PREAMBLE<br />

BYLAWS OF THE<br />

SASKATCHEWAN<br />

LAND SURVEYORS’ ASSOCIATION<br />

Whereas <strong>the</strong> <strong>Saskatchewan</strong> land surveyors’ association, hereinafter referred to as <strong>the</strong> association, is<br />

duly incorporated by an Act <strong>of</strong> <strong>the</strong> Legislature <strong>of</strong> <strong>the</strong> Province <strong>of</strong> <strong>Saskatchewan</strong>; and<br />

Whereas power is given to <strong>the</strong> council and <strong>the</strong> Membership <strong>of</strong> <strong>the</strong> said association to make bylaws<br />

in accordance with <strong>the</strong> provisions <strong>of</strong> <strong>the</strong> Act for <strong>the</strong> better management and regulation <strong>of</strong> <strong>the</strong><br />

council, <strong>the</strong> association, <strong>the</strong> members <strong>of</strong> <strong>the</strong> association, <strong>the</strong> pr<strong>of</strong>ession <strong>of</strong> land surveying<br />

and pr<strong>of</strong>essional surveying and for <strong>the</strong> management <strong>of</strong> <strong>the</strong> property <strong>of</strong> <strong>the</strong> association and<br />

for <strong>the</strong> carrying out <strong>of</strong> <strong>the</strong> provisions <strong>of</strong> this Act:<br />

Now <strong>the</strong>refore be it enacted by <strong>the</strong> council and <strong>the</strong> Membership <strong>of</strong> <strong>the</strong> association that <strong>the</strong> following<br />

be and are hereby adopted as <strong>the</strong> <strong>Bylaws</strong> <strong>of</strong> <strong>the</strong> <strong>Saskatchewan</strong> <strong>Land</strong> <strong>Surveyors</strong>’ <strong>Association</strong><br />

within and for <strong>the</strong> Province <strong>of</strong> <strong>Saskatchewan</strong>.<br />

SECTION 1<br />

Part I<br />

Administrative <strong>Bylaws</strong> for<br />

<strong>Saskatchewan</strong> land surveyors and Pr<strong>of</strong>essional <strong>Surveyors</strong><br />

Article I<br />

Seal <strong>of</strong> <strong>the</strong> association<br />

The seal <strong>of</strong> <strong>the</strong> association shall continue and be <strong>the</strong> same as <strong>the</strong> impression affixed to <strong>the</strong> margin<br />

<strong>of</strong> <strong>the</strong>se bylaws.<br />

SECTION 1 (Amended 2011/09/19)<br />

Article II<br />

Execution <strong>of</strong> Documents<br />

(1) Except as provided for in <strong>the</strong> Act, all documents o<strong>the</strong>r than cheques issued in <strong>the</strong> name, on<br />

behalf, <strong>of</strong> <strong>the</strong> association, shall be executed under <strong>the</strong> signatures <strong>of</strong> <strong>the</strong> president and <strong>the</strong><br />

executive director.<br />

(2) In <strong>the</strong> absence or incapacity <strong>of</strong> <strong>the</strong> president, <strong>the</strong> vice president shall co-sign <strong>the</strong> document<br />

with <strong>the</strong> executive director.<br />

(3) In <strong>the</strong> absence or incapacity <strong>of</strong> <strong>the</strong> executive director, <strong>the</strong> document shall be signed by <strong>the</strong><br />

president and vice president.<br />

SECTION 1 (Amended 2011/09/19)<br />

Article III<br />

Finances<br />

(1) The finances <strong>of</strong> <strong>the</strong> association shall be kept in accounts under <strong>the</strong> name <strong>of</strong> <strong>the</strong> association<br />

in a chartered bank or guaranteed investment instruments.<br />

(2) All cheques less than <strong>the</strong> amount authorized from time to time by <strong>the</strong> council shall be signed<br />

by <strong>the</strong> executive director.<br />

(3) In <strong>the</strong> absence or incapacity <strong>of</strong> <strong>the</strong> executive director, an acting executive director shall be<br />

appointed under <strong>the</strong> provisions <strong>of</strong> subsection 12(3) <strong>of</strong> <strong>the</strong> Act.<br />

(4) Cheques exceeding <strong>the</strong> authorized amount shall be signed by:<br />

(i) <strong>the</strong> executive director or an acting executive director; and<br />

(ii) such member <strong>of</strong> <strong>the</strong> council as may be appointed from time to time by <strong>the</strong> council.<br />

Article IV<br />

Fiscal Year and Audit<br />

SECTION 1<br />

The council shall, prior to <strong>the</strong> close <strong>of</strong> each fiscal year, make arrangements with a chartered<br />

accountant to audit <strong>the</strong> books <strong>of</strong> <strong>the</strong> association. (Amended 2011/09/19)<br />

SECTION 2<br />

The financial year <strong>of</strong> <strong>the</strong> association shall close at December 31st in each and every year, when an<br />

audit <strong>of</strong> <strong>the</strong> books <strong>of</strong> <strong>the</strong> association shall be made.<br />

SECTION 3<br />

The audited financial statement shall be provided to <strong>the</strong> members <strong>of</strong> <strong>the</strong> association, on or before<br />

February 14th <strong>of</strong> <strong>the</strong> following year, through electronic means or via mail upon <strong>the</strong> member’s request.<br />

Article V<br />

Meetings <strong>of</strong> <strong>the</strong> association<br />

SECTION 1 - Council<br />

(1) The council shall hold at least two meetings in each year at such times and in such places in<br />

<strong>Saskatchewan</strong> as <strong>the</strong> council may determine.<br />

(2) Meetings <strong>of</strong> <strong>the</strong> council, o<strong>the</strong>r than those mentioned in subsection (1) may be called at any<br />

time by <strong>the</strong> President or any two members <strong>of</strong> <strong>the</strong> council.<br />

(3) The council shall meet within 30 days after its election.<br />

(4) Notice <strong>of</strong> each meeting <strong>of</strong> <strong>the</strong> council shall be given by <strong>the</strong> executive director to each member<br />

<strong>the</strong>re<strong>of</strong>, and also to such members <strong>of</strong> <strong>the</strong> association that have business <strong>the</strong>rewith, at least<br />

seven days before <strong>the</strong> day fixed for <strong>the</strong> meeting.<br />

(5) The council shall not transact business at any meeting or hold any hearing in which less than<br />

a majority <strong>of</strong> members <strong>of</strong> council are present.<br />

(6) All meetings <strong>of</strong> <strong>the</strong> council shall be presided over by <strong>the</strong> President or, in his/her absence, by<br />

<strong>the</strong> Vice President or, in <strong>the</strong> absence <strong>of</strong> both, by a Chairman to be elected by <strong>the</strong> members <strong>of</strong><br />

<strong>the</strong> council present.<br />

(7) All questions voted on at a council meeting, except as o<strong>the</strong>rwise specified in <strong>the</strong> Act shall be<br />

decided by a plurality <strong>of</strong> <strong>the</strong> votes.<br />

(8) All members <strong>of</strong> council have full voting power except <strong>the</strong> presiding <strong>of</strong>ficer who shall vote only<br />

when <strong>the</strong> votes are evenly decided.<br />

(9) Meetings <strong>of</strong> council can be in person, by telephone conference, by Internet conference or any<br />

combination <strong>the</strong>re<strong>of</strong>. (Added 2011/09/19)<br />

(10)(a) Subject to subsection (10)(b) When <strong>the</strong> question is called for voting on motions <strong>of</strong> council,<br />

members participating in <strong>the</strong> meeting by telephone or Internet conferencing are deemed to<br />

be in support <strong>of</strong> <strong>the</strong> motion unless <strong>the</strong>y voice ei<strong>the</strong>r <strong>the</strong>ir opposition or <strong>the</strong>ir intension to<br />

abstain from voting. (Added 2011/09/19)<br />

(10)(b) At <strong>the</strong> request <strong>of</strong> <strong>the</strong> presiding <strong>of</strong>ficer or any member <strong>of</strong> council, voting on any specific<br />

motion <strong>of</strong> council shall be by verbal response from each voting member <strong>of</strong> council as that<br />

member’s name is called by <strong>the</strong> presiding <strong>of</strong>ficer. (Added 2011/09/19)<br />

SECTION 2 - Annual and Special Meetings<br />

(1) Except as herein provided, Robert’s Rules <strong>of</strong> Order Newly Revised (10th Edition) shall<br />

govern in <strong>the</strong> discussion on motions and resolutions at all Annual and Special Meetings.<br />

(2) Except in <strong>the</strong> case <strong>of</strong> resolutions that are brought forward by <strong>the</strong> council, or by a standing<br />

committee consisting <strong>of</strong> at least two persons, and which are published and circulated to <strong>the</strong><br />

members <strong>of</strong> <strong>the</strong> association at least two weeks in advance <strong>of</strong> an Annual or Special Meeting,<br />

every resolution to establish or amend a bylaw or association policy shall be in writing and<br />

shall contain <strong>the</strong> name and signature <strong>of</strong> <strong>the</strong> mover and seconder <strong>the</strong>re<strong>of</strong>. (Amended 2006/04/16)<br />

(3) Every resolution shall be recognized by <strong>the</strong> chair before being presented for discussion.<br />

(4) The Chairman may limit <strong>the</strong> length <strong>of</strong> time allowed each member when speaking to a<br />

resolution.<br />

(5) All discussions on a resolution shall close when such resolution has been finally put to <strong>the</strong><br />

meeting for a vote.<br />

(6)(a) Subject to sub-subsection (6)(b) <strong>the</strong> order <strong>of</strong> business for <strong>the</strong> annual meeting shall be as<br />

follows: (Amended 2011/09/19)<br />

(i) Call to order and president’s address<br />

(ii) Presentation <strong>of</strong> minutes <strong>of</strong> last annual meeting and all intervening special meetings<br />

(iii) Report <strong>of</strong> council<br />

(iv) Presentation <strong>of</strong> bylaws passed by council<br />

(v) Report <strong>of</strong> executive director<br />

(vi) Auditor’s report<br />

(vii) Reports <strong>of</strong> standing committees<br />

(viii) Reports <strong>of</strong> ad hoc and o<strong>the</strong>r committees<br />

(ix) Ratification <strong>of</strong> all actions by <strong>the</strong> council, standing committees and ad hoc committees<br />

on behalf <strong>of</strong> <strong>the</strong> association<br />

(x) Reports from outside agencies<br />

(xi) Voting on motions for which written notice has been given<br />

(xii) O<strong>the</strong>r unfinished business<br />

(xiii) Election <strong>of</strong> <strong>of</strong>ficers and transition <strong>of</strong> council<br />

(xiv) New business<br />

(xv) Open Forum<br />

(xvi) Adjournment<br />

(b) The chairman <strong>of</strong> <strong>the</strong> annual meeting may, with <strong>the</strong> approval <strong>of</strong> a majority <strong>of</strong> members present<br />

at <strong>the</strong> meeting, vary <strong>the</strong> order <strong>of</strong> business.<br />

SECTION 3 - Quorum<br />

A quorum for any annual or special meeting shall be twenty licensed members.<br />

SECTION 4 - Voting (Amended 2011/09/19)<br />

(1) All questions voted on at any annual or special meeting except as o<strong>the</strong>rwise specified in <strong>the</strong><br />

Act, shall be decided by a plurality <strong>of</strong> <strong>the</strong> votes <strong>of</strong> <strong>the</strong> licensed <strong>Saskatchewan</strong> <strong>Land</strong> <strong>Surveyors</strong><br />

and Registered Pr<strong>of</strong>essional <strong>Surveyors</strong> present.<br />

(2) Each licensed <strong>Saskatchewan</strong> <strong>Land</strong> Surveyor and Registered Pr<strong>of</strong>essional Surveyor shall be<br />

entitled to one vote.<br />

SECTION 5 - Time and Place<br />

The annual meeting <strong>of</strong> <strong>the</strong> association is to be held in <strong>Saskatchewan</strong> at a time and place determined<br />

by council.<br />

SECTION 1 (Amended 2006/04/16)<br />

Article VI<br />

Scholarships, Bursaries and Prizes<br />

(1) There shall be an annual scholarship <strong>of</strong> $1,250 granted to a student land surveyor from<br />

<strong>Saskatchewan</strong> who is enrolled in any program that will, upon completion, result in <strong>the</strong><br />

candidate receiving a certificate <strong>of</strong> completion from <strong>the</strong> BELS.<br />

(2) The criteria for awarding <strong>the</strong> scholarship shall be approved by <strong>the</strong> council upon <strong>the</strong><br />

recommendation <strong>of</strong> <strong>the</strong> Public Relations Committee.<br />

(3) Selection <strong>of</strong> <strong>the</strong> winning applicant shall be by <strong>the</strong> council based upon <strong>the</strong> recommendation<br />

<strong>of</strong> <strong>the</strong> Public Relations Committee.<br />

SECTION 2<br />

There shall be a scholarship <strong>of</strong>fered annually in <strong>the</strong> amount <strong>of</strong> $1,250 to a student entering <strong>the</strong><br />

fourth year in <strong>the</strong> Geomatics Engineering program at <strong>the</strong> University <strong>of</strong> Calgary, who has completed<br />

secondary schooling within <strong>the</strong> province <strong>of</strong> <strong>Saskatchewan</strong>. The award will be based on academic<br />

merit and <strong>the</strong> candidate must have attained a grade point average <strong>of</strong> not less than 2.60 in <strong>the</strong><br />

previous academic year. To be eligible students must be enrolled in Survey Law and Field Surveys in<br />

<strong>the</strong> fourth year and have selected a topic dealing with cadastral land studies for <strong>the</strong>ir Field Surveys<br />

project. (Amended 2006/04/16)<br />

SECTION 3 (Amended 2011/09/19)<br />

(1) Subject to subsection (2) <strong>the</strong>re shall be a scholarship <strong>of</strong>fered annually in <strong>the</strong> amount <strong>of</strong><br />

$1,250 to <strong>the</strong> second year Geomatics Engineering Technology student at <strong>the</strong> <strong>Saskatchewan</strong><br />

Institute <strong>of</strong> Applied Science and Technology, who achieved <strong>the</strong> best academic record in <strong>the</strong><br />

first year <strong>of</strong> <strong>the</strong> student’s program at <strong>the</strong> Institute.<br />

(2) In any year when <strong>the</strong>re are no candidates that meet <strong>the</strong> criteria set out in subsection (1),<br />

