Note: Under this Rule, the Managers can enter into contracts on behalf of the<br />

<strong>Club</strong> to reinsure other insurers for P & I and non P & I risks.<br />

Terms of entry, assignment and special entries<br />

Terms of entry<br />

5.1.1 <strong>The</strong> standard terms of entry upon which ships will be accepted by the<br />

Managers are those set out in the <strong>Rules</strong>.<br />

5.1.2.1. <strong>The</strong> standard risks against which a Member is insured are those set out in<br />

Rule 20.<br />

5.1.2.2 However, a Member shall only be insured against the risks specified in<br />

paragraphs 4.A, 15.A, 19.A, 21.2, 29.A, 35 and 36 of Rule 20 if the<br />

insurance, and any sum insured, any additional contribution and any<br />

other terms have been specifically agreed in writing with the Managers<br />

and specified (other than the amount of any additional contribution<br />

payable to the <strong>Club</strong>) in the Certificate of Entry.<br />

5.1.2.3 <strong>The</strong> rights of recovery set out in these <strong>Rules</strong> may be excluded, limited,<br />

modified or otherwise altered by any special terms which have been<br />

agreed in writing between an applicant and the Managers.<br />

5.1.2.4 <strong>The</strong> Terms of Entry and the insurance provided by the <strong>Club</strong> shall not,<br />

nor is intended to, confer any right or benefit on any third party under<br />

the Contracts (Rights of Third Parties) Act 1999 save to the extent<br />

provided in Rule 8.<br />

5.1.3 <strong>The</strong> Managers may, subject to the directions of the Board, accept entries<br />

on terms as to contribution other than those set out in the <strong>Rules</strong>. In<br />

particular an entry may be accepted on the basis that a fixed premium is<br />

to be paid instead of Calls.<br />

Assignment<br />

5.1.4.1 No insurance given by the <strong>Club</strong> and no interest under these <strong>Rules</strong> or<br />

under any contract between the <strong>Club</strong> and any Member may be assigned<br />

without the written consent of the Managers who shall have the right in<br />

their discretion to give or refuse such consent without stating any reason<br />

or to give such consent upon any terms or conditions as they may think<br />

fit. Any purported assignment made without such consent or without<br />

there being due compliance with any such terms and conditions as the<br />

Managers may impose shall, unless the Managers in their discretion<br />

otherwise determine, be void and of no effect.
