<strong>Wayland</strong> Board <strong>of</strong> Public Works, acting also as the<br />

<strong>Cemetery</strong> Commissioners according to <strong>Town</strong> Bylaws,<br />

have established these rules as a guide to<br />

proper use <strong>of</strong> <strong>Town</strong> Cemeteries. These rules may be<br />

adjusted by the Commissioners, as necessary, to<br />

carry out their duties. The Commissioners stand<br />

ready at all times, to answer all questions regarding<br />

these established rules.<br />

General Rules<br />

1. <strong>Town</strong> cemeteries are open from 7:15 am until<br />

sunset.<br />

2. Visitors must respect the solemnity <strong>of</strong> the<br />

cemeteries at all times.<br />

3. Alcoholic beverages, firearms, and dogs are<br />

prohibited in all town cemeteries.<br />

4. The following activities are prohibited in all<br />

town cemeteries: rollerblading, skateboarding, the<br />

use <strong>of</strong> mini-bikes, horseback riding, solicitation <strong>of</strong><br />

any kind, the sale <strong>of</strong> any items, instructing persons<br />

in the use and operation <strong>of</strong> a motor vehicle.<br />

5. The <strong>Cemetery</strong> Commission shall make<br />

reasonable efforts to protect all trees, flowers,<br />

shrubs, commemorative memorials and other<br />

property. However, the <strong>Cemetery</strong> Commission is<br />

not responsible for the protection or replacement<br />

<strong>of</strong> any property or landscape.<br />

6. Only residents or former residents <strong>of</strong> the <strong>Town</strong><br />

<strong>of</strong> <strong>Wayland</strong>, Massachusetts, shall be entitled to<br />

purchase a lot or single grave.<br />

7. Any lot owner who wishes to assure burial<br />

privileges to a specific individual, must notify the<br />

<strong>Cemetery</strong> Commission in writing. This documentation<br />

must be signed, dated, and notarized.<br />

8. No lot (or portion <strong>of</strong> a lot) may be sold or divided,<br />

without first obtaining written permission from the<br />

<strong>Cemetery</strong> Commissioners.<br />

9. The cost <strong>of</strong> “Perpetual Care” is included in the<br />

total price <strong>of</strong> lot sales. Perpetual care covers all lot<br />

and grave surface maintenance, such as mowing the<br />

grass, or removing leaves. It does not include the<br />

maintenance <strong>of</strong> markers, monuments, flowers,<br />

shrubs, or any other plants.<br />

10. <strong>Cemetery</strong> lots shall not be used for any purpose<br />

other than as burial sites for human remains.<br />

11. No lot owner shall allow the remains <strong>of</strong> any<br />

person to be deposited within the bounds <strong>of</strong> his or<br />

her lot, for pr<strong>of</strong>it.<br />

12. No tomb, mausoleum, crypt, or other structure<br />

(intended for above ground interment), may be<br />

constructed within the bounds <strong>of</strong> town cemeteries,<br />

without written approval from the <strong>Cemetery</strong><br />

Commission Director.<br />

13. No trees or shrubs within all cemetery bounds<br />

may be cut down, destroyed, or altered. Lot<br />

owners who desire any landscaping changes must<br />

first obtain written approval from the <strong>Cemetery</strong><br />

Commission. The Commission reserves the right<br />

to make any landscaping changes as they feel<br />

necessary, for the overall improvement and safety <strong>of</strong><br />

town cemeteries.<br />

All deeded lots give access to the cemetery, and<br />

convey the right to use cemetery roadways, where<br />

consistent with the other rules contained herein.<br />

All motor vehicles are required to stay within the<br />

designated paths marked on the town’s cemetery<br />

diagrams.<br />

Traffic Rules<br />

1. The speed limit in town cemeteries is five (5)<br />

miles per hour.<br />

2. Horses are specifically prohibited from town<br />

cemeteries, unless they are part <strong>of</strong> a funeral cortege<br />

or authorized activity.<br />

3. All pedestrians have the right-<strong>of</strong>-way. Additionally,<br />

motor vehicles must yield to funeral<br />

processions.<br />

4. Any person who causes damage with a motor<br />

vehicle in town cemeteries, shall be held liable for<br />

the cost <strong>of</strong> damages.<br />

Glossary <strong>of</strong> Terms<br />

LOT - Land area is assigned a numbered division,<br />

according to the town cemetery record card, and<br />

may consist <strong>of</strong> one (1) or more graves.<br />

GRAVE - Area within a lot, that is <strong>of</strong> sufficient size<br />

to accommodate one full size interment and/or up<br />

to six (6) cremated remains.<br />

INTERMENT - The permanent disposition <strong>of</strong> a<br />

deceased person's remains, through burial.<br />

CREMATION - The technical process by which<br />

human remains are reduced to bone fragments.<br />

DEED - The original conveyance document<br />

provided by the <strong>Cemetery</strong> Commission to the<br />

original lot purchaser.<br />

MEMORIAL - Includes any monument and/or<br />

marker, used for identification on a cemetery lot.<br />

MONUMENT - Includes any tombstone or<br />

memorial consisting <strong>of</strong> granite or marble, which<br />

shall extend above the surface <strong>of</strong> the ground.<br />

MARKER - A memorial flush with the ground,<br />

usually located at a grave site.<br />

The <strong>Town</strong> <strong>of</strong> <strong>Wayland</strong> <strong>Cemetery</strong> Commission<br />

has the right to expel from the grounds, and<br />

issue an arrest warrant for anyone who violates<br />

these rules and regulations. The Commission<br />

shall have charge over all town cemetery grounds<br />

and buildings, including the conduct <strong>of</strong><br />

funerals, traffic, employees, lot owners, and<br />