<strong>the</strong> scholarship shall be granted, on <strong>the</strong> basis <strong>of</strong> third highest academic record, to a student<br />

entering <strong>the</strong> first year <strong>of</strong> <strong>the</strong> Geomatics Engineering Technology program at <strong>the</strong> <strong>Saskatchewan</strong><br />

Institute <strong>of</strong> Applied Science and Technology.<br />

SECTION 4 (Amended 2011/09/19)<br />

There shall be two scholarships <strong>of</strong>fered annually in <strong>the</strong> amount <strong>of</strong> $1,250, granted on <strong>the</strong> basis<br />

<strong>of</strong> first and second highest academic records, to students entering <strong>the</strong> first year <strong>of</strong> <strong>the</strong> Geomatics<br />

Engineering Technology program at <strong>the</strong> <strong>Saskatchewan</strong> Institute <strong>of</strong> Applied Science and Technology.<br />

Article VII<br />

O<strong>the</strong>r associations and Organizations<br />

SECTION 1 - <strong>Saskatchewan</strong> <strong>Association</strong> <strong>of</strong> Geomatics Technologists<br />

The <strong>Saskatchewan</strong> <strong>Land</strong> <strong>Surveyors</strong> <strong>Association</strong> (<strong>the</strong> “<strong>Association</strong>”) will generally assist and support<br />

<strong>the</strong> <strong>Saskatchewan</strong> <strong>Association</strong> <strong>of</strong> Geomatics Technologists Inc. (SAGT) as follows:<br />

(1) The <strong>Association</strong> may assist SAGT as herein set out and as may from time to time be requested<br />

by SAGT and approved by council, in <strong>the</strong> management <strong>of</strong> its affairs and in <strong>the</strong> promotion <strong>of</strong><br />

its objectives.<br />

(2) The council <strong>of</strong> <strong>the</strong> <strong>Association</strong> may nominate and appoint two members <strong>of</strong> <strong>the</strong> <strong>Association</strong><br />

to serve as Advisory Members to SAGT. One appointee shall be appointed annually, each<br />

appointment for a term <strong>of</strong> two years.<br />

(3) The council <strong>of</strong> <strong>the</strong> <strong>Association</strong> may nominate and appoint three members <strong>of</strong> <strong>the</strong> <strong>Association</strong> to<br />

serve on <strong>the</strong> Certification Board <strong>of</strong> <strong>the</strong> SAGT; said appointments to be made when vacancies<br />

arise in <strong>the</strong> number <strong>of</strong> <strong>the</strong> <strong>Association</strong>’s members on <strong>the</strong> said Board.<br />

(4) If requested by <strong>the</strong> Certification Board <strong>of</strong> <strong>the</strong> SAGT, <strong>the</strong> <strong>Association</strong> may appoint three<br />

members <strong>of</strong> <strong>the</strong> <strong>Association</strong> to <strong>the</strong> Panel <strong>of</strong> Examiners for <strong>the</strong> Certification Board <strong>of</strong> <strong>the</strong><br />

SAGT; such appointments to be made when initially requested and when vacancies arise in<br />

<strong>the</strong> number <strong>of</strong> members <strong>of</strong> <strong>the</strong> <strong>Association</strong> on <strong>the</strong> said Panel <strong>of</strong> Examiners.<br />

(5) The council <strong>of</strong> <strong>the</strong> <strong>Association</strong> may from time to time receive <strong>the</strong> recommendations <strong>of</strong> <strong>the</strong><br />

Certification Board <strong>of</strong> <strong>the</strong> SAGT and/or <strong>the</strong> Advisory Members to <strong>the</strong> SAGT and approve<br />

such recommendations in respect to standards, educational requirements, classifications or<br />

o<strong>the</strong>r matters as council deems just.<br />

(6) The <strong>Association</strong> may support and/or co-sponsor, toge<strong>the</strong>r with <strong>the</strong> SAGT education seminars<br />

and o<strong>the</strong>r projects <strong>of</strong> common interest.<br />

SECTION 2 - Pr<strong>of</strong>essional <strong>Surveyors</strong> Canada (Amended 2011/09/19)<br />

(1) The <strong>Saskatchewan</strong> <strong>Land</strong> <strong>Surveyors</strong>’ <strong>Association</strong> shall maintain a relationship with<br />

Pr<strong>of</strong>essional <strong>Surveyors</strong> Canada.<br />

(2) The council shall appoint a <strong>Saskatchewan</strong> land surveyor or pr<strong>of</strong>essional surveyor to serve as<br />

representative on <strong>the</strong> Pr<strong>of</strong>essional <strong>Association</strong> Liaison Committee <strong>of</strong> Pr<strong>of</strong>essional <strong>Surveyors</strong><br />

Canada; such appointment to be for a term <strong>of</strong> three years. A <strong>Saskatchewan</strong> land surveyor<br />

or pr<strong>of</strong>essional surveyor so appointed is eligible for re-appointment upon <strong>the</strong> expiration <strong>of</strong><br />

his/her term.<br />

(3) The association shall, in each year, pay <strong>the</strong> annual levy required to maintain its relationship<br />

Committees<br />

Standing committees <strong>of</strong> <strong>the</strong> association are to be <strong>the</strong> Convention, Education, Finance, Government<br />

SECTION 1<br />

Article IX<br />

Remuneration and Reimbursement<br />

In-town members <strong>of</strong> council, attending a meeting <strong>of</strong> council are entitled to a stipend <strong>of</strong> $75 per<br />

SECTION 2<br />

Out-<strong>of</strong>-town members <strong>of</strong> council, attending a meeting <strong>of</strong> council are entitled to a stipend <strong>of</strong> $175.<br />

Any member residing over 275 km from <strong>the</strong> location <strong>of</strong> <strong>the</strong> meeting is entitled to $250.00 per<br />

SECTION 3<br />

Members <strong>of</strong> council, committee members and o<strong>the</strong>r members <strong>of</strong> <strong>the</strong> association, when incurring<br />

expenditures on behalf <strong>of</strong> a committee, <strong>the</strong> council, or <strong>the</strong> association, and approved by council,<br />

are entitled to claim travel expenses in accordance with <strong>the</strong> rates approved by council and which<br />

conform with <strong>the</strong> provincial government’s travel allowance rates.<br />

Regulatory <strong>Bylaws</strong> for <strong>Saskatchewan</strong> land surveyors<br />

Article XI<br />

Pr<strong>of</strong>essional Examinations, Qualifications, Standards & Tests <strong>of</strong> Competency<br />

SECTION 1- Definitions<br />

(1) “Board <strong>of</strong> examiners for land surveyors” (BELS) means any board <strong>of</strong> examiners approved by<br />

<strong>the</strong> council <strong>of</strong> <strong>the</strong> association to administer <strong>the</strong> curriculum, arrange for qualified examiners,<br />

establish a schedule <strong>of</strong> examinations and establish criteria for applicants to receive credits<br />

in a course <strong>of</strong> study in surveying. (Amended 2005/06/03)<br />

(2) “Certificate <strong>of</strong> completion” means a certificate issued by <strong>the</strong> BELS which establishes that<br />

<strong>the</strong> holder has completed his/her academic qualifications to <strong>the</strong> level <strong>of</strong> <strong>the</strong> baccalaureate<br />

degree in surveying engineering, survey science, geomatics engineering or equivalent degree<br />

in surveying. (Amended 2005/06/03)<br />

(3) “Board <strong>of</strong> examiners for <strong>Saskatchewan</strong> land surveyors” means a board <strong>of</strong> examiners<br />

established for <strong>the</strong> examination <strong>of</strong> applicants for a commission as a <strong>Saskatchewan</strong> land<br />

surveyor.<br />

(4) “Pr<strong>of</strong>essional examinations” means examinations set by <strong>the</strong> board <strong>of</strong> examiners for<br />

<strong>Saskatchewan</strong> land surveyors.<br />

(5) “Practical experience” means <strong>the</strong> actual practice, in <strong>Saskatchewan</strong>, as a land surveyor in<br />

training or student land surveyor under <strong>the</strong> supervision <strong>of</strong> a <strong>Saskatchewan</strong> land surveyor<br />

with whom a Form “O” land surveyor in training agreement or Form “L” student land surveyor<br />

agreement has been signed and approved by <strong>the</strong> council. (Amended 2009/06/12)<br />

(6) “Field experience” means practical experience in <strong>the</strong> field, in <strong>the</strong> province <strong>of</strong> <strong>Saskatchewan</strong>,<br />

but does not include work carried out on Canada <strong>Land</strong>s except in <strong>the</strong> case <strong>of</strong> interjurisdictional<br />

SECTION 2 - Board <strong>of</strong> examiners for <strong>Saskatchewan</strong> land surveyors<br />

(1) The pr<strong>of</strong>essional examinations <strong>of</strong> applicants for a commission as a <strong>Saskatchewan</strong> land<br />

surveyor shall be under <strong>the</strong> control <strong>of</strong> <strong>the</strong> board <strong>of</strong> examiners for <strong>Saskatchewan</strong> land<br />

surveyors.<br />

(2) The council <strong>of</strong> <strong>the</strong> association shall appoint <strong>the</strong> board <strong>of</strong> examiners for <strong>Saskatchewan</strong> land<br />

surveyors which board <strong>of</strong> examiners shall be comprised <strong>of</strong> a chairperson and such o<strong>the</strong>r<br />

members as <strong>the</strong> council deems necessary.<br />

(3) The board <strong>of</strong> examiners for <strong>Saskatchewan</strong> land surveyors, after consultation with council,<br />

shall make rules governing <strong>the</strong> conduct <strong>of</strong> <strong>the</strong> pr<strong>of</strong>essional examinations. (Amended 2009/06/12)<br />

(4) The pr<strong>of</strong>essional examinations shall be held at such times and places as may be fixed by <strong>the</strong><br />

board <strong>of</strong> examiners for <strong>Saskatchewan</strong> land surveyors.<br />

(5) The board <strong>of</strong> examiners for <strong>Saskatchewan</strong> land surveyors shall report <strong>the</strong> results <strong>of</strong> <strong>the</strong><br />

pr<strong>of</strong>essional examinations to <strong>the</strong> council <strong>of</strong> <strong>the</strong> association.<br />

SECTION 3 - Pr<strong>of</strong>essional Examinations<br />

(1) The pr<strong>of</strong>essional examinations for land surveyors in training shall be comprised <strong>of</strong> <strong>the</strong><br />

following:<br />

(a) Written examinations;<br />

(i) Provincial statutes;<br />

- One paper on <strong>the</strong> <strong>Land</strong> Surveys Act and Regulations.<br />

- Two papers dealing with <strong>the</strong> o<strong>the</strong>r relevant provincial acts and regulations<br />

(ii) Standards <strong>of</strong> practice and principals <strong>of</strong> evidence;<br />

(iii) Practical surveying;<br />

(b) A practical surveying project which shall have, as a major components, <strong>the</strong> restoration<br />

and re-establishment <strong>of</strong> primary monuments in <strong>the</strong> <strong>Saskatchewan</strong> quadrilateral<br />

township system as well as activity in <strong>the</strong> secondary survey system including <strong>the</strong><br />

subdivision process in <strong>Saskatchewan</strong>.<br />

(c) Oral on practice<br />

(2) The pr<strong>of</strong>essional examination for an applicant who holds a licence as a land surveyor in<br />

ano<strong>the</strong>r Canadian jurisdiction, and who is a member in good standing <strong>of</strong> <strong>the</strong> pr<strong>of</strong>essional<br />

survey association in that jurisdiction, shall be comprised <strong>of</strong> a single written or computerbased<br />

examination, <strong>of</strong> not more than four hours duration, that tests <strong>the</strong> candidate’s knowledge<br />

<strong>of</strong> those aspects <strong>of</strong> pr<strong>of</strong>essional land surveying that are unique to <strong>Saskatchewan</strong> including<br />

matters related to jurisprudence, <strong>the</strong> systems <strong>of</strong> survey and <strong>the</strong> land registration system.<br />

SECTION 4 - Student land surveyors<br />

(1) An applicant for admission as a student land surveyor shall submit appropriate documents<br />

to council from an approved course <strong>of</strong> study in surveying listed in Article XVI, SECTION<br />

2 as evidence that <strong>the</strong> applicant has met <strong>the</strong> requirements <strong>of</strong> subsection 19(2) <strong>of</strong> <strong>the</strong><br />

Act along with one copy <strong>of</strong> Form L, duly executed, and <strong>the</strong> fee prescribed in Article XXI.<br />

(2) The executive director shall automatically cancel <strong>the</strong> registration <strong>of</strong> any student land surveyor<br />

who has not paid <strong>the</strong> annual prescribed fee by January 15 <strong>of</strong> each year following <strong>the</strong> year <strong>of</strong><br />

admission. (Amended 2009/06/12)<br />

(3) Every Student <strong>Land</strong> Surveyor who has obtained a Certificate <strong>of</strong> Completion from <strong>the</strong> BELS<br />

is eligible to apply for membership as a <strong>Saskatchewan</strong> <strong>Land</strong> Surveyor in Training.(Amended<br />

SECTION 5 - <strong>Land</strong> surveyors in training<br />

(1) An applicant for admission as a land surveyor in training shall submit appropriate documents<br />

to council as evidence that <strong>the</strong> applicant has met <strong>the</strong> requirements <strong>of</strong> subsection 19(3) <strong>of</strong> <strong>the</strong><br />

Act and Article XVI <strong>of</strong> <strong>the</strong> <strong>Bylaws</strong>, along with one copy <strong>of</strong> Form O, duly executed, and <strong>the</strong> fee<br />

prescribed in Article XXI.<br />

(2) The executive director shall automatically cancel <strong>the</strong> registration <strong>of</strong> any land surveyor in<br />

training who has not paid <strong>the</strong> annual prescribed fee by January 15 <strong>of</strong> each year following <strong>the</strong><br />

year <strong>of</strong> admission. (Amended 2009/06/12)<br />

(3) Subject to subsection (4), every land surveyor in training is required to serve a minimum<br />

term <strong>of</strong> one year practical experience, at least nine months <strong>of</strong> which must be field<br />

experience in <strong>the</strong> Province <strong>of</strong> <strong>Saskatchewan</strong>, before presenting himself/herself for <strong>the</strong><br />

pr<strong>of</strong>essional examinations to qualify for a commission as a <strong>Saskatchewan</strong> land surveyor.<br />

(4) Notwithstanding <strong>the</strong> requirement <strong>of</strong> Subsection (3), a land surveyor in training who:<br />

