> auctions the works of art as acommission agent, acting in its own name and for the account ofthe unnamed party supplying the object. An Auctioneer ap pointedby <strong>Karl</strong> & <strong>Faber</strong> holds the auction in the name and for the accountof <strong>Karl</strong> & <strong>Faber</strong>. Claims pertaining to the auction shall be directedto <strong>Karl</strong> & <strong>Faber</strong>, and not to the Auctioneer. Objects which arethe property of <strong>Karl</strong> & <strong>Faber</strong> (so-called Own Goods) are speciallymarked with “‡”.3. All bidders shall communicate their name and address in a timelymanner before the auction. <strong>Karl</strong> & <strong>Faber</strong> reserves the right to requestbidders unknown to the company to present a valid iden titycard, passport, or similar identifying documentation. Bidder numbersshall be issued, if appropriate. If a bidder wants to make bidsin the name of a third party, then he must give notice to this effectbefore the auction begins, stating the name and ad dress of theparty he is representing and submitting a written proxy. The salescontract shall otherwise, upon the fall of the hammer, be broughtabout with the bidder.4. The estimate prices specified in the catalogue of <strong>Karl</strong> & <strong>Faber</strong>(where appropriate, the upper and lower estimated value) arestated in Euros. They serve as a guide for the market value of theobject being auctioned. The starting price is fixed by the Auctioneer;bids shall be placed at the Auctioneer’s discretion, eachprice shall, as a rule, be 10% above the preceding bid. <strong>Karl</strong> & <strong>Faber</strong>reserves the right to combine or to split catalogue numbers, or – ifthere is special reason for doing so – to call them in an order otherthan that given in the catalogue or to withdraw them5. Bids may also be made in writing or by telephone. Bids made inwriting or by telephone shall be only admitted if the bidder hassubmitted an application for the admission of such bids to <strong>Karl</strong>& <strong>Faber</strong> at least 24 hours before commencement of the auction.The request must stipulate the work of art, stating the cataloguenumber and the catalogue name. If there is any doubt, the cataloguenumber shall be decisive; any uncertainties shall be for thedetriment of the bidder. Telephone bids shall be accepted only asof an estimated price of E 1,000. With the requesting of per missionto make bids by telephone, the bidder agrees to telephone callsbeing recorded. <strong>Karl</strong> & <strong>Faber</strong> shall not assume any guarantee forthe handling of written bids or bids made by tele phone. <strong>Karl</strong> & <strong>Faber</strong>shall, in particular, not be liable for errors in transmission orfor the establishment and for maintaining telephone connections.This shall not apply if <strong>Karl</strong> & <strong>Faber</strong> is responsible for a mistake dueto intent or gross negligence.6. The hammer shall fall, after a bid has been called three times, ifno higher bid is made. If several persons make the same bid andno higher bid is made after it has been called three times, then thecase shall be decided by drawing lots. A bid may be accepted subjectto reservation in individual cases, which the Auctioneer shallpoint out in each case. Any such acceptance of a bid shall only takeeffect if <strong>Karl</strong> & <strong>Faber</strong> confirms the bid in writing by presenting a
nur wirksam, wenn <strong>Karl</strong> & <strong>Faber</strong> das Gebot innerhalb von 4 Wochennach dem Tage der Versteigerung schriftlich durch entsprechendeRechnungslegung bestätigt; der Bieter bleibt so lange ansein Gebot gebunden. <strong>Karl</strong> & <strong>Faber</strong> kann innerhalb einer Auktioneinen Zuschlag zurücknehmen und das Kunst werk erneut ausbieten,wenn ein rechtzeitig abgegebenes höheres Gebot irrtümlichübersehen und dies vom Bieter unverzüglich beanstandet wordenist oder wenn sonst Zweifel über den Zuschlag bestehen. Übt <strong>Karl</strong>& <strong>Faber</strong> dieses Recht aus, wird der ursprüngliche Zuschlag unwirksam.<strong>Karl</strong> & <strong>Faber</strong> hat das Recht, den Zuschlag zu verweigernoder ein Gebot abzulehnen, wenn ein besonderer Grund vorliegt.Ein besonderer Grund liegt insbesondere vor, wenn ein Bieter <strong>Karl</strong>& <strong>Faber</strong> unbekannt ist und nicht spätestens bis <strong>zum</strong> Beginn derVersteigerung Sicherheit ge leistet hat. Wird ein Gebot abgelehnt,bleibt das vorangegangene Gebot wirksam. Der Zuschlag verpflichtetden Bieter zur Abnahme und Zahlung.7. Schriftliche Gebote gelten als in der Versteigerung bereits ab gegebeneGebote. Gehen mehrere gleich hohe schriftliche Ge bote fürein und dasselbe Kunstwerk ein, erhält das zuerst einge troffeneGebot den Zuschlag, wenn kein höheres Gebot vor liegt oder abgegebenwird. Bei gleichem Eingangstag entscheidet das Los. Jedesschriftliche Gebot wird von <strong>Karl</strong> & <strong>Faber</strong> nur mit dem Betragin Anspruch genommen, der erforderlich ist, um ein anderes abgegebenesGebot zu überbieten. Ein schriftliches Gebot, das aufdem dafür vorgesehenen Formblatt abzugeben ist, muss vom Bieterunterzeichnet sein und den für das Kunst werk gebotenen Preis(ohne Aufgeld, Folgerechtsabgabe und Mehrwertsteuer) nennen.8. Der Kaufpreis besteht aus dem Zuschlagspreis zuzüglich Aufgeld.Umlagen sowie gesetzliche MwSt. können