Article 21<br />
1. The property and the right to inherit shall be recognized<br />
and guaranteed. The abrogation of the universal right to property<br />
shall be impermissible.<br />
2. Restriction of the rights referred to in the paragraph 1 shall<br />
be permissible for the important social needs in the cases envisa<strong>ge</strong>d<br />
by the Law and in accordance with a procedure established, so<br />
that the nature of the proprietary right is not infrin<strong>ge</strong>d.<br />
3. Deprivation of the property for the important social needs<br />
is permissible in the circumstances directly defi ned by the Law,<br />
under a court decision or in the case of the ur<strong>ge</strong>nt necessity<br />
determined by the organic law, with condition of prior, full and<br />
fair compensation. Compensation shall be free from any taxes<br />
and fees. (15.10.2010 N3710).<br />
