of the P & I War risks Clause – <strong>2001</strong>, issued by the <strong>Club</strong> or any<br />

subsequent amendments thereto in force at the time of such insurance.<br />

PROVIDED ALWAYS THAT the Managers shall be at liberty to<br />

reinsure in whole or in part the risk or risks of the <strong>Club</strong> against any of<br />

the costs, liabilities or expenses insured by a Member under this Rule 5.2<br />

and in the event that such reinsurance is arranged such a Member shall<br />

be entitled to recover from the funds of the <strong>Club</strong> only the net amount<br />

actually recovered under such reinsurance arrangements, together with<br />

that portion (if any) of the risk or risks retained by the <strong>Club</strong>.<br />

5.3 Where a ship is entered by a charterer other than a demise or bareboat<br />

charterer the charterer shall be entitled to recover for his liability,<br />

together with costs and expenses incidental thereto, to indemnify the<br />

owner or disponent owner of the entered ship in respect of the risks set<br />

out in Rule 20.<br />

Application for entry<br />

6.1 Every applicant shall apply for an entry in such manner and form as the<br />

Managers may from time to time require.<br />

6.2 <strong>The</strong> applicant must furnish to the Managers:<br />

(i) all material particulars and information; and<br />

(ii) all such additional particulars and information as the Managers may<br />

require.<br />

6.3 An applicant warrants on his own behalf and on behalf of any other<br />

person entitled under these <strong>Rules</strong> that he has furnished all material<br />

particulars and information and that all such particulars and information<br />

are, so far as he knew or could with reasonable diligence ascertain, true<br />

and complete, and will remain so throughout the period of insurance.<br />

<strong>The</strong> particulars and information so furnished shall, if the entry of the<br />

relevant ship be accepted, be deemed to form the basis of the contract of<br />

insurance between the Member or applicant and the <strong>Club</strong>.<br />

6.4 Before any application for entry is accepted by the Managers, the<br />

Managers shall agree in writing the terms and conditions that will apply<br />

to the entry if the application is accepted, including (without prejudice<br />

to the generality of the foregoing) the contribution to be paid to the<br />

<strong>Club</strong>, the commencement of cover, and the terms and conditions on<br />

which the ship is to be accepted.