(a) has gained field experience in cadastral surveys while serving as a student land surveyor<br />

under <strong>the</strong> direct supervision <strong>of</strong> a <strong>Saskatchewan</strong> land surveyor, may be credited with<br />

one month <strong>of</strong> practical experience for each two months served, to a maximum credit<br />

<strong>of</strong> three months, when reported on Form ‘M’ following admission as a land surveyor in<br />

training;<br />

(b) between <strong>the</strong> 3rd and 4th years <strong>of</strong> a baccalaureate degree program listed in Article<br />

XVI, SECTION 2, has gained field experience in cadastral surveys under <strong>the</strong> direct<br />

supervision <strong>of</strong> a <strong>Saskatchewan</strong> land surveyor, may be credited with up to three months<br />

<strong>of</strong> that experience when reported on Form ‘P’.<br />

(5) Upon completion <strong>of</strong> <strong>the</strong> practical experience requirements each land surveyor in<br />

training shall file with <strong>the</strong> executive director one duly executed copy <strong>of</strong> Form ‘P’.<br />

(6) Upon receipt <strong>of</strong> Forms M or P, <strong>the</strong> executive director shall present same to council at its<br />

first meeting <strong>the</strong>reafter. Upon <strong>the</strong> practical experience <strong>of</strong> <strong>the</strong> land surveyor in training being<br />

completed to <strong>the</strong> satisfaction <strong>of</strong> council, <strong>the</strong> executive director shall advise <strong>the</strong> candidate and<br />

<strong>the</strong> board <strong>of</strong> examiners for <strong>Saskatchewan</strong> land surveyors that he/she is eligible to write <strong>the</strong><br />

pr<strong>of</strong>essional examinations specified in Subsection 3(1). (Replaced by new section 2009/06/12)<br />

(7) A land surveyor in training who has not completed <strong>the</strong> required term <strong>of</strong> practical experience<br />

within five years from <strong>the</strong> date <strong>of</strong> registration in that membership category must apply<br />

to council for permission to maintain membership as a land surveyor in training. The<br />

application must include a plan, that is satisfactory to council, by which <strong>the</strong> required<br />

period <strong>of</strong> practical experience will be completed within <strong>the</strong> following twelve month period.<br />

(8) The executive director shall automatically cancel <strong>the</strong> registration <strong>of</strong> any land surveyor in<br />

training who has not complied with subsection (7). (Amended 2009/06/12)<br />

(9) A person whose registration has been cancelled under subsection (8) may re-apply<br />

for membership as a land surveyor in training under <strong>the</strong> provisions <strong>of</strong> subsection (1).<br />

SECTION 6 - <strong>Land</strong> surveyors licensed in o<strong>the</strong>r Canadian jurisdictions<br />

(1) An applicant for a commission as a <strong>Saskatchewan</strong> land surveyor who holds a current licence<br />

as a land surveyor in any o<strong>the</strong>r Canadian jurisdiction and who is a member in good standing<br />

<strong>of</strong> <strong>the</strong> pr<strong>of</strong>essional survey association in that jurisdiction;<br />

(a) is deemed to have met <strong>the</strong> requirements <strong>of</strong> subsection 19(4) clause (a) <strong>of</strong> <strong>the</strong> “<strong>Land</strong><br />

<strong>Surveyors</strong> and Pr<strong>of</strong>essional <strong>Surveyors</strong> Act” with regard to <strong>the</strong> period <strong>of</strong> actual practice<br />

as a <strong>Saskatchewan</strong> land surveyor in training; and<br />

(b) may apply to write <strong>the</strong> pr<strong>of</strong>essional examination specified in Subsection 3(2).<br />

(2) Applications under this section shall be in writing and accompanied by <strong>the</strong> fee specified in<br />

Article XXXIV Subsection 4(3) clause (b).<br />

SECTION 7<br />

After having successfully completed <strong>the</strong> pr<strong>of</strong>essional examinations and having been approved by<br />

council, a candidate, shall, before being granted a commission, file with <strong>the</strong> executive director <strong>the</strong><br />

following:<br />

(1) Oath <strong>of</strong> <strong>of</strong>fice in Form A<br />

(2) Admission fee as prescribed in Article XXI, and on being admitted, shall be issued a<br />

commission in Form B.<br />

SECTION 8<br />

A land surveyor shall not enter into Form L or Form O agreements until <strong>the</strong> expiration <strong>of</strong> two years<br />

from <strong>the</strong> date <strong>of</strong> his/her commission. (Amended 2009/06/12)<br />

SECTION 9<br />

(1) The annual registration fee for a student land surveyor or a land surveyor in training shall<br />

be as prescribed in Article XXI, payable to <strong>the</strong> executive director not later than January 15<br />

in every year.<br />

(2) Upon receipt <strong>of</strong> <strong>the</strong> registration fee, <strong>the</strong> executive director shall issue to that person a<br />

registration card for <strong>the</strong> year in respect <strong>of</strong> which <strong>the</strong> fee is paid.<br />

Article XII<br />

Code <strong>of</strong> Ethics<br />

It shall be inconsistent with <strong>the</strong> honour, integrity and dignity <strong>of</strong> <strong>the</strong> pr<strong>of</strong>ession for any <strong>Saskatchewan</strong><br />

land surveyor:<br />

SECTION 1<br />

To act for his/her clients in pr<strong>of</strong>essional matters o<strong>the</strong>rwise than as a faithful agent or trustee or to<br />

accept any remuneration o<strong>the</strong>r than his/her stated charges for services rendered his/her clients,<br />

except as provided in Section 2 here<strong>of</strong>.<br />

SECTION 2<br />

To accept any commissions, discounts, allowances, or any indirect pr<strong>of</strong>it in connection with any<br />

work which he/she is engaged to do in <strong>the</strong> practice <strong>of</strong> his/her pr<strong>of</strong>ession which may be entrusted<br />

to him/her, unless and until receipt by him/her <strong>of</strong> such commissions, discounts, allowances or any<br />

indirect pr<strong>of</strong>it has been duly authorized in writing by <strong>the</strong> clients.<br />

SECTION 3<br />

To abstain or neglect to advise and inform at all times his/her client or clients <strong>of</strong> any business<br />

connections, interest or circumstances which may be deemed to influence his/her judgment or affect<br />

<strong>the</strong> character and qualify <strong>of</strong> his/her services to his/her clients.<br />

SECTION 4<br />

To <strong>of</strong>fer or to pay any commission for <strong>the</strong> securing <strong>of</strong> any pr<strong>of</strong>essional work to any person not a<br />

member <strong>of</strong> <strong>the</strong> association or to o<strong>the</strong>rwise improperly solicit pr<strong>of</strong>essional work.<br />

SECTION 5<br />

To quote a price to a client or <strong>the</strong> agent <strong>of</strong> a client in <strong>the</strong> knowledge that such agent intends to<br />

quote a higher price to his/her clients or to enter into any arrangement whereby <strong>the</strong> pr<strong>of</strong>essional<br />

services rendered shall cost <strong>the</strong> owner <strong>of</strong> <strong>the</strong> land more than <strong>the</strong> <strong>Land</strong> Surveyor received for his/her<br />

services.<br />

SECTION 6<br />

To attempt to supplant ano<strong>the</strong>r <strong>Land</strong> Surveyor after definite steps have been taken towards <strong>the</strong><br />

employment <strong>of</strong> such <strong>Land</strong> Surveyor.<br />

SECTION 7<br />

To accept employment by a client while <strong>the</strong> claim for compensation or damages or both, <strong>of</strong> a fellow<br />

<strong>Land</strong> Surveyor previously employed by <strong>the</strong> same client, remains unsatisfied and whose employment<br />

has been terminated, unless such claim for compensation or damages has been referred to arbitration<br />

or issue has been joined by due process <strong>of</strong> law.<br />

SECTION 8<br />

To underbid a fellow <strong>Land</strong> Surveyor who has already been retained by reducing <strong>the</strong> usual charges or<br />

to compete improperly with a fellow <strong>Land</strong> Surveyor after having been informed <strong>of</strong> such fellow <strong>Land</strong><br />

Surveyor’s charges.<br />

SECTION 9<br />

To accept any engagement to review <strong>the</strong> work <strong>of</strong> a fellow <strong>Land</strong> Surveyor for a client without first<br />

notifying such fellow <strong>Land</strong> Surveyor, if at all possible.<br />

SECTION 10<br />

To advertise in an unpr<strong>of</strong>essional manner by making exaggerated or o<strong>the</strong>rwise misleading statements<br />

regarding his/her qualifications or experience.<br />

SECTION 11<br />

To sign and certify any plan or certificate for which he/she is not pr<strong>of</strong>essionally responsible.<br />

SECTION 12<br />

To associate himself/herself with or to allow his/her name to be used in a pr<strong>of</strong>essional way with any<br />

enterprise <strong>of</strong> doubtful character or to do any act or thing unbecoming to <strong>the</strong> dignity or honour <strong>of</strong><br />

<strong>the</strong> pr<strong>of</strong>ession.<br />

SECTION 13<br />

Sections 1 to 12 apply mutatis mutandis to Student <strong>Land</strong> <strong>Surveyors</strong>, <strong>Land</strong> <strong>Surveyors</strong> in Training<br />

and Pr<strong>of</strong>essional <strong>Surveyors</strong>.<br />

Article XIII<br />

Standards <strong>of</strong> Practice<br />

The provisions contained in this article are <strong>the</strong> minimum standards <strong>of</strong> practice as established<br />

pursuant to clause 15(2)(e) <strong>of</strong> The <strong>Land</strong> <strong>Surveyors</strong> and Pr<strong>of</strong>essional <strong>Surveyors</strong> Act and shall be<br />

adhered to by <strong>the</strong> members <strong>of</strong> <strong>the</strong> association in <strong>the</strong> conduct <strong>of</strong> Pr<strong>of</strong>essional <strong>Land</strong> Surveying.<br />

SECTION 1 - Real Property Reports<br />

(1) The <strong>Saskatchewan</strong> land surveyors Real Property Report shall replace those documents<br />

known as “Surveyor’s Certificates” or “Mortgage Certificates.”<br />

(2) Definitions:<br />

(a) “<strong>Saskatchewan</strong> land surveyors’ Real Property Report” means <strong>the</strong> plan and report<br />

prepared in respect <strong>of</strong> <strong>the</strong> survey performed for <strong>the</strong> purpose <strong>of</strong> certifying <strong>the</strong> location<br />

<strong>of</strong> all visible permanent structures relative to <strong>the</strong> boundaries <strong>of</strong> <strong>the</strong> parcel <strong>of</strong> land and<br />

for <strong>the</strong> purpose <strong>of</strong> this Standard shall be referred to as a Real Property Report.<br />

(b) “structure” means any permanent building constructed or placed in, on, or over<br />

land.<br />

(c) “parcel” means a unit <strong>of</strong> land described in a Real Property Report.<br />

(d) “Surveyor” means a <strong>Saskatchewan</strong> land surveyor.<br />

(3) A surveyor performing a survey for <strong>the</strong> purpose <strong>of</strong> identifying, locating and illustrating<br />

structures, toge<strong>the</strong>r with <strong>the</strong> extent <strong>of</strong> <strong>the</strong> parcel shall prepare a Real Property Report in<br />

accordance with this standard.<br />

(4) When conducting a survey for a Real Property Report, a surveyor shall:<br />

(a) perform sufficient research to identify <strong>the</strong> parcel boundaries, including obtaining a<br />

copy <strong>of</strong> <strong>the</strong> current Title which shall be retained in his/her file; (Amended June 3, 2005)<br />

(b) research all easements and rights <strong>of</strong> way that relate to <strong>the</strong> title;<br />

(c) locate and confirm sufficient monumentation to determine <strong>the</strong> parcel boundaries;<br />

(d) find or re-establish monuments at one or more corners <strong>of</strong> <strong>the</strong> parcel in accordance<br />

with <strong>the</strong> <strong>Land</strong> Surveys Act and show <strong>the</strong> location <strong>of</strong> <strong>the</strong> found or re-established corner<br />

on <strong>the</strong> plan; (Amended June 3, 2005)<br />

(e) locate <strong>the</strong> main external walls <strong>of</strong> all structures on <strong>the</strong> parcel relative to <strong>the</strong> boundaries<br />

<strong>the</strong>re<strong>of</strong>, whe<strong>the</strong>r entirely or partially within <strong>the</strong> parcel, toge<strong>the</strong>r with any visible<br />

portions <strong>of</strong> <strong>the</strong> structure which may extend beyond <strong>the</strong> parcel boundaries.<br />

(5) A Real Property Report shall consist <strong>of</strong> a plan and a report.<br />

(a) When preparing a plan for a Real Property Report, a surveyor shall:<br />

(i) indicate that <strong>the</strong> plan is part <strong>of</strong> a Real Property Report and that it is prepared in<br />

accordance with Article No. XIII <strong>of</strong> <strong>the</strong> <strong>Bylaws</strong>;<br />

(ii) indicate <strong>the</strong> Surface Parcel Number, Reference <strong>Land</strong> Description, municipality and<br />

where available, <strong>the</strong> municipal address <strong>of</strong> <strong>the</strong> parcel; (Amended June 3, 2005)<br />

(iii) show land descriptions for adjoining lands; (Amended June 3, 2005)<br />

(iv) illustrate all structures located pursuant to subsection 1(4) clause (e) with <strong>the</strong>ir<br />

dimensions and minimum distances from <strong>the</strong> boundaries <strong>of</strong> <strong>the</strong> subject parcel;<br />

(v) indicate <strong>the</strong> stage <strong>of</strong> building construction and number <strong>of</strong> stories; (Amended June 3, 2005)<br />

(vi) identify encroachments <strong>of</strong> above ground structures and <strong>the</strong> nature <strong>of</strong> such<br />

encroachments;<br />

(vii) indicate all linear dimensions <strong>of</strong> <strong>the</strong> parcel;<br />

(viii) illustrate, identify and dimension all registered interests based on easements which<br />

affect <strong>the</strong> parcel; (Amended June 3, 2005)<br />

(ix) indicate <strong>the</strong> date <strong>of</strong> survey;<br />

(x) certify <strong>the</strong> plan by date, signature and embossed seal; (Amended June 3, 2005)<br />

(xi) show <strong>the</strong> copyright symbol © and year;<br />

(xii) draw <strong>the</strong> plan to scale where reasonable;<br />

(xiii) show a North arrow;<br />

(xiv) state <strong>the</strong> units <strong>of</strong> measurement.<br />

(b) When preparing a report for a Real Property Report, a surveyor shall:<br />

(i) indicate <strong>the</strong> effective date <strong>of</strong> <strong>the</strong> title search, <strong>the</strong> registered owner, <strong>the</strong> Title Number<br />

and description <strong>of</strong> any easements affecting <strong>the</strong> subject parcel; (Amended June 3, 2005)<br />

