The April cricket fixture
During April 2000 the Bar
cricket team played
Sonnenberg Hoffman &
Galombik. The Bar won
this encounter by two wickets
despite finding itself
at 85/8, chasing a score of
135 runs. The target was
reached without the loss of
a further wicket, thanks to
the Rogers fraternity, Owen
and John. All members of
the team distinguished
themselves in a variety of
ways. Butler was caught off
a full toss bowled underarm
by an opponent making up
the gender quota, Muller
accumulated 18 runs in 15
overs, while the team leaders,
Fitzgerald SC and
Arendse SC, failed to garner
a run between the two
of them. Despite the result,
the King Commission
might be interested in some
of these performances, particularly
since all team
members were prepared to
furnish 'forecasting' information.
Tennis court
Brian Pincus SC was chosen
for the Western
Province Veterans tennis
team, and played in the
Veterans World Tennis
Championships at the end
of March 2000.
Acting appointments
during the second term
Willie Duminy SC and
Nathan Erasmus held acting
appointments to the Bench
during the second term.

New name
Believe it or not, the official
name of the Bar at Pretoria
was until February this
year, The Society of
Advocates of South Africa
(Transvaal Provincial Division),
the name adopted in
19 J 1. At the last general
meeting this was finally
changed to Pretoria Society
of Advocates / Pretoria
Vereniging van Advokate,
thanks to a well-motivated
and overdue motion by Pat
Ellis.

Sedert die vorige uitgawe

hierdie Vereniging wat die
afgelope twee jaar waargeneem

met die waarnemende
aanstellings in ander afdelings
van die hooggeregshof,
is dit duidelik
dat die aanstelling van meer
regters in Pretoria dringend
aandag moet geniet. Die
wagtyd vir verhoordatums
is tans ongeveer elf
maande, ' n verdere aanduiding
van die volume
werk wat deur die Transvaalse
Provinsiale Afdeling
behartig moet word.
Opleiding
Die Februarie 2000 in name
het 20 pupille opgelewer
waarvan 18 die eksamen
aangepak het. Opleiding
geniet hoe prioriteit by
hierdie Balie. Gedurende
Oktober 1999 is 'n spesiale
lesingslokaal ingerig vir
pupille, danksy finansiele
ondersteuning deur Nedbank.
Benewens die gebruiklike
lesings, het Ig Bredenkamp
en John Mullins ook 'n
advokaatsopleidingprogram
gekoordineer wat 'n litigasiewerkwinkel
en skynhof
ingesluit het. Regters
Van Dijkhorst, Mynhardt,
Du Plessis en Botha het die
pupille 'n waardevolle
voorsmakie gegee van wat
hulle te wagte kan wees in
die bestrede mosiehof.
Junior Bar Council
The Pretoria Bar was one of
the first to introduce a special
body to promote the
interests of junior members
(0 - 5 years). From humble
beginnings in 1995, when
members of the Junior Bar
Council were only permitted
as observers at meetings
of the Bar Council, the
report back by the Junior
Bar Council is now a fixed
item on the agenda. The
junior members are not only
allowed, but also expected,
to make contributions to
meetings of the Bar Council.
The newly elected
members for the year 2000
are Julian du Plessis, Alan
Lewis, Liezl Haupt, Martin
van Twisk and Rian Genis.
Visit by Judge Tarek
Bennour
The president of the African
Regional Group of the
International Association of
Judges (lAJ), Bennour J
from Tunisia, visited South
Africa during April 2000 as
special rapporteur enquiring
about South Africa's
application to become a
Second Term 2000 Advocate 9

member of the lA]. He was
also received at the Pretoria
Bar at a function attended
by the senior members of
the Bar Council, as well as
Botha ] (who was able to
communicate with the visitor
in French) and our most
recent appointment to the
Bench, Bertelsmann ].

