• The causes of action have distinct origins<br />

• The purposes and interests that both bodies of law<br />

primarily protect are contrasting<br />

• Passing off protects a right of property in business or<br />

goodwill<br />

• Whereas s 52 TPA is concerned with consumer protection<br />

• S 52 TPA is not restricted by common law principles<br />

relating to passing off and provides wider protection than<br />

passing off