(ii) make reference to all above ground structures that encroach onto <strong>the</strong> parcel as<br />

well as any portion <strong>of</strong> <strong>the</strong> above ground structures that are not within <strong>the</strong> parcel<br />

boundaries;<br />

(iii) refer to <strong>the</strong> plan as being part <strong>of</strong> <strong>the</strong> report;<br />

(iv) number all pages in <strong>the</strong> report;<br />

(v) date, sign and seal <strong>the</strong> report.<br />

(6) All Real Property Reports or topographic plans issued by a <strong>Saskatchewan</strong> land surveyor<br />

shall be up-to-date and cannot be considered up-to-date unless:<br />

(a) a field inspection has been done and it has been determined that it reflects current<br />

conditions and;<br />

(b) a statement has been added to <strong>the</strong> Real Property Report or plan stating that a site<br />

inspection has been made on <strong>the</strong> date <strong>of</strong> issuance and that <strong>the</strong> Real Property Report<br />

or plan reflects current conditions; and<br />

(c) <strong>the</strong> current Title information as required in <strong>the</strong> Standards for Real Property Reports<br />

has been indicated on <strong>the</strong> Real Property Report. (Amended June 3, 2005)<br />

SECTION 2 - Recording <strong>of</strong> Real Property Reports<br />

All <strong>Saskatchewan</strong> land surveyors shall submit to <strong>the</strong> executive director a completed Form ‘S’ showing<br />

all Real Property Reports performed in <strong>the</strong> province <strong>of</strong> <strong>Saskatchewan</strong>. Form ‘S’ shall be submitted,<br />

in digital form where practicable, within six months <strong>of</strong> Real Property Reports having been completed.<br />

SECTION 3 - Primary Surveys<br />

(1) Where a Section or Quarter Section corner is re-established or restored in accordance with<br />

<strong>the</strong> provisions <strong>of</strong> The <strong>Land</strong> Surveys Act (2000) <strong>the</strong> <strong>Land</strong> Surveyor shall within ninety days<br />

<strong>of</strong> doing so, report <strong>the</strong> facts in connection with such re-establishment or restoration, on an<br />

acceptable format, to <strong>the</strong> Controller <strong>of</strong> Surveys. However, it shall be deemed that a report<br />

has been submitted where <strong>the</strong> particulars <strong>of</strong> <strong>the</strong> re-establishment or restoration are clearly<br />

shown on a Plan <strong>of</strong> Survey submitted for examination under <strong>the</strong> <strong>Land</strong> Surveys Act (2000).<br />

(Amended June 3, 2005 and May 25, 2007)<br />

(2) Where, upon carrying out a survey, it is necessary to establish a monument at a corner <strong>of</strong> a<br />

Quarter Section or Legal Subdivision not previously monumented, <strong>the</strong> Surveyor shall within<br />

ninety days <strong>of</strong> doing so, report <strong>the</strong> facts in connection with such establishment, on an<br />

acceptable format, to <strong>the</strong> Controller <strong>of</strong> Surveys. However, it shall be deemed that a report<br />

has been submitted where <strong>the</strong> particulars <strong>of</strong> <strong>the</strong> establishment, are clearly shown on a Plan<br />

submitted for examination under <strong>the</strong> <strong>Land</strong> Surveys Act (2000). (Amended June 3, 2005)<br />

SECTION 4 - Closures<br />

It shall be good practice to obtain a minimum closure in raw field data <strong>of</strong> one part in five<br />

thousand.<br />

SECTION 5 - Confirmation <strong>of</strong> Monuments<br />

It shall be good practice to confirm that any monuments used from any previous surveys are in <strong>the</strong>ir<br />

original undisturbed location prior to carrying out any new surveys conducted under <strong>the</strong> authority<br />

<strong>of</strong> <strong>the</strong> <strong>Land</strong> Surveys Act. Where this is not evident on a plan <strong>of</strong> survey, a complete report outlining<br />

<strong>the</strong> methods used to confirm <strong>the</strong> locations <strong>of</strong> <strong>the</strong>se monuments shall accompany plans or o<strong>the</strong>r<br />

documentation submitted to <strong>the</strong> Chief Surveyor’s Office or Central Survey and Mapping Agency<br />

<strong>Saskatchewan</strong> <strong>Land</strong> <strong>Surveyors</strong> <strong>Association</strong> - <strong>Bylaws</strong> - September 19, 2011 1


SECTION 6 - Wellsites and Related Facilities<br />

These standards are in addition to <strong>the</strong> information required under <strong>the</strong> Oil and Gas Conservation<br />

Regulations, 1985 (and amendments <strong>the</strong>reto).<br />

(1) A <strong>Saskatchewan</strong> land surveyor, performing a survey for <strong>the</strong> location <strong>of</strong> wellsites and related<br />

facilities in surveyed territory, shall find, restore or re-establish sufficient monuments to<br />

define at least one boundary <strong>of</strong> <strong>the</strong> 1/4 section affected and shall measure <strong>the</strong> relationship <strong>of</strong><br />

<strong>the</strong> wellsite and related facilities to <strong>the</strong> said boundary.<br />

(a) Where it is necessary to restore or re-establish a survey monument, it shall be restored<br />

or re-established in accordance with <strong>the</strong> provisions <strong>of</strong> <strong>the</strong> <strong>Land</strong> Surveys Act, and in<br />

accordance with Section 3, Article XIII <strong>of</strong> <strong>the</strong> <strong>Bylaws</strong>.<br />

(b) In all cases where evidence <strong>of</strong> an original section or quarter section corner is found,<br />

a standard iron post shall be established and a complete report shall be made to <strong>the</strong><br />

Controller <strong>of</strong> Surveys in accordance with Section 3, Article XIII <strong>of</strong> <strong>the</strong> <strong>Bylaws</strong>.<br />

(2) Where <strong>the</strong> boundaries <strong>of</strong> a well site or related facility terminate on, are coincident with or<br />

purport to define a property boundary, <strong>the</strong> said boundary shall be established in accordance<br />

with <strong>the</strong> provisions <strong>of</strong> <strong>the</strong> The <strong>Land</strong> Surveys Act.<br />

(3) The type <strong>of</strong> monument placed on <strong>the</strong> boundaries <strong>of</strong> <strong>the</strong> well-site and related facilities shall<br />

be shown on <strong>the</strong> plan.<br />

(4) Elevations shall be determined from a minimum <strong>of</strong> two bench marks, one <strong>of</strong> which is<br />

recommended to be a bench mark with a published geodetic elevation, which is <strong>of</strong> public<br />

record. Fourth order accuracy (±120 mm x pdistance (km) ) shall be achieved within <strong>the</strong><br />

surveyor’s own work. The datum shall be geodetic and also noted on <strong>the</strong> plan.<br />

(5) (a) The name <strong>of</strong> <strong>the</strong> certifying <strong>Land</strong> Surveyor shall be printed legibly on <strong>the</strong> plan.<br />

(b) The seal <strong>of</strong> <strong>the</strong> certifying <strong>Land</strong> Surveyor shall be affixed to <strong>the</strong> plan.<br />

(6) Closures shall be in accordance with Section 4, Article XIII <strong>of</strong> <strong>the</strong> <strong>Bylaws</strong>.<br />

SECTION 7 – Correction <strong>of</strong> Monuments<br />

Where a monument which was originally intended to be on a previously surveyed line is found to<br />

be <strong>of</strong>f line, it shall be good practice to correct <strong>the</strong> position <strong>of</strong> <strong>the</strong> monument. Where correction <strong>of</strong><br />

<strong>the</strong> monument is not practicable, <strong>the</strong> position <strong>of</strong> <strong>the</strong> monument shall be shown on a Plan <strong>of</strong> Survey.<br />

SECTION 8 – Closure <strong>of</strong> Surveys <strong>of</strong> Rights <strong>of</strong> Way<br />

On surveys <strong>of</strong> rights <strong>of</strong> way which terminate within <strong>the</strong> interior <strong>of</strong> a section, it shall be good practice<br />

to show angular and linear measurements from <strong>the</strong> terminal monument to <strong>the</strong> nearest found primary<br />

monument. (Passed 2005/06/02)<br />

SECTION 9 – Intersecting Section Lines and Surveyed Quarter Section Lines<br />

When surveying boundaries that intersect surveyed section or quarter section lines, it shall be good<br />

practice to use <strong>the</strong> nearest section or quarter section corners on each side <strong>of</strong> <strong>the</strong> point <strong>of</strong> intersection.<br />

If <strong>the</strong> monuments at <strong>the</strong>se corners are lost, <strong>the</strong>y shall be re-established in accordance with subsection<br />

29 (1.1) <strong>of</strong> The <strong>Land</strong> Surveys Act, 2000. Where this is not practicable an intersection can be made<br />

with a secondary monument if <strong>the</strong> accuracy <strong>of</strong> its position has been verified and a full report shall<br />

be submitted with <strong>the</strong> Plan. (Passed 2005/06/02)<br />

SECTION 1 - Life Membership<br />

Article XIV<br />

Categories <strong>of</strong> Membership<br />

(1) Subject to subsections (2) and (3) <strong>the</strong> council may confer life membership in <strong>the</strong> association<br />

upon any person who has been engaged in actual practice as a land surveyor in <strong>Saskatchewan</strong><br />

for a period <strong>of</strong> thirty years or more, and who has during that period been duly authorized to<br />

practice as a land surveyor.<br />

(2) Candidates for Life Membership shall be nominated by five licensed <strong>Saskatchewan</strong> land<br />

surveyors. The nomination must be submitted in writing and approved as to qualifications<br />

by <strong>the</strong> majority <strong>of</strong> council. Once council has determined that <strong>the</strong> candidate has met <strong>the</strong><br />

qualifications <strong>the</strong>y shall seek <strong>the</strong> candidates approval <strong>of</strong> <strong>the</strong> nomination. When consent is<br />

obtained council shall publish <strong>the</strong> nomination report in <strong>the</strong> next annual Committee Reports.<br />

The nominee must <strong>the</strong>n be elected by secret ballot by a majority <strong>of</strong> <strong>the</strong> licensed members<br />

present at an Annual Meeting.<br />

(3) The following criteria shall be used in <strong>the</strong> determination <strong>of</strong> qualifications <strong>of</strong> a nominee for<br />

Life Membership.<br />

(a) The member must have rendered signal service to <strong>the</strong> association and to <strong>the</strong> survey<br />

pr<strong>of</strong>ession.<br />

(b) Signal service shall include at least one term on <strong>the</strong> council <strong>of</strong> <strong>the</strong> association in combination<br />

with three or more <strong>of</strong> <strong>the</strong> following:<br />

(i) Active service <strong>of</strong> not less than twelve years on one or more <strong>of</strong> <strong>the</strong> Committees <strong>of</strong> <strong>the</strong><br />

association and/or related organizations.<br />

(ii) Service as President <strong>of</strong> <strong>the</strong> association for one or more terms.<br />

(iii) Significant contribution to <strong>the</strong> association through research and publication <strong>of</strong><br />

papers pertaining to land surveying and/or related disciplines.<br />

(iv) Contributions to <strong>the</strong> enhancement <strong>of</strong> <strong>the</strong> pr<strong>of</strong>essional standing <strong>of</strong> <strong>the</strong> association<br />

through good public relations with o<strong>the</strong>r pr<strong>of</strong>essional organizations and <strong>the</strong> public<br />

at large.<br />

(v) Leadership in setting new directions in land surveying or related disciplines.<br />

(vi) Participation in <strong>the</strong> development <strong>of</strong> new techniques or equipment in surveying or<br />

mapping.<br />

(4) All living Life Members appointed prior to December 31, 1998 shall continue to be life<br />

members.<br />

(5) Life Members shall be exempted from payment <strong>of</strong> <strong>the</strong> annual membership fee to <strong>the</strong><br />

association.<br />

SECTION 2 - Honourary Membership<br />

The following criteria is to be used to determine eligibility for Honourary Membership:<br />

(1) The council may, with <strong>the</strong> approval <strong>of</strong> two thirds <strong>of</strong> those licenced members who vote at an<br />

annual or special meeting, confer honourary membership in <strong>the</strong> association upon any person<br />

who, through <strong>the</strong>ir own initiative and leadership, has rendered eminent service relating to<br />

<strong>the</strong> pr<strong>of</strong>ession <strong>of</strong> surveying.<br />

(2) There shall at no time be more than three living honourary members <strong>of</strong> <strong>the</strong> association.<br />

(3) An honourary member is not required to pay an annual fee or any levy payable to <strong>the</strong><br />

association.<br />

(4) Unless <strong>the</strong> council o<strong>the</strong>rwise directs, an honourary member is entitled to receive all<br />

publications, reports, and notices that are generally available to <strong>Saskatchewan</strong> land<br />

surveyors.<br />

(5) An honourary member may attend an annual general meeting or special meeting <strong>of</strong> <strong>the</strong><br />

association and is entitled to discuss any motion or resolution before <strong>the</strong> meeting, but<br />

no honourary member may propose a motion or resolution or vote at a meeting <strong>of</strong> <strong>the</strong><br />

association, unless o<strong>the</strong>rwise qualified to practice under <strong>the</strong> provisions <strong>of</strong> this Act.<br />

(6) Every honourary member shall have all <strong>the</strong> privileges <strong>of</strong> <strong>the</strong> association except <strong>the</strong> right to<br />

practice and to vote unless o<strong>the</strong>rwise qualified to practice under <strong>the</strong> provisions <strong>of</strong> <strong>the</strong> Act.<br />

(7) An Honourary Membership may be revoked by <strong>the</strong> council for conduct considered by <strong>the</strong><br />

council to be detrimental to <strong>the</strong> association.<br />

(8) All living Honourary Members appointed prior to December 31, 1998 shall continue to be<br />

Honourary Members.<br />

SECTION 3 - Retired Membership<br />

Any <strong>Saskatchewan</strong> land surveyor who is not in arrears <strong>of</strong> fees shall, prior to January 15th in <strong>the</strong> year<br />

in which he/she wishes to retire, file a Certificate <strong>of</strong> Retirement in Form R with <strong>the</strong> executive director<br />

and upon annual payment <strong>of</strong> <strong>the</strong> retirement fee, as prescribed in Article XXI shall be registered as a<br />

retired member and entitled to use <strong>the</strong> abbreviation S.L.S. (Retired) or S.L.S. (Ret.)<br />

