Construction in Waterways<br />

Criteria <strong>and</strong> Limitations<br />

* Structures must be placed within an area extending<br />

waterward at a 45° angle from property’s seawall at the<br />

side property lines, not to exceed 25’ waterward from<br />

seawall, nor encroach 25’ <strong>of</strong> established centerline <strong>of</strong><br />

waterway except: In waterways where width is less than<br />

100’ or in waterways not seawalled, structures will be<br />

placed to not exceed 10’ waterward unless 50’ passageway<br />

can be maintained.<br />

* Construction (single family homes) is permitted to<br />

dedicated public platted canals for freest<strong>and</strong>ing concrete<br />

docks protruding no more than 10’ waterward from<br />

seawall <strong>and</strong> on lots having at least 85’ <strong>of</strong> seawall length:<br />

a) a boat lift <strong>and</strong> up to 3 outpilings, or b) up to 6<br />

outpilings, or c) 2 boat lifts.

* For single-family & multi-family homes on lots with<br />

less than 85’ <strong>of</strong> seawall length: a) freest<strong>and</strong>ing concrete<br />

dock protruding no more than 10’ waterward, b) 1 boat lift<br />

or up to 3 outpilings <strong>and</strong> c) on lots with 50’ or less <strong>of</strong><br />

seawall, an approved extension may extend up to 25’<br />

waterward within the 45 degree angle.<br />

* Construction (multi-family homes) is permitted to<br />

dedicated public platted canals for freest<strong>and</strong>ing concrete<br />

docks protruding no more than 10’ waterward from seawall<br />

<strong>and</strong> on lots having at least 85’ <strong>of</strong> seawall length with a canal<br />

width <strong>of</strong> less than 120’: a) a boat lift <strong>and</strong> up to 3 outpilings,<br />

or b) up to 6 outpilings, or c) 2 boat lifts, or…

* On lots having a canal width <strong>of</strong> 120’ or greater with at<br />

least 85’ <strong>of</strong> seawall: a) freest<strong>and</strong>ing concrete finger docks<br />

a minimum <strong>of</strong> 4’ in width protruding no more than 25’<br />

waterward from seawall, b) finger docks shall be separated<br />

by a minimum <strong>of</strong> 27’ in width, c) number <strong>of</strong> boat slips not<br />

to exceed number <strong>of</strong> units, d) up to 3 bumper piles per<br />

slip(s), provided bumper piles are within 45 degree rule,<br />

<strong>and</strong> e) areas currently permitted with finger docks are<br />

allowed to install boat lifts at permitted slips provided they<br />

are no more than 25’ waterward <strong>of</strong> the seawall & within<br />

the 45 degree angle area.

Maintenance <strong>of</strong> seawalls & appurtenances<br />

* The cost <strong>and</strong> expense <strong>of</strong> <strong>maintenance</strong> that are the<br />

responsibilities <strong>of</strong> canal <strong>maintenance</strong> assessment district<br />

include:<br />

1) Remove from canals anything impeding flow <strong>of</strong><br />

water or navigation.<br />

2) Maintain berm to proper height by placing fill on<br />

water side <strong>of</strong> seawall whenever necessary.<br />

3) Repair deteriorating seawall or remove & replace<br />

entirely the seawall, berm <strong>and</strong> backfill. Protect<br />

abutting & adjoining properties.<br />

4) Supply fill material to property owners who wish<br />

to fill sinkholes.

5) Inspect seawall, berm & backfill on properties<br />

on a regular basis.<br />

6) Administer & implement the program for canal<br />

<strong>maintenance</strong> <strong>and</strong> act as trustee for funds<br />

generated, to be expended only in the canal<br />

<strong>maintenance</strong> assessment district.<br />

7) Dredge for boat docks <strong>and</strong> provide other<br />

<strong>maintenance</strong> services upon payment <strong>of</strong> user fees<br />

in amounts as established by resolution <strong>of</strong> <strong>City</strong><br />

Council.<br />

8) Dredge navigable channels when needed.

Maintenance <strong>of</strong> seawalls & appurtenances<br />

* It is the responsibility <strong>of</strong> property owners <strong>and</strong> tenants within<br />

the canal <strong>maintenance</strong> district to provide proper & safe<br />

<strong>maintenance</strong> <strong>of</strong> all appurtenances <strong>of</strong> theirs as they may affect<br />

the condition <strong>of</strong> seawalls <strong>and</strong> canals, <strong>and</strong> specifically the<br />

following:<br />

1) On the water side <strong>of</strong> seawalls, <strong>maintenance</strong> <strong>of</strong> all<br />

davits or other hoisting or launching devises, docks,<br />

pilings, other devices, dock lights, water lines, power<br />

lines, boats <strong>and</strong> all other equipment.<br />

2) On the l<strong>and</strong> side <strong>of</strong> seawalls: a) <strong>maintenance</strong> <strong>of</strong> all<br />

davits or other hoisting or launching devices, patios,<br />

swimming pools, walks, sprinkler & plumbing systems,<br />

wiring, grass, trees, shrubbery & other appurtenances or<br />

structures erected or placed upon the property.

On the l<strong>and</strong> side <strong>of</strong> seawalls: b) Maintenance <strong>of</strong> the<br />

backfill at least level with top <strong>of</strong> seawall caps. c) Refrain from<br />

any act that might endanger integrity <strong>of</strong> seawalls, tie-rods or<br />

deadman. Any object or structure attached to or resting on or<br />

against the seawall or cap is prohibited, including cleats or<br />

anchors. Tie-<strong>of</strong>f anchors may be placed 6’ or more l<strong>and</strong>ward<br />

<strong>of</strong> seawall.<br />

3) Maintaining the appearance <strong>of</strong> the seawall <strong>and</strong> cap<br />

similar to those on adjoining lots.<br />

4) Dredging, except in navigable channels.
