A judge may decide to render a decision on a motion "on the papers" rather than hold<strong>in</strong>g a<br />
hear<strong>in</strong>g <strong>in</strong> the courtroom; <strong>in</strong> such a case, the judge will vacate the hear<strong>in</strong>g.<br />
At the beg<strong>in</strong>n<strong>in</strong>g of the trial, after the jury has been selected, if it is a jury trial, the parties have<br />
an opportunity to make <strong>in</strong>dividual open<strong>in</strong>g statements, <strong>in</strong> which they can describe the issues<br />

objection.<br />
“Public Access to Electronic <strong>Court</strong> Records” is an <strong>in</strong>ternet database where docket <strong>in</strong>formation<br />
is stored.<br />
Dur<strong>in</strong>g jury selection, after all of the jurors challenged for cause have been excused, the<br />
parties will have an opportunity to request that additional jurors be excused without hav<strong>in</strong>g to<br />
give any reason for the request.<br />

A claim by the defendant aga<strong>in</strong>st the pla<strong>in</strong>tiff that is not based on the same events or<br />
transactions as the pla<strong>in</strong>tiff’s claim aga<strong>in</strong>st the defendant.<br />
If the physical or mental condition of a party (or a person under the custody or legal control of<br />
a party) is at issue <strong>in</strong> a lawsuit, the <strong>Court</strong> may order that person to have a physical or mental<br />
exam<strong>in</strong>ation by a medical professional such as a physician or psychiatrist; unlike other<br />
discovery procedures, physical or mental exam<strong>in</strong>ations can be obta<strong>in</strong>ed only by fil<strong>in</strong>g a motion<br />
with the court, or by agreement of the parties.<br />
Formal documents that are filed with the court, especially <strong>in</strong>itial fil<strong>in</strong>gs such as compla<strong>in</strong>ts and<br />
answers. Plead<strong>in</strong>gs and most other court fil<strong>in</strong>gs are written on plead<strong>in</strong>g paper, which <strong>in</strong> this<br />
<strong>Court</strong> is letter-sized paper with the l<strong>in</strong>e numbers 1 through 28 runn<strong>in</strong>g down the left side.<br />
PLAINTIFF The person who filed the compla<strong>in</strong>t and claims to be <strong>in</strong>jured by a violation of the law.<br />

In the center of the courtroom, there are two long tables and chairs where the lawyers and<br />
parties sit dur<strong>in</strong>g hear<strong>in</strong>gs and trial; the table nearest the jury box is usually the pla<strong>in</strong>tiff’s.<br />
The last section of a compla<strong>in</strong>t <strong>in</strong> which the pla<strong>in</strong>tiff tells the <strong>Court</strong> what the pla<strong>in</strong>tiff wants<br />
from the lawsuit: money damages, a court order tell<strong>in</strong>g the defendant to do or not do<br />
someth<strong>in</strong>g, or other relief.<br />
A hear<strong>in</strong>g shortly before trial where the judge discusses the requirements for conduct<strong>in</strong>g trial<br />
and resolves any f<strong>in</strong>al issues that have arisen before trial.<br />
The disclosures required by Rule 26(a) (3) of the <strong>Federal</strong> Rules of Civil Procedure of certa<strong>in</strong><br />
<strong>in</strong>formation about evidence that you may present at trial (except for evidence that will be used<br />
solely for impeachment).<br />
PRIVILEGED INFORMATION Information that is protected by legal rules from disclosure dur<strong>in</strong>g discovery and trial.<br />
PRO BONO REPRESENTATION Legal representation by an attorney that is free to the person represented.<br />
PRO SE<br />
A Lat<strong>in</strong> term mean<strong>in</strong>g "for onself." A pro se litigant is a party without a lawyer handl<strong>in</strong>g a case<br />
<strong>in</strong> court.<br />
PROCEDURAL RULES The rules parties must follow for br<strong>in</strong>g<strong>in</strong>g and defend<strong>in</strong>g aga<strong>in</strong>st a lawsuit <strong>in</strong> court.<br />
PROCESS SERVER A person authorized by law to serve the compla<strong>in</strong>t and summons on the defendant.<br />
PROOF OF SERVICE<br />
A document attached to each document filed with the court (or filed separately at the same<br />
time as the document) <strong>in</strong> which the filer affirms that he or she has served the document on<br />
other parties.<br />