SECTION 1<br />

Article XV<br />

Re-entry Education<br />

A <strong>Saskatchewan</strong> land surveyor who has not held an annual license to practice for a period <strong>of</strong> two<br />

or more consecutive years and who wishes to obtain an annual license shall satisfy <strong>the</strong> following<br />

conditions in addition to <strong>the</strong> requirements o<strong>the</strong>rwise specified in <strong>the</strong> Act and <strong>the</strong> <strong>Bylaws</strong>:<br />

(1) The <strong>Saskatchewan</strong> land surveyor shall submit to council a resume <strong>of</strong> his/her activities<br />

during <strong>the</strong> period in which an annual license was not held, toge<strong>the</strong>r with <strong>the</strong> investigation fee<br />

prescribed in Article XXI.<br />

(2) The council shall review <strong>the</strong> resume and determine which, if any, educational programs<br />

or courses, as sponsored or approved by <strong>the</strong> Education Committee, are required to be<br />

successfully completed prior to <strong>the</strong> issuance <strong>of</strong> an annual license. The council may also<br />

require that <strong>the</strong> <strong>Saskatchewan</strong> land surveyor submit to such examinations, as set by <strong>the</strong><br />

Board <strong>of</strong> Examiners for <strong>Saskatchewan</strong> land surveyors as council deems fit.<br />

(3) The council shall notify <strong>the</strong> member in writing <strong>of</strong> its requirements within sixty days <strong>of</strong> <strong>the</strong><br />

application for an annual license by <strong>the</strong> <strong>Saskatchewan</strong> land surveyor.<br />

For <strong>the</strong> purposes <strong>of</strong> subsection 19(2) clause (b) <strong>of</strong> <strong>the</strong> Act, <strong>the</strong> following courses <strong>of</strong> study in surveying<br />

are approved:<br />

(i) Geomatics Engineering degree program, University <strong>of</strong> Calgary;<br />

(ii) Geodesy and Geomatics Engineering degree program, University <strong>of</strong> New Brunswick;<br />

(iii) Geomatics degree program, University <strong>of</strong> Laval;<br />

(iv) Certificate <strong>of</strong> completion from <strong>the</strong> BELS. (Amended June 3, 2005)<br />

SECTION 1 - Mandatory Continuing Education<br />

(1) Definitions<br />

Article XVII<br />

Continuing Education<br />

(a) Continuing Education Period (C.E.P.) means a period consisting <strong>of</strong> two consecutive<br />

calendar years beginning January 1st following <strong>the</strong> Proclamation <strong>of</strong> The <strong>Land</strong> <strong>Surveyors</strong><br />

and Pr<strong>of</strong>essional <strong>Surveyors</strong> Act and continuing every two calendar years <strong>the</strong>reafter.<br />

The first C.E.P. will begin January 1, 1998 and will end December 31, 1999.<br />

(b) Pr<strong>of</strong>essional Development Credits (P.D.C.) means credits assigned by <strong>the</strong> council <strong>of</strong> <strong>the</strong><br />

association to <strong>the</strong> various forms <strong>of</strong> continuing education activities.<br />

(2) Requirements<br />

Subject to subsections (1) to (7) every <strong>Saskatchewan</strong> land surveyor shall acquire thirty<br />

Pr<strong>of</strong>essional Development Credits in <strong>the</strong> previous Continuing Education Period. Excess<br />

credits obtained during a Continuing Education Period may be carried forward to <strong>the</strong> next<br />

period to a maximum <strong>of</strong> twenty-five percent <strong>of</strong> <strong>the</strong> total required credits for one continuing<br />

education period.<br />

(3) Determination <strong>of</strong> Pr<strong>of</strong>essional Development Credits<br />

The council <strong>of</strong> <strong>the</strong> association shall publish and distribute annually, <strong>the</strong> point values <strong>of</strong><br />

association sponsored events, seminars and meetings.<br />

(4) Records<br />

Each <strong>Saskatchewan</strong> land surveyor is responsible for <strong>the</strong> design <strong>of</strong> <strong>the</strong>ir own Continuing<br />

Education Activities. The maintenance <strong>of</strong> records to be used to support <strong>the</strong> P.D.C.’s claimed<br />

is <strong>the</strong> responsibility <strong>of</strong> <strong>the</strong> individual. Records required may include, but are not limited to<br />

<strong>the</strong> following:<br />

(a) A log showing:<br />

(i) type <strong>of</strong> activity claimed<br />

(ii) sponsoring organization<br />

(iii) dates<br />

(iv) location<br />

(v) duration<br />

(vi) instructor’s or speaker’s names and qualifications<br />

(vii) credits earned<br />

(b) Attendance verification records in <strong>the</strong> form <strong>of</strong> completion certificates or documents<br />

supporting evidence <strong>of</strong> attendance.<br />

A report, in <strong>the</strong> prescribed form, <strong>of</strong> accumulated point shall be forwarded to <strong>the</strong> association<br />

<strong>of</strong>fice for filing by <strong>the</strong> executive director at <strong>the</strong> end <strong>of</strong> <strong>the</strong> current CEP. Records must be<br />

maintained for a period <strong>of</strong> six years and copies may be requested by <strong>the</strong> association for<br />

verification purposes. (Amended 2004/05/15)<br />

(5) Exemptions<br />

A <strong>Saskatchewan</strong> land surveyor may be exempt from <strong>the</strong>se Mandatory Continuing Education<br />

requirements for one <strong>of</strong> <strong>the</strong> following reasons:<br />

(a) A newly commissioned <strong>Saskatchewan</strong> land surveyor shall be exempt for <strong>the</strong> C.E.P. in<br />

which <strong>the</strong> initial issuance <strong>of</strong> a license to practice as a <strong>Saskatchewan</strong> land surveyor is<br />

made and all <strong>of</strong> <strong>the</strong> next C.E.P.<br />

(b) A <strong>Saskatchewan</strong> land surveyor experiencing physical disability, illness or o<strong>the</strong>r<br />

extenuating circumstances as reviewed by <strong>the</strong> Education Committee may be exempt.<br />

Supporting documentation may be requested by <strong>the</strong> Committee.<br />

(c) Retired <strong>Saskatchewan</strong> land surveyors shall be exempt. In <strong>the</strong> event such a member<br />

wishes to resume active practice, thirty [30] P.D.C.’s must have been acquired in <strong>the</strong><br />

two year period immediately prior to <strong>the</strong> date on which reinstatement is requested.<br />

Depending on <strong>the</strong> date <strong>of</strong> reinstatement, <strong>the</strong>re may be insufficient time to acquire thirty<br />

[30] P.D.C.’s for <strong>the</strong> next C.E.P. in which case council will determine <strong>the</strong> requirements<br />

for <strong>the</strong> member to acquire a license to practice in <strong>the</strong> next C.E.P.. The executive<br />

director shall audit <strong>the</strong> claimed P.D.C.’s prior to <strong>the</strong> issuance <strong>of</strong> <strong>the</strong> said license.<br />

(d) Life members and honourary members shall be exempt.<br />

(6) Audit<br />

The council <strong>of</strong> <strong>the</strong> association shall conduct an audit <strong>of</strong> at least ten percent<br />

<strong>of</strong> <strong>the</strong> <strong>Saskatchewan</strong> land surveyors claiming P.D.C.’s for each C.E.P. Audits shall be done at<br />

random between <strong>the</strong> 15th and 30th <strong>of</strong> <strong>the</strong> month following <strong>the</strong> end <strong>of</strong> <strong>the</strong> C.E.P.<br />

(7) List <strong>of</strong> Pr<strong>of</strong>essional Development Credits<br />

The council <strong>of</strong> <strong>the</strong> association shall establish a list <strong>of</strong> activities categorized as Part ‘A’ and Part<br />

‘B’. All forms <strong>of</strong> educational achievements must be similar to one or more <strong>of</strong> <strong>the</strong> activities<br />

listed. Thirty percent <strong>of</strong> claimed P.D.C.’s must be from Part A. Remaining P.D.C.’s may be<br />

acquired from activities listed in Part B.<br />

SECTION 1<br />

Article XVIII<br />

Reinstatement<br />

A person who has been expelled as a <strong>Saskatchewan</strong> land surveyor and who desires to be reinstated,<br />

shall apply to council for reinstatement and satisfy <strong>the</strong> following conditions in addition to <strong>the</strong><br />

requirements o<strong>the</strong>rwise specified in <strong>the</strong> Act and <strong>the</strong> <strong>Bylaws</strong>:<br />

(1) The applicant shall submit a complete resume to council detailing his/her activities in <strong>the</strong><br />

period since <strong>the</strong> expulsion order.<br />

(2) The applicant shall submit a report to council giving <strong>the</strong> reasons why he/she should be<br />

considered for reinstatement.<br />

(3) The applicant shall pay <strong>the</strong> investigation fee as prescribed in Article XXI.<br />

(4) The council may require that <strong>the</strong> applicant submit to <strong>the</strong> requirements <strong>of</strong> Article XV <strong>of</strong> <strong>the</strong><br />

<strong>Bylaws</strong> or may set any o<strong>the</strong>r terms and conditions that <strong>the</strong> council considers appropriate.<br />

SECTION 1<br />

Article XIX<br />

Maintenance <strong>of</strong> Membership<br />

A <strong>Saskatchewan</strong> land surveyor shall not practice pr<strong>of</strong>essional surveying unless he/she is license as<br />

a Pr<strong>of</strong>essional Surveyor.<br />

SECTION 1<br />

Article XX<br />

Liability Protection<br />

All <strong>Saskatchewan</strong> land surveyors practicing pr<strong>of</strong>essional land surveying on a fee for service basis<br />

shall be covered by Pr<strong>of</strong>essional Liability Insurance.<br />

SECTION 2<br />

The minimum liability shall be $100,000.00 per loss and $100,000.00 per policy period.<br />

SECTION 3<br />

SECTION 4<br />

All Retired members who have practiced on a fee for service basis shall establish to <strong>the</strong> council’s<br />

satisfaction that he/she has provided for adequate insurance coverage.<br />

SECTION 1<br />

Article XXI<br />

Registration, Licensing and o<strong>the</strong>r Fees<br />

(1) The annual license fee for a <strong>Saskatchewan</strong> land surveyor shall be $1,550.00 plus applicable<br />

taxes payable to <strong>the</strong> association not later than January 15th in every year. (Amended 2006/05/26)<br />

(2) Where a <strong>Saskatchewan</strong> land surveyor obtains an annual license for both pr<strong>of</strong>essional land<br />

surveying and pr<strong>of</strong>essional surveying, <strong>the</strong> combined annual license fee shall be $1,550.00<br />

plus applicable taxes payable to <strong>the</strong> association not later than January 15th in every year.<br />

SECTION 2<br />

(Amended 2006/05/26)<br />

In addition to <strong>the</strong> annual license fee, <strong>the</strong>re shall be a fee <strong>of</strong> ten percent <strong>of</strong> <strong>the</strong> annual license fee for<br />

licensing after January 15th in any year.<br />

SECTION 3<br />

The annual fee for a retired member is ten percent <strong>of</strong> <strong>the</strong> current annual license fee.<br />

SECTION 4<br />

The application <strong>of</strong> a <strong>Saskatchewan</strong> land surveyor for licensing made subsequent to <strong>the</strong> filing <strong>of</strong> a<br />

certificate <strong>of</strong> retirement in <strong>the</strong> same year shall be treated as a late license for that year.<br />

SECTION 5<br />

Every <strong>Saskatchewan</strong> land surveyor who was not licensed in <strong>the</strong> previous two consecutive years is<br />

required to submit to an investigation as to his/her qualifications to resume <strong>the</strong> practice <strong>of</strong> pr<strong>of</strong>essional<br />

land surveying in <strong>Saskatchewan</strong> and shall pay an investigation fee as prescribed in Section 6, in<br />

addition to <strong>the</strong> current fee and all arrears before receiving an annual license to resume <strong>the</strong> practice<br />

<strong>of</strong> pr<strong>of</strong>essional land surveying in <strong>Saskatchewan</strong>. Arrears are all unpaid past active fees and any<br />

o<strong>the</strong>r monies owing to <strong>the</strong> association, less payments received for retirement membership.<br />

SECTION 6<br />

The following fees shall apply:<br />

(1) Application fee for a commission is equal to <strong>the</strong> annual fee payable under subsection<br />

1(1) prorated to <strong>the</strong> number <strong>of</strong> whole months remaining in <strong>the</strong> calendar year.<br />

SECTION 7 (Added 2006/05/26)<br />

(1) In addition to <strong>the</strong> annual license fee, each <strong>Saskatchewan</strong> land surveyor shall pay:<br />

i. any special levy in <strong>the</strong> amount set by a resolution passed by two thirds <strong>of</strong> <strong>the</strong> licensed<br />

members who are <strong>Saskatchewan</strong> land surveyors and who vote at an Annual or Special<br />

Meeting;<br />

ii. any fees related to <strong>the</strong> number <strong>of</strong> specific survey-related activities performed or<br />

authorized by a <strong>Saskatchewan</strong> land surveyor as established by a resolution passed by<br />

two thirds <strong>of</strong> <strong>the</strong> licensed members who are <strong>Saskatchewan</strong> land surveyors and who<br />

vote at an Annual or Special Meeting.<br />

(2) The amount <strong>of</strong> <strong>the</strong> fees, and <strong>the</strong> specific survey-related activities on which those fees are<br />

to be paid, as established under subsection 1 clause (ii), shall be subject to review and<br />

continuation or amendment by a resolution passed by two thirds <strong>of</strong> <strong>the</strong> licensed members<br />

who are <strong>Saskatchewan</strong> land surveyors and who vote at each Annual Meeting.<br />

Article XXII<br />

Supervision<br />

SECTION 1<br />

A licensed <strong>Saskatchewan</strong> land surveyor shall not have more than an aggregate total <strong>of</strong> two Student<br />

<strong>Land</strong> <strong>Surveyors</strong> or <strong>Land</strong> <strong>Surveyors</strong> in Training under his/her supervision at any one time.<br />

