16. Service Charges/User Fee<br />
For a period <strong>of</strong> first three years from date <strong>of</strong> commencement <strong>of</strong> operations <strong>of</strong><br />
TMC, the charges <strong>for</strong> providing basic services <strong>of</strong> aggregation at collection<br />
enters and auction at the TMC should not exceed 2% <strong>of</strong> value <strong>of</strong> produce. All<br />
other services including value added services should be market based and PE<br />
will have freedom to fix these service charges. Service quality levels as<br />
prescribed in the OMDA will have to be complied by PE.<br />
17. Arbitration<br />
Parties in OMDA Agreement shall use their respective reasonable endeavour<br />
to settle any dispute amicably. Arbitration <strong>of</strong> all disputes arising under<br />
OMDA that remains unresolved will be under Arbitration and Conciliation<br />
Act, 1996.<br />
18. General Awareness and Training Programme/Project Development Facility<br />
General Awareness, publicity and training <strong>of</strong> various stakeholders shall be<br />
taken <strong>up</strong> through Ch. Charan Singh National Institute <strong>of</strong> Agriculture<br />
<strong>Market</strong>ing, Jaipur and other National and State level Institutions or<br />
empanelled pr<strong>of</strong>essional institutions as decided from time to time.<br />