"Retirement" of
Luciene Smith
We were sad to learn recent­
. ly that Luciene had decided
to "retire" and to concentrate
her considerable talents
on other pursuits not
related to the Bar.
Luciene was a familiar
(and very attractive!) figure
at the Bar for a quarter of a
century, She did freelance
typing work for many of the
members and, no doubt, for
many of the present judges
in this division. Unfortunately
Puckrin SC rather
selfishly secured a bit of a
monopoly on her services
for most of the time, but
other members had the benefit
of her excellent work
and her sunny personality
as well.
At a recent cocktail party
the Society said goodbye to
Lucis;ne and thanked her for
her contribution, wishing
her everything of the best
for the future.
Wyle Michiel Botha se
Ons het met skok en leedwese
kennis geneem van
die skielike afsterwe van
ons gerespekteerde kollega
op 20 Mei 2000.
Michiel was nie net 'n
besondere veelsydige persoon
met wye belangstellings
en groot kundigheid
op vele terreine.
Hy was onder andere
bekend vir sy prestasies as
'n langafstand atleet. Sedert
1983 het hy die Comrades
Marathon elf keer voltooi,
en by nie minder nie as
se we geleenthede het hy 'n
silwer medalje verower. In
1985 is hy ook gekies vir
die destydse Noord­
Transvaalse Marathonspan
vir veteraanatlete en hy het
die Barbertonse Madeliefie
vir baie jare met onderskeiding
gedra gedurende interprovinsiale
byeenkomste.
l-\Yle Michiel Botha SC
In Balieverband het
Michiel meer as sy deel
gedoen. Hy het vir me er as
'n dekade gedien in die
redaksie van hierdie tydskrif.
Hy het ook gedien in
subkomitees van die Balie,
onder andere die Personeelkomitee,
waar hy 'n
leidende rol vervul het.
Michiel se organisasievermoens
was legendaries.
Of dit nou 'n besigheidsaflos
of 'n ski-vakansie was,
kon almal altyd staatmaak
daarop dat hy die reelings
tot in die fynste besonderhede
sou tref en uitvoer. Hy
het baie van die jonger kol­
en staptoere. Hy het 'n
buitengewone algemene
kennis gehad en kon onderhoudend
en met gesag praat
oor 'n groot aantal onderwerpe..
Dis bekend dat Michiel
'n baie goeie gesinsman en
'n uitstekende vader vir sy
twee dogters, Ulla en
Andrea, was.
Michiel Botha was voorwaar
'n man uit een stuk.
Hy laat 'n leemte by die
Balie wat nie maklik gevuI
sal word nie. Langs hierdie
weg word daar ook van die
geleentheid gebruik gemaak
om innige simpatie te betuig
met mev Botha, die
dogters en ander naasbestaandes
wat insluit
regter ehris Botha.
Pretoria Bar cricket
match

On 25 March 2000 Mike
Maritz SC's "has beens"
took on Goosen SC's "also
rans" at the Irene Country
Club Oval in a limited overs
match. The "has beens"
amassed a creditable 171 all
out with the main contribution
by Dirk Coetsee who
scored 70 odd. A number of
lusty blows by Gerhard
Cilliers pushed up the scoring
rate and contributed to
the respectability of the
score.
Preis se then bowled his
way into the annals of
Pretoria Bar cricketing history
by ripping the heart of
the "also rans" top order.
First to go was Van Onselen
for nought, the latter thereby
building on his unspectacular
spell of left hand
seam bowling outside the
off stump.
Goosen tried valiantly to
play a captain's innings.
However, after one characteristic
slog-hoik to rnidwicket,
he haplessly skied a
gentle full toss to the keeper.
Duminy showed plenty
of promise when umpiring:
his poker-faced refusals of
raucous appeals for LBW
indicates that this young
man has a bright future at
the Bar.
The "has beens" were
eventually dismissed for
130, Sean Mulligan contributing
a classy undefeated
half century. This was
followed by the customary
festivities. With the aid of
Bacchus the ignominious
defeats in earlier years at
the hands of the ] ohannesburg
Bar were soon forgotten.
The post-match euphoria
transmitted the following
clear message: "The
older we get, the better we
were!"