Article XXIII<br />

Suggested Schedule <strong>of</strong> Fees<br />

SECTION 1<br />

The council may publish a Suggested Schedule <strong>of</strong> Fees for Pr<strong>of</strong>essional <strong>Land</strong> Surveying Services based<br />

upon cost analysis studies in order to ensure fair charges to <strong>the</strong> public, reasonable compensation<br />

to members and overall maintenance <strong>of</strong> pr<strong>of</strong>essional standards. No member shall make any<br />

fraudulent or exorbitant charge for his/her services or make any charge for services which are apt to<br />

bring <strong>the</strong> pr<strong>of</strong>ession into disrepute.<br />

(1) For <strong>the</strong> purposes <strong>of</strong> this Article:<br />

Article XXIV<br />

Survey Offices<br />

(i) “survey <strong>of</strong>fice” means a place <strong>of</strong> business, open to <strong>the</strong> public, where any <strong>of</strong> <strong>the</strong><br />

activities included in <strong>the</strong> practice <strong>of</strong> pr<strong>of</strong>essional land surveying, as defined in The<br />

<strong>Land</strong> <strong>Surveyors</strong> and Pr<strong>of</strong>essional <strong>Surveyors</strong> Act, are carried on;<br />

(ii) “consultation <strong>of</strong>fice”;<br />

(A) means an <strong>of</strong>fice maintained for <strong>the</strong> sole purpose <strong>of</strong> client communication and open to<br />

<strong>the</strong> public for specified hours during which a licensed <strong>Saskatchewan</strong> land surveyor<br />

is in attendance;<br />

(B) must be advertised as a consultation <strong>of</strong>fice and <strong>the</strong> hours <strong>of</strong> operation must be<br />

listed;<br />

(C) must be registered with <strong>the</strong> executive director as a consultation <strong>of</strong>fice;<br />

(D) is not a survey <strong>of</strong>fice;<br />

(iii) “normally present” means practising in <strong>the</strong> <strong>of</strong>fice or in <strong>the</strong> field during regularly<br />

scheduled hours and includes time absent due to sickness, vacation leave or<br />

pr<strong>of</strong>essional development.<br />

(2) Every Survey Office shall be operated and supervised by a licensed <strong>Saskatchewan</strong> land<br />

surveyor.<br />

(3) A <strong>Saskatchewan</strong> land surveyor shall not operate or supervise more than one survey <strong>of</strong>fice.<br />

(4) In <strong>the</strong> case <strong>of</strong> a survey <strong>of</strong>fice at which a licensed <strong>Saskatchewan</strong> land surveyor is not normally<br />

present at all times, it shall not be advertised as a survey <strong>of</strong>fice unless:<br />

(i) <strong>the</strong> hours during which <strong>the</strong> <strong>Saskatchewan</strong> land surveyor is normally present are<br />

specified in <strong>the</strong> advertisement;<br />

(ii) <strong>the</strong>re is no technical staff present in <strong>the</strong> <strong>of</strong>fice during <strong>the</strong> hours when <strong>the</strong> <strong>Saskatchewan</strong><br />

land surveyor is not practising;<br />

(iii) <strong>the</strong> survey <strong>of</strong>fice is registered as a part-time <strong>of</strong>fice with <strong>the</strong> executive director.<br />

PART III<br />

Regulatory <strong>Bylaws</strong> for <strong>Saskatchewan</strong> land surveyors and Pr<strong>of</strong>essional<br />

<strong>Surveyors</strong><br />

Article XXV<br />

Qualifications & Tests <strong>of</strong> Competency for Pr<strong>of</strong>essional <strong>Surveyors</strong><br />

SECTION 1 - Definitions<br />

(1) Admissions Board for Pr<strong>of</strong>essional <strong>Surveyors</strong> (ABPS) means a board <strong>of</strong> examiners appointed<br />

by <strong>the</strong> council <strong>of</strong> <strong>the</strong> <strong>Saskatchewan</strong> <strong>Land</strong> <strong>Surveyors</strong> <strong>Association</strong> whose purpose shall be<br />

to review <strong>the</strong> credentials <strong>of</strong> all applicants, arrange for qualified examiners and establish<br />

examinations.<br />

(2) “Notice <strong>of</strong> Acceptance” means a notice issued by <strong>the</strong> executive director under instruction by<br />

council which establishes that <strong>the</strong> applicant is qualified to write examinations for admission<br />

as a Pr<strong>of</strong>essional Surveyor in <strong>the</strong> prescribed category.<br />

(3) “Pr<strong>of</strong>essional Examinations” means examinations prescribed by <strong>the</strong> ABPS.<br />

SECTION 2<br />

(1) The examination <strong>of</strong> applicants for a Certificates <strong>of</strong> Registration as a Pr<strong>of</strong>essional Surveyor<br />

shall be under <strong>the</strong> control <strong>of</strong> <strong>the</strong> council <strong>of</strong> <strong>the</strong> <strong>Saskatchewan</strong> land surveyors’ association.<br />

(2) The council shall appoint members to <strong>the</strong> ABPS to examine all applicants and <strong>the</strong> ABPS<br />

shall report <strong>the</strong> results <strong>of</strong> each examination to council.<br />

(3) The ABPS may, after consultation with <strong>the</strong> council, make rules prescribing <strong>the</strong> subjects <strong>of</strong><br />

examination, <strong>the</strong> fees payable by applicants, and governing <strong>the</strong> conduct <strong>of</strong> examinations.<br />

(4) Examination <strong>of</strong> applicants for a Certificate <strong>of</strong> Registration as a Pr<strong>of</strong>essional Surveyor shall<br />

be held at such time and place as may be fixed by <strong>the</strong> ABPS.<br />

SECTION 3<br />

A licensed <strong>Saskatchewan</strong> land surveyor, upon submission <strong>of</strong> an Oath <strong>of</strong> Office in Form A(1) and<br />

upon payment <strong>of</strong> <strong>the</strong> applicable fee, shall be issued a Certificate <strong>of</strong> Registration in Form “C”.<br />

SECTION 4<br />

(1) An applicant who fulfils <strong>the</strong> requirements <strong>of</strong> Subsection 19(5)(b) <strong>of</strong> <strong>the</strong> Act is eligible to apply<br />

to <strong>the</strong> association for a Notice <strong>of</strong> Acceptance.<br />

(2) Applicants under subsection (1) must submit <strong>the</strong>ir work experience on Form “U” with respect<br />

to <strong>the</strong> category or categories <strong>of</strong> practice being applied for.<br />

(3) The work experience under subsection (2) must:<br />

(a) include a minimum <strong>of</strong> two hundred and twenty working days, <strong>of</strong> which at least one<br />

hundred and ten days must be practical experience, in each <strong>of</strong> <strong>the</strong> categories <strong>of</strong> practice<br />

being applied for; and<br />

(b) be obtained under <strong>the</strong> direct supervision <strong>of</strong> a Pr<strong>of</strong>essional Surveyor for <strong>the</strong> particular<br />

category or, at <strong>the</strong> discretion <strong>of</strong> council, under <strong>the</strong> direct supervision <strong>of</strong> ano<strong>the</strong>r<br />

suitably qualified Pr<strong>of</strong>essional.<br />

SECTION 5<br />

(1) The executive director shall present all documents received in accordance with Section 4 to<br />

council at its first meeting <strong>the</strong>reafter prior to submission for review by <strong>the</strong> ABPS.<br />

(2) The ABPS, after completing an assessment <strong>of</strong> <strong>the</strong> applicant’s submission and upon finding<br />

<strong>the</strong> applicant qualified, shall, after consultation with council, direct <strong>the</strong> executive director to<br />

issue a “Notice <strong>of</strong> Acceptance” to <strong>the</strong> applicant advising <strong>the</strong> applicant that he/she is eligible<br />

to write Pr<strong>of</strong>essional Examinations.<br />

(3) Upon successful completion <strong>of</strong> <strong>the</strong> Pr<strong>of</strong>essional Examinations, <strong>the</strong> submission <strong>of</strong> an Oath<br />

<strong>of</strong> Office in Form A1, and payment <strong>of</strong> <strong>the</strong> applicable fee, council shall direct <strong>the</strong> executive<br />

director to issue a Certificate <strong>of</strong> Registration in Form “C” to <strong>the</strong> applicant.<br />

SECTION 6<br />

A person who receives a Certificate <strong>of</strong> Registration as a Pr<strong>of</strong>essional Surveyor shall be eligible to use<br />

<strong>the</strong> title “Pr<strong>of</strong>essional Surveyor” or <strong>the</strong> abbreviation “P. Surv.”<br />

SECTION 7<br />

(1) The annual license fee for a Pr<strong>of</strong>essional Surveyor shall be as prescribed in Article XXXIV,<br />

payable to <strong>the</strong> association not later than January 15 in every year.<br />

(2) Upon receipt <strong>of</strong> <strong>the</strong> annual license fee, <strong>the</strong> executive director shall issue to that person an<br />

annual license in Form H for <strong>the</strong> year in respect <strong>of</strong> which <strong>the</strong> fee is paid.<br />

Article XXVI<br />

Code <strong>of</strong> Ethics<br />

It shall be inconsistent with <strong>the</strong> honour, integrity and dignity <strong>of</strong> <strong>the</strong> pr<strong>of</strong>ession for any Pr<strong>of</strong>essional<br />

Surveyor:<br />

SECTION 1<br />

To act for his/her clients in pr<strong>of</strong>essional matters o<strong>the</strong>rwise than as a faithful agent or trustee or to<br />

accept any remuneration o<strong>the</strong>r than his/her stated charges for services rendered his/her clients,<br />

except as provided in Section 2 here<strong>of</strong>.<br />

SECTION 2<br />

To accept any commissions, discounts, allowances, or any indirect pr<strong>of</strong>it in connection with any<br />

work which he/she is engaged to do in <strong>the</strong> practice <strong>of</strong> his/her pr<strong>of</strong>ession which may be entrusted<br />

to him/her, unless and until receipt by him/her <strong>of</strong> such commissions, discounts, allowances or any<br />

indirect pr<strong>of</strong>it has been duly authorized in writing by <strong>the</strong> clients.<br />

SECTION 3<br />

To abstain or neglect to advise and inform at all times his/her client or clients <strong>of</strong> any business<br />

connections, interest or circumstances which may be deemed to influence his/her judgment or affect<br />

<strong>the</strong> character and qualify <strong>of</strong> his/her services to his/her clients.<br />

SECTION 4<br />

To <strong>of</strong>fer or to pay any commission for <strong>the</strong> securing <strong>of</strong> any pr<strong>of</strong>essional work to any person not a<br />

member <strong>of</strong> <strong>the</strong> association or to o<strong>the</strong>rwise improperly solicit pr<strong>of</strong>essional work.<br />

SECTION 5<br />

To quote a price to a client or <strong>the</strong> agent <strong>of</strong> a client in <strong>the</strong> knowledge that such agent intends to quote<br />

a higher price to his/her clients or to enter into any arrangement whereby <strong>the</strong> pr<strong>of</strong>essional services<br />

rendered shall cost more than <strong>the</strong> Pr<strong>of</strong>essional Surveyor received for his/her services.<br />

SECTION 6<br />

To attempt to supplant ano<strong>the</strong>r Pr<strong>of</strong>essional Surveyor after definite steps have been taken towards<br />

<strong>the</strong> employment <strong>of</strong> such Pr<strong>of</strong>essional Surveyor.<br />

SECTION 7<br />

To accept employment by a client while <strong>the</strong> claim for compensation or damages or both, <strong>of</strong> a fellow<br />

Pr<strong>of</strong>essional Surveyor previously employed by <strong>the</strong> same client, remains unsatisfied and whose<br />

employment has been terminated, unless such claim for compensation or damages has been referred<br />

to arbitration or issue has been joined by due process <strong>of</strong> law.<br />

SECTION 8<br />

To underbid a fellow Pr<strong>of</strong>essional Surveyor who has already been retained by reducing <strong>the</strong> usual<br />

charges or to compete improperly with a fellow Pr<strong>of</strong>essional Surveyor after having been informed <strong>of</strong><br />

such fellow Pr<strong>of</strong>essional Surveyor’s charges.<br />

SECTION 9<br />

To accept any engagement to review <strong>the</strong> work <strong>of</strong> a fellow Pr<strong>of</strong>essional Surveyor for a client without<br />

first notifying such fellow Pr<strong>of</strong>essional Surveyor, if at all possible.<br />

SECTION 10<br />

To advertise in an unpr<strong>of</strong>essional manner by making exaggerated or o<strong>the</strong>rwise misleading statements<br />

regarding his/her qualifications or experience.<br />

SECTION 11<br />

To sign and certify any plans or certificates for which he/she is not pr<strong>of</strong>essionally responsible.<br />

SECTION 12<br />

To associate himself/herself with or to allow his/her name to be used in a pr<strong>of</strong>essional way with any<br />

enterprise <strong>of</strong> doubtful character or to do any act or thing unbecoming to <strong>the</strong> dignity or honour <strong>of</strong><br />

<strong>the</strong> pr<strong>of</strong>ession.<br />

SECTION 1<br />

Article XXVII<br />

Categories <strong>of</strong> Practice for Pr<strong>of</strong>essional <strong>Surveyors</strong><br />

Pr<strong>of</strong>essional <strong>Surveyors</strong> must demonstrate pr<strong>of</strong>essional competence in one or more <strong>of</strong> <strong>the</strong> following<br />

categories <strong>of</strong> practice:<br />

(1) General Surveying which may include but is not limited to Construction surveys, Topographic<br />

surveys, Industrial Surveys and horizontal and vertical Control surveys;<br />

(2) Geodetic Surveys;<br />

(3) Photogrammetric Surveys;<br />

(4) Hydrographic Surveys;<br />

(5) Mapping and Cartographic Surveys;<br />

(6) Geographic Information Systems;<br />

(7) Such o<strong>the</strong>r areas <strong>of</strong> specialization as may be approved by council;<br />

but may not practice as a Pr<strong>of</strong>essional <strong>Land</strong> Surveyor unless he/she is so licensed.<br />

SECTION 2<br />

A Pr<strong>of</strong>essional Surveyor shall practice only in <strong>the</strong> category or categories in which he/she is<br />

pr<strong>of</strong>essionally competent.<br />

SECTION 1<br />

Article XXVIII<br />

Re-entry Education<br />

A Pr<strong>of</strong>essional Surveyor who has not held an annual license to practice for a period <strong>of</strong> two or more<br />

consecutive years and who wishes to obtain an annual license shall satisfy <strong>the</strong> following conditions<br />

in addition to <strong>the</strong> requirements o<strong>the</strong>rwise specified in <strong>the</strong> Act and <strong>the</strong> <strong>Bylaws</strong>.<br />

