Cases <strong>of</strong> doubt<br />

In any case where a magistrate is uncerta<strong>in</strong> as to how <strong>the</strong>se pr<strong>in</strong>ciples apply to<br />

<strong>the</strong> particular circumstances, he or she may seek guidance from <strong>the</strong> Senior<br />

Magistrate or <strong>the</strong> head <strong>of</strong> <strong>the</strong> judiciary, <strong>the</strong> Chief Justice. If <strong>the</strong>re is not time to do<br />

so, he or she should err on <strong>the</strong> side <strong>of</strong> caution; <strong>the</strong> question may never<strong>the</strong>less be<br />

referred to <strong>the</strong> Chief Justice for <strong>the</strong> future.<br />
