These include: • Installing a standard Fish and Boat Commission sign. • Mowing and cutting brush more frequently. • Sealing or resurfacing the parking area. • Removing the remaining parts of the dam. Future Considerations for Berm or Dam Construction As part of the planning process, a number of critical issues related to constructing either a berm and small pond, or reconstructing the dam were identified. While these issues are certainly not insurmountable, they must be addressed before any agency or organization could undertake either project. The issues are included here to serve as a checklist for future action. Funding • Near term Fish and Boat Commission funding is not probable given the current forecast of some $150,000,000 required for current priority projects at Commission facilities, including $85,000,000 in fish hatchery improvements and $58,000,000 million in dam improvements. • Current Fish and Boat Commission goals do not include dam construction or land acquisition. • Local funding is simply not available from local or county governments due to limited resources and the need to focus on local community facility and service priorities. • Operation and maintenance costs would be in addition to construction costs. • Grant funds for the construction of a dam are limited given the high cost, commitment required for operation and maintenance, and environmental considerations. • Grants would not include funds for operation and maintenance. • Potential funding sources for the berm and small pond (Use #5) include: • North American Wetlands Conservation Act Grants Program, U.S. Fish and Reining Pond Master Site Plan 04-05
Section VI – Identified Uses and Recommended Actions Page VI-5 Wildlife Service – intended to promote the long term conservation of wetland ecosystems, the funds may be used for the enhancement and restoration of wetlands and uplands associated with wetlands. A local funding match is required. The program has been used successfully in Wayne County. • Ducks Unlimited, Inc. – This private nonprofit organization often provides funds and partners with other organizations for wetlands enhancement which benefits waterfowl. • Pennsylvania Community Conservation Partnership Program, Small Community Development Projects, Department of Conservation and Natural Resources – funding of up to $40,000 for the development or rehabilitation of park, recreation and conservation areas. Municipal applicant and local match required for grants in excess of $20,000. Environmental • U.S. Environmental Protection Agency, U.S. Fish and Wildlife, U.S. Army Corps of Engineers, and the Pennsylvania Department of Environmental Protection regulations would apply. • Key environmental concerns include wetlands inundation and downstream water quality, including temperature. (See detailed discussion in Section IV.) • A permit would be required from the Department of Environmental Protection, Bureau of Waterways Engineering, . 3 3 DEP regulations provide for certain waivers of permit requirements as detailed in §105.12 of DEP’s Rules and Regulations. The only waiver available to the Reining Pond uses would be for a dam not exceeding three feet in height within the • The DEP permit process is complex and the review and approval process typically takes one year from the time DEP receives a complete application. • The application requires a wide range of detailed information including, among others: • Pennsylvania Historical and Museum Commission notification • PNDI search. • Site plan with cross sections and location maps • Erosion and sedimentation control plan • Hydrologic and hydrualic analysis including dam break analysis • Environmental assessment form and mitigation plan • Detailed construction drawings • Emergency action plan • Plan to address any dam settling or other structural compromise • Operation and maintenance manual • Certification by professional engineer Diversity of Public Opinion - As discussed in Section V, most citizens who commented at the December 14, 2004, public meeting supported the reconstruction of the dam. However, if such construction is specifically proposed, a number of issues may be raised by citizens who would not support construction of a dam or berm. These issues include: (See also the the three comment letter summaries at the end of Section V.) • The cost versus recreation benefit and use of limited tax revenues. • The availability of other, similar fishing areas. banks of the stream where the stream does not exceed fifty feet in width and no wild trout are not present.
