§ <strong>199</strong>-9 ZONING § <strong>199</strong>-9<br />

§ <strong>199</strong>-9. Residential-Agricultural District (RA-40).<br />

A. Permitted uses shall be as follows:<br />

(1) Any use permitted and as regulated in a Residential District (R-20 and R-30).<br />

(2) Farm, forestry or nursery, including the display and sale of natural products raised in town and<br />

the raising of stock as limited in Subsection B(2) below. The raising of horses for personal use is<br />

permitted, provided that such action is carried on at least 300 feet from any property line.<br />

(3) Accessory uses.<br />

(4) Resort, as defined in this chapter, by special permit from the Board of Selectmen and subject to<br />

all applicable provisions of this chapter and to the following special requirements:<br />

(a) The minimum area for such use shall be 200 acres;<br />

(b) The minimum setback of all buildings or structures and unenclosed recreational and off-street<br />

parking areas from any adjacent property line shall be 100 feet;<br />

(c) Off-street parking shall be provided on the premises for maximum use of all facilities;<br />

(d) No public address system shall be permitted except when such system is inaudible at any<br />

property line;<br />

(e) The resort shall comply with the Board of Health regulations pertaining to on-lot sewage<br />

disposal systems and water supply and any other laws and regulations regarding the<br />

establishment and maintenance of such use; and<br />

(f) No special permit shall be issued for the establishment or expansion of such use unless the<br />

site plan has been reviewed by the Planning Board and Conservation Commission and<br />

approved, in writing, by the Board of Health and the Board of Selectmen.<br />

(5) Municipal use; provided, however, that no new municipal use shall be established and no<br />

existing municipal use shall be substantially expanded unless and until the representative town<br />

meeting votes an appropriation for said use.<br />

B. Uses which may be permitted by the Board of Appeals in accordance with the regulations appearing<br />

in Section <strong>199</strong>-34B(3) of this chapter, and in compliance with all applicable provisions of this<br />

chapter, shall be as follows:<br />

(1) Boat livery, riding stable and ski tow.<br />

(2) The raising of hogs, pigs, poultry or fur bearing animals, provided that such activity is carried on<br />

at least 300 feet from any property line.<br />

(3) Cluster development as regulated in Article X of this chapter.<br />
