5. Additional payments and contributions to the national television<br />

archive<br />

Section 19 of the 1990 Act<br />

(see also Section 29 of the<br />

1990 Act)<br />

<strong>Channel</strong> 5 DRL<br />

(1) The Licensee shall pay to <strong>Ofcom</strong>:-<br />

(a) in respect of the first complete calendar year falling within<br />

the <strong>Licensing</strong> Period, the amount of the Cash Bid, which<br />

shall be payable by equal instalments on the penultimate<br />

business day of each calendar month throughout that<br />

calendar year unless the amount of the Cash Bid is equal<br />

to or less than £100,000, in which case it shall be payable<br />

in full on the penultimate business day of the first month of<br />

that calendar year; and<br />

(b) in respect of each subsequent year falling wholly or partly<br />

in the <strong>Licensing</strong> Period, the amount of the Cash Bid as<br />

increased by the Appropriate Percentage, which shall be<br />

payable by equal instalments on the penultimate business<br />

day of each calendar month throughout the relevant year<br />

or part thereof, unless the amount of the Cash Bid as<br />

increased by the Appropriate Percentage is equal to or<br />

less than £100,000 in which case it shall be payable in full<br />

on the penultimate business day of the first month of the<br />

relevant year or part thereof.<br />

(2) The Licensee shall pay to <strong>Ofcom</strong> in respect of each accounting<br />

period of the Licensee falling within the <strong>Licensing</strong> Period an<br />

amount representing the Relevant Percentage of Qualifying<br />

Revenue.<br />

(3) <strong>Ofcom</strong> may:-<br />

(a) before the beginning of any accounting period of the<br />

Licensee, estimate the amount representing the Relevant<br />

Percentage of Qualifying Revenue for that accounting<br />

period (and the Licensee shall pay such estimated amount<br />

(the “Estimated Amount”) by instalments on the<br />

penultimate business day of each calendar month<br />

throughout that accounting period);<br />

(b) at such times as it shall think fit revise the Estimated<br />

Amount and adjust the instalments payable by the<br />

Licensee to take account of any such revision; and<br />

(c) determine that the part of the Licensee’s additional<br />

payments calculated using the Relevant Percentage of<br />

Qualifying Revenue and payable monthly will be based on<br />

the preceding month’s actual qualifying revenue.<br />

(4) (a) The Licensee shall pay to <strong>Ofcom</strong> a sum equal to the<br />

amount (if any) by which the amount of the Relevant<br />

Percentage of Qualifying Revenue in respect of any<br />

accounting period of the Licensee exceeds the Estimated