(1) The Pr<strong>of</strong>essional Surveyor shall submit to council a resume <strong>of</strong> his/her activities during <strong>the</strong><br />

period in which an annual license was not held, toge<strong>the</strong>r with <strong>the</strong> investigation fee prescribed<br />

in Article XXXIV.<br />

(2) The council shall review <strong>the</strong> resume and determine which, if any, educational programs<br />

or courses, as sponsored or approved by <strong>the</strong> Education Committee, are required to be<br />

successfully completed prior to <strong>the</strong> issuance <strong>of</strong> an annual license. The council may also<br />

require that <strong>the</strong> Pr<strong>of</strong>essional Surveyor submit to such examinations, as set by <strong>the</strong> ABPS, as<br />

council deems fit.<br />

(3) The council shall notify <strong>the</strong> member in writing <strong>of</strong> its requirements within sixty days <strong>of</strong> <strong>the</strong><br />

application for an annual license by <strong>the</strong> Pr<strong>of</strong>essional Surveyor.<br />

Article XXIX<br />

Education Programs<br />

The following university degree programs have been approved by <strong>the</strong> association.<br />

(1) Universities:<br />

(i) University <strong>of</strong> Calgary, Geomatics Engineering<br />

(ii) University <strong>of</strong> New Brunswick, Geodesy and Geomatics Engineering<br />

(iii) University <strong>of</strong> Toronto, Erindale College, Geomatics<br />

(iv) University <strong>of</strong> Laval, Geomatics<br />

(2) O<strong>the</strong>rs<br />

For <strong>the</strong> purposes <strong>of</strong> subsection 19(5)(b) <strong>of</strong> <strong>the</strong> Act, <strong>the</strong> council may undertake consultations<br />

with educational institutions or educators in <strong>the</strong> pr<strong>of</strong>ession <strong>of</strong> surveying, <strong>the</strong> ABPS and/or <strong>the</strong><br />

Education Committee to evaluate degree courses in Surveying Engineering, Survey Science,<br />

Geomatics or equivalent degrees at Universities and Colleges, and such o<strong>the</strong>r courses <strong>of</strong><br />

study that <strong>the</strong> council deems appropriate.<br />

SECTION 1 - Mandatory Continuing Education<br />

(1) Definitions<br />

Article XXX<br />

Continuing Education<br />

(a) Continuing Education Period (C.E.P.) means a period consisting <strong>of</strong> two consecutive<br />

calendar years beginning January 1st following Proclamation <strong>of</strong> The <strong>Land</strong> <strong>Surveyors</strong><br />

and Pr<strong>of</strong>essional <strong>Surveyors</strong> Act and continuing every two calendar years <strong>the</strong>reafter.<br />

The first C.E.P. will begin January 1, 1998 and will end December 31, 1999.<br />

(b) Pr<strong>of</strong>essional Development Credits (P.D.C.) means credits assigned by <strong>the</strong> council <strong>of</strong><br />

<strong>the</strong> association to <strong>the</strong> various forms <strong>of</strong> continuing education activities.<br />

(2) Requirements<br />

Subject to Subsections (1) to (7), every Pr<strong>of</strong>essional Surveyor <strong>of</strong> <strong>the</strong> <strong>Saskatchewan</strong> land<br />

surveyors’ association shall acquire thirty Pr<strong>of</strong>essional Development Credits in <strong>the</strong> previous<br />

Continuing Education Period. Excess credits obtained during a Continuing Education Period<br />

<strong>Saskatchewan</strong> <strong>Land</strong> <strong>Surveyors</strong> <strong>Association</strong> - <strong>Bylaws</strong> - September 19, 2011 29


may be carried forward to <strong>the</strong> next period to a maximum <strong>of</strong> twenty-five percent <strong>of</strong> <strong>the</strong> total<br />

required credits for one continuing education period.<br />

(3) Determination <strong>of</strong> Pr<strong>of</strong>essional Development Credits<br />

The council <strong>of</strong> <strong>the</strong> association shall publish and distribute annually <strong>the</strong> point values <strong>of</strong><br />

association sponsored events, seminars and meetings.<br />

(4) Records<br />

Each Pr<strong>of</strong>essional Surveyor <strong>of</strong> <strong>the</strong> association is responsible for <strong>the</strong> design <strong>of</strong> <strong>the</strong>ir own<br />

Continuing Education Activities. The maintenance <strong>of</strong> records to be used to support <strong>the</strong><br />

P.D.C.’s claimed is <strong>the</strong> responsibility <strong>of</strong> <strong>the</strong> individual Pr<strong>of</strong>essional Surveyor. Records<br />

required may include, but are not limited to <strong>the</strong> following:<br />

(a) A log showing:<br />

(i) type <strong>of</strong> activity claimed<br />

(ii) sponsoring organization<br />

(iii) dates<br />

(iv) location<br />

(v) duration<br />

(vi) instructor’s or speaker’s names and qualifications<br />

(vii) credits earned<br />

(b) Attendance verification records in <strong>the</strong> form <strong>of</strong> completion certificates or documents<br />

supporting evidence <strong>of</strong> attendance.<br />

A report, in <strong>the</strong> prescribed form, <strong>of</strong> accumulated points shall be forwarded to <strong>the</strong> association<br />

<strong>of</strong>fice for filing by <strong>the</strong> executive director at <strong>the</strong> end <strong>of</strong> <strong>the</strong> current C.E.P. Records must be<br />

maintained for a period <strong>of</strong> 6 years and copies may be requested by <strong>the</strong> association for<br />

verification purposes. (Amended 2004/05/15)<br />

(5) Exemptions<br />

A Pr<strong>of</strong>essional Surveyor may be exempt from <strong>the</strong>se Mandatory Continuing Education<br />

requirements for one <strong>of</strong> <strong>the</strong> following reasons:<br />

(a) A Pr<strong>of</strong>essional Surveyor who is a new member <strong>of</strong> <strong>the</strong> association shall be exempt for<br />

<strong>the</strong> C.E.P. in which <strong>the</strong> initial license to practice as a P. Surv. is made and all <strong>of</strong> <strong>the</strong> next<br />

C.E.P.<br />

(b) A Pr<strong>of</strong>essional Surveyor experiencing physical disability, illness or o<strong>the</strong>r extenuating<br />

circumstances as reviewed by <strong>the</strong> Education Committee may be exempt. Supporting<br />

documentation may be requested by <strong>the</strong> Committee.<br />

(c) A Pr<strong>of</strong>essional Surveyor who has ceased to practice shall be exempt. In <strong>the</strong> event<br />

such a member wishes to resume active practice, thirty [30] P.D.C.’s must have been<br />

acquired in <strong>the</strong> two year period immediately prior to <strong>the</strong> date on which reinstatement<br />

is requested. Depending on <strong>the</strong> date <strong>of</strong> reinstatement, <strong>the</strong>re may be insufficient time<br />

to acquire thirty [30] P.D.C.’s for <strong>the</strong> next C.E.P. in which case council will determine<br />

<strong>the</strong> requirements for <strong>the</strong> member to acquire a license to practice as a Pr<strong>of</strong>essional<br />

Surveyor in <strong>the</strong> next C.E.P.. The executive director shall audit <strong>the</strong> claimed P.D.C.’s<br />

prior to <strong>the</strong> issuance <strong>of</strong> <strong>the</strong> said license.<br />

(d) A Pr<strong>of</strong>essional Surveyor who is also a <strong>Saskatchewan</strong> land surveyor need only comply<br />

with <strong>the</strong> continuing education requirements <strong>of</strong> ARTICLE XVII.<br />

(6) Audit<br />

The council <strong>of</strong> <strong>the</strong> association shall conduct an audit <strong>of</strong> at least 10% <strong>of</strong> <strong>the</strong> Pr<strong>of</strong>essional<br />

<strong>Surveyors</strong> claiming P.D.C.’s for each C.E.P. Audits shall be done at random between <strong>the</strong> 15th<br />

and 30 th <strong>of</strong> <strong>the</strong> month following <strong>the</strong> end <strong>of</strong> <strong>the</strong> C.E.P.<br />

(7) List <strong>of</strong> Pr<strong>of</strong>essional Development Credits<br />

SECTION 1<br />

The council <strong>of</strong> <strong>the</strong> association shall establish a list <strong>of</strong> activities categorized as Part ‘A’ and Part<br />

‘B’. All forms <strong>of</strong> educational achievements must be similar to one or more <strong>of</strong> <strong>the</strong> activities<br />

listed. Thirty percent <strong>of</strong> claimed P.D.C.’s must be from Part A. Remaining P.D.C.’s may be<br />

acquired from activities listed in Part B.<br />

Article XXXI<br />

Reinstatement<br />

A Pr<strong>of</strong>essional Surveyor who has been expelled as a member and who desires to be reinstated, shall<br />

apply to council for reinstatement and satisfy <strong>the</strong> following conditions in addition to <strong>the</strong> requirements<br />

o<strong>the</strong>rwise specified in <strong>the</strong> Act and <strong>the</strong> <strong>Bylaws</strong>:<br />

(1) The applicant shall submit a complete resume to council detailing his/her activities in <strong>the</strong><br />

period since <strong>the</strong> expulsion order.<br />

(2) The applicant shall submit a report to council giving <strong>the</strong> reasons why he/she should be<br />

considered for reinstatement.<br />

(3) The applicant shall pay <strong>the</strong> investigation fee as prescribed in Article XXXIV.<br />

(4) The council may require that <strong>the</strong> applicant submit to <strong>the</strong> requirements <strong>of</strong> Article XXVIII <strong>of</strong> <strong>the</strong><br />

<strong>Bylaws</strong> or may set any o<strong>the</strong>r terms and conditions that <strong>the</strong> council considers appropriate.<br />

SECTION 1<br />

Article XXXII<br />

Maintenance <strong>of</strong> Membership<br />

A <strong>Land</strong> Surveyor shall not practice pr<strong>of</strong>essional surveying unless licensed as a Pr<strong>of</strong>essional<br />

Surveyor.<br />

Article XXXIII<br />

Liability Protection<br />

All Pr<strong>of</strong>essional <strong>Surveyors</strong> practicing pr<strong>of</strong>essional surveying on a fee for service basis shall be<br />

covered by Pr<strong>of</strong>essional Liability Insurance.<br />

SECTION 2<br />

The minimum liability shall be $100,000.00 per loss and $100,000.00 per policy period.<br />

SECTION 4<br />

All Pr<strong>of</strong>essional <strong>Surveyors</strong> who have ceased to practice on a fee-for-service basis shall establish to<br />

<strong>the</strong> council’s satisfaction that he/she has provided for adequate insurance coverage.<br />

SECTION 1<br />

Article XXXIV<br />

Registration, Licensing and o<strong>the</strong>r Fees<br />

(1) The annual license fee for a Pr<strong>of</strong>essional Surveyor shall be $600.00 plus applicable taxes<br />

payable to <strong>the</strong> association not later than January 15th in every year.<br />

(2) Where a Pr<strong>of</strong>essional Surveyor obtains an annual license for both pr<strong>of</strong>essional surveying and<br />

land surveying, <strong>the</strong> combined license fee shall be $1,550.00 plus applicable taxes payable to<br />

<strong>the</strong> association not later than January 15th in every year. (Amended 2006/05/26)<br />

SECTION 2<br />

In addition to <strong>the</strong> annual license fee, <strong>the</strong>re shall be a fee <strong>of</strong> twenty percent <strong>of</strong> <strong>the</strong> annual license fee<br />

for licensing after January 15th in any year.<br />

SECTION 3<br />

Every member <strong>of</strong> <strong>the</strong> association who was not licensed in <strong>the</strong> previous year is required to submit<br />

to an investigation as to his/her qualifications to resume <strong>the</strong> practice <strong>of</strong> pr<strong>of</strong>essional surveying in<br />

<strong>Saskatchewan</strong> and shall pay an investigation fee as prescribed in subsection 4(4) herein, in addition<br />

to <strong>the</strong> current fee and all arrears before receiving an annual license to resume <strong>the</strong> practice <strong>of</strong><br />

pr<strong>of</strong>essional surveying in <strong>Saskatchewan</strong>. Arrears are all monies owing to <strong>the</strong> association including<br />

all unpaid annual license fees.<br />

SECTION 4<br />

The following fees shall apply:<br />

(1) Admission Fee for <strong>Saskatchewan</strong> land surveyors under provisions <strong>of</strong><br />

SECTION 1<br />

Article XXXV<br />

Property Management<br />

The association may acquire and hold real and personal property for its corporate purposes but for<br />

no o<strong>the</strong>r purpose.<br />

SECTION 2<br />

No real or personal property acquired by <strong>the</strong> association shall be sold, mortgaged, leased or o<strong>the</strong>rwise<br />

disposed <strong>of</strong> except with <strong>the</strong> consent <strong>of</strong> <strong>the</strong> council given at a meeting duly called for that purpose.<br />

SECTION 3<br />

Notice <strong>of</strong> such meeting setting forth <strong>the</strong> purpose <strong>of</strong> <strong>the</strong> meeting shall be given by <strong>the</strong> executive<br />

director to every member <strong>of</strong> <strong>the</strong> council at least seven days before <strong>the</strong> day fixed for <strong>the</strong> meeting.<br />

SECTION 1 - Composition<br />

(1) council shall be composed <strong>of</strong>:<br />

(a) Seven elected, licensed members who shall be <strong>the</strong> President, Vice President, Past<br />

President and four councillors at large.<br />

(b) One public representative that may be appointed in accordance with Section 9 <strong>of</strong> <strong>the</strong><br />

Act.<br />

SECTION 2 - Term <strong>of</strong> Office<br />

(1) The term <strong>of</strong> <strong>of</strong>fice for councillors shall be two years with two councillors elected one year<br />

and two councillors elected in <strong>the</strong> alternate year. The two year terms shall begin immediately<br />

following <strong>the</strong> election process at <strong>the</strong> Annual Meeting.<br />

(2) The term <strong>of</strong> <strong>of</strong>fice for <strong>the</strong> President, Vice President and Past President shall be one year and<br />

shall begin immediately following <strong>the</strong> election process at <strong>the</strong> Annual Meeting.<br />

(3) The term <strong>of</strong> <strong>of</strong>fice for <strong>the</strong> public representative shall be in accordance with Section 9 <strong>of</strong> <strong>the</strong><br />

Act.<br />

SECTION 1<br />

Article XXXVII<br />

Officers <strong>of</strong> <strong>the</strong> association<br />

The <strong>of</strong>ficers <strong>of</strong> <strong>the</strong> association shall be <strong>the</strong> President and <strong>the</strong> Vice President who shall be elected in<br />

accordance with Article XXXIX <strong>of</strong> <strong>the</strong> <strong>Bylaws</strong> and <strong>the</strong> executive director who shall be appointed in<br />

accordance with subsection 12(2) <strong>of</strong> <strong>the</strong> Act.<br />

