16. Ist der Käufer in Zahlungsverzug, kann Karl & Faber nach Set zeneiner Nachfrist vom Vertrag zurücktreten; wird dieses Recht ausgeübt,erlöschen alle Rechte des Käufers am ersteigerten Kunstwerk.In einem solchen Fall ist Karl & Faber berechtigt, vom KäuferSchadensersatz in Höhe des entgangenen Entgelts (Abgeld undAufgeld) sowie angefallener Kosten für Katalog abbildungen zuverlangen. Darüber hinaus haftet der Käufer für Transport-, Lager-und Versicherungskosten bis zur Rück gabe oder, nach Wahlvon Karl & Faber, bis zur erneuten Ver steigerung des Kunstwerkes.Wird das Kunstwerk in der nächsten oder übernächsten Auktionversteigert, haftet der Käufer außerdem für jeglichen Mindererlös.Auf einen Mehrerlös hat er keinen Anspruch. Karl & Faber hat dasRecht, den Käufer von weiteren Geboten in der Versteigerung auszuschließen.17. Sämtliche zur Versteigerung gelangenden Kunstwerke können imRahmen der Vorbesichtigung geprüft und besichtigt werden. Siesind durchgehend gebraucht und haben einen ihrem Alter und ihrerProvenienz entsprechenden Zustand, insbesondere Erhaltungszustand.Beanstandungen dieses Zustandes werden im Katalog nurerwähnt, wenn sie nach Auffassung von Karl & Faber den optischenGesamteindruck des Kunstwerkes nicht unerheblich beeinträchtigen.In allen Fällen ist jedoch der tatsächliche Zustand des Kunstwerkeszum Zeitpunkt seines Zu schlages vereinbarte Beschaffenheitim Sinne der gesetzlichen Bestimmungen. WeitergehendeAnsprüche des Käufers sind ausgeschlossen, vgl. Ziff. 16.18. Alle Angaben im Katalog oder in einer entsprechenden Inter net-Präsentation beinhalten lediglich Meinungsäußerungen, die nachbestem Wissen und Gewissen gemacht werden. Diese Angaben sindrechtlich weder eine Beschaffenheitszusage noch eine Garantie.Das Gleiche gilt für Katalogabbildungen; sie dienen dem Zweck,dem Interessenten eine ungefähre Vorstellung vom Kunstwerk zuverschaffen und sind weder Bestandteil einer Beschaffenheitsvereinbarungnoch einer Garantie. Karl & Faber behält sich vor, Katalogangabenüber die zu versteigernden Kunstwerke vor der Auktion zuberichtigen. Diese Berich ti gung kann durch schriftlichen Aushangam Ort der Versteigerung oder mündlich durch den Auktionatorunmittelbar vor der Ver steigerung des Kunstwerkes erfolgen. In einemsolchen Fall treten die berichtigten Angaben an die Stelle derKatalog be schreibung. Mit diesen Maßgaben sind alle Ansprüchegegen Karl & Faber, insbesondere Schadensersatzansprüche wegenRechts- und Sachmängeln sowie aus sonstigen Gründen (Verlust/Beschädigung)ausgeschlossen. Dies gilt nicht, soweit solcheAn sprüche auf vorsätzlichem oder grob fahrlässigem Handeln vonKarl & Faber (einschließlich seiner Erfüllungsgehilfen) be ruhen, ihreUrsache in der Verletzung von vertraglichen Kardinal pflichten habenoder Schäden wegen Verletzung des Lebens, des Körpers oderder Gesundheit betreffen.19. Karl & Faber verpflichtet sich jedoch, auf rechtzeitiges (siehe Ziff.19.a) Verlangen des Käufers Ansprüche aus dem Innen verhältnismit dem Einlieferer diesem gegenüber - ggf. auch ge richtlich - geltendzu machen, wenn der Käufer nachgewiesen hat, dass Katalogangabenüber die Urheberschaft und die Tech nik des ersteigertenKunstwerkes unrichtig sind und auch nicht mit der anerkanntenMeinung der Experten am Tag der Auktion übereinstimmten. ImFalle erfolgreicher Inanspruchnahme des Kom mittenten erstattetKarl & Faber dem Käufer den Kaufpreis, wenn keine AnsprücheDritter an dem Kunstwerk bestehen und das Kunstwerk am Sitzvon Karl & Faber in unverändertem Zu stand zurückgegeben wird.15. The ownership to the acquired work of art shall only pass on to thebuyer after the complete payment of all amounts owed to Karl &Faber.16. If the buyer is in default of payment, then Karl & Faber may rescindthe contract after having granted an additional period of respite; ifsuch right is exercised, then all the rights of the buyer in respectof the work of art bought by auction shall ex pire and become void.Karl & Faber shall in such case be entitled to claim compensationof damages from the buyer in the amount of lost remuneration forthe work of art (seller’s commission and buyer’s premium), and anycosts incurred for catalogue illustrations. The buyer shall, in addition,be lia ble for transportation-, storage- and insurance costs untilthe work of art is returned or – as Karl & Faber may select – is putup for renewed auction. If the work of art is sold at the next auctionor at the auction following next thereupon, then the buyer shall furthermorealso be liable for any shortfall in proceeds. He shall not beentitled to any surplus in proceeds. Karl & Faber shall have the rightto exclude the buyer from making further bids at the auction.17. All the works of art put up for auction may be inspected and viewedin the context of the preliminary viewing. They are al to gether used,and the condition they are in, particularly their state of preservation,corresponds with their age and provenance. Ob jections to thiscondition shall only be referred to in the catalogue if, in the opinionof Karl & Faber, they sub-stantially impair the overall visual impressionof the work of art. The actual condition of the work of artat the time of the fall of the hammer shall, how-ever, in all cases bethe agreed quality as defined by statutory regulations.18. All the details given in the catalogue or in a corresponding Internetpresentation are merely expressions of opinion made in accordancewith best of knowledge and belief. These details do notconstitute a legally binding confirmatory commitment re gardingquality and nature, nor any such guarantee. The same appliesfor the illustrations in the catalogue; these illus trations serve forthe purpose of giving interested customers an im pression of thework of art; they are not part of an agreement regarding qualityand nature, nor of any such guarantee to this effect. Karl & Faberreserves the right to correct catalogue details regarding the worksof art to be sold by auction before the auction. Such correction maybe made by way of a written notice displayed at the place wherethe auction is held, or it may be given verbally by the Auctioneerimmediately before the work of art is sold by auction. The correcteddetails shall, in any such case, apply in lieu of the descriptionin the catalogue. All claims against Karl & Faber shall be excludedwith and by these provisions, particularly all claims for da magecompensation due to defects of quality and of title, as well as forother reasons [loss/ damage]. This shall not apply, in as far as suchclaims are based on intentional or grossly negligent actions of Karl& Faber [in cluding its vicarious agents], or if they are based on thein frin gement or breach of essential contractual duties, or if theycon cern damages due to the injury of life, body or health.19. Karl & Faber undertakes, upon the timely request of the buyer (cf.Item 19a), to assert the rights and claims provided for under theinternal relationship with the Consignor against such Con signor –also before court if necessary – if the buyer has proven that thedetails given in the catalogue regarding the origination and thetechnique of the work of art bought at the auction are in cor rectand were also not in agreement with the recognized opinion ofexperts on the date of the auction.