hinzukommen.Umgelegt wird insbesondere das von <strong>Karl</strong> & <strong>Faber</strong> an die VGBild- Kunst zur Abgeltung gesetzlicher Ansprüche nach § 26UrhG auf den Verkaufserlös für Originalwerke der bildendenKunst - entstanden ab 1900 - pauschal entrichtete Folgerecht.Es wird, was die MwSt. betrifft, je nach rechtzeitig vor der Rechnungsstellungzu machender Vorgabe des Einlieferers differenzbesteuertoder regelbesteuert verkauft. Regelbesteuerte Kunstwerkewerden mit „R“ hinter der Katalognummer gekennzeichnet.a) Als Aufgeld wird bei der Differenzbesteuerung pro Einzelobjekterhoben: auf einen Zuschlagspreis bis einschließlich 300.000 Euro30 %, auf einen Zuschlagspreis über 300.000 Euro bis einschließlich500.000 Euro für den überschreitenden Betrag 28 %, auf einenZuschlagspreis über 500.000 Euro für den diesen überschreitendenBetrag 27 %. In diesem Aufgeld sind alle pauschalen Umlagen sowiedie gesetzliche Mehrwertsteuer ohne separaten Ausweis enthalten.b) Als Aufgeld wird bei der Regelbesteuerung pro Einzelobjektbeim vorsteuerabzugsberechtigten Käufer erhoben: auf einenZuschlagspreis bis einschließlich 300.000 Euro 23 %, auf einenZuschlagspreis über 300.000 Euro bis einschließlich 500.000 Eurofür den überschreitenden Betrag 21 %, auf einen Zuschlagspreisüber 500.000 Euro für den diesen überschreitenden Betrag 19 %,zuzüglich einer Folgerechtsumlage von 1,3 % auf den Kaufpreis.Hat der Käufer seinen Wohnsitz innerhalb der EU, wird auf den Zuschlagspreis,das Aufgeld und die Folgerechtsumlage die gesetzlicheMwSt. von 7 %, erhoben und so ausgewiesen. Bei Bilddrucken,Offsetdrucken und Siebdrucken (Serigraphien) beträgt die gesetzlicheMehrwertsteuer 19 %.c) Die vorgenannten Sätze für Folgerechtsumlagen und Mehrwertsteuersowie die Gegenstände, auf die sie anfallen, entsprechenstatement of account within 4 weeks of the date of the auction;the bidder shall be bound by his bid for the duration of this periodof time. <strong>Karl</strong> & <strong>Faber</strong> may withdraw its acceptance of a bid duringan auction and call for new bids for the work of art at the sameauction, if a higher bid made in good time has been overlooked bymistake and the relevant bidder has objected to such immediately,or if there is doubt of any other nature regarding the acceptanceof a bid. If <strong>Karl</strong> & <strong>Faber</strong> exercises this right, then the acceptanceof the original bid shall cease to be effective. <strong>Karl</strong> & <strong>Faber</strong> shall beentitled to refuse the acceptance of a bid or to reject a bid if thereis special reason on hand for doing so. A special reason shall be onhand in particular, if a bidder is unknown to <strong>Karl</strong> & <strong>Faber</strong> and hasnot provided security at the latest, by the time the auction begins.If a bid is rejected, then the preceding bid shall remain in effect.The ac cep tance of a bid shall oblige the bidder to acceptance andpayment.7. Written bids shall be deemed bids already made at the auction. If<strong>Karl</strong> & <strong>Faber</strong> receives several written bids to the same amount forone and the same work of art, then the bid received first shall beaccepted, if no higher bid has been submitted or is made. <strong>Karl</strong> &<strong>Faber</strong> shall only avail itself of each written bid up to the amountwhich is necessary in order to outbid an other bid which has beenmade. A written bid, which is to be submitted using the form sheetprovided for such purpose, must be signed by the bidder and stipulatethe hammer price (with out premium, fee for droit de suite,and value added tax due) offered for the work of art.8. The purchase price consists of the hammer price plus premium;allocated costs and statutory value added tax may be added. Inparticular the flat rate for droit de suite paid by <strong>Karl</strong> & <strong>Faber</strong> toVG Bild und Kunst for the compensation of statutory entitlementspursuant to § 26 UrhG levied upon the sales proceeds of originalworks of the fine arts – created as of 1900 – shall be levied. Salesshall, regarding value added tax, be made according to variedmodes, depending on the requirements to be specified by the Consignorin a timely manner before invoicing, either by differentialtaxation or under regular taxation. Works of art subject to regulartaxation shall be indicated and marked with „R“ behind the cataloguenumber. Applicable shall be specifically:a) For differential taxation, each individual object shall be subjectto a premium of 30% on a hammer price up to and including300.000 Euro 28% on the amount exceeding a hammer price ofover 300.000 Euro and up to and including 500.000 Euro 27% onthe amount exceeding 500.000 Euro. This premium includes allallocated costs, the droit de suite if applicable and the statutoryvalue added tax without separate indication thereof.b) For regular taxation, for buyers entitled to deduct prepaid valueadded tax, each individual object shall be subject to a premium of23% on a hammer price up to and including 300.000 Euro 21% onthe amount exceeding a hammer price of over 300.000 Euro andup to and including 500.000 Euro 19% on the amount exceeding500.000 Euro. In addition, a 1.3% fee for droit de suite will apply.If the buyer has his place of residence within the EU, then the statutoryvalue added tax to the amount of 7 % shall be levied on thehammer price, the premium and the fee for droit de suite, and itshall be indicated as such.