SECTION 1<br />

Article XXXVIII<br />

Duties <strong>of</strong> Officers<br />

The President, in presiding at meetings <strong>of</strong> <strong>the</strong> association and council shall see that o<strong>the</strong>r <strong>of</strong>ficers<br />

perform <strong>the</strong>ir respective duties and shall sign all orders with <strong>the</strong> executive director. He/she shall<br />

also have power to call special meetings <strong>of</strong> council and shall be obliged to do so on a requisition<br />

signed by two members <strong>of</strong> council.<br />

SECTION 2<br />

(1) The Vice President shall act as President in <strong>the</strong> absence or inability <strong>of</strong> <strong>the</strong> President to<br />

perform his/her duties.<br />

(2) In <strong>the</strong> event <strong>of</strong> <strong>the</strong> inability, death, disqualification or resignation <strong>of</strong> <strong>the</strong> President, <strong>the</strong> Vice<br />

President shall become President for <strong>the</strong> remainder <strong>of</strong> <strong>the</strong> term <strong>of</strong> <strong>of</strong>fice.<br />

SECTION 3<br />

The duties <strong>of</strong> <strong>the</strong> executive director shall be:<br />

(1) to conduct, under <strong>the</strong> direction <strong>of</strong> <strong>the</strong> council, <strong>the</strong> correspondence relating to <strong>the</strong> affairs <strong>of</strong><br />

<strong>the</strong> association;<br />

(2) to keep copies <strong>of</strong> all such letters written by him/her and files <strong>of</strong> all letters received;<br />

(3) to keep a proper record <strong>of</strong> <strong>the</strong> proceedings <strong>of</strong> each meeting <strong>of</strong> <strong>the</strong> association and council;<br />

(4) to present <strong>the</strong> minutes <strong>of</strong> <strong>the</strong> same at <strong>the</strong> next regular meeting; and<br />

(5) to lay before council a summary <strong>of</strong> <strong>the</strong>se transactions at each regular meeting;<br />

(6) to transact all routine business, pr<strong>of</strong>essional land surveying business, and pr<strong>of</strong>essional<br />

surveying business requiring attention between <strong>the</strong> various meetings <strong>of</strong> <strong>the</strong> council;<br />

(7) to receive such fees and issue such certificates and licenses as called for under <strong>the</strong> <strong>Land</strong><br />

<strong>Surveyors</strong> and Pr<strong>of</strong>essional <strong>Surveyors</strong> Act, or under <strong>the</strong>se <strong>Bylaws</strong>.<br />

(8) to deposit in a chartered bank or o<strong>the</strong>r Federal Government approved institution all funds<br />

<strong>of</strong> <strong>the</strong> association;<br />

(9) to keep a true record <strong>of</strong> all monies received and expended;<br />

(10) to give a report to <strong>the</strong> council at every regular meeting upon <strong>the</strong> state <strong>of</strong> finances;<br />

(11) to perform all o<strong>the</strong>r duties required by <strong>the</strong> Act or <strong>Bylaws</strong>, and to deliver to his/her successor<br />

in <strong>of</strong>fice all books, papers and o<strong>the</strong>r property belonging to <strong>the</strong> association and council that<br />

may be in his/her possession.<br />

(12) to serve as <strong>the</strong> custodian <strong>of</strong> <strong>the</strong> seal <strong>of</strong> <strong>the</strong> association.<br />

SECTION 4<br />

The President and Vice President <strong>of</strong> <strong>the</strong> association shall execute a contract or any o<strong>the</strong>r suitable<br />

arrangement with <strong>the</strong> executive director, which shall stipulate <strong>the</strong> Terms, Duties, Conditions and<br />

Remuneration <strong>of</strong> <strong>the</strong> executive director. The said contract or o<strong>the</strong>r suitable arrangement to be<br />

ratified by council prior to final signatures <strong>of</strong> <strong>the</strong> parties involved.<br />

SECTION 5<br />

council may appoint such employees as it considers necessary to conduct <strong>the</strong> business <strong>of</strong> <strong>the</strong><br />

association and prescribe <strong>the</strong> Terms, Duties, Conditions and Remuneration <strong>of</strong> employment.<br />

SECTION 1 - Election <strong>of</strong> council<br />

Article XXXIX<br />

Elections<br />

(1) At each Annual Meeting <strong>of</strong> <strong>the</strong> association <strong>the</strong>re shall be elected a President, Vice President<br />

and two councillors, and such o<strong>the</strong>r councillors as may be required to fill a vacancy.<br />

(2) At all elections, retiring members <strong>of</strong> council shall be eligible for re-election but no member<br />

<strong>of</strong> <strong>the</strong> council may hold <strong>the</strong> same <strong>of</strong>fice for more than three consecutive terms.<br />

(3) Licensed members <strong>of</strong> <strong>the</strong> association who reside in <strong>Saskatchewan</strong> are qualified to hold<br />

<strong>of</strong>fice.<br />

SECTION 2 - Nominations<br />

(1) Any two licensed members qualified to vote may, in writing, nominate as a candidate for<br />

election any licensed member <strong>of</strong> <strong>the</strong> association in good standing who resides in <strong>Saskatchewan</strong><br />

and consents in writing to such nominations.<br />

(2)(a) The council shall appoint a Nominating Committee <strong>of</strong> at least two licensed members <strong>of</strong> <strong>the</strong><br />

association at least ninety days prior to <strong>the</strong> day fixed for <strong>the</strong> Annual Meeting.<br />

(b) The Nominating Committee shall nominate a full slate <strong>of</strong> <strong>of</strong>ficers and members to be elected<br />

for presentation at <strong>the</strong> Annual Meeting toge<strong>the</strong>r with a brief biography <strong>of</strong> each nominee.<br />

(3) If only one person is nominated for any one position, <strong>the</strong>n <strong>the</strong> person so nominated shall be<br />

deemed elected by acclamation.<br />

SECTION 3 - Voting<br />

(1) Licensed members <strong>of</strong> <strong>the</strong> association are qualified to vote in elections.<br />

(2) All voting shall be by secret ballot conducted at <strong>the</strong> Annual Meeting.<br />

(3) The presiding <strong>of</strong>ficer at <strong>the</strong> Annual Meeting shall appoint three licensed members as<br />

scrutineers who are not candidates for <strong>the</strong> purpose <strong>of</strong> counting <strong>the</strong> ballots cast.<br />

(4) The candidates receiving <strong>the</strong> highest number <strong>of</strong> votes cast shall be declared elected.<br />

(5) If two or more candidates for any one position within <strong>the</strong> election receive an equal number<br />

<strong>of</strong> votes, <strong>the</strong> members counting <strong>the</strong> ballots shall, by lot conducted in <strong>the</strong> presence <strong>of</strong> each<br />

o<strong>the</strong>r, determine which <strong>of</strong> those candidates shall be elected.<br />

(6)(a) In case <strong>of</strong> any doubt or dispute as to who has been elected a member <strong>of</strong> <strong>the</strong> council or as to<br />

<strong>the</strong> legality <strong>of</strong> <strong>the</strong> election <strong>of</strong> a member, <strong>the</strong> o<strong>the</strong>r duly elected members shall be a committee<br />

to hold an inquiry and decide <strong>the</strong> question at issue.<br />

(b) The person, if any, declared by <strong>the</strong> committee to have been elected shall be deemed to be a<br />

member legally elected and if <strong>the</strong> election is found to have been illegal <strong>the</strong> committee may<br />

order a new election.<br />

SECTION 1<br />

Article XL<br />

Duties <strong>of</strong> council<br />

Within thirty days <strong>of</strong> <strong>the</strong> Annual Meeting, <strong>the</strong> council shall appoint members <strong>of</strong> council responsible<br />

for each <strong>of</strong> <strong>the</strong> following Standing Committees:<br />

(1) Convention;<br />

(2) Education;<br />

(3) Finance;<br />

(4) Nominating;<br />

(5) Practice; and<br />

(6) Public Relations.<br />

SECTION 2<br />

The council shall maintain a current Manual <strong>of</strong> Committee Structure and Responsibilities.<br />

SECTION 1<br />

Article XLI<br />

Membership Reporting<br />

All licensed members practicing within a firm shall provide to <strong>the</strong> association, prior to January 15 th<br />

<strong>of</strong> each year, <strong>the</strong> name and address <strong>of</strong> <strong>the</strong> firm and shall indicate his/her scope <strong>of</strong> practice.<br />

SECTION 2<br />

When a licensed member ceases to practice within <strong>the</strong> firm, as reported pursuant to Section 1, or<br />

commences to practice with a firm not previously reported to <strong>the</strong> association, <strong>the</strong> member shall<br />

forthwith provide that information to <strong>the</strong> association.<br />

SECTION 3<br />

The association shall assign a unique identifier to all licensed members to be marked on all standard<br />

iron posts placed.<br />

Article XLII<br />

Special Meetings<br />

SECTION 1<br />

Special meetings <strong>of</strong> <strong>the</strong> association shall be called on a written request <strong>of</strong> ten licensed members <strong>of</strong><br />

<strong>the</strong> association addressed to <strong>the</strong> executive director, setting forth <strong>the</strong> reason for and object <strong>of</strong> <strong>the</strong><br />

Special Meeting.<br />

SECTION 1<br />

Article XLIII<br />

Member Seals<br />

The association may issue a seal to every licensed <strong>Saskatchewan</strong> land surveyor or licensed<br />

Pr<strong>of</strong>essional Surveyor. (Amended June 3, 2005)<br />

SECTION 2<br />

The Seal:<br />

(a) shall be in <strong>the</strong> following format:<br />

(b) may be digital, embossed, rubber stamp or as supplied by <strong>the</strong> association; (Passed June 3, 2005)<br />

(c) shall contain as a minimum <strong>the</strong> following information:<br />

(i) <strong>the</strong> words “<strong>Saskatchewan</strong> land surveyors’ association”;<br />

(ii) <strong>the</strong> initials and surname <strong>of</strong> <strong>the</strong> licensed member;<br />

(iii) <strong>the</strong> commission number or registration number <strong>of</strong> <strong>the</strong> licensed member;<br />

(iv) <strong>the</strong> abbreviation “S.L.S.” for <strong>Saskatchewan</strong> land surveyor or “P. Surv.” for Pr<strong>of</strong>essional<br />

Surveyor, whichever is applicable.<br />

SECTION 3<br />

The seal shall be used on all plans, drawings and documents requiring certification by a <strong>Saskatchewan</strong><br />

land surveyor or Pr<strong>of</strong>essional Surveyor.<br />

SECTION 4<br />

Any member who ceases to be licensed to practice shall forthwith cause his/her seal to be forwarded<br />

to <strong>the</strong> association.<br />

SECTION 5<br />

The cost <strong>of</strong> <strong>the</strong> seal shall be borne by <strong>the</strong> association; however, any member requiring a replacement<br />

seal may obtain one from <strong>the</strong> association at his/her own expense.<br />

SECTION 1<br />

Article XLIV<br />

Permanent Register, Annual Register,<br />

Life, Honourary and Retired Member Registers and Licences<br />

The Permanent Register shall be in Form D.<br />

SECTION 2<br />

The Annual Register for <strong>Saskatchewan</strong> land surveyors shall be in Form E and shall be compiled<br />

immediately following <strong>the</strong> 15th day <strong>of</strong> January in each year. The executive director shall forward<br />

a certified copy <strong>of</strong> <strong>the</strong> Annual Register to <strong>the</strong> Minister <strong>of</strong> Justice, to every <strong>Land</strong> Titles <strong>of</strong>fice, to <strong>the</strong><br />

Chief Surveyor’s <strong>of</strong>fice, to <strong>the</strong> Central Survey and Mapping Agency, to approving authorities under<br />

<strong>the</strong> Planning and Development Act and o<strong>the</strong>rs as may be required, on or before <strong>the</strong> 1st day <strong>of</strong><br />

February in each year.<br />

SECTION 3<br />

The Annual Register for Pr<strong>of</strong>essional <strong>Surveyors</strong> shall be in Form F and shall be compiled immediately<br />

following <strong>the</strong> 15th day <strong>of</strong> January in each year.<br />

SECTION 4<br />

(1) The Annual License for a <strong>Saskatchewan</strong> land surveyor shall be in Form G.<br />

(2) The Annual License for Pr<strong>of</strong>essional <strong>Surveyors</strong> shall be in Form H.<br />

SECTION 5<br />

The Life Member Register shall be in Form J.<br />

SECTION 6<br />

The Honourary Member Register shall be in Form K.<br />

SECTION 7<br />

The Student <strong>Land</strong> Surveyor Annual Registration shall be in Form N.<br />

SECTION 8<br />

The <strong>Land</strong> Surveyor in Training Annual Registration shall be in Form Q.<br />

SECTION 9<br />

All licenses and Registrations shall expire on January 15th <strong>of</strong> each year.<br />

SECTION 10<br />

Any person upon payment <strong>of</strong> a fee prescribed in Article XXI to <strong>the</strong> executive director shall be supplied<br />

with a certified copy or uncertified copy <strong>of</strong> <strong>the</strong> Annual Register.<br />

Article XLV<br />

Field Notes and Survey Records<br />

The association shall have <strong>the</strong> power to examine <strong>the</strong> field notes and survey records in any media <strong>of</strong><br />

any member if so required for <strong>the</strong> purposes <strong>of</strong> any investigation, hearing or audit <strong>of</strong> <strong>the</strong> member’s<br />

practice. The executive director shall give two weeks written notice to <strong>the</strong> member <strong>of</strong> <strong>the</strong> association’s<br />

intention to examine field notes and survey records.<br />

SECTION 1<br />

Article XLVI<br />

Responding to Executive Director<br />

When a member is requested by <strong>the</strong> executive director or council to forward information or material<br />

to <strong>the</strong> association, <strong>the</strong> member shall comply or give adequate reason for non compliance within<br />

thirty days <strong>of</strong> receipt <strong>of</strong> <strong>the</strong> said request.<br />

and completion <strong>of</strong> subdivision plans. In <strong>the</strong> case <strong>of</strong> an application under <strong>the</strong> Mutual Recognition<br />

Agreement (MRA), <strong>the</strong> applicant need only indicate “The practical survey project as required<br />

under <strong>the</strong> MRA.”)<br />
